31	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

33	60		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4-101, is
34	61		amended to read as follows:
35		-
36	62		Section 4-101. A. All licenses and permits issued by the
37	63		Director of Wildlife Conservation, the Department of Wildlife
38	64		Conservation or by any of its agents shall be u sed only in
39	65		conformity with the prov isions of this title and the rules
40	66		promulgated by the Oklahoma Wildlif e Conservation Commission.

42	94		B. All persons making application for any licenses required by
43	95		this section shall produce a valid license to operate a mot or
44	96		vehicle or other positive proof of identification, age and
45	97		residency, and any such license issued shall show such data as well
46	98		as the date and time of issuance.

50	99		C. All licenses are nontransferable. No per son shall alter,
51	100		change, lend or transfer any l icense. No person shall use or bo rrow
52	101		a license which has not been issued to that person by the Director,
53	102		the Department or by any of its agents pursuant to the provisions of
54	103		this section.
55		-
56	104		D. No person may engage in activities requiring a license
57	105		without that person’s carrying such lice nse on their person and
58	106		producing the same for an inspection upon the dem and of any Oklahoma
59	107		citizen or game warden.
60		-
61	108		E. Any person required to produce a license must also iden tify
62	109		themselves as the person to whom such lice nse was issued, and
63	110		failure or refusal to comply shall be deemed prima facie evidence of
64	111		a violation of this section.

66	112		F. Unless otherwise provided in this Code:
67		-
68	113		1. Hunting licenses Licenses issued pursuant to paragraph 1 of
69	114		subsection C and paragraphs 1 and 3 2 of subsection E of Section 4 -
70	115		112 of this title and paragraphs 1 and 3 2 of subsection B of
71	116		Section 4-113 of this title shall expire on December 31 of the year

73	145		subsection C and paragraphs 2 and 4 of sub section E of Section 4 -112
74	146		of this title and paragraphs 2 and 4 of subsection B of Section 4-
75	147		113 of this title shall expire on June 30 of the fiscal year issued.
76	148		All other licenses and paragraphs 1 and 2 of subsection C and
77	149		paragraph 1 of subsec tion E of Section 4-110 of this title shall
78	150		terminate December 31 for the year expire one (1) year after the
79	151		date issued. Unless otherwise specified, all other licenses shall
80	152		expire December 31 for the year issued; and
81		-
82	153		2. Any person convic ted of violating any of the p rovisions of
83	154		this title may have any or all licenses held by that person or the
84	155		privilege of applying for, purchasing or exercising the benefits
85	156		conferred by the licenses revoked b y the Department in accordance
86	157		with rules promulgated by the Commission or b y a court of competent
87	158		jurisdiction for a period of not less than one (1) year. For
88	159		purposes of this paragraph, a court conviction, a plea of guilty, a
89	160		plea of nolo contendere, th e imposition of a deferred or suspended
90		-

92	161		sentence by a court, or forfeiture o f bond shall be deemed a
93	162		conviction.

95	163		G. Should any license or permit issued pursuant to Part 1 o f
96	164		Article IV of this title be lost or destroyed, duplicates will be
97	165		issued by the Department at a fee of One Dollar and fifty cent s
98	166		($1.50).

100	167		H. Upon harvesting any whitetail or mule deer, or any other
101	168		wildlife where the hunter, according to Commission rul es, is

102	196		required to check the wildlife in at a Department check station, the
103	197		taker of the wildlife shall:

105	198		1. Securely attach the n ame of the taker, time of harvest, date
106	199		of harvest and license number to the carcass of the wildlife;
107		-
108	200		2. Check in the carcass of the wildlife electronically using
109	201		the online check station provided on the offi cial website of the
110	202		Oklahoma Department of Wild life Conservation or as p rescribed by
111	203		rule of the Commission, within twenty-four (24) hours of leaving the
112	204		hunt area and in all cases prior to processing the carcass; and
113		-
114	205		3. Not remove evidence of the sex of the animal until after the
115	206		carcass of the anima l has been checked in.
116		-
117	207		I. It shall be unlawful for any license or permit holder to
118	208		knowingly make a false statement or give f alse information to any
119	209		authorized hunter check station or to an authorized Departm ent
120	210		employee when complying with the provisions of subsection H of thi s
121	211		section. Information which may be collected at a Department check
122	212		station shall include but not be l imited to the name, address,
123	213		license or permit number and signature of the taker, t he date, time,
124	214		county, method or weapon of the kill, sex and weight of carcass,
125	215		whether or not the animal was taken on public hunting land and if so
126	216		in what area, or any oth er information which may be required by the
127	217		Commission.

129	218		J. 1. Any person convicte d of violating the provisions of this
130	219		section or of making a false st atement or giving any false

131	247		information in order to acquire any license or permit, pursuant to
132	248		the provisions of this section, shall be punishable by a fine of not
133	249		less than One Hundred D ollars ($100.00) nor more than Two Hundred

136	250		Fifty Dollars ($250.00), o r by imprisonment in the county jail for a
137	251		period not to exceed ten (10) days, or by both such fine and
138	252		imprisonment. Any person convicted of a second or subsequent
139	253		violation of the prov isions of this section or of making a false
140	254		statement or giving any f alse information in order to acquire any
141	255		license or permit, pursuant to the provisions of this section, shall
142	256		be punishable by a fine of not less than Two Hundred Fifty Dollars
143	257		($250.00) nor more than Seven Hundred Fifty Dollars ($750 .00), or by
144	258		imprisonment in the county jail for a period not to exceed ten (10)
145	259		days, or by both such fine and imprisonment.

147	260		2. Any hunting or fishing license issued to a person by the
148	261		Department of Wildlife Conservation shall be automatically revoked
149	262		upon conviction of the p erson of violating the provisions of this
150	263		section. The revocation shall be for a period set by the court of
151	264		not less than one (1) year nor more than ten (10) years. If the
152	265		court does not set a period, the revocation shall be for one (1)
153	266		year from the date of the conviction. During this period of
154	267		revocation, the Department shall not issue the person a hunti ng or
155	268		fishing license. If the court does not set a revocation period, the
156	269		Department shall not issue that person a license within one (1) year
157	270		of the conviction of the person pursuant to this section. A person

158	298		who has a license or permit revoked pursuant to this section shall
159	299		surrender the revoked license or permit to the court , or the court
160	300		may order the defendant to surrender the license or permit directly
161	301		to an officer from the Department of Wildlife Conservation present
162	302		at the hearing. If the license or permit is surrendered to the
163	303		court, the court shall send the Department of Wildlife Conservation
164	304		the revoked license. The court shall also send the Department a
165	305		copy of the judgment of conviction. For purposes of this section,
166	306		“conviction” shall include a plea of guilty or nolo contendere to an
167	307		offense or the imposition of deferred adjudication for an offense.
168	308		In lieu of sending a paper co py of the documents and information
169	309		required by this subsection, the court clerk may transmit the
170	310		conviction information by using an electronic method authorized by
171	311		the Department of Wildl ife Conservation.

173	312		K. Any person who has had th eir license privileg es revoked
174	313		shall not be entitled to purchase, apply for, or exercise the
175	314		benefits conferred by any license until t he revocation period has
176	315		expired or the person has obtained approval from t he Director. Any
177	316		person violating the provisio ns of this subsectio n, upon conviction,

180	317		shall be punished by a fine of not more than Five Hundred Dollars
181	318		($500.00), or by imprisonmen t in a county jail for a term of not
182	319		more than ninety (90) days or by both the fine and imprisonment.

187	350		SECTION 2. AMENDATORY 29 O.S. 2021, Section 4-112, as
188	351		last amended by Sectio n 3, Chapter 229, O.S. L. 2017, is amended to
189	352		read as follows:
190		-
191	353		Section 4-112. A. Except as otherwise provi ded for in the
192	354		Oklahoma Wildlife Conservation Code or the Oklahom a Farmed Cervidae
193	355		Act, no person may hunt, pursue, trap, harass , catch, kill, take o r
194	356		attempt to take in any manner, use, have in possession, sell, or
195	357		transport all or any portion of any wild life except fish, without
196	358		having first procured a license from th e Department of Wildlife
197	359		Conservation. The Oklahoma Wildlife Conservation Commissio n shall
198	360		designate a consecutive Saturday and Sunda y in September of each
199	361		year as free hunting days in which residents of this state may hunt
200	362		without first procuring a hunti ng license pursuant to the provisions
201	363		of this section.

203	364		B. The following legal residents of Oklahoma shall be exempt
204	365		from the annual hunting license requirement of paragraph 1 of
205	366		subsection E of this section and the following nonresidents shall be
206	367		exempt from the annual nonresid ent hunting licenses required
207	368		pursuant to paragraph 1 of subsection C of this section:

209	369		1. Legal residents unde r sixteen (16) years of age;
210		-
211	370		2. Legal residents sixty -five (65) years of age or older
212	371		provided they have obtained a senio r citizen lifetime hunt ing or

218	402		4. Legal resident veterans having a disability of sixty percent
219	403		(60%) or more and registered w ith the veterans registry created by
220	404		the Oklahoma Department of Veterans Affairs; provided, that if the
221	405		veteran has previously received an exemption pursuant to this
222		-

224	406		paragraph, no registration with the veterans registry shall be
225	407		required;

227	408		5. Legal resident owners or tenants who hunt on land own ed or
228	409		leased by them;
229		-
230	410		6. Any nonresident under fourteen (14) years of age;
231		-
232	411		7. Legal residents having a proven disability which renders
233	412		them nonambulatory and confines them to a wheelchair, as certified
234	413		by a physician licensed in this state or in any stat e which borders
235	414		this state;
236		-
237	415		8. Any legal resident or nonresident under eighteen (18) years
238	416		of age who is in the physical custod y of a child care facility as
239	417		defined by Section 402 of Title 10 of the Oklahoma Statute s; and
240		-
241	418		9. Any legal resident or nonresi dent hunting, pursuin g,
242	419		trapping, harassing, catching, killing, taking, or attempting to
243	420		take in any manner any species of rattl esnake during an organized
244	421		rattlesnake-hunting event or festival and who has a rattlesna ke
245	422		permit issued pursuant to Section 4 -143 of this title.

253	455		year purchased– One Hundred Forty-one Dollars ($141.00).

258	459		2. Annual hunting license for nonresidents huntin g game other
259	460		than deer, antelope, elk or bear which expire s on June 30 of the

261	462		Hundred Seventy-five Dollars ($175.00). Nonresidents hunting big
262	463		game or combination big game and upland game in a commercial hunting
263	464		area shall be required to have this license;

268	466		be valid for hunting all deer allowed during the current calendar
269	467		year deer gun season – Two Hundred Seventy-nine Dollars ($279.00);

271	468		4. 3. Archery hunting license for deer for nonresidents which
272	469		shall expire on January 15 of the calendar year after the year
273	470		purchased or if purchased during the deer archery season it shall
274	471		expire at the end of that d eer archery season – Two Hundred Seventy-
275	472		nine Dollars ($279.00);

292	512		to have this license; and

294	513		9. 8. Ten-day hunting license for non residents hunting small
295	514		game in a commercial huntin g area – Five Dollars ($5.00).

297	515		D. Of the fees collected pursuant t o the provisions of
298	516		subsection C of this section:

300	517		1. Five Dollars ($5. 00) of the license fee of each license
301	518		issued pursuant to paragraph s 1 through 7 of subsection C of this
302	519		section and Two Dollars and fifty cents ($2.50) of the license fee
303	520		for each license issued pursuant to paragraph 8 of subsection C of
304	521		this section shall be deposited in the Wildlife Land Acquisition
305	522		Fund created pursuant to the provisions of Section 4 -132 of this
306	523		title; and

314	555		provisions of Section 4 -141 of this title.

316	556		E. Except as otherwise provided, the annual resident hunting
317	557		licenses issued purs uant to this subsection shall expire one (1)
318	558		year after the date of issuance. The resident hunting licenses
319	559		issued pursuant to this section and the fee for each license shall
320	560		be:

322	561		1. Annual hunting license for residents eighteen (18) years of
323	562		age and older which expires on Dece mber 31 of the year purchased -
324	563		Twenty-four Dollars ($24.00);
325		-
326	564		2. Annual hunting license for residents eighteen (18) years of
327	565		age and older which expires on June 30 of th e fiscal year purchased
328	566		– Thirty-one Dollars ($31.00);

330	567		3. Annual hunting license for residents sixteen (16) or
331	568		seventeen (17) years of age which expires on December 31 of the year
332	569		purchased - Four Dollars ($4.00);

334	570		4. 2. Annual hunting license for residents sixteen (16) or
335	571		seventeen (17) years of age which expires on June 30 of the fiscal
336	572		year purchased – Six Dollars ($6.00);

338	573		5. 3. Ten-day hunting license for residents for small game in a
339	574		commercial hunting area - Five Dollars ($5.00);

357	614		States Department of Veterans Affairs o r its
358	615		successor, certifying that the person is a di sabled
359	616		veteran in receipt of compensation at the on e-hundred-
360	617		percent rate and register ed with the veterans registry
361	618		created by the Oklahoma Department of Veterans
362	619		Affairs; provided, that if the veteran has previously
363	620		received an exemption pursuant to this subparagraph,
364	621		no registration with the veterans reg istry shall be
365	622		required, and
366		-
367	623		b. residents hunting in big game or combin ation big game
368	624		and upland game commercial hunting areas;

451	769		Land Fund created pursuant to the provisions of Section 4-141 of

454	771		G. The provisions of this section shall not be construed to
455	772		require a hunting license, resident or nonresident, of any person
456	773		merely because the person participates, as owner or handler of an
457	774		entry, as an official, or as a spectator in the conduct of a field
458	775		trial or performance test of dogs, whether a resident or nonresident

464	807		H. 1. Any person arrested for hu nting game other than deer,
465	808		antelope, elk, bear or turkey without a valid hunting licens e as
466	809		required by the provisions of subsectio n A of this section may
467	810		purchase a substitute temporary thirty-day license from the
468	811		arresting game warden in lieu of posting bond. Proof of hunter
469	812		safety certification will not be required for the temporary
470	813		substitute license. The fee for a substitute li cense purchased
471	814		pursuant to the provisions of this subsection shall be:
472		-
473	815		a. for legal residents, Fifty Dollars ($50.00), and
474		-
475	816		b. for nonresidents, One Hundred Forty-five Dollars
476	817		($145.00).

478	818		2. Except as otherwise p rovided for by this subsection, the
479	819		fees from licenses purchased pursuant to the provisions of this
480	820		subsection shall be deposited in the Wildlife Conservation Fund to

483	821		be used exclusively for developing, managing, preserving, and
484	822		protecting wildlife and wil dlife habitat.

486	823		I. Any person producing proo f in court that a current hunting
487	824		license issued by the Department of Wildlife Conservation to that
488	825		person was in force at t he time of the alleged offense shall be
489	826		entitled to dismissal of a charge of violating t his section upon

501	864		jail for a period not to exceed thirty (30) days, or by both.

503	865		K. Unless a substitute license is purchase d as provided for by
504	866		subsection H of this section, any nonresident convicted of violating
505	867		the provisions of this section shall be punished by the imposition
506	868		of a fine of not less than Two Hundred Dollars ($200.00) nor more
507	869		than Five Hundred Dollars ($500.0 0), or by imprisonment in the
508	870		county jail for a period not to exceed six (6) months, or by both.

510	871		L. The Oklahoma Wildlife Conservation Commission shall
511	872		promulgate any rules necessary to implement the provisions of this
512	873		section.
