52 | 55 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

53 | 56 | | SECTION 1. NEW LAW A new section of law to be codified |
---|
54 | 57 | | in the Oklahoma Statutes as Section 4300 of Title 59, unless there |
---|
55 | 58 | | is created a duplication in numbering, reads as follows: |
---|
56 | 59 | | This act shall be known and may be cited as the “Oklah oma Home- |
---|
57 | 60 | | based Business Fairness Act”. |
---|
58 | 61 | | SECTION 2. NEW LAW A new section of law to be codified |
---|
59 | 62 | | in the Oklahoma Stat utes as Section 4300.1 of Title 59, unless there |
---|
60 | 63 | | is created a duplication in numb ering, reads as follows: |
---|
61 | 64 | | A. For purposes of this section: |
---|
90 | 94 | | 2. "Home-based business" means any business for the |
---|
91 | 95 | | manufacture, provision or sale of goods or services that is owned |
---|
92 | 96 | | and operated by the owner or te nant of the residential dwelling ; and |
---|
93 | 97 | | 3. "No-impact home-based business" means a home-based business |
---|
94 | 98 | | for which the following apply: |
---|
95 | 99 | | a. the total number of on-site employees and clients do |
---|
96 | 100 | | not exceed the municipal occupancy limit for the |
---|
97 | 101 | | residential property , and |
---|
98 | 102 | | b. the business activities are characterized by all of |
---|
99 | 103 | | the following: |
---|
100 | 104 | | (1) are limited to the sale of lawful goods and |
---|
101 | 105 | | services, |
---|
102 | 106 | | (2) do not generate on-street parking or a |
---|
103 | 107 | | substantial increase in traffic through the |
---|
104 | 108 | | residential area, |
---|
105 | 109 | | (3) occur inside the residential dwelling or in the |
---|
106 | 110 | | yard, and |
---|
107 | 111 | | (4) are not visible from the street. |
---|
108 | 112 | | B. The use of a residential dwelling for a home -based business |
---|
109 | 113 | | is a permitted use, except that this permission does not supersede |
---|
110 | 114 | | any of the following: |
---|
140 | 145 | | 2. Any master deed or other document applicable to a common |
---|
141 | 146 | | interest ownership community including, but not limited to, a |
---|
142 | 147 | | homeowner association (HOA). |
---|
143 | 148 | | C. A municipality shall not prohibit a no -impact home-based |
---|
144 | 149 | | business or otherwise require a person to apply, regist er or obtain |
---|
145 | 150 | | any permit, license, variance or other type of prior approval from |
---|
146 | 151 | | the municipality to operate a no-impact home-based business. |
---|
147 | 152 | | D. A municipality may establish reasonable regulations for a |
---|
148 | 153 | | home-based business if the regulations are narrowly tailored for any |
---|
149 | 154 | | of the following purposes: |
---|
150 | 155 | | 1. The protection of the public healt h and safety including |
---|
151 | 156 | | rules and regulations rela ted to fire and building codes, health and |
---|
152 | 157 | | sanitation, transportation or traffic control , solid or hazardous |
---|
153 | 158 | | waste, pollution and noise control ; |
---|
154 | 159 | | 2. Ensuring that the business activity is: |
---|
155 | 160 | | a. compatible with residential use of the property and |
---|
156 | 161 | | surrounding residential use, |
---|
157 | 162 | | b. secondary to the use as a residential dwelling , or |
---|
158 | 163 | | c. complying with state and federal law and paying |
---|
159 | 164 | | applicable taxes; or |
---|
190 | 196 | | E. A municipality shall not requ ire a person as a condition of |
---|
191 | 197 | | operating a home-based business to: |
---|
192 | 198 | | 1. Rezone the property for commercial use ; or |
---|
193 | 199 | | 2. Install or equip fire sprinklers in a single family detached |
---|
194 | 200 | | residential dwelling or any residential dwelling wit h not more than |
---|
195 | 201 | | two dwelling units. |
---|
196 | 202 | | F. The question of whether a regulation complies with this |
---|
197 | 203 | | section shall be a judicial question, and the municipality that |
---|
198 | 204 | | enacted the regulation shall establ ish by clear and convincing |
---|
199 | 205 | | evidence that the regulation complie s with this section. |
---|
200 | 206 | | SECTION 3. This act shall become effective No vember 1, 2021. |
---|
