43	75		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
44	76		SECTION 1. NEW LAW A ne w section of law to be codified
45	77		in the Oklahoma Statutes as Section 85.49 of Title 74, unless there
46	78		is created a duplication in numbering, reads as follows:
47	79		A. Beginning on July 1, 2024, five per cent (5%) of all state
48	80		contracts shall be awarded to busines ses that have been in operation
49	81		for less than five (5) years.
50	82		B. For competitive bids submitted to the state pursuant to the
51	83		Oklahoma Central Purchasing Act or pursuant to the Public
52	84		Competitive Bidding Ac t of 1974 by eligible new corporations, the
53	85		State Purchasing Director shall prepare and implement a bid -
54	86		preference program. The program shall require that, if the
55	87		percentage of such funds expended on eligible new corporations is
56		-	less than ten percent (10%), a percentage shall be added to the
57		-	price of the lowest bid and if the eligible new corporation submits
58		-	a bid that falls below the lowest bid plus the percentage, it sha ll
59		-	receive the contract. As used in this subsection, "eligible new
