6762 SECTION 1. AMENDATORY 76 O.S. 2011, Section 10.1, as
6863 amended by Section 1, Chapter 225, O.S.L. 2013 (76 O.S. Supp. 2020,
6964 Section 10.1), is amended to read as follows:

96-Section 10.1 A. 1. The purpos e of this section is to
97-encourage landowners to make land available to the public for
98-outdoor recreational purposes by limiting their liability to persons
9995 entering upon and using such land and to third persons who may be
10096 damaged by the acts or omissions of persons going upon these lands.
10197 2. As used in this section:
10298 a. "land" means real property, roads, water,
10399 watercourses, private ways, buildings, structures, and
104100 machinery or equipment whe n attached to realty,
105101 b. "outdoor recreational purposes" includes any of the
106102 following, or any combination thereof: hunting,
107103 fishing, swimming, boating, camping, picnicking,
108104 hiking, pleasure driving, jogging, cycling, other
109105 sporting events and activities, nature study, water
110106 skiing, jet skiing, winter sports, viewing or enjoying
111107 historical, archaeological, scenic, or scientific
112108 sites, and aviation at non -public-use airports,
113109 c. "owner" means the possessor of a fee interest, a
114110 tenant, lessee, occupant, or p erson in control of the
115111 land,
116112 d. "charge" means the admission price or fee asked in
117113 return for invitation or permission to enter or go
118114 upon the land. The term "charge" shall not include:
115+(1) a license or permit fee imposed by a governmental
116+entity for the purpose of regulating the use of
117+land, a water or park area, or lake reservation,

145-(1) a license or permit fee imposed by a governmental
146-entity for the purpose of regulating the use of
147-land, a water or park area, or lak e reservation,
148145 (2) hunting, fishing, boating, and other license and
149146 permit fees,
150147 (3) hunting or fishing leases, or
151148 (4) donations made at fly -ins at non-public-use
152149 airports, and
153150 e. "non-public-use airport" means an airport that is
154151 primarily used by the owner with access to the public
155152 as permitted by the owner.
156153 B. An owner who provides the public with land for outdoor
157154 recreational purposes owes no duty of care to keep the land safe for
158155 entry or use by others, or to give warning to persons entering or
159156 using the land of any hazardous conditions, structures, or
160157 activities.
161158 C. 1. Except as otherwise provided by this section, an owner
162159 who provides the public with land for outdoor recreational pu rposes
163160 shall not:
164161 a. be presumed to extend any assurance that the land is
165162 safe for any purpose,
166163 b. incur any duty of care toward a person who enters or
167164 uses the land, or

202-2. Any commercial or other activity for profit directly related
203-to the use is conducted on any part of the land.
204-E. 1. An owner of land leased to the state or to other public
205-entity for outdoor recreational purposes owes no duty of care to
206-keep the land safe fo r entry or use by others, or to give warning to
207-persons entering or using the land of any hazardous conditions,
208-structures, or activities. Any owner who leases or subleases land

247-F. E. 1. Except as provid ed in this section, no person is
248-relieved of liability which would exist for want of ordinary care or
249-for deliberate, willful, or malicious injury to persons or property.
250-The provisions shall not create or increase the liability of any
251-person.
252-2. This section shall not relieve any owner of any liability
253-for the operation and maintenance of structures affixed to real
254-property by the owner for use by the general public.
255-G. F. By entering or using land, no person shall be deemed to
256-be acting as an employee or agent of the owner whether the entry or
257-use is with or without the knowledge or consent of the owner.
258-H. G. The provisions of this section shall not apply to any
259-land that is used primarily for farming or ranching activities or to
260-roads, water, waterco urses, private ways, buildings, structures, and
261-machinery or equipment when attached to realty which is used
262-primarily for farming or ranching activities.
263-The Oklahoma Limitation of Liability for Farming and Ranching
264-Land Act shall govern such land.
265-SECTION 2. This act shall become effective November 1, 2021. "

354-BE IT ENACTED BY THE P EOPLE OF THE STATE OF OKLAHOMA:
355-SECTION 3. AMENDATORY 74 O.S. 2011, Section 840 -5.5, as
356-last amended by Section 1, Chapter 365, O.S.L. 2019 (74 O.S. Supp.
357-2020, Section 840-5.5), is amended to read as follows:
358-Section 840-5.5. A. The following offices, positions, and
359-personnel shall be in the unclassified service and shall not be
360-placed under the classified service:
361-1. Persons chosen by popular vote or appointment to fill an
362-elective office, and their employees, except the emplo yees of the
363-Corporation Commission, the State Department of Education and the
364-Department of Labor;
365-2. Members of boards and commissions, and heads of agencies;
366-also one principal assistant or deputy and one executive secretary
367-for each state agency;
368-3. All judges, elected or appointed, and their employees;

395-4. Persons employed with one -time, limited duration, federal or
396-other grant funding that is not continuing or indefinitely
397-renewable. The length of the unclassified employment shall not
398-exceed the period of time for which that specific federal funding is
399-provided;
400-5. All officers and employees of The Oklahoma State System of
401-Higher Education, State Board of Education and Oklahoma Department
402-of Career and Technology Education;
403-6. Persons employed in a professional or scientific capacity to
404-make or conduct a temporary and special inquiry, investigation, or
405-examination on behalf of the Legislature or a committee thereof or
406-by authority of the Governor. These appointments and authorizations
407-shall terminate on the first day of the regular legislative session
408-immediately following the appointment, if not terminated earlier.
409-However, nothing in this paragraph shall prevent the reauthorization
410-and reappointment of any such person. Any such appointment shall be
411-funded from the budget of the appointing authority;
412-7. Election officials and employees;
413-8. Temporary employees employed to work less than one thousand
414-(1,000) hours in any twelve -month period, and seasonal employees
415-employed by the Oklahoma Tourism and Recreation Department pursuant
416-to Section 2241 of this title who work less than one thousand six

494-v. a maximum of seven positions for the purpose of
495-administering programs in the Oklahoma Highway Safety
496-Office, within full-time employee limitations of the
497-Department, employed with federal funding that is
498-continuing or indefinitely renewable. The
499-authorization for such positions shall be terminated
500-if the federal funding for positions is discontinued;
501-provided, any person appointed to a position prescribed in
502-subparagraph d, e or f of this paragraph shall have a right of
503-return to the classified commissioned posit ion without any loss of
504-rights, privileges or benefits immediately upon completion of the
505-duties in the unclassified commissioned position;
506-10. Professional trainees only during the prescribed length of
507-their course of training or extension study;
508-11. Students who are employed on a part -time basis, which shall
509-be seventy-five percent (75%) of a normal forty -hour work week or
510-thirty (30) hours per week, or less, or on a full -time basis if the
511-employment is pursuant to a cooperative education program such a s
512-that provided for under Title I IV -D of the Higher Education Act of
513-1965 (20 U.S.C. 1087a -1087c), as amended, and who are regularly

549-(10) hours of accredited undergraduate courses;
550-provided, however, the student shall only be required
551-to be enrolled in a minimum of six (6) hours of
552-accredited undergraduate courses during the summer, or

556-12. The spouses of personnel who are employed on a part -time
557-basis to assist or work as a relief for their spouses in the

560-museum and site attendants who are unavoidably absent. Service
561-substitutes may work as part -time or full-time relief for absentees
562-for a period of not m ore than four (4) weeks per year in the
563-Oklahoma Historical Society sites and museums; such substitutes will
564-not count towards the agency’s full -time-equivalent (FTE) employee

1497-B. If an agency has the authority to employ personnel in the
1498-following offices and positions, the appointing authority shall have
1499-the discretion to appoint pe rsonnel to the unclassified service:

1501-psychologists, and nurses;
1502-2. Certified public accountants;

1510-C. Effective July 1, 1996, authorization for unclassified
1511-offices, positions, or personnel contained in a bill or joint
1512-resolution shall terminate June 30 of the ensuing fiscal year after
1513-the authorization unless the authorization is codified in the

1542-D. The appointing authority of agencies participating in the
1543-statewide information systems project may establish unclassified
1544-positions and appoint unclassified employees to the project as
1545-needed. Additional unclassified positions may be established, if
1546-required, to appoint an unclassified employee to perform the duties
1547-of a permanent classified employee who is temporarily absent from a
1548-classified position as a result of assignment to this project. All
1549-unclassified appointments under this authority shall expire no later
1550-than December 31, 2007, and all unclassified positions e stablished
1551-to support the project shall be abolished. Both the positions and
1552-appointments resulting from this authority shall be exempt from any
1553-agency FTE limitations and any limits imposed on the number of
1554-unclassified positions authorized. Permanent c lassified employees
1555-may request a leave of absence from classified status and accept an
1556-unclassified appointment and compensation with the same agency under
1557-the provisions of this subsection; provided, the leave shall expire
1558-no later than December 31, 2007 . Employees accepting the
1559-appointment and compensation shall be entitled to participate

1561-employees, including retirement and insurance programs. Immediately
1562-upon termination of an unclas sified appointment pursuant to this
