48101 SECTION 1. AMENDATORY 29 O.S. 20 21, Section 4-135, is
49102 amended to read as follows:

51103 Section 4-135. A. The Department of Wildlife Conserv ation is
52104 authorized to issue permits to lando wners, agricultural lessees, or
53105 their designated agents with written permission of the landowner or
54106 agricultural lessee and to any entity of state, county, or local
55107 government to control nuisance or damage by an y species of wildlife
56108 including, but not limi ted to, beaver, coyote, deer, bobcat,
57109 raccoon, and crow under rules promulgated by the Oklahoma Wildlife
58110 Conservation Commission. The permits may be issued without
59111 limitation by statewide season regulations, ba g limits or methods of
60112 taking. A permitted l andowner, agricultural lessee or a designated
61113 agent with written permission of the landowner or agricultural
62114 lessee may, with a valid permit issued pursuant to this section,
63115 control the wildlife specified in thi s subsection and feral swine at
64116 night to protect marketable agricu ltural crops, livesto ck, or
65117 processed feed, seed or other materials used in the production of an
66118 agricultural commodity.

68119 B. Except as otherwise specified in this subsection, the permit
69120 to hunt at night shall be valid for a period of u p to one (1) year
70121 from the date the permit was issued. Each landowner, lessee, or
71122 designated agent Landowners or agricultural lessees with a valid
72123 permit shall be required to have a current agricultural exempti on
73124 permit issued by the Oklahoma Tax Commissi on.

75152 C. Notwithstanding the provisions of Section 5-203.1 of this
76153 title, a landowner, agricultural lessee, or designated agent with
77154 written permission of the landowner or lessee and with a valid
78155 permit may use a headlight carried on the person while huntin g at
79156 night. Nothing in this section shall authorize the use of a
80157 headlight mounted on a vehicle or the use of a headlight from a
81158 public roadway.

83159 D. Any person who has been convicted of, or pled guilty to, a
84160 violation of Section 5-203.1 or Section 5-411 of this title within
85161 the previous three (3) years shall not be eligible to receive a
86162 permit pursuant to this section. The permit can be issued by the
87163 local game warden in the county for which the permit is to be used
88164 or by the Law Enforcement Division of t he Department of Wild life
89165 Conservation.

93166 E. Notwithstanding the provisions of Section 1289.13 of Title
94167 21 of the Oklahoma Statutes, it It shall be lawful for any private
95168 landowner or designated employee of the l andowner or lessee to have
96169 a chamber-loaded firearm on property owned by the landowner, and to
97170 use the firearm for the purpose of controlling nuisance or damage by
98171 any wildlife or feral swine. Nothing in this section shall
99172 authorize any convicted felon to carry a firearm.

101173 SECTION 2. AMENDATORY 29 O. S. 2021, Section 5-203.1, is

104202 Section 5-203.1. A. No Except as provided in Section 3 of this
105203 act, no person may attempt to take, take, attempt to catch, catch ,
106204 attempt to capture, capture, attempt to kil l, or kill any deer,
107205 feral animal or other wildlife except fish and frogs by the use of a
108206 vehicle mounted vehicle-mounted spotlight or other powerful light at
109207 night, by what is commonly known as "headlighting". Provided,
110208 however, nothing in this section s hall prevent one from po ssessing a
111209 .22 caliber rimfire rifle or .22 pistol and a light carried while in
112210 pursuit of furbearers with hounds during the legal, open furbearers
113211 season, while possessing a valid huntin g license.

115212 B. Any person may use a shotgun, using No. 6 size shot or
116213 smaller, longbow, light and a call for the purpose of hunting
117214 predatory animals, provided that written permission is obtained from
118215 the local game warden for each twenty -four-hour period of hunting.

120216 C. It shall be illegal to hunt f rom a boat with a firear m from
121217 sunset until one-half (1/2) hour before sunrise. This shall not
122218 pertain to hunting of waterfowl enroute from bank to blind with
123219 unloaded shotguns.

125220 D. C. Except as otherwise provided for in this section and in
126221 Section 3 of this act, no person may harass, attempt to capture,
127222 capture, attempt to take or take, kill or attempt to kill any
128223 wildlife with the aid of any motor -driven land, air or water
129224 conveyance. A nonambulatory person m ay hunt from said conveyances
130225 with written permission of the Director of Wildlife Conservation. A

131253 person may hunt from an air conveyance if issued a permit pursuant
132254 to Section 1 4-107.2 of this act title. Nothing in this section
133255 shall prevent the use of motor-driven land or water conveyances for

136256 following dogs in the act of hunting, when use is restricted to
137257 public roads or waterways. Motor -driven land or water conveyances
138258 may be used on private property for following dogs in the act of
139259 hunting with the permission of the landowner or occupant.

141260 E. D. Employees of the Okla homa Department of Agriculture,
142261 Food, and Forestry Wildlife Services Division and the United States
143262 Department of Agriculture Wildlife Services while engaged in
144263 wildlife management activi ties for the protection of agriculture,
145264 property, human health and sa fety and natural resources shall be
146265 exempt from the provisions of this section.

148266 F. E. Any person convicted of violating the provisions of this
149267 section shall be guilty of a misdemeanor an d shall be punished by a
150268 fine of not less tha n Two Hundred Fifty Doll ars ($250.00) One
151269 Thousand Dollars ($1,000.00) for a first offense and not less than
152270 Five Hundred Dollars ($500.00) Two Thousand Dollars ($2,000.00) for
153271 a second offense or by imprisonmen t in the county jail for not less
154272 than ten (10) days nor more than on e (1) year, or and by
155273 confiscation pursuant to Section 5 -402 of this title or by such
156274 fine, imprisonment and confiscation.

158275 F. A district court, upon request by the district attorney,
159276 shall order the hunting and fishing license priv ileges of a person

160304 convicted of a violation of this section suspended, revoked, or
161305 denied for a period not less than one (1) year nor more than ten
162306 (10) years. Upon completion of the period of suspension,
163307 revocation, or denial of licensure, the person m ay apply for a new
164308 hunting or fishing licens e or request a reinstatement of a lifetime
165309 license, if the person previously held a lifetime license. The
166310 person applying for a new or reinstated license shall be requi red to
167311 pay a reinstatement fee of Two Hundr ed Dollars ($200.00) for
168312 residents of this state and a reinstatement fee of Five Hundred
169313 Dollars ($500.00) for nonresidents. This fee shall be in addition
170314 to any other fees required for the hunting and fishing li cense.

172315 SECTION 3. NEW LAW A new section of law to be codified
173316 in the Oklahoma Statutes as Section 4-135.2 of Title 29, unless
174317 there is created a duplication in numbering, reads as follows:

176318 A. Except during deer gun seasons, a lando wner, agricultural
177319 lessee, or their designated agent with written permission f rom the

180320 landowner or agricultural lessee may control nuisance or damage by
181321 coyotes or feral swine without a permit as provided for in Section
182322 4-135 of Title 29 of the Oklahoma St atutes during the day or night,
183323 and without limitation by statewide season reg ulations or bag
184324 limits, and with the use of any legal means of take, to protect
185325 marketable agricultural crops, livestock or processed feed, seed , or
186326 other materials used in the p roduction of an agricultural commodity.

188355 activities shall be required to have a current agricultural
189356 exemption permit issued by the Oklahoma Tax Commission.

191357 B. Notwithstanding the provisions o f Section 5-203.1 of Title
192358 29 of the Oklahoma Statutes, a landowner, agricultur al lessee, or
193359 designated agent of the landowner or lessee may use a headlight,
194360 thermal, or light enhancement device carried on the person, a
195361 vehicle with or without a mounted sp otlight or night vision
196362 equipment while controlling nuisance coyotes and feral sw ine at
197363 night. Nothing in this subsection shall authorize the use of a
198364 headlight, thermal or night vision equipment , or a spotlight from a
199365 public roadway.

201366 C. Any person who h as been convicted of, or pleads guilty to, a
202367 violation of Section 5-203.1 of Title 29 of the Oklahoma Statutes or
203368 Section 5-411 of Title 29 of the Oklahoma Statutes within a previous
204369 three-year period shall not control nuisance or damage by coyotes or
205370 feral swine at night.

207371 SECTION 4. This act shall become effective Nove mber 1, 2022.
