4375 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
4476 SECTION 1. NEW LAW A ne w section of law to be codified
4577 in the Oklahoma Statutes as Section 85.49 of Title 74, unless there
4678 is created a duplication in numbering, reads as follows:
4779 A. Beginning on July 1, 2024, five per cent (5%) of all state
4880 contracts shall be awarded to busines ses that have been in operation
4981 for less than five (5) years.
5082 B. For competitive bids submitted to the state pursuant to the
5183 Oklahoma Central Purchasing Act or pursuant to the Public
5284 Competitive Bidding Ac t of 1974 by eligible new corporations, the
5385 State Purchasing Director shall prepare and implement a bid -
5486 preference program. The program shall require that, if the
5587 percentage of such funds expended on eligible new corporations is
56-less than ten percent (10%), a percentage shall be added to the
57-price of the lowest bid and if the eligible new corporation submits
58-a bid that falls below the lowest bid plus the percentage, it sha ll
59-receive the contract. As used in this subsection, "eligible new
