3159 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3360 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4-101, is
3461 amended to read as follows:

3662 Section 4-101. A. All licenses and permits issued by the
3763 Director of Wildlife Conservation, the Department of Wildlife
3864 Conservation or by any of its agents shall be u sed only in
3965 conformity with the prov isions of this title and the rules
4066 promulgated by the Oklahoma Wildlif e Conservation Commission.

4294 B. All persons making application for any licenses required by
4395 this section shall produce a valid license to operate a mot or
4496 vehicle or other positive proof of identification, age and
4597 residency, and any such license issued shall show such data as well
4698 as the date and time of issuance.

5099 C. All licenses are nontransferable. No per son shall alter,
51100 change, lend or transfer any l icense. No person shall use or bo rrow
52101 a license which has not been issued to that person by the Director,
53102 the Department or by any of its agents pursuant to the provisions of
54103 this section.

56104 D. No person may engage in activities requiring a license
57105 without that person’s carrying such lice nse on their person and
58106 producing the same for an inspection upon the dem and of any Oklahoma
59107 citizen or game warden.

61108 E. Any person required to produce a license must also iden tify
62109 themselves as the person to whom such lice nse was issued, and
63110 failure or refusal to comply shall be deemed prima facie evidence of
64111 a violation of this section.

66112 F. Unless otherwise provided in this Code:

68113 1. Hunting licenses Licenses issued pursuant to paragraph 1 of
69114 subsection C and paragraphs 1 and 3 2 of subsection E of Section 4 -
70115 112 of this title and paragraphs 1 and 3 2 of subsection B of
71116 Section 4-113 of this title shall expire on December 31 of the year

75147 113 of this title shall expire on June 30 of the fiscal year issued.
76148 All other licenses and paragraphs 1 and 2 of subsection C and
77149 paragraph 1 of subsec tion E of Section 4-110 of this title shall
78150 terminate December 31 for the year expire one (1) year after the
79151 date issued. Unless otherwise specified, all other licenses shall
80152 expire December 31 for the year issued; and

82153 2. Any person convic ted of violating any of the p rovisions of
83154 this title may have any or all licenses held by that person or the
84155 privilege of applying for, purchasing or exercising the benefits
85156 conferred by the licenses revoked b y the Department in accordance
86157 with rules promulgated by the Commission or b y a court of competent
87158 jurisdiction for a period of not less than one (1) year. For
88159 purposes of this paragraph, a court conviction, a plea of guilty, a
89160 plea of nolo contendere, th e imposition of a deferred or suspended

92161 sentence by a court, or forfeiture o f bond shall be deemed a
93162 conviction.

95163 G. Should any license or permit issued pursuant to Part 1 o f
96164 Article IV of this title be lost or destroyed, duplicates will be
97165 issued by the Department at a fee of One Dollar and fifty cent s
98166 ($1.50).

100167 H. Upon harvesting any whitetail or mule deer, or any other
101168 wildlife where the hunter, according to Commission rul es, is

102196 required to check the wildlife in at a Department check station, the
103197 taker of the wildlife shall:

105198 1. Securely attach the n ame of the taker, time of harvest, date
106199 of harvest and license number to the carcass of the wildlife;
107-
108200 2. Check in the carcass of the wildlife electronically using
109201 the online check station provided on the offi cial website of the
110202 Oklahoma Department of Wild life Conservation or as p rescribed by
111203 rule of the Commission, within twenty-four (24) hours of leaving the
112204 hunt area and in all cases prior to processing the carcass; and
113-
114205 3. Not remove evidence of the sex of the animal until after the
115206 carcass of the anima l has been checked in.

117207 I. It shall be unlawful for any license or permit holder to
118208 knowingly make a false statement or give f alse information to any
119209 authorized hunter check station or to an authorized Departm ent
120210 employee when complying with the provisions of subsection H of thi s
121211 section. Information which may be collected at a Department check
122212 station shall include but not be l imited to the name, address,
123213 license or permit number and signature of the taker, t he date, time,
124214 county, method or weapon of the kill, sex and weight of carcass,
125215 whether or not the animal was taken on public hunting land and if so
126216 in what area, or any oth er information which may be required by the
127217 Commission.

129218 J. 1. Any person convicte d of violating the provisions of this

131247 information in order to acquire any license or permit, pursuant to
132248 the provisions of this section, shall be punishable by a fine of not
133249 less than One Hundred D ollars ($100.00) nor more than Two Hundred

136250 Fifty Dollars ($250.00), o r by imprisonment in the county jail for a
137251 period not to exceed ten (10) days, or by both such fine and
138252 imprisonment. Any person convicted of a second or subsequent
139253 violation of the prov isions of this section or of making a false
140254 statement or giving any f alse information in order to acquire any
141255 license or permit, pursuant to the provisions of this section, shall
142256 be punishable by a fine of not less than Two Hundred Fifty Dollars
143257 ($250.00) nor more than Seven Hundred Fifty Dollars ($750 .00), or by
144258 imprisonment in the county jail for a period not to exceed ten (10)
145259 days, or by both such fine and imprisonment.

147260 2. Any hunting or fishing license issued to a person by the
148261 Department of Wildlife Conservation shall be automatically revoked
149262 upon conviction of the p erson of violating the provisions of this
150263 section. The revocation shall be for a period set by the court of
151264 not less than one (1) year nor more than ten (10) years. If the
152265 court does not set a period, the revocation shall be for one (1)
153266 year from the date of the conviction. During this period of
154267 revocation, the Department shall not issue the person a hunti ng or
155268 fishing license. If the court does not set a revocation period, the
156269 Department shall not issue that person a license within one (1) year
157270 of the conviction of the person pursuant to this section. A person

158298 who has a license or permit revoked pursuant to this section shall
159299 surrender the revoked license or permit to the court , or the court
160300 may order the defendant to surrender the license or permit directly
161301 to an officer from the Department of Wildlife Conservation present
162302 at the hearing. If the license or permit is surrendered to the
163303 court, the court shall send the Department of Wildlife Conservation
164304 the revoked license. The court shall also send the Department a
165305 copy of the judgment of conviction. For purposes of this section,
166306 “conviction” shall include a plea of guilty or nolo contendere to an
167307 offense or the imposition of deferred adjudication for an offense.
168308 In lieu of sending a paper co py of the documents and information
169309 required by this subsection, the court clerk may transmit the
170310 conviction information by using an electronic method authorized by
171311 the Department of Wildl ife Conservation.

173312 K. Any person who has had th eir license privileg es revoked
174313 shall not be entitled to purchase, apply for, or exercise the
175314 benefits conferred by any license until t he revocation period has
176315 expired or the person has obtained approval from t he Director. Any
177316 person violating the provisio ns of this subsectio n, upon conviction,

180317 shall be punished by a fine of not more than Five Hundred Dollars
181318 ($500.00), or by imprisonmen t in a county jail for a term of not
182319 more than ninety (90) days or by both the fine and imprisonment.

187350 SECTION 2. AMENDATORY 29 O.S. 2021, Section 4-112, as
188351 last amended by Sectio n 3, Chapter 229, O.S. L. 2017, is amended to
189352 read as follows:

191353 Section 4-112. A. Except as otherwise provi ded for in the
192354 Oklahoma Wildlife Conservation Code or the Oklahom a Farmed Cervidae
193355 Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
194356 attempt to take in any manner, use, have in possession, sell, or
195357 transport all or any portion of any wild life except fish, without
196358 having first procured a license from th e Department of Wildlife
197359 Conservation. The Oklahoma Wildlife Conservation Commissio n shall
198360 designate a consecutive Saturday and Sunda y in September of each
199361 year as free hunting days in which residents of this state may hunt
200362 without first procuring a hunti ng license pursuant to the provisions
201363 of this section.

203364 B. The following legal residents of Oklahoma shall be exempt
204365 from the annual hunting license requirement of paragraph 1 of
205366 subsection E of this section and the following nonresidents shall be
206367 exempt from the annual nonresid ent hunting licenses required
207368 pursuant to paragraph 1 of subsection C of this section:

209369 1. Legal residents unde r sixteen (16) years of age;
210-
211370 2. Legal residents sixty -five (65) years of age or older
212371 provided they have obtained a senio r citizen lifetime hunt ing or

213399 combination hunting and fishing l icense pursuant to th e provisions
214400 of Section 4-114 of this title;

216401 3. Legal residents born on or before January 1, 1923;

218402 4. Legal resident veterans having a disability of sixty percent
219403 (60%) or more and registered w ith the veterans registry created by
220404 the Oklahoma Department of Veterans Affairs; provided, that if the
221405 veteran has previously received an exemption pursuant to this

224406 paragraph, no registration with the veterans registry shall be
225407 required;

227408 5. Legal resident owners or tenants who hunt on land own ed or
228409 leased by them;

230410 6. Any nonresident under fourteen (14) years of age;

232411 7. Legal residents having a proven disability which renders
233412 them nonambulatory and confines them to a wheelchair, as certified
234413 by a physician licensed in this state or in any stat e which borders
235414 this state;

237415 8. Any legal resident or nonresident under eighteen (18) years
238416 of age who is in the physical custod y of a child care facility as
239417 defined by Section 402 of Title 10 of the Oklahoma Statute s; and
240-
241418 9. Any legal resident or nonresi dent hunting, pursuin g,
242419 trapping, harassing, catching, killing, taking, or attempting to
243420 take in any manner any species of rattl esnake during an organized
244421 rattlesnake-hunting event or festival and who has a rattlesna ke
245422 permit issued pursuant to Section 4 -143 of this title.

248451 Conservation Code, the nonresident hunting licen ses issued pursuant
249452 to this section and the fee for each license shall be:

251453 1. Annual hunting license for nonresidents hunting g ame other
252454 than deer, antelope, elk or bear which expires on December 31 of the
253455 year purchased– One Hundred Forty-one Dollars ($141.00).
254456 Nonresidents hunting big game or combination big game an d upland
255457 game in a commercial hunting area shall be required t o have this

258459 2. Annual hunting license for nonresidents huntin g game other
259460 than deer, antelope, elk or bear which expire s on June 30 of the

261462 Hundred Seventy-five Dollars ($175.00). Nonresidents hunting big
262463 game or combination big game and upland game in a commercial hunting
263464 area shall be required to have this license;

268466 be valid for hunting all deer allowed during the current calendar

272469 shall expire on January 15 of the calendar year after the year
273470 purchased or if purchased during the deer archery season it shall
274471 expire at the end of that d eer archery season – Two Hundred Seventy-

301518 issued pursuant to paragraph s 1 through 7 of subsection C of this
302519 section and Two Dollars and fifty cents ($2.50) of the license fee
303520 for each license issued pursuant to paragraph 8 of subsection C of
304521 this section shall be deposited in the Wildlife Land Acquisition
305522 Fund created pursuant to the provisions of Section 4 -132 of this

312553 section shall be for the Oklahoma Wildlife Land Stamp and shall be
313554 deposited in the Oklahoma Wildlife Land Fund created pur suant to the
314555 provisions of Section 4 -141 of this title.

316556 E. Except as otherwise provided, the annual resident hunting
317557 licenses issued purs uant to this subsection shall expire one (1)
318558 year after the date of issuance. The resident hunting licenses
319559 issued pursuant to this section and the fee for each license shall

322561 1. Annual hunting license for residents eighteen (18) years of
323562 age and older which expires on Dece mber 31 of the year purchased -
324563 Twenty-four Dollars ($24.00);

326564 2. Annual hunting license for residents eighteen (18) years of
327565 age and older which expires on June 30 of th e fiscal year purchased
328566 – Thirty-one Dollars ($31.00);

346607 disabled and are receiving disability paym ents from the Multiple
347608 Injury Trust Fund pur suant to Section 31 of Title 85A of the

359616 veteran in receipt of compensation at the on e-hundred-
360617 percent rate and register ed with the veterans registry
361618 created by the Oklahoma Department of Veterans
362619 Affairs; provided, that if the veteran has previously
363620 received an exemption pursuant to this subparagraph,
364621 no registration with the veterans reg istry shall be
365622 required, and

455772 require a hunting license, resident or nonresident, of any person
456773 merely because the person participates, as owner or handler of an
457774 entry, as an official, or as a spectator in the conduct of a field
458775 trial or performance test of dogs, whether a resident or nonresident
459776 of the State of Oklahoma this state. No license to hunt shall be

461805 that person is in no way engaged in hunting and does not take or
462806 attempt to take in any manner any game.

464807 H. 1. Any person arrested for hu nting game other than deer,
465808 antelope, elk, bear or turkey without a valid hunting licens e as
466809 required by the provisions of subsectio n A of this section may
467810 purchase a substitute temporary thirty-day license from the
468811 arresting game warden in lieu of posting bond. Proof of hunter
469812 safety certification will not be required for the temporary
470813 substitute license. The fee for a substitute li cense purchased
471814 pursuant to the provisions of this subsection shall be:
472-
473815 a. for legal residents, Fifty Dollars ($50.00), and
474-
475816 b. for nonresidents, One Hundred Forty-five Dollars
476817 ($145.00).

478818 2. Except as otherwise p rovided for by this subsection, the
479819 fees from licenses purchased pursuant to the provisions of this
480820 subsection shall be deposited in the Wildlife Conservation Fund to

486823 I. Any person producing proo f in court that a current hunting
487824 license issued by the Department of Wildlife Conservation to that

489826 entitled to dismissal of a charge of violating t his section upon

493857 attorney within seventy -two (72) hours after t he violation, the
494858 charge shall be dismissed without payment of court costs.

496859 J. Unless a substitute license is purchased as provided for by
497860 subsection H of this section, any resident convicted of violating
498861 the provisions of this section shall be punished b y the imposition
499862 of a fine of not less than Twenty-five Dollars ($25.00) nor more
500863 than Two Hundred Dollars ($200.00), or by imprisonment in the county
501864 jail for a period not to exceed thirty (30) days, or by both.

503865 K. Unless a substitute license is purchase d as provided for by
504866 subsection H of this section, any nonresident convicted of violating
505867 the provisions of this section shall be punished by the imposition
506868 of a fine of not less than Two Hundred Dollars ($200.00) nor more
507869 than Five Hundred Dollars ($500.0 0), or by imprisonment in the
508870 county jail for a period not to exceed six (6) months, or by both.

510871 L. The Oklahoma Wildlife Conservation Commission shall
511872 promulgate any rules necessary to implement the provisions of this
512873 section.
