6186 SECTION 1. NEW LAW A new sectio n of law to be codified

92142 SECTION 2. NEW LAW A new section of law to be codified
93-in the Oklahoma Statutes as Section 383.1 of Title 3, unless there

95-A. There is hereby created within the Oklahoma Aeronautics
96-Commission the Fly-In Oklahoma Program. The purpose of this program
97-shall be to enhance and incentivize avia tion and aerospace tourism
98-areas at publicly owned airports within the state through
99-opportunities to improve airports, terminal buildings, recreational
100-aviation activities, and other aviation travel -related
101-infrastructure as well as to advertise tourism opportunities to the
102-aviation community and enhance general awareness of the aviation and
103-aerospace industry. The program shall also promote fly-in events
104-and activities as well as encourag e pilots and aviation enth usiasts
105-to utilize the Oklahoma Airport S ystem. The program shall be
106-administered by the Oklahoma Aeronautics Commission in collaboration
107-with the Oklahoma Tourism and Recreation Department.
108-B. Grants for publicly owned airports and municipalities or
109-public trusts, which operate publicly owned airports that are in the
110-Oklahoma Airport System , shall be available for development and
111-improvement of infrastructure and equipment that would support fly -
112-in tourism, advertising of fly -in tourism, and general awar eness of
113-the aviation industry within the state. Recipients that receive
114-funding from the Commission pursuant to this program shall be
115-required to keep track of tourism activities and uses of the grant
145+A. Pursuant to Oklahoma Sunset Law, there is hereby created the
146+Fly In Oklahoma grant program to continue until Novembe r 2028, and
147+such program shall be subject to renewal. The purpose of the grant
148+program shall be to incentivize qualified potential tourism areas
149+within the state through fly-in opportunities by improving airports,
150+air traffic facilities, runways, landing s trips, aircraft hangers,
151+fly-in restaurants and other associated travel-related businesses
152+and advertising that are accessible primarily by aircraft .
153+B. Public owned or operated airports, landing airstrips,
154+airplane tiedown facilities, hangers or storage facilities, runways,
155+aircraft repair facilities and aircraft-related tourism areas shall
156+be eligible to apply for the Fly In Oklahoma gr ant program. The
157+program shall be administered through the Office of the Lieutenant
158+Governor, Cabinet Secretary of Tourism, Wildlife and Heritage, in
159+collaboration with the Oklahoma Tourism and Recreation Department to
160+develop public fly-in opportunities that promote, advertise and
161+attract aircraft tourism within this state.
162+C. The total maximum grant fund shall be One Million Dollars
163+($1,000,000.00). The funds shall be derived from legislative
164+appropriations and other public and private sources of monies
165+including other grants and matching funds received by this state.

142-at their airport and report on an annual basis how th is funding has
143-enhanced aviation and aerospace activity at their airport.
144-C. Contingent upon the availability of funds appropriated by
145-the Legislature, the Oklahoma Aeronautics Commission may use
146-established processes or may contract with qualified entiti es to
147-carry out the duties and responsibi lities of this program.
148-D. The Oklahoma Aeronautics Commission shall promulgate any
149-rules necessary to implement the provisions of the Fly -In Oklahoma
150-Program.
217+The grants awarded through the Fly In Oklahoma Act shall only be
218+available for development and improvement of infrastructure relating
219+to potential fly-in tourism in this state, state tourism advertising
220+campaigns and for new construction and infrastructure in nearby
221+targeted fly-in areas that will increase air traffic to the existing
222+businesses, restaurants, natural resources and tourism attractions
223+through improved fly-in opportunities.
224+D. The Oklahoma Tourism and Recreation Department shall
225+promulgate rules, procedures, forms and grant application materials
226+to solicit and receive grant applications from eligible private
227+businesses and political subdivisions within this state and to
228+administer this program. The Office of the Lieutenant Governor
229+shall conduct case studies on eligible grant applications to
230+determine the feasibility and potential financial impact for the
231+best award of grant funds awarded under this program.
232+E. Fly In Oklahoma grants may be required to be repaid to this
233+state over a term of years as specified in a written grant contract
234+or such grants may be offered as a partial financial incentive that
235+requires partial or no repayment as determined on a case-by-case
236+basis and specified in the written grant contract. All potential
237+grant applications deemed fiscally prudent for tourism and
238+consideration by this state shall be submitted to the Legislature
239+through the President Pro Tempore of the Senate and the Speaker of
240+the House of Representatives by January 1 each year . The

292+Legislature shall conduct a review of each grant under consideration
293+before any grant awards are made by the Office of the Lieutenant
294+Governor, Cabinet Secretary of Tourism, Wildlife and Heritage . Upon
295+approval of a grant award, the Legislature shall communicate its
296+approval by Joint Resolution. Upon final approval by Joint
297+Resolution of the Legislature, the grant may be awarded by written
298+grant contract entered between the approved business or political
299+subdivision of this state and the Oklahoma Tourism and Recreation
300+Department with approval by the Cabinet Secretary of Tourism,
301+Wildlife and Heritage.
302+F. Notwithstanding any law to the contrary limiting this
303+state’s authority to provide financial assistance to any political
304+subdivision or public trust of this state or to offer state funds to
305+private businesses for a public-related purpose, the Lieutenant
306+Governor shall be authorized under the Fly In Oklahoma Act to
307+partnership with this state’s private businesses, political
308+subdivisions or both for purposes of tourism investments in the
309+airways-related industries of this state.
