57109 SECTION 1. AMENDATORY Section 3, Chapter 159, O.S .L.
58110 2018 (36 O.S. Supp. 2020, Section 6711), is amended to read as
59111 follows:

61112 Section 6711. A. The purpose of this act is to promote the
62113 public welfare by creating a comprehensive legal framework within
63114 which travel insurance may be sold in this state.
64-
65115 B. The requirements of the act shall apply to travel insurance
66116 where covering any resident of this state that is sold, solicited,
67117 negotiated or offered in this state and policies and certificates
68118 that are delivered or issued for delivery in this state. It s hall
69119 not apply to cancellation fee waivers and travel assistance
70120 services, except as expressly provided herein.

72121 B. C. All other applicable provisions of this state ’s insurance
73122 laws shall continue to apply to travel insurance except that the
74123 specific provisions of this act the Travel Insurance Act shall
75124 supersede any general provisions of law that would otherwise be
76125 applicable to travel insurance.

82156 Section 6712. As used in this act the Travel Insurance Act , the
83157 term:

85158 1. “Aggregator site” means a website that provides access to
86159 information regarding insurance products from more than one insurer,
87160 including product and insurer information, for use in comparison
88161 shopping;

92162 2. “Blanket travel insurance ” means a policy of travel
93163 insurance issued to any eligible group providing coverage for
94164 specific classes of persons defined in the policy, with coverage
95165 provided to all members of the eligible group without a separate
96166 charge to individual members of the eligible group;

98167 3. “Cancellation fee waiver ” means a contractual agreement
99168 between a supplier of travel services and its customer to waive some
100169 or all of the nonrefun dable cancellation fee provisions of the
101170 supplier’s underlying travel contract, with or without regard to the
102171 reason for the cancellation or form of reimbursement. A
103172 cancellation fee waiver is not insurance;

105173 4. “Commissioner” means the Oklahoma Insurance Commissioner;

107174 5. “Eligible group” means, solely for the purposes of travel
108175 insurance, two or more persons who are engaged in a common
109176 enterprise, or have an economic, educational or social affinity or
110177 relationship, including, but not limited to, any of t he following:

112178 a. any entity engaged in the business of providing travel
113179 or travel services, including, but not limited to,

181313 renters, lessees or passengers defined by their travel
182314 status on the rented or leased vehicles. The common
183315 carrier, the operator, owner or lessor of a means of
184316 transportation or the automobile or truck rental or
185317 leasing company is the policyholder under a policy to
186318 which this paragraph applies, or

188319 m. any other group where the Commissioner has determined
189320 that the members are engaged in a common enterprise,
190321 or have an economic, educational or social affinity or
191322 relationship, and that issuance of the policy would
192323 not be contrary to the public interest;

194324 6. “Fulfillment materials ” means documentation sent to the
195325 purchaser of a travel protection plan confirming the purchase and
196326 providing the coverage and assistance details of the travel
197327 protection plan;

199328 7. “Group travel insurance ” means travel insurance issued to
200329 any eligible group;

202330 8. “Limited lines travel insurance producer ” means any of the

213364 9. “Offer and disseminate ” means providing general information,
214365 including a description of the coverage and price, as well as
215366 processing the application and collect ing premiums;

217367 10. “Travel administrator ” means a person who directly or
218368 indirectly underwrites, collects charges, collateral or premiums
219369 from or adjusts or settles claims on residents of this state, in
220370 connection with travel insurance, except that a perso n shall not be

223371 considered a travel administrator if the only actions of the person
224372 are those that would otherwise cause the person to be considered a
225373 travel administrator are among the following he or she is:

227374 a. a person working for a travel administrator whose
228375 activities are subject to the supervision and control
229376 of the travel administrator,

231377 b. an insurance producer selling insurance or engaged in
232378 administrative and claims -related activities within
233379 the scope of the license of the producer,
234-
235380 c. a travel retailer offering and disseminating travel
236381 insurance and registered under the license of a

237409 limited lines travel insurance producer in accordance
238410 with this act the Travel Insurance Act ,
239-
240411 d. an individual adjusting or settling claims in the
241412 normal course of pract ice or employment of the
242413 individual as an attorney -at-law and who does not
243414 collect charges or premiums in connection with
244415 insurance coverage, or
245-
246416 e. a business entity that is affiliated with a licensed
247417 insurer while acting as a travel administrator for the
248418 direct and assumed insurance business of an affiliated
249419 insurer;
250-
251420 11. “Travel assistance services ” means noninsurance services
252421 that may be distributed by limited lines travel insurance producers
253422 or other entities, and for which there the consumer is no
254423 indemnification for the travel protection plan customer not
255424 indemnified based on a fortuitous event, nor any and where providing
256425 the services does not result in transfer or shifting of risk that
257426 would constitute the business of insurance. Travel assistance
258427 services include, but are not limited to: security advisories;
259428 destination information; vaccination and immunization information
260429 services; travel reservation services; entertainment; activity and
261430 event planning; translation assistance; emergency messaging;
262431 international legal and medical referrals; medical case monitoring;
263432 coordination of transportation arrangements; emergency cash transfer

268462 concierge services; and any other service that is furnished in
269463 connection with planned travel that is not related to the
270464 adjudication of a travel insurance claim, unless otherwise approved
271465 by the Commissioner in a travel insurance filing . Travel assistance
272466 services are not insurance and not related to insurance;

274467 12. “Travel insurance” means insurance coverage for personal
275468 risks incident to planned travel, including:
276-
277469 a. interruption or cancellation of trip or event,
278-
279470 b. loss of baggage or per sonal effects,
280-
281471 c. damages to accommodations or rental vehicles,
282-
283472 d. sickness, accident, disability or death occurring
284473 during travel,
285-
286474 e. emergency evacuation,
287-
288475 f. repatriation of remains, or
289-
290476 g. any other contractual obligations to indemnify or pay
291477 a specified amount to the traveler upon determinable
292478 contingencies related to travel as approved by the
293479 Commissioner.

295480 Travel insurance does shall not include major medical plans that
296481 provide comprehensive medical protection for travelers with trips
297482 lasting longer than six (6) months, including, but not limited to,

299511 product that requires a specific insurance producer license;

301512 13. “Travel protection plans ” means plans that provide one or
302513 more of the following: travel insurance, travel assistance services
303514 and cancellation fee waivers; and

305515 14. “Travel retailer” means a business entity that makes,
306516 arranges or offers planned travel and may offer and disseminate
307517 travel insurance as a service to its customers o n behalf of and
308518 under the direction of a limited lines travel insurance producer.

312519 SECTION 3. AMENDATORY Section 5, Chapter 159, O.S.L.
313520 2018 (36 O.S. Supp. 2020, Section 6713), is amended to read as
314521 follows:

316522 Section 6713. A. The Insurance Commissioner may issue a
317523 limited lines travel insurance producer license to an individual or
318524 business entity that has filed with the Commissioner an application
319525 for such license in a form and manner prescribed by the
320526 Commissioner. The limited li nes travel insurance producer shall be
321527 licensed to sell, solicit or negotiate travel insurance through a
322528 licensed insurer. No person may act as a limited lines travel
323529 insurance producer or travel insurance retailer unless properly
324530 licensed or registered, respectively.

326531 B. A travel retailer may offer and disseminate travel insurance
327532 under a limited lines travel insurance producer business entity
328533 license only if:

330561 1. The limited lines travel insurance producer or travel
331562 retailer provides to purchasers of tra vel insurance:

333563 a. a description of the material terms or the actual
334564 material terms of the insurance coverage,

336565 b. a description of the process for filing a claim,

338566 c. a description of the review or cancellation process
339567 for the travel insurance policy, and
340-
341568 d. the identity and contact information of the insurer
342569 and limited lines travel insurance producer;
343-
344570 2. At the time of licensure, the limited lines travel insurance
345571 producer shall establish and maintain a register on a form
346572 prescribed by the Commissioner of each travel retailer that offers
347573 travel insurance on behalf of the limited lines travel insurance.
348574 The register shall be maintained and updated by the limited lines
349575 travel insurance producer and shall include the name, address and
350576 contact information of t he travel retailer and an officer or person
351577 who directs or controls the operations of the travel retailer and
352578 the federal tax identification number of the travel retailer. The

355579 limited lines travel insurance producer shall submit the register to
356580 the Insurance Department upon reasonable request. The limited lines
357581 travel insurance producer shall also certify that the registered
358582 travel retailer complies with 18 U.S.C., Section 1033. The grounds
359583 for the suspension, revocation and the penalties applicable to
360584 resident insurance producers, pursuant to Section 1435.13 of Title

362613 limited lines travel insurance producers and travel retailers;

364614 3. The limited lines travel insurance producer has designat ed
365615 one of its employees, a designated responsible producer, who is a
366616 licensed individual producer as the person responsible for the
367617 compliance with the travel insurance laws and regulations applicable
368618 to the limited lines travel insurance producer and its registrants;
369-
370619 4. The designated responsible producer, president, secretary,
371620 treasurer and any other officer or person who directs or controls
372621 the limited lines travel insurance producer ’s insurance operations
373622 comply with the fingerprinting requirements app licable to insurance
374623 producers in the resident state of the limited lines travel
375624 insurance producer;
376-
377625 5. The limited lines travel insurance producer has paid all
378626 applicable insurance producer licensing fees as set forth in Section
379627 1435.23 of Title 36 of the Oklahoma Statutes this title; and
380-
381628 6. The limited lines travel insurance producer requires each
382629 employee and authorized representative of the travel retailer whose
383630 duties include offering and disseminating travel insurance to
384631 receive a program of instruc tion or training, which is subject to
385632 the discretion of the Commissioner to review and approve. The
386633 training material shall, at a minimum, contain adequate instructions
387634 on the types of insurance offered, ethical sales practices and
388635 required disclosures to prospective customers.

391664 insurance shall make available to prospective purchasers brochures
392665 or other written materials that have been approved by the travel
393666 insurer. Such materials shall include info rmation which, at a

398668 1. Provides the identity and contact information of the insurer
399669 and the limited lines travel insurance producer;

401670 2. Explains that the purchase of travel insurance is not
402671 required in order to purchase any other product or serv ice from the
403672 travel retailer; and

405673 3. Explains that an unlicensed travel retailer is permitted to
406674 provide only general information about the insurance offered by the
407675 travel retailer, including a description of the coverage and price,
408676 but is not qualified o r authorized to answer technical questions
409677 about the terms and conditions of the insurance offered by the
410678 travel retailer or to evaluate the adequacy of the customer ’s
411679 existing insurance coverage.

413680 D. A travel retailer employee or authorized representative who
414681 is not licensed as an insurance producer may not:

416682 1. Evaluate or interpret the technical terms, benefits and
417683 conditions of the offered travel insurance coverage;
418-
419684 2. Evaluate or provide advice concerning existing insurance
420685 coverage for a prospective purchaser; or

422713 3. Hold himself, herself or itself out as a licensed insurer,
423714 licensed producer or insurance expert.

425715 E. Notwithstanding any other provision in law, a travel
426716 retailer whose insurance -related activities, and those of its
427717 employees and authori zed representatives, are limited to offering
428718 and disseminating travel insurance on behalf of and under the
429719 direction of a limited lines travel insurance producer meeting the
430720 conditions stated in this act the Travel Insurance Act , is
431721 authorized to receive r elated compensation, upon registration by the
432722 limited lines travel insurance producer as described in paragraph 2
433723 of subsection B of this section.

435724 F. As the insurer designee, the limited lines travel insurance
436725 producer is responsible for the acts of the t ravel retailer and
437726 shall use reasonable means to ensure compliance by the travel
438727 retailer with this act the Travel Insurance Act .

442728 G. Any person licensed as an insurance producer with a line of
443729 authority set forth in paragraphs 1 through 4, 6 and 7 of subs ection
444730 A of Section 1435.8 of this title is authorized to sell, solicit and
445731 negotiate travel insurance. The producer is not required to be
446732 appointed by an insurer in order to sell, solicit or negotiate the
447733 travel insurance.

453764 Section 6714. A. A travel insurer shall pay premium tax, as
454765 provided in Section 624 of Title 36 of the Oklahoma Statutes this
455766 title, on travel insurance premiums paid by any of the following:

457767 1. An individual primary policyholder who is a resident of this
458768 state;
459-
460769 2. A primary certificate -holder who is a resident of this state
461770 who elects coverage under a group travel insurance policy; or
462-
463771 3. A blanket travel insurance policyholder that is a resident
464772 of this state, or has its principal place of business or the
465773 principal place of business of an affiliate or subsidiary that has
466774 purchased blanket travel insurance in this state for eligible
467775 blanket group members, subject to any apportionment rules which
468776 apply to the insurer across multiple taxing jurisdictions or that
469777 permits permit the insurer to allocate premium on an apportioned
470778 basis in a reasonable and equitable manner in those jurisdictio ns.

472779 B. A travel insurer shall:

474780 1. Document the state of residence or principal place of
475781 business of the policyholder or certificate -holder, as required in
476782 subsection A of this section; and
477-
478783 2. Report as premium only the amount allocable to travel
479784 insurance and not any amounts received for travel assistance
480785 services or cancellation fee waivers.

487815 elects and purchases travel insurance under a group policy; and

489816 2. “Primary policyholder ” means an individual person who elects
490817 and purchases individual travel insurance.

501826 Insurance Act and other provisions of Title 36 of the Oklahoma
502827 Statutes this title regarding the sale and marketing of travel
503828 insurance and travel protection plans, the provisions of this act
504829 the Travel Insurance Act shall control.

506830 B. Offering or selling a travel insurance policy that could
507831 never result in payment of any claims for any insured under the
508832 policy is an unfair trade practice under Section 1203 of Title 36 of

517866 limited to, forms, endorsements, policies, rate filings and

520868 2. Travel For travel insurance policies or certificates that
521869 contain pre-existing condition exclusions must clearly disclose the
522870 exclusion, information about the pre -existing condition exclusions
523871 shall be provided prior to the time of purchase and shall be in the
524872 fulfillment materials of the coverage.

526873 3. Policyholders or certificate holders shall have a minimum of
527874 ten (10) days from t he later of the date of purchase of a travel

530875 protection plan or the delivery of the fulfillment materials of the
531876 plan to review and cancel the policy or certificate for a full
532877 refund of the travel protection plan price, unless the insured has
533878 either started the covered trip or has filed a claim under the
534879 travel insurance coverage. For the purposes of this paragraph,
535880 sending documentation confirming the purchase and providing the
536881 coverage and assistance details of the travel protection plan, as
537882 applicable, to a physical or electronic mail address provided by the
538883 purchaser of a travel protection plan shall constitute delivery of
539884 the travel protection plan ’s fulfillment materials The fulfillment
540885 materials and the information described in paragraph 1 of subsect ion
541886 B of Section 6713 of this title shall be provided to a policyholder
542887 or certificate holder as soon as practicable following the purchase
543888 of a travel protection plan. Unless the insured has either started

544916 a covered trip or filed a claim under the travel insurance coverage,
545917 a policyholder or certificate holder may cancel a policy or
546918 certificate for a full refund of the travel protection plan price
547919 from the date of purchase of the travel protection plan until at
548920 least:

550921 a. fifteen (15) days following the da te of delivery by
551922 mail of the fulfillment materials of the travel
552923 protection plan, or

554924 b. ten (10) days following the date of delivery by other
555925 means of the fulfillment materials of the travel
556926 protection plan.

558927 4. The company shall disclose in the policy fulfillment and
559928 documentation and fulfillment materials whether the travel insurance
560929 is primary or secondary to other applicable coverage.

562930 5. Where travel insurance is marketed directly to a consumer
563931 through a website of the insurer or by others through an aggregator
564932 site, it shall not be an unfair trade practice or other violation of
565933 law where an accurate summary or short description of coverage is
566934 provided on the web page, so long as the consumer has access to the
567935 full provisions of the policy through elec tronic means.

575967 a consumer to take an affirmative action to deselect coverage such
576968 as unchecking a box on an electronic form when they purchase the
577969 consumer purchases a trip.

579970 E. It shall not be an unfair trade practice to include market
580971 blanket travel insurance coverage with the purchase of a trip,
581972 provided the coverage is not marketed as free.

583973 F. Where the destination jurisdiction of the consumer requires
584974 insurance coverage, it shall not be an unfair trade practice to
585975 require that the consumer choose bet ween the following options as a
586976 condition of purchasing a trip or travel package:

588977 1. Purchasing the coverage required by the destination
589978 jurisdiction through the travel retailer or limited lines travel
590979 insurance producer supplying the trip or travel packa ge; or

592980 2. Agreeing to obtain and provide proof of coverage that meets
593981 the requirements of the destination jurisdiction prior to departure.
