144144 Section 801. ARTICLE 1. Definitions. A. As used in the
145145 Oklahoma Uniform Code of Military Justice, unless the context
146146 otherwise requires:
147147 1. “Accuser” means a person who signs and swears to cha rges,
148148 any person who directs that charges nominally be signed and sworn t o
149149 by another, and any other person who has an interest other than an
150150 official interest in the prosecution of the accused;
151151 2. “Adjutant General” means the commander and most senior
152152 military officer of the Oklahoma National Guard appointed by the
153153 Governor with the advice and consent of the Senate. The Adjutant
154154 General exercises command and control over the Oklahoma National
155155 Guard when it is not activated for federal duty under Title 10 of
156156 the United States Code. The Adjutant General serves as the
157157 executive and administrative head of the Military Department of the
158158 State of Oklahoma as provided for in Section 21 of this title;
159159 3. “Administrative control (ADCON) ” means the control or
160160 exercise of authority ove r subordinate units and other organizations
161161 or units with respect to administration and support, including
162162 control of resources and equipment, personnel management, unit
163163 logistics, individual and unit training, readiness, mobilization ,
164164 demobilization and o ther matters not included in the operational
165165 missions of the subordinate units or other organizations or units.

219219 Justice (OUCMJ) for disciplinary purposes;
220220 4. “Allowance” means an amount of money provided to members of
221221 the state military forces when adequate services or facilities are
222222 not provided by the military. Allowances are usually provided tax -
223223 free for basic housing, basic s ubsistence, cost of living, clothing
224224 expenses and separation from family members;
225225 5. “Arrest in quarters” means moral restraint, as opposed to
226226 physical restraint, limiting the liberty of an officer. The limits
227227 of arrest in quarters are set by the authori ty imposing nonjudicial
228228 punishment and may extend b eyond the physical quarters of an
229229 officer;
230230 6. “Assistant Adjutant General ” means an officer appointed by
231231 the Adjutant General to assist the Adjutant General in the discharge
232232 and performance of his or her duties. An Assistant Adjutant General
233233 shall meet the qualifications prescribed by law for the Adjutant
234234 General. At least one Assistant Adjutant General for the Army
235235 National Guard and one Assistant Adjutant General for the Air
236236 National Guard are customar ily appointed to establish lines of
237237 command and administration into each component of the state military
238238 forces. Additional assistant adjutants general may be appointed
239239 pursuant to law, custom or National Guard regulations;
240240 7. “Cadet” or “officer candidate” means a person who is
241241 enrolled in or attending a state military academy, a regional

294294 purpose of becoming a commissioned officer in the state military
295295 forces;
296296 8. “Classified information ” means:
297297 a. any information or material that has been determined
298298 pursuant to federal law, by an Executive Order issued
299299 by the President in execution of federal law, or a
300300 lawfully promulgated federal regulation, to require
301301 protection against unauthorized disc losure for reasons
302302 of national security and that is so designated, and
303303 b. any restricted data, as defined in Section 11(y) of
304304 the Atomic Energy Act of 1954 (42 U.S.C., Section
305305 2014(y));
306306 9. “Code” means the Oklahoma Uniform Code of Mi litary Justice
307307 (OUCMJ);
308308 10. “Command authority” means the authority that a commander
309309 lawfully exercises over subordinates by virtue of rank or
310310 assignment. Disciplinary authority under the OUCMJ is inherent to
311311 command authority;
312312 11. “Commander” means a designated commissioned officer vested
313313 with command authority pursuant to law, regulation, assignment,
314314 lawful order or custom;
315315 12. “Commanding officer” includes only commissioned officers of
316316 the state military forces and shall include officers in charge on ly

369369 15) of this title. “Commander” has the same meaning as “commanding
370370 officer” unless the context otherwise requires;
371371 13. “Component” means one of two constituent parts that make up
372372 the state military forces , namely the army force responsible for
373373 land-based operations and the air force responsible for aerial
374374 operations and related support activities;
375375 14. “Confidential information ” means any information or
376376 material that shall be designat ed as confidential pur suant to
377377 Section 24A.27 of Title 51 of the Oklahoma Statutes and any
378378 information or material that may be kept confidential pursuant to
379379 Section 24A.28 of Title 51 of the Oklahom a Statutes that has not
380380 previously been released by an app ropriate authority;
381381 15. “Convening authority” includes, in addition to t he person
382382 who convened the court, a commissioned officer commanding for the
383383 time being or a successor in command to the conve ning authority;
384384 16. “Day” means calendar day and is not s ynonymous with the
385385 term “unit training assembly ”. Any punishment authori zed by this
386386 act which is measured in terms of days shall, when served in a
387387 status other than annual field training, be constr ued to mean
388388 succeeding duty days;
389389 17. “Court of Criminal Appeals” means the Oklahoma Court of
390390 Criminal Appeals, the highest court in the State of Oklahoma with

442442 appellate jurisdiction in criminal cases. It is the court of last
443443 resort for courts-martial conducted under the Code;
444444 18. “Duty status” means duty in the state military forc es under
445445 an order issued by authority of law, and i ncludes travel to and from
446446 such duty;
447447 19. “Enlisted member” means a person in an enlisted grade;
448448 20. “Fatigue duty” means general labor performed by members of
449449 the state military fo rces when unarmed, inc luding but not limited to
450450 cleaning, digging, loadin g, organizing, etc.;
451451 21. “Fine” means a type of punishment that makes a member
452452 pecuniarily liable to the State of Oklahoma f or the amounts
453453 specified by nonjudicial punishment or adju dged by a court-martial.
454454 A fine may be paid in cash by a member, collect ed by deduction from
455455 the current pay of a member or collected by deduction on settlement
456456 of the pay account of a member upon discharge;
457457 22. “Forfeiture” means a loss of monetary comp ensation provided
458458 to members of the Oklahoma National Guard or Oklahoma S tate Guard
459459 for performance of military duties as a result of nonjudicial
460460 punishment or as adjudged by a court -martial. A forfeiture is
461461 applicable to basic pay and allowances if total forfeitures of pay
462462 and allowances are specifically adjudged by a general court-martial;
463463 provided, that forfeitures other than total forfeitures shall not
464464 apply to special pay, other than hardship d uty pay, or proficiency
465465 or incentive pay;

517517 23. “Grade” means a step or degree in a graduated scale of
518518 office or military rank which is established and designated as a
519519 grade by law or regulation;
520520 24. “Installation commander ” means a commissioned officer
521521 responsible for the protection of assigned forces and assets ,
522522 lodging, dining and administrative reporting, regardless of the
523523 command relations of the various types of forces present on the
524524 installation. For purposes of this definition, an installation is
525525 an Armed Forces Reserve Center, air base, armory, camp, pos t,
526526 readiness center, office building, the joint forces headquarters or
527527 other facility, location, structure or property so designated as an
528528 “installation” by the Adjutant General;
529529 25. “Joint forces headquarters” means the joint headquarters
530530 provided for and established in Secti on 21 of this title;
531531 26. “Judge advocate” means a commissioned officer of the
532532 organized state military forces who is a member in good standing of
533533 the bar of the highest court of a state, and is certified or
534534 designated as a judge advo cate in the Judge Advo cate General’s Corps
535535 of the Army or the Air Force, or a reserve component of the same;
536536 27. “May” is used in a permissive sense. The phrase “no person
537537 may” means that no person is required, authorized, or permitted to
538538 do the act prescribed;
539539 28. “Military court” means a court-martial or a court of
540540 inquiry;

592592 29. “Military Court of Appeals” means the intermediate
593593 appellate court of record established in Section 866 of this title
594594 (Article 66) and charged with conducting an appellate revi ew of
595595 questions of law arising from general and special courts -martial
596596 proceedings conducted by the state military forces and, when
597597 necessary in furtherance of its jurisdiction, reviewing all
598598 petitions for extraordinary relief properly brought before it;
599599 30. “Military department” means the administrative agency
600600 established in Section 21 of this title charged with coordinating
601601 and supervising state military forces. The military department
602602 consists of a joint forces headquarters, an army component and an
603603 air force component unde r the command and control of the Adjutant
604604 General when not activated for federal duty under Title 10 of the
605605 United States Code;
606606 31. “Military judge” means a judicial officer w ho presides over
607607 a general or special court -martial and is detailed in accordanc e
608608 with Section 826 of this title (Article 26);
609609 32. “Military magistrate” means a licensed attorney detailed or
610610 appointed who conducts reviews or otherwise acts on prereferral
611611 matters relating to the rights of victims under subsection D of
612612 Section 806B of this title (Article 6B, subsection D), investigativ e
613613 subpoenas under subparagraph a of paragraph 1 of subsection A of
614614 Section 4 of this act or who conducts appellate proceedings on
615615 behalf of the Military Court of Appeals under paragraph 3 of

828828 33. 34. “Military publication ” means a written publication of
829829 an administrative nature such as a regu lation, instruction,
830830 pamphlet, circular, permanent or general order, numb ered adjutant
831831 general policy memorandum or blank form promulgated or publ ished by
832832 or under the authority of the Adjutant General. An order or
833833 directive issued by the Adjutant General that is operational i n
834834 nature or issued in execution of a military missi on shall not be
835835 included within the meaning of military publication. Rul es of
836836 procedure published by the State Judge Advocate for the Military
837837 Court of Appeals are included in the me aning of military
838838 publication;
839839 34. 35. “Month’s pay” means the amount of basic pay that would
840840 be paid to a member if that member were serving on active duty;

892892 35. 36. “National security” means the national defense and
893893 foreign relations of the United State s;
894894 36. 37. “Nexus” means the appearance of a connection between a
895895 nonmilitary offense and the state military forces which brings
896896 discredit or dishonor to the state military forces due to
897897 representations of membership in the state military forces by a
898898 member. Such representati ons may be made directly or indirectly,
899899 including but not limited to publication on social media or other
900900 electronic communication platforms;
901901 37. 38. “Noncommissioned officer ” means an enlisted member
902902 above the pay grade of E -4 or an enlisted member in th e army
903903 component of state military forces holding t he rank of corporal;
904904 38. 39. “Nonjudicial punishment ” means punishment imposed
905905 administratively by a commander or officer in charge for minor
906906 offenses in lieu of a court -martial;
907907 39. 40. “Officer” means a commissioned or warrant officer;
908908 40. 41. “Officer in charge” means a commissioned or warrant
909909 officer designated as such b y appropriate authority;
910910 41. 42. “Pay” means monetary compensation provided to members
911911 of the state military forces in exchange for performance of military
912912 duties carried out pursuan t to a lawful order or otherwise under the
913913 authority of law, including ba sic pay, special pay, proficiency pay
914914 and incentive pay. “Pay” shall not mean allowances as defined in
915915 this section;

10611061 52. 53. “State Judge Advocate ” means a member of the Oklahoma
10621062 National Guard qualified as a judge advocate, a s defined in this

11291129 54. 55. “Superior commissioned officer ” means a commissioned

11311131 55. 56. “Supplies” means materiel, equipment and stores of all
11321132 types possessed or lawful ly controlled by state military forces; and
11331133 56. 57. “Title 32 active duty” means training or other duty,
11341134 other than inactive duty, performed by a member of the Army National
11351135 Guard of the United States or the Air National Guard of the United
11361136 States in the member’s status as a member of the Oklahoma Nationa l
11371137 Guard pursuant to Section 316, 502, 503, 504 or 505 of Title 32 of

12001200 SECTION 2. AMENDATORY Section 21, Chapter 408, O .S.L.
12011201 2019 (44 O.S. Supp. 2020, Section 815), is amended to read as

12031203 Section 815. ARTICLE 15. Commanding officer ’s nonjudicial
12041204 punishment.
12051205 A. Except as provided in subsecti on B of this section, any
12061206 commanding officer and, for purposes of this se ction, any officer in
12071207 charge, may impose disciplinary punishments for min or offenses
12081208 arising under the punitive articles of the Oklahoma Uniform Code of
12091209 Military Justice without the i ntervention of a court -martial.
12101210 B. Any superior commander may limit or w ithhold the exercise of
12111211 nonjudicial punishment authority by subordinate c ommanders,
12121212 including limiting authority over certain categories of military
12131213 personnel or offenses. Likewise, individual cases may b e reserved

14111411 F. The Governor, the Adjutant General, an officer ex ercising
14121412 general or special court-martial convening authority, or a gener al
14131413 officer in command may impose:
14141414 1. Upon officers of the officer ’s command:
14151415 a. any punishment authorized in subsection E of this
14161416 section, except for the punishments provided in
14171417 paragraphs 6 and 7 of subsection E of this section,
14181418 and
14191419 b. arrest in quarters for not more than thirty (30) days
14201420 which need not be consecutive; and
14211421 2. Upon enlisted members of the office r’s command, any
14221422 punishment authorized in subsection E of this section.
14231423 Admonitions or reprimands given as nonjudicial punishment to
14241424 commissioned officers and warrant officers shall be administered in
14251425 writing. In all other cases, unless otherwise prescrib ed by
14261426 regulations promulgated by the Adjutant General, such punishments
14271427 may be administered either orally or in writing.
14281428 G. Whenever any punishme nts are combined to run consecutively,
14291429 the total length of the combined punishment shall not exceed the
14301430 authorized duration of the l ongest punishment included in the
14311431 combination, and there shall be an apportionment of punishments so
14321432 that no single punishme nt in the combination exceeds its authorized
14331433 length under this section.

14851485 H. Once the commander has determined that nonjudicial
14861486 punishment is appropriate, the commander shall provide r easonable
14871487 notice to the member of his or her intent to impose nonjudicial
14881488 punishment. At the time the commander provides notification as
14891489 required in this subsection, the member shall be entitled to examin e
14901490 all statements and other evidence that the comman der has examined
14911491 and intends to rely upon as the basis for punishment. T he member
14921492 shall be provided a copy of the documentary evidence unless it is
14931493 privileged, classified, or otherwi se restricted by law, regulation,
14941494 or instruction. At the time the comman der provides notification as
14951495 required in this subsection, the commander s hall also inform the
14961496 member as to the quantum of punishment potentially to be imposed.
14971497 While a member undergo ing nonjudicial punish ment is not entitled to
14981498 representation by a duly ap pointed defense counsel, the member may
14991499 seek legal advice from any judge advocate available for this
15001500 purpose.
15011501 I. The right to demand trial by court -martial in lieu of
15021502 nonjudicial punishment shall arise on ly when arrest in quarters or
15031503 restriction will be c onsidered as punishments. If the commanding
15041504 officer determines that arre st in quarters or restriction will be
15051505 considered as punishments, prior to the offer of nonjudicial
15061506 punishment the accused shall be n otified in writing of the right to
15071507 demand trial by court-martial. Should the commanding officer

15641564 arrest in quarters or restriction, the accused shall be afforded a
15651565 reasonable amount of time to confer with legal counsel and to
15661566 prepare a response.
15671567 J. The officer who imposes the punishment, or his or her
15681568 successor in command, may, at any time, suspend, set aside, mitigate
15691569 or remit any part or amount of the punishme nt and restore all
15701570 rights, privileges and property affected. The officer also may
15711571 mitigate:
15721572 1. Reduction in grade to forfeiture of pay;
15731573 2. Arrest in quarters to restriction; or
15741574 3. Extra duties to restriction.
15751575 The mitigated punishment shall not be for a greater period than
15761576 the punishment mitigated. When mitigating reducti on in grade to
15771577 forfeiture of pay, the amount of the forf eiture shall not be greater
15781578 than the amount that could have been imposed initially under this
15791579 article by the officer who imposed the punishment mitiga ted.
15801580 K. A person punished under this section who considers the
15811581 punishment unjust or disproportionate to t he offense may, through
15821582 his or her chain of command, appeal to the Senior Assistant Adjutant

16401640 Adjutant General exercising appellate authority may exercise the
16411641 same powers with respect to the punishment imposed as may be

16431643 imposed the punishment. Befo re acting on an appeal from a
16441644 punishment, the Senior Ass istant Adjutant General shall refer the
16451645 case to a judge advocate for consideration and advice.
16461646 K. L. Except for nonjudicial pun ishment imposed by the Governor
16471647 or the Adjutant General, the final appel late authority for
16481648 nonjudicial punishment imposed within state military forces is the
16491649 Adjutant General. A person punished under this section whose appeal
16501650 was previously denied by a Se nior Assistant Adjutan t General may
16511651 lodge an additional appeal with the Adjutant General within five (5)
16521652 days after the appeal i s denied. In the event the officer imposing
16531653 nonjudicial punishment is the Senior Assistant Adjutant General, an
16541654 appeal thereof shall be addressed dir ectly to the Adjutant General.
16551655 In the event the officer imposing nonjudicial punishment is the
16561656 Adjutant General, an appeal thereof shall be addressed directly to
16571657 the Governor. An appeal offered pursuant to this subsection shall

17121712 L. M. Whenever nonjudicial punishment is imposed under this

17141714 1. After adjudication and while the punishment is being c arried
17151715 out or while the adjudged punishment is pen ding before the appellate
17161716 authority, the commander or of ficer in charge who imposed the
17171717 nonjudicial punishment, upon the request of the accused, may:
17181718 a. excuse the accused from attenda nce at scheduled unit
17191719 training assemblies, or
17201720 b. arrange for the accused to drill on alternate dates
17211721 and in alternate locations; or
17221722 2. If necessary to maintain good order and discipline within
17231723 the unit, the commander or officer in charge who imposed the
17241724 nonjudicial punishment may order the accused to drill on alternate
17251725 dates and in alternate locations. The order shall be reduced to
17261726 writing and shall become part of the record of nonjudicial
17271727 punishment.
17281728 M. N. The imposition and enforcement of disciplinary punishment
17291729 under this section for any act or omission shall not be a bar to
17301730 trial by court-martial or a civilian court of compet ent jurisdiction
17311731 for a crime or offense arising out of the same act or omission; but
17321732 the fact that a disciplinary punishment has been enforced may be
17331733 demonstrated by the accused upon trial and, when s o demonstrated, it

17901790 N. O. When nonjudicial punishment has been imposed for an
17911791 offense, punishment shall not again be imposed for the same offense
17921792 under this section. O nce nonjudicial punishment has been imposed,
17931793 it may not be increased, upon appeal or otherwise. When a co mmander
17941794 or officer in charge determines that nonjudicial punishment is
17951795 appropriate for a particular member, all known offenses d etermined
17961796 to be appropriate for disposition by nonjudicial punishment an d
17971797 ready to be considered at that time, including all off enses arising
17981798 from a single incident or course of conduct, shall be considered
17991799 together and shall not be made the basis for mult iple punishments.
18001800 This subsection shall in no way restrict the right of a commander to
18011801 prefer court-martial charges for an offe nse previously punished
18021802 under the provisions of this section.
18031803 O. P. In accordance with subsection B of Section 843 of this
18041804 title (Article 43, subsect ion B), a person accused of an offense is
18051805 not liable to be punished under this section if the offense was
18061806 committed more than two (2) years before the imposition of

18611861 P. Q. Whenever a punishment of forfeiture of pay is imposed
18621862 under this section, the forfeiture shall not apply to pay accruing
18631863 before the date that punishment is imposed, but only pay accruing on
18641864 or after the date that punishment is imposed.
18651865 Q. R. The Adjutant General may promulgate regulations
18661866 prescribing the type and form of records to be kept of proceedings
18671867 conducted pursuant to this section. The Adjutant General may
18681868 promulgate any other r egulations necessary to carry out the
18691869 provisions of this section.

23992399 2. The conduct warranting the sanctio n is preceded by a clear

24562456 misconduct requires contempt proceedings, should inform the alleged
24572457 offender of his or her intention t o institute said proceedings.
24582458 D. Notice and opportunity to pro vide evidence or testim ony.
24592459 Before imposing any punishment for contempt, the judicial officer
24602460 shall give the offender notice of the charges and an opportunity to
24612461 adduce evidence or argument re levant to guilt or punishment.
24622462 E. Imposition of sanctions. Th e judicial officer befo re whom
24632463 the misconduct occurs may impose appropriate sanctions including
24642464 punishment for contempt.
24652465 F. Punishment. The punishment for contempt under subsection A
24662466 of this section shall not exceed the punishments p rovided in
24672467 subsection A of Section 566 of Ti tle 21 of the Oklahoma Statutes.
24682468 G. Review. A punishment under this section:
24692469 1. If imposed by a military judge, may be reviewed by the
24702470 Military Court of Appeals in acc ordance with the uniform rules of
24712471 procedure for the Military Co urt of Appeals under su bsection L of
24722472 Section 866 of this title (Article 66, subsection L);

26182618 granted. Decisions of the Military Court of Appeals shall be final
26192619 unless a Petition for Review is gran ted by the Oklahoma Court of
26202620 Criminal Appeals or a writ of c ertiorari is granted pursuant to

27522752 E. Scope of review on certiorari. The scope of revie w to be

27552755 F. Additional proceedings. If the Oklahoma Court of Criminal
27562756 Appeals determines that additional proceedings a re warranted, the
27572757 Oklahoma Court of Criminal Appeal s may order a hearing, rehearing or
27582758 other proceedings in accordance with the Rules of the Court of
27592759 Criminal Appeals.
27602760 G. Action in accordance wit h decisions of the Oklahoma Court o f
27612761 Criminal Appeals. The State Judge Advocate shall instruct the
27622762 appropriate authority to take action in accordance with the decision
27632763 of the Oklahoma Court of Criminal Appeals.
27642764 SECTION 9. It being immediately necessary for the preservati on
