6356 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6457 SECTION 1. AMENDATORY 70 O.S. 20 21, Section 9-101, is
6558 amended to read as follows:
6659 Section 9-101. A. Any A school district may provide
6760 transportation for any a child who is participating in any a
6861 prekindergarten or early childhood program operated by the school
62+district or any a child who is participating in any a Head Start
63+program offered within the school district.
64+B. Upon a request for a student transfer p ursuant to the
65+provisions of the Education Open Transfer Act, if the parent or

96-district or any a child who is participating in any a Head Start
97-program offered within the school district.
98-B. Upon a request for a student transfer p ursuant to the
99-provisions of the Education Open Transfer Act, if the parent or
10092 legal guardian of the student requests that the receiving district
10193 provide transportation for the student, and if the receiving
10294 district grants the transfer, then the receiving district may
10395 provide such transportation only within the boundaries of the
10496 receiving school district. A re ceiving school district shall not
10597 cross school district boundaries to transpor t a kindergarten through
10698 eighth-grade student transferred pursuant to t he Education Open
10799 Transfer Act except as otherwise authorized in Section 9 -105 of this
108100 title.
109101 C. Any A school district may provide transportation for each
110102 student who should attend any enrolled in a public elementary or
111103 secondary school when, and only whe n, transportation is necessary
112104 for accomplishment of one of the following purposes:
113105 1. To provide adequate educational facilities and opportunities
114106 which otherwise would not be available , which shall include those
115107 purposes provided in the Education Open T ransfer Act; and
116108 2. To transport students whose homes are more than a reasonable
117109 walking distance, as defi ned by regulations of the State Board of
118110 Education, from the school attended by such student. Provided, that
119111 no state funds shall be paid for the tr ansportation of a student
112+whose residence is within one and one -half (1 1/2) miles from the
113+school attended by such student.
114+SECTION 2. AMENDATORY 70 O.S. 2021, Section 3-141, is
115+amended to read as follows:

149-SECTION 2. AMENDATORY 70 O.S. 2021, Section 3-141, is
150-amended to read as follows:
151142 Section 3-141. A. Transportation shall be provided by the
152143 charter school in accordance with Sections 9 -101 through 9-118 of
153144 Title 70 of the Oklahoma Statutes and only within the transportation
154145 boundaries of the school district in which the c harter school is
155146 located this title.
156147 B. A charter school shall provide the parent or legal guardian
157148 information regarding transportation at the time the student enrolls
158149 in the charter school.
159150 SECTION 3. REPEALER 70 O.S. 2021, Section 9-105, is
160151 hereby repealed.
161152 SECTION 4. This act shall become effective July 1, 2022.
162153 SECTION 5. It being immediately necessary for the preservation
163154 of the public peace, health , or safety, an emergency is hereby
164155 declared to exist, by reason whereof thi s act shall take effect and
165156 be in full force from and after its passage and approval.
