50	102		2014 (70 O.S. Supp. 20 20, Section 21-102.1), is amended to read as

53	104		Section 21-102.1. The Oklahoma Board of Private Vocational
54	105		Schools is authorized to:

56	106		1. Appoint and fix the compensation of a director who:

58	107		a. shall employ and fix the duties and compensation of
59	108		such clerical or other assistants as are reasonably
60	109		necessary to effectuate the provisions of this act
61	110		Section 21-101 et seq. of this title , and

63	111		b. may execute contracts on behalf of the Board;
64		-
65	112		2. Promulgate rules to include but not be limited to the
66	113		implementation of minimum standards for the operation of private
67	114		schools and the requirements for application of a school, seminar or
68	115		workshop for a license of state authorization;

70	116		3. Approve or disapprove:

72	117		a. applications for state authorization,
73		-
74	118		b. other applications for licensing including
75	119		applications for sustained licenses ,

77	120		c. requests for exemption, and

94	158		private schools, which shall include standards for :

102	162		d. advertising practices, and

104	163		e. refund of tuition and fees paid by students for
105	164		courses of instruction or training not completed , and
106	165		shall promulgate and adopt reasonable rules and
107	166		regulations for the implementation of such minimum
108	167		standards for the operation of private schools ;

110	168		7. Where possible, to regulate degrees offered by distance
111	169		education, make use of the State Regents for Higher Education 's
112	170		interstate reciprocity agreements to create a more efficient and
113	171		cost-effective means of the regulation of private schools;

115	172		8. Make use of interstate reciprocity agreements that
116	173		reasonably satisfy the Board 's minimum standards to approve state
117	174		authorization or other license application, if such agreements

137	215		electronic means, but shall charge for the pick up or m ailing of a

142	219		electronically stored record as an original, subject to approval by
143	220		the Oklahoma Archives and Records Commission and when in accordance
144	221		with the record retention and destruction policy of the Board;

147	223		applicant or licensed school or seminar including joint visits wit h
148	224		an accrediting organization or federal or state agency;

183	271		state authorization for private vocational schools, seminars, and
184	272		workshops and such other schools that make offerings of courses or
185	273		programs as permitted by this act Section 21-101 et seq. of this

188	302		SECTION 2. AMENDATORY 70 O.S. 2011, Sec tion 21-106, as
189	303		amended by Section 10, Chapter 276, O.S.L. 2014 (70 O.S. Supp. 20 20,
190	304		Section 21-106), is amended to read as follows:

192	305		Section 21-106. A. A license issued pursuant to this act
193	306		Section 21-101 et seq. of this title shall expire annually on Ju ne
194	307		30. Such license shall be renewed annually with the complete
195	308		renewal application and any and all appropriate fees due prior to
196	309		expiration annually on or before June 1 of each year. Licenses
197	310		shall be renewed by the Oklahoma Board of Private Vocational Schools
198	311		if the Board determines that such school remains in compliance with
199	312		the standards or other requirements set by the Board. The license
200	313		of any school licensed by the Board to provide postsecondary
201	314		education or other limited offering may be revoked i f the school is
202	315		found to be in violation of the Oklahoma Statutes, the minimum
203	316		standards established by the Board , or if an accreditation
204	317		organization or other governmental entity 's approval, material to
205	318		the continuity of the school, is revoked.

207	319		B. If a school is accredited by an accrediting organization
208	320		approved by the U.S. Department of Education for multiple years, a
209	321		sustained license may be obtained annually during the period of the
210	322		multi-year accreditation.

212	323		C. A license of a school shall not be effec tive unless the
213	324		private school has filed with the Board a corporate surety bond or a

217	354		C. D. Private schools or applicants shall pay the following
218	355		base fees to the Board:

222	356		1. One Thousand Two Hundred Dollars ($1,200.00) per license
223	357		shall be paid to the Board for the issuance of an initial license
224	358		for a school, seminar, or workshop to provide postsecondary
225	359		education or other vocational -technical education or training
226	360		pursuant to the provisions of this act Section 21-101 et seq. of
227	361		this title;

229	362		2. Three Hundred Dollars ($300.00) shall be paid for the
230	363		initial license of each new branch. A branch 's renewal fee shall be
231	364		based on the tuition it collected;
232		-
233	365		3. For each renewal of a lic ense, a fee based on the tuition
234	366		collected by a school, workshop or seminar from residents of
235	367		Oklahoma or other persons present in Oklahoma, as shown in the
236	368		current financial statement of the school , shall be paid to the
237	369		Board. If a school, workshop or se minar does not provide adequate
238	370		details of its Oklahoma tuition, then the renewal fee shall be based
239	371		on the nationwide tuition reported. For each main and branch
240	372		school, seminar, or workshop, the renewal fees shall be calculated
241	373		based upon the level of ne t tuition in the immediate prior calendar
242	374		year as follows:

272	418		catalog, catalog addendum(s) or a combination of a catalog and
273	419		catalog addendum(s) per campus included in the catalog or addendums
274	420		to be charged as follows:

276	421		a. One Hundred Dollars ($100.00) for the review of a
277	422		revised or replacement catalog that does not include a
278	423		program change or addition, or

280	424		b. One Hundred Fifty Dollars ($150.00) for the review of
281	425		the related catalog, catalog addendum or a combination

287	457		shall be paid in addition to the review fee provided for in
288	458		paragraph 5 of this subsection whenever a main or branch private
289	459		school changes location; and

291	460		7. One Hundred Dollars ($100.00) A review fee of Fifty Dollars
292	461		($50.00) shall also be paid whenever a school, seminar or workshop
293	462		is required to provide preliminary Board review or approval
294	463		documentation to be forwarded to an accrediting organization, the
295	464		U.S. Department of Education or another state or federal agency;

297	465		8. The payment of the fee required by paragraph 7 of this
298	466		subsection shall be applied as a credit against the subsequent fee
299	467		for a review of a catalog or catalog addendum( s) that is submitted
300	468		to include incorporation of the same topic(s) following final
301	469		approval of the subject matter by an accreditor or the U.S.
302	470		Department of Education;

304	471		9. Two Hundred Dollars ($200.00) shall be paid by each school
305	472		to the Board for attendan ce at a school workshop or webinar by the
306	473		school's required personnel, although one person may attend to
307	474		represent multiple, related schools ;

311	475		10. Two Hundred Dollars ($200.00) for a half -day and Three
312	476		Hundred Dollars ($300.00) for a full day of optional t raining; and

319	508		E. The base fees authorized by para graphs 1, 2 and 3 of
320	509		subsection D of this section shall increase by seven percent (7%)
321	510		for the fiscal year ending June 30, 202 2.

323	511		D. F. If the annual licensing renewal application is not
324	512		complete on or before the first day of June each year, the fee for
325	513		license renewal shall become delinquent and the license shall not be
326	514		renewed except upon payment of an additional late fee. Late fees
327	515		shall be determined based upon the school 's past history of
328	516		submitting late filings. The appropriate late fees shall be pa id in
329	517		full prior to the Board 's issuance of a renewal license in the
330	518		following amounts:

332	519		1. Two Hundred Fifty Dollars ($250.00) for a first violation;
333		-
334	520		2. Five Hundred Dollars ($500.00) for a second violation within
335	521		ten (10) years of the first late filing, whether consecutive or not;
336	522		and

338	523		3. One Thousand Dollars ($1,000.00) for a third violation
339	524		within ten (10) years of the first late filing, whether consecutive
340	525		or not.

350	559		H. In-state site visit fees shall be charged for the purpose of
351	560		reviewing compliance with minimum standards or contractual

354	561		agreements, facility inspection or complaint investigation. The
355	562		fees shall be charged to an applicant, school, seminar or workshop
356	563		as follows:

358	564		1. Two Hundred Twenty -five Dollars ($225.00) per day when the
359	565		site visit does not require overnight lodging;
360		-
361	566		2. Four Hundred Fifty Dollars ($450.00) per day if overnight
362	567		lodging is required; and
363		-
364	568		3. Travel fees to multiple entities on the same day may be
365	569		apportioned or prorated when each visit involves on -site time of
366	570		less than three (3) hours.

368	571		I. An in-state visit fee shall not be charged:
369		-
370	572		1. When the Board joins an accrediting organization, the U.S.
371	573		Department of Education or another state o r federal agency with the
372	574		organization or agency 's site visit to an applicant, school, seminar
373	575		or workshop; or

379	606		F. J. The Board shall be authorized to require reimbursement
380	607		for any fees charged by a financial institution or the State
381	608		Treasurer for a returned check or other failed form of payment. The
382	609		amount to be reimbursed shall be invoiced to an entity within forty -
383	610		five (45) days after the Board 's first knowledge of the fee.

385	611		G. K. All fees, penalties and fines collected by the Board
386	612		pursuant to the provisions of this act Section 21-101 et seq. of
387	613		this title shall be deposited with the State Treasurer for credit to
388	614		the Oklahoma Board of Private Vocational Schools Revolving Fund.

390	615		SECTION 3. It being immediately necessary for the preservation
391	616		of the public peace, health or safety, an emergency is hereby
392	617		declared to exist, by reason whereof this act shall take effect and
393	618		be in full force from and after its passage and approval.
