2956 SECTION 1. AMENDATORY 43A O.S. 2011, Section 10 -108, is
3057 amended to read as follows:

3258 Section 10-108. A. 1. If the Department of Human Services
3359 determines that a vulnerable adul t is suffering from abuse, neglect,
3460 self-neglect, or financial neglect or exploitation presenting a
3561 substantial risk of death or immediate and serious physical harm to
3662 the person or financial exploitation of the estate of the person,
3763 and the vulnerable adu lt lacks mental capacity to consent to receive
3864 protective services and no consent can be obtained, the Department

4395 appointing a temporary guardian of the person and/or
4496 the estate,

4897 b. freezing the assets of the vulnerable adult, if the
4998 vulnerable adult is being exploited, establishing any
5099 new accounts necessary to pay the daily living
51100 expenses of the vulner able adult, and directing a full
52101 accounting and investigation of the person alleged to
53102 be improperly managing the estate of the vulnerable
54103 adult,
55-
56104 c. suspending or revoking the powers of an attorney -in-
57105 fact granted by a durable power of attorney, or
58106 revoking an irrevocable trust, or terminating a
59107 guardianship or conservatorship established pursuant
60108 to the Oklahoma Guardianship and Conservatorship Act,
61109 or
62-
63110 d. directing any law enforcement agency to transport any
64111 incapacitated person or vulnerable adult as nece ssary
65112 for appropriate care, treatment and residential
66113 placement. If such transportation is ordered,
67114 reimbursement for expenses incurred from the
68115 transportation of a vulnerable adult under the

69143 Department’s temporary guardianship shall be paid as
70144 provided for in Section 10-107 of this title.

72145 2. Under no circumstances shall the court authorize the
73146 Department, pursuant to this subsection, to consent or deny consent
74147 to a Do-Not-Resuscitate order or the withdrawal of hydration or
75148 nutrition or other life -sustaining treatment although the court
76149 retains jurisdiction to hear such matters under applicable law.

78150 3. The district court which may be petitioned by the Department
79151 for an order pursuant to paragraph 1 of this subsection is:
80-
81152 a. the district court in the count y in which the
82153 vulnerable adult resides,
83-
84154 b. the district court in the county in which the
85155 vulnerable adult is receiving inpatient services, or
86-
87156 c. the district court in the county where the vulnerable
88157 adult is located when any delay caused by taking the
89158 petition to the district court in the county of the
90-

92159 residence of the vulnerable adult would result in
93160 greater substantial risk of death or greater serious
94161 physical harm to the vulnerable adult. The petition
95162 shall include an explanation of why the petition wa s
96163 filed in the district court in the county specified by
97164 this subparagraph rather than in the district court as
98165 specified in subparagraph a or b of this paragraph.

100193 B. The petition shall be sworn to and include the name, age,
101194 and address of the vulnerable adult who the Department has
102195 determined is in need of emergency protective services, the nature
103196 of the abuse, neglect, or exploitation, the services needed, and
104197 information relating to the capacity of the person to consent to
105198 services and a description of the attempts of the Department to
106199 obtain consent and the name of the person or organization proposed
107200 to be appointed as temporary guardian.

109201 C. 1. The vulnerable adult shall receive an opportunity for a
110202 hearing upon the petition, and shall be personally s erved with a
111203 copy of the petition and a notice scheduling hearing at least forty -
112204 eight (48) hours prior to any such hearing if the petition seeks
113205 temporary guardianship of thirty (30) days or more.

115206 2. a. The hearing shall be set by the court on an expedite d
116207 basis, but no later than five (5) calendar days, not
117208 including weekends or holidays when the court is
118209 closed, from the date the notice scheduling hearing is
119210 signed by the judge. The vulnerable adult shall have
120211 a right to a closed hearing unless such vul nerable
121212 adult requests otherwise.

123213 b. Unless the vulnerable adult objects or the person
124214 requiring notification pursuant to this subparagraph
125215 is alleged to have abused, neglected or exploited the
126216 vulnerable adult, the following persons shall be

130246 (1) the legal guardian, guardian ad litem and
131247 caretaker of the vulnerable adult,

135248 (2) any person so requested by the vulnerable adult
136249 to be present at the hearing, and

138250 (3) persons required to be notified pursuant to
139251 Section 3-110 of Title 30 of the Oklahoma
140252 Statutes.

142253 D. 1. Upon sworn testimony of a representative of the
143254 Department, or statement of a district attorney representing the
144255 Department, that immediate and reasonably foreseeable death or
145256 serious physical harm to or financial exploitation of the vulnerable
146257 adult will result, the court may waive prior notice and issue a
147258 seventy-two-hour temporary guardianship and provide involuntary
148259 protective services whether or not during regular courthouse
149260 business hours. However, within twenty -four (24) hours of issuance
150261 of the seventy-two-hour order, the vulnerable adult and the attorney
151262 of the vulnerable adult, if known, shall be personally served with
152263 written notice scheduling a hearing within seventy -two (72) hours.

154264 2. If a hearing on the seventy -two-hour order is declined, or
155265 upon conclusion of any such hearing, the court may terminate the
156266 temporary guardianship and involuntary services or enter a temporary

157294 guardianship for up to thirty (30) additional calendar day s as
158295 provided for in subsection G of this section.

160296 E. 1. The vulnerable adult has a right to be present and
161297 represented by counsel at any hearing authorized by this section.
162298 If the vulnerable adult is indigent or, in the determination of the
163299 court, lacks capacity to waive the right to counsel, the court shall
164300 immediately appoint counsel who shall personally meet with the
165301 vulnerable adult and attempt to discuss the petition or any pending
166302 motion prior to any hearing.

168303 2. If the vulnerable adult is not in attendance at a scheduled
169304 hearing, the court shall make a special finding as to why the
170305 vulnerable adult is unable to attend, and, upon the request of the
171306 vulnerable adult or the attorney of the vulnerable adult, may
172307 continue the hearing to allow the vulne rable adult to attend.

174308 3. If the vulnerable adult is indigent, the cost of
175309 representation by counsel shall be borne by court funds.

179310 4. If the vulnerable adult is not indigent, the court may order
180311 costs of representation paid from the estate in the same m anner as
181312 currently paid under the Oklahoma Guardianship and Conservatorship

184314 F. 1. After a hearing on the petition, the court may:

186315 a. appoint a temporary guardian and order involuntary
187316 protective services including, but not limited to,
188317 authorization for medical and/or psychological

189345 treatment and evaluations, and residential placement
190346 subject to the provisions of subsection G of this
191347 section,

193348 b. issue an order freezing all assets of the vulnerable
194349 adult, establish any new accounts necessary to pay the
195350 daily living expenses of the vulnerable adult, and
196351 order a full accounting and investigation of the
197352 person alleged to be improperly managing the
198353 vulnerable adult’s estate,

200354 c. suspend or revoke powers of attorney or terminate a
201355 guardianship or conservatorsh ip upon a finding that
202356 the attorney-in-fact, guardian or conservator failed
203357 to act appropriately on behalf of the vulnerable
204358 adult, or
205-
206359 d. order any law enforcement agency to transport any
207360 incapacitated person or vulnerable adult as necessary
208361 for appropriate care, treatment and residential
209362 placement. If such transportation is ordered,
210363 reimbursement for expenses incurred from the
211364 transportation of a vulnerable adult under the
212365 Department’s temporary guardianship shall be paid as
213366 provided for in Section 10 -107 of this title.

215367 2. a. Except as otherwise provided by subparagraphs b and c
216368 of this paragraph, the court appointing a temporary

217396 guardian and ordering involuntary protective services
218397 shall not have authority to order the sale of the real
219398 property of the vulnerable adult.

223399 b. If the Department of Human Services has been appointed
224400 temporary guardian and the court issues an order for
225401 the Department to continue as the temporary guardian
226402 of the vulnerable adult beyond the one hundred eighty
227403 (180) calendar days aut horized by this section because
228404 there is no one willing and able to act as guardian
229405 for the vulnerable adult, the Department, as temporary
230406 guardian may, after one (1) year from its initial
231407 appointment, sell the real property of a vulnerable
232408 adult pursuant to the provisions of the Oklahoma
233409 Guardianship and Conservatorship Act.

235410 c. The Department, as temporary guardian of a vulnerable
236411 adult, may also sell the real property of the
237412 vulnerable adult pursuant to the provisions of the
238413 Oklahoma Guardianship and Cons ervatorship Act prior to
239414 the one-year requirement specified in subparagraph b
240415 of this paragraph, if not selling the real property
241416 would jeopardize the vulnerable adult ’s eligibility
242417 for Medicaid. The fact that the vulnerable adult
243418 would be in jeopardy for receipt of Medicaid if the
244419 property was not sold shall be stated upon the court

245447 order directing the sale of the real property of the
246448 vulnerable adult.

248449 d. The court may issue an order authorizing the
249450 Department to sell personal property of a vulnerable
250451 adult when additional resources are required to pay
251452 for necessary care for the vulnerable adult pursuant
252453 to state law.

254454 G. Whenever the court issues an order for involuntary
255455 protective services, the court shall adhere to the following
256456 limitations:
257-
258457 1. Only such protective services as are necessary to remove the
259458 conditions creating the emergency shall be ordered, and the court
260459 shall specifically designate the approved services in the order of
261460 the court. When the conditions creating the emergency have been
262461 removed, the court shall dismiss the temporary guardianship ordered
263462 pursuant to this section ;

267463 2. The scope of service provided by the Department shall be
268464 limited to protective services or the establishment of eligibility
269465 for protective services for the person and estate. The Department
270466 shall request dismissal of the temporary guardianship ordered
271467 pursuant to this section when:

273468 a. an appropriate level of care for the vulnerable adult
274469 as determined by the Department has been established ,
470+b. assets have been sec ured, if applicable, and

278498 c. a representative payee or trustee has been set for
279499 financial management , if applicable;

281500 3. Protective services authorized by an involuntary protective
282501 services order shall not include a change of residence unless the
283502 court specifically finds such action is necessary to remove the
284503 conditions creating the emergency and gives specific approval for
285504 such action in the order of the court. Emergency placement may be
286505 made to such facilities as nursing homes, hospital rehabilitation
287506 centers, assisted living centers, foster care and in -home
288507 placements, or to other appropriate facilities for emergency care or
289508 evaluation to determine the extent of a vulnerable adult ’s physical,
290509 mental and functional limitations; provided, however, emergency
291510 placement shall not be made or construed as an alternative to
292511 emergency detention and protective custody as authorized under
293512 Section 5-206 et seq. of this title or made or construed as an
294513 alternative to involuntary commitment under Section 5 -410 et seq. of
295514 this title when a vulnerable adult otherwise meets the criteria for
296515 involuntary commitment. Services to such vulnerable adults shall be
297516 provided in a manner that is appropriate for the adult ’s age and
298517 condition and, except for facilities operated by the Department of
299518 Mental Health and Substance Abuse Services or community -based
300519 structured crisis centers under contract with the Department
301520 pursuant to Section 3 -317 of this title, services provided to
302521 vulnerable adults pursuant to this section shall be prov ided in a

303549 setting that is segregated from any patients or residents of a
304550 facility who have been determined to be a danger to others; and

306551 3. 4. Involuntary protective services may be provided for a
307552 period not to exceed thirty (30) calendar days except as p rovided by
308553 subsections L and M of this section.

312554 H. The court shall appoint the Department or an interested
313555 person or organization as temporary guardian of the person with
314556 responsibility for the welfare of such person and authority to give
315557 consent on behalf of the person for the approved involuntary
316558 protective services until the expiration of the order.

318559 I. The issuance of an order for involuntary protective services
319560 and the appointment of a temporary guardian shall not deprive the
320561 vulnerable adult of any r ights except to the extent validly provided
321562 for in the order or appointment.

323563 J. 1. To enforce an order for involuntary protective services,
324564 the court may authorize:
325-
326565 a. forcible entry of the premises of the vulnerable adult
327566 to be protected for the purpose of rendering
328567 protective services but only after a reasonable
329568 showing to the court that good faith attempts to gain
330569 voluntary access to the premises have failed and
331570 forcible entry is necessary,

333598 b. the transporting of the vulnerable adult to another
334599 location for the provision of involuntary services,
335600 and

337601 c. the eviction of persons who are in a position to
338602 exploit the vulnerable adult from any property owned,
339603 leased, or rented by the vulnerable adult and
340604 restriction of those persons ’ further access to any
341605 property of the vulnerable adult.

343606 2. If forcible entry is authorized by the court, the order
344607 shall include a directive that the Department ’s representative be
345608 accompanied by a police officer or deputy sheriff in the county
346609 where the vulnerable adult or prope rty of the vulnerable adult is
347610 located, and the police officer or deputy sheriff shall make the
348611 forcible entry.

350612 K. The vulnerable adult, the temporary guardian, or any
351613 interested person may petition the court to have the order to

354614 provide involuntary prote ctive services set aside or modified at any
355615 time.

357616 L. If the vulnerable adult continues to need involuntary
358617 protective services after expiration of the thirty -day temporary
359618 guardianship provided in subsection G of this section, the temporary
360619 guardian shall immediately file a verified motion requesting the
361620 court to, except as otherwise provided by subsection F of this
362621 section, continue the temporary guardianship and involuntary

363649 protective services under this section for a period not to exceed
364650 one hundred eighty (180) calendar days.

366651 M. 1. Service of the verified motion shall be made in
367652 conformity with subsection C of this section.
368-
369653 2. Upon filing such motion, the court shall order that a
370654 physical, mental, and social evaluation of the vulnerable adult be
371655 conducted by the Department and that a proposed plan of care be
372656 submitted to the court within thirty (30) calendar days thereafter
373657 reflecting the evaluation findings and recommended services.
374-
375658 3. Upon filing such motion, the prior temporary guardianship
376659 shall remain in full force and effect pending a review hearing after
377660 the thirty-day evaluation period. The caretaker, guardian or next -
378661 of-kin of the vulnerable adult may request that the evaluation
379662 period be shortened for good cause.

381663 4. The evaluation shall in clude at least the following
382664 information:
383-
384665 a. the address of the place where the person is residing
385666 and the person or agency which is providing care,
386667 treatment, or services at present,
387-
388668 b. a summary of the professional treatment and services
389669 provided to the person by the Department or agency, if
390670 any, in connection with the problem creating the need
391671 for emergency protective services, and

393699 c. a medical and social evaluation , including, but not
394700 limited to, the Department ’s assessment of the
395701 person’s capacity to consent to services, a

398702 psychological or psychiatric evaluation and review if
399703 the mental state of the person is in question, and any
400704 recommendations for or against maintenance of partial
401705 legal rights. The evaluation and review shall include
402706 recommendations for placement based upon the best
403707 interests of the vulnerable adult taking into
404708 consideration the following:
405-
406709 (1) the least restrictive environment,
407-
408710 (2) the desires of the vulnerable adult and legal
409711 guardian,
410-
411712 (3) the desires of the caretaker of the vulnerab le
412713 adult and of any of the persons specified in
413714 Section 3-110 of Title 30 of the Oklahoma
414715 Statutes,
415-
416716 (4) the physical and mental health needs of the
417717 vulnerable adult,
418-
419718 (5) the available programs and services, and
420-
421719 (6) the health, well-being and welfare of the
422720 vulnerable adult and the public.

424721 During the hearing to consider the motion to continue the
425722 temporary guardianship of the vulnerable adult for up to one hundred

426750 eighty (180) calendar days, the court shall consider the
427751 Department’s findings and proposed pla n of care and any other
428752 evidence presented by the caretaker, guardian or other interested
429753 persons. The court shall either terminate the temporary
430754 guardianship and all involuntary services or continue the temporary
431755 guardianship and specify any necessary se rvices to be provided by
432756 the Department for a period not to exceed one hundred eighty (180)
433757 calendar days. Provided, the court may continue the guardianship of
434758 the Department, if there is no one willing and able to act as
435759 guardian for the vulnerable adult .

437760 N. Neither the Department nor any of its employees or any other
438761 petitioner shall be liable for filing a petition pursuant to the
439-

441762 Protective Services for Vulnerable Adults Act if the petition was
442763 filed in good faith.
