27	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

29	56		SECTION 1. AMENDATORY 37A O.S. 2021, Section 2 -121, is
30	57		amended to read as follows:

32	58		Section 2-121. A. An employee license shall authorize the
33	59		holder thereof to work in a licensed package store, retail s pirits,
34	60		retail wine or retail beer establishment, brewpub, mixed bev erage
35	61		establishment, beer and wine establishment, bo ttle club, public
36	62		event or any establishment where alcohol or alcoholic beverages are
37	63		sold, mixed or served. Persons employed by a mixe d beverage, on-
38	64		premises beer and wine, retail wine, retail beer, pub lic event or a
39	65		bottle club licensee who do not parti cipate in the service, mixing

40	93		or sale of mixed beverages shall not be required to have an employee
41	94		license. Provided, however, that a m anager employed by a mixed
42	95		beverage licensee, public event licensee or a bottle club shall be
43	96		required to have an employ ee license whether or not the manager
44	97		participates in the service, mixing or sale of mixed beverages.
45	98		Applicants for an employee licens e must shall be at least eighteen
46	99		(18) years of age, except for applicants employed by a grocery store

49	100		or convenience store who shall b e at least sixteen (16) years of
50	101		age, and have a health card issued by the county in which they are
51	102		employed, if the county issues such a card; provided, the provisions
52	103		of this section shal l not be construed to permit any person under
53	104		twenty-one (21) years of age to be employed to sell spirits.
54	105		Employees of a special event, caterer, unless catering a mixed
55	106		beverage-licensed premises, or airline/railroad beverage licensee s
56	107		shall not be required to obtain an employee license; further,
57	108		employees of beer distr ibutors and other licensees holding licenses
58	109		issued by the ABLE Commission shall not be required to obtain an
59	110		employee license if such employee only sells alcohol or alc oholic
60	111		beverages to establishments holding licenses issued by the ABLE
61	112		Commission and not to the public. Persons employed by a hotel
62	113		licensee who participate in the stocking of hotel room mini -bars or
63	114		in the handling of alcoholic beverages to be placed in such devices
64	115		shall be required to have an employee license. As a prerequisite to
65	116		the issuance of an employee license, not later than fourteen (14)

66	144		days after initial licensure, the first -time applicant shall be
67	145		required to have successfully completed a t raining program cond ucted
68	146		by the ABLE Commission, or by another entity approved by the ABLE
69	147		Commission, including an in-house training program conducted by the
70	148		employer. Proof of training completion shall be made available for
71	149		inspection by the ABLE Commi ssion at the busines s location employing
72	150		the licensee. The failure of an employee lice nsee to comply with
73	151		this section may constitute a revocable offense.

75	152		B. In the event the ABLE Commission denies an application for
76	153		an employee license, the Commission s hall provide written notice to
77	154		the applicant’s employer, if any. The notice shall be g iven at the
78	155		time notice is provided to the applicant.
	156	+	SECTION 2. It being immediately necessary for the pr eservation
	157	+	of the public peace, health or safe ty, an emergency is hereby
	158	+	declared to exist, by reason whereof this act shall take eff ect and
	159	+	be in full force from and after its passage and approval.
