3841 An Act relating to home-based businesses; creating
3942 the Oklahoma Home-based Business Fairness Act;
4043 providing short title; defining terms; autho rizing
4144 use of residential home for certain businesses;
4245 construing permitted use; limiting authority of
4346 municipality; allowing municipal regulations for
4447 certain purposes; prohibiting imposition of certain
4548 conditions on home-based business; requiring certain
4649 evidence for challenge to regulations; providing for
4750 codification; and providing an effective date .

5255 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5356 SECTION 1. NEW LAW A new section of law to be codified
5457 in the Oklahoma Statutes as Section 4300 of Title 59, unless there
5558 is created a duplication in numbering, reads as follows:
5659 This act shall be known and may be cited as the “Oklah oma Home-
5760 based Business Fairness Act”.
5861 SECTION 2. NEW LAW A new section of law to be codified
5962 in the Oklahoma Stat utes as Section 4300.1 of Title 59, unless there
6063 is created a duplication in numb ering, reads as follows:
6164 A. For purposes of this section:
62-1. "Goods" means any merchandise, equipment, p roducts, supplies
63-or materials;

92+1. "Goods" means any merchandise, equipment, p roducts, supplies
93+or materials;
9094 2. "Home-based business" means any business for the
9195 manufacture, provision or sale of goods or services that is owned
9296 and operated by the owner or te nant of the residential dwelling ; and
9397 3. "No-impact home-based business" means a home-based business
9498 for which the following apply:
9599 a. the total number of on-site employees and clients do
96100 not exceed the municipal occupancy limit for the
97101 residential property , and
98102 b. the business activities are characterized by all of
99103 the following:
100104 (1) are limited to the sale of lawful goods and
101105 services,
102106 (2) do not generate on-street parking or a
103107 substantial increase in traffic through the
104108 residential area,
105109 (3) occur inside the residential dwelling or in the
106110 yard, and
107111 (4) are not visible from the street.
108112 B. The use of a residential dwelling for a home -based business
109113 is a permitted use, except that this permission does not supersede
110114 any of the following:
111-1. Any deed restriction , covenant or agreement restricting the
112-use of land including, but not limited to, a pro perty lease

142+1. Any deed restriction , covenant or agreement restricting the
143+use of land including, but not limited to, a pro perty lease
144+agreement; or
140145 2. Any master deed or other document applicable to a common
141146 interest ownership community including, but not limited to, a
142147 homeowner association (HOA).
143148 C. A municipality shall not prohibit a no -impact home-based
144149 business or otherwise require a person to apply, regist er or obtain
145150 any permit, license, variance or other type of prior approval from
146151 the municipality to operate a no-impact home-based business.
147152 D. A municipality may establish reasonable regulations for a
148153 home-based business if the regulations are narrowly tailored for any
149154 of the following purposes:
150155 1. The protection of the public healt h and safety including
151156 rules and regulations rela ted to fire and building codes, health and
152157 sanitation, transportation or traffic control , solid or hazardous
153158 waste, pollution and noise control ;
154159 2. Ensuring that the business activity is:
155160 a. compatible with residential use of the property and
156161 surrounding residential use,
157162 b. secondary to the use as a residential dwelling , or
158163 c. complying with state and federal law and paying
159164 applicable taxes; or
160-3. Limiting or prohibiting th e use of a home-based business for
161-the purposes of sell ing illegal drugs, liquor, o perating or
162-maintaining a structured sober living home, pornography, obscenity,
163-nude or topless dancing and other adult-oriented businesses.

192+3. Limiting or prohibiting th e use of a home-based business for
193+the purposes of sell ing illegal drugs, liquor, o perating or
194+maintaining a structured sober living home, pornography, obscenity,
195+nude or topless dancing and other adult-oriented businesses.
190196 E. A municipality shall not requ ire a person as a condition of
191197 operating a home-based business to:
192198 1. Rezone the property for commercial use ; or
193199 2. Install or equip fire sprinklers in a single family detached
194200 residential dwelling or any residential dwelling wit h not more than
195201 two dwelling units.
196202 F. The question of whether a regulation complies with this
197203 section shall be a judicial question, and the municipality that
198204 enacted the regulation shall establ ish by clear and convincing
199205 evidence that the regulation complie s with this section.
200206 SECTION 3. This act shall become effective No vember 1, 2021.
