4039 An Act relating to the State Board of Cosmetology and
4140 Barbering; amending 59 O.S. 2021, Section 199.2,
4241 which relates to the State Board of Cosmetology and
4342 Barbering; modifying language; increasing membership;
4443 increasing requirement of quorum; providing
4544 qualifications for new m embers; and providing an

5251 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
5352 SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.2, is
5453 amended to read as follows:
5554 Section 199.2. A. 1. There is hereby re-created, to continue
5655 until July 1, 2024, in accordance with the provisions of the
5756 Oklahoma Sunset Law, a State Board of Cosmetology and Barbering
5857 which shall be composed of eleven (11) thirteen (13) members to be
5958 appointed by the Governor and to serve at the pleasure of the
6059 Governor.
6160 2. One member shall be appointed from each congressional
6261 district and the additiona l members shall be appointed at -large.
6362 However, when congressional distric ts are redrawn, each member

90-appointed prior to July 1 of the year in which such modifica tion
9191 becomes effective shall complete the current term of office and
9292 appointments made after July 1 of the year in which such
9393 modification becomes effective shall be ba sed on the redrawn
9494 districts. Appointments made after July 1 of the year in which such
9595 modification becomes effective shall be from any redrawn districts
9696 which are not represented by a board member until such time a s each
9797 of the modified congressional dis tricts are represented by a board
9898 member. One member shall be a barber appointed at -large.
9999 3. At the time of appointment, the m embers shall be citizens of
100100 this state, at least twenty -five (25) years of age, and sha ll be
101101 high school graduates. Six members shall, at the time of
102102 appointment, have had at least five (5) years ’ continuous practical
103103 experience in the practice of cosmeto logy in this state; one member
104104 shall be appointed at large and, at the time of the appo intment,
105105 have had at least five (5) year s’ continuous practical experience i n
106106 the practice of barbering in this state; one member shall be a
107107 massage therapist appointed at-large; one member shall be a licensed
108108 owner of a massage therapy establishment at -large; one member shall
109109 be a lay person; one member shall be an administrator of a licensed
110110 private cosmetology school; one member shall be an administrator of
111111 a licensed barber school; and one member shall be an administrator
112112 of a public school licensed to teach cosmetology or barbering.
113+4. No two members shall be graduates of the same cosmetology

139-4. No two members shall be graduates of the same cosmetology
140-school, nor shall they be organize rs of or promote the organization
141142 of any cosmetic, beauty, or hairdressers ’ association. Each of the
142143 eight cosmetology appointe es shall continue to be actively engaged
143144 in the profession of cosmetology wh ile serving. No two members
144145 engaged in the professi on of barbering shall be organizers of or
145146 promote the organization of any barbering association . Each of the
146147 two barbering appointees shall continue to be actively engaged in
147148 the profession of barbering while serving.
148149 5. If any member retires or ceases t o practice his or her
149150 profession during the term of membership on the Board, such terms
150151 shall automatically cease and the Govern or shall appoint a like-
151152 qualified person to fulfill the remainder of the ter m.
152153 B. The terms of office for Board members shall b e four (4)
153154 years ending June 30.
154155 C. Each member shall serve until a successor is appointed and
155156 qualified.
156157 D. Six Seven members of the Board shall constitute a quorum for
157158 the transaction of business.
158159 E. The Governor may remove any member of the Board at any time
159160 at the Governor’s discretion. Vacancies shall be filled by
160161 appointment by the Governor for the unexpired portion of th e term.
161162 F. The Board shall organize by electing from its membership a
162163 chair and vice-chair, each to serve for a period of one ( 1) year.
164+The presiding officer shall not be entitled to vote upon any
165+question except in the case of a tie vote.

189-The presiding officer shall not be entitled to vote upon any
190-question except in the case o f a tie vote.
191193 Members shall be reimbursed for their actual and necessary
192194 traveling expenses as provided by the State Travel Reimbursement
193195 Act.
194196 G. Within thirty (30) days after the end of each fiscal year,
195197 the Board shall make a full report to the Governor of all its
196198 receipts and expenditures, and also a full statement of its work
197199 during the year, together w ith such recommendations as the Board
198200 deems expedient.
199201 H. The Board may expend funds for suitable office space for the
200202 transaction of its business . The Board shall adopt a common seal
201203 for the use of the executive director in authenticating Board
202204 documents.
203205 I. The Board shall meet at its office for the tr ansaction of
204206 such business as may come before it on the second Monday in January,
205207 March, May, July, September, and November and at such other times as
206208 it may deem advisable.
207209 SECTION 2. This act shall become effec tive November 1, 2022.
