52 | 51 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA: |

53 | 52 | | SECTION 1. AMENDATORY 59 O.S. 2021, Section 199.2, is |
---|
54 | 53 | | amended to read as follows: |

55 | 54 | | Section 199.2. A. 1. There is hereby re-created, to continue |
---|
56 | 55 | | until July 1, 2024, in accordance with the provisions of the |
---|
57 | 56 | | Oklahoma Sunset Law, a State Board of Cosmetology and Barbering |
---|
58 | 57 | | which shall be composed of eleven (11) thirteen (13) members to be |
---|
59 | 58 | | appointed by the Governor and to serve at the pleasure of the |
---|
60 | 59 | | Governor. |
---|
61 | 60 | | 2. One member shall be appointed from each congressional |
---|
62 | 61 | | district and the additiona l members shall be appointed at -large. |
---|
63 | 62 | | However, when congressional distric ts are redrawn, each member |
---|
91 | 91 | | becomes effective shall complete the current term of office and |
---|
92 | 92 | | appointments made after July 1 of the year in which such |
---|
93 | 93 | | modification becomes effective shall be ba sed on the redrawn |

94 | 94 | | districts. Appointments made after July 1 of the year in which such |

95 | 95 | | modification becomes effective shall be from any redrawn districts |
---|
96 | 96 | | which are not represented by a board member until such time a s each |

97 | 97 | | of the modified congressional dis tricts are represented by a board |

98 | 98 | | member. One member shall be a barber appointed at -large. |

99 | 99 | | 3. At the time of appointment, the m embers shall be citizens of |
---|
100 | 100 | | this state, at least twenty -five (25) years of age, and sha ll be |
---|
101 | 101 | | high school graduates. Six members shall, at the time of |
---|
102 | 102 | | appointment, have had at least five (5) years ’ continuous practical |
---|
103 | 103 | | experience in the practice of cosmeto logy in this state; one member |
---|
104 | 104 | | shall be appointed at large and, at the time of the appo intment, |
---|
105 | 105 | | have had at least five (5) year s’ continuous practical experience i n |
---|
106 | 106 | | the practice of barbering in this state; one member shall be a |
---|
107 | 107 | | massage therapist appointed at-large; one member shall be a licensed |
---|
108 | 108 | | owner of a massage therapy establishment at -large; one member shall |
---|
109 | 109 | | be a lay person; one member shall be an administrator of a licensed |
---|
110 | 110 | | private cosmetology school; one member shall be an administrator of |
---|
111 | 111 | | a licensed barber school; and one member shall be an administrator |
---|
112 | 112 | | of a public school licensed to teach cosmetology or barbering. |
---|
141 | 142 | | of any cosmetic, beauty, or hairdressers ’ association. Each of the |

142 | 143 | | eight cosmetology appointe es shall continue to be actively engaged |

143 | 144 | | in the profession of cosmetology wh ile serving. No two members |

144 | 145 | | engaged in the professi on of barbering shall be organizers of or |

145 | 146 | | promote the organization of any barbering association . Each of the |

146 | 147 | | two barbering appointees shall continue to be actively engaged in |

147 | 148 | | the profession of barbering while serving. |

148 | 149 | | 5. If any member retires or ceases t o practice his or her |
---|
149 | 150 | | profession during the term of membership on the Board, such terms |
---|
150 | 151 | | shall automatically cease and the Govern or shall appoint a like- |
---|
151 | 152 | | qualified person to fulfill the remainder of the ter m. |
---|
152 | 153 | | B. The terms of office for Board members shall b e four (4) |
---|
153 | 154 | | years ending June 30. |

154 | 155 | | C. Each member shall serve until a successor is appointed and |
---|
155 | 156 | | qualified. |

156 | 157 | | D. Six Seven members of the Board shall constitute a quorum for |
---|
157 | 158 | | the transaction of business. |
---|
158 | 159 | | E. The Governor may remove any member of the Board at any time |
---|
159 | 160 | | at the Governor’s discretion. Vacancies shall be filled by |
---|
160 | 161 | | appointment by the Governor for the unexpired portion of th e term. |

161 | 162 | | F. The Board shall organize by electing from its membership a |
---|
162 | 163 | | chair and vice-chair, each to serve for a period of one ( 1) year. |

191 | 193 | | Members shall be reimbursed for their actual and necessary |
---|
192 | 194 | | traveling expenses as provided by the State Travel Reimbursement |
---|

194 | 196 | | G. Within thirty (30) days after the end of each fiscal year, |

195 | 197 | | the Board shall make a full report to the Governor of all its |
---|
196 | 198 | | receipts and expenditures, and also a full statement of its work |
---|
197 | 199 | | during the year, together w ith such recommendations as the Board |
---|
198 | 200 | | deems expedient. |

199 | 201 | | H. The Board may expend funds for suitable office space for the |
---|
200 | 202 | | transaction of its business . The Board shall adopt a common seal |
---|
201 | 203 | | for the use of the executive director in authenticating Board |
---|
202 | 204 | | documents. |

203 | 205 | | I. The Board shall meet at its office for the tr ansaction of |
---|
204 | 206 | | such business as may come before it on the second Monday in January, |
---|
205 | 207 | | March, May, July, September, and November and at such other times as |
---|
206 | 208 | | it may deem advisable. |

207 | 209 | | SECTION 2. This act shall become effec tive November 1, 2022. |
