124247 office. Anyone convicted of violating the provisions of this
125248 paragraph shall be guilty of a misdemeanor and shal l be punished as
126249 provided by law.

128250 4. The Commissioner or any employee of th e Department shall not
129251 be a candidate for any political office, or in any way be active or
130252 participate in any political contest of any Primary, General, or
131253 Special Election, except to cast a ballot. No commissioned officer

202361 2. Any person appointed to a position in the Communications

365+C. 1. Upon initial appointment to the position of Cadet
366+Highway Patrolman or Probati onary Communications Dispatcher, the
367+appointed employee shall be required to serve an initial
368+probationary period of twe lve (12) months. The Commissioner may
369+extend the probationary period for up to three (3) additional months

396+provided that the employee a nd the Office of Management and
397+Enterprise Services are notified in writing as to such action and
398+the reasons thereof. During such probationary period, the employee
399+may be terminated at any time and for any reason at the discretion
400+of the Commissioner. R etention in the service after expiration of
401+the initial probationary period shall entitle such employee to be
402+classified as a permanent employee and the employee shall be so
403+classified. No permanent employee may be discharged or removed
404+except as provided for in this section.
405+2. A commissioned office r of the Oklahoma Highway Patrol
406+Division may be promoted during the init ial probationary period if
407+such officer satisfactorily completes all training requirements
408+prescribed by the Commissioner.
409+D. 1. No commissioned officer of the Department shall be a
410+candidate for any political off ice or take part in or contribute any
411+money or other thing of value, directly or indirectly, to any
412+political campaign or to any candidate fo r public office. Anyone
413+convicted of violating the provisions of this paragraph sh all be
414+guilty of a misdemeanor a nd shall be punished as provided by law.
415+2. No commissioned officer of the Department, while in the

448+3. The Commissioner or any empl oyee of the Department shall not
449+be a candidate for any political office, or in any way be active or
450+participate in any political c ontest of any Primary, General, or

456+F. 1. No permanent employee, as provided for in this section,
457+who is a commissioned officer of the Depart ment, may be suspended
458+without pay or dismissed unless the employee has been notified in
459+writing by the Commissioner of such intended action and the reasons
460+thereof. No such notice shall be given by the Commissioner unless
461+sworn charges or statements have been obtained to justify the
462+action.
463+2. Whenever such charges are preferred, the Commissioner may
464+suspend the accused pending the hearing and final determina tion of
465+such charges. If the charges are not sustained in whole or in part,
466+the accused shall be entitled to pay during the period of suc h
467+suspension. If the charges are sustained in whole or in part, the
468+accused shall not receive any pay for the period of such suspension.

495+3. Commissioned officers of the Department o f Public Safety are
496+not entitled to appeal intra-agency transfer to the O klahoma Merit
497+Protection Commission pursuant to the Oklahoma Personnel Act unless
498+the transfer is in violation of Section 840-2.5 or 840-2.9 of Title
499+74 of the Oklahoma Statutes.
500+4. The Department of Public Safety shall follow the uniform
501+grievance procedure established and adopted by the Office of
502+Management and Enterprise Services for permanent classified
503+employees, except for those employees who are commissioned officers
504+of the Department. The Department of Publ ic Safety shall establish
505+and adopt a proprietary grievance procedure for commissioned
506+officers of the Department which is otherwise in compliance with the
507+provisions of Section 840-6.2 of Title 74 of the Oklahoma Statutes.
508+E. G. 1. The Commissioner is h ereby authorized to purchase and
509+issue uniforms and necessary equipment for all commissioned officers
510+of the Oklahoma Highway Patrol Division of the Department. All
511+uniforms and equipment shall be used only in the performan ce of the
512+official duties of such officers and shall remain the property of
513+the Department, except as provided in Section 2 -150 of this title.
514+2. Each commissioned officer of the Highway Patrol Division of
515+the Department of Public Safety shall be entitled to reimbursement
516+of expenses pursuant to the State Travel Reimbursement Act while
517+away from the assigned area of the officer as designated by the
518+

544+Chief of the Oklahoma Highway Patrol Division, when such expense is
545+incurred in the service of the state.
546+F. H. 1. The positions with the rank of Colonel and Lieutenant
547+Colonel of the Oklahoma Highway Patrol Division shall be filled from
548+the body of commissioned officers of the Oklahoma Highway Patrol
549+Division and appointment to said position positions shall be based
550+on qualifications, prev ious record as a commissioned officer of th e
551+Oklahoma Highway Patrol Division, length of service, years of
552+experience within the Oklahoma Highway Patrol Division or other
553+service as prescribed in this subsection, and efficienc y of service
554+performed.
555+2. In addition to the requirements of paragraph 1 of this
556+subsection, the position of Chief of the Oklahoma Highway Patrol
557+Division shall be based on one of the following:
558+a. one (1) year of experience in any combination:
559+(1) as Commissioner of Public Safety,
560+(2) as Assistant Commissioner of Public Safe ty, or
561+(3) as Assistant Chief,
562+b. two (2) years of experience in any combination:
563+(1) as Deputy Chief or higher rank, or
564+(2) if the experience was prior to April 21, 2006, as
565+Major or higher rank,
566+c. four (4) years of experience in any combination:
567+(1) as Major or higher rank, or

600+3. In addition to the requirements of paragraph 1 of this
601+subsection, the position of Deputy Chief of the Oklahoma Hig hway
602+Patrol Division shall be based on one of the following:
603+a. one (1) year of experience in any combination:
604+(1) as Commissioner of Public Safety,
605+(2) as Assistant Commissioner of Public Safety, or
606+(3) as Colonel,
607+b. two (2) years of experience in any co mbination:
608+(1) as Major or higher rank, or
609+(2) if the experience was pri or to April 21, 2006, as
610+Captain or higher rank, or
611+c. four (4) years of experience in any combination:
612+(1) as Captain or higher rank, or
613+(2) if the experience was prior to April 21, 2 006, as
614+Highway Patrol First Lieutenant or higher rank.
615+G. I. The Commissioner of Public Safety is hereby authoriz ed to
616+send employees of the Department of Publ ic Safety to schools such as
617+Northwestern University Center for Public Safety, Southern Police
618+

644+Institute, the FBI National Academy, the I nstitute of Police
645+Technology and Management, or to any other schools of similar
646+training which would be conducive to i mproving the efficiency of the
647+Oklahoma Highway Patrol Division and the Department of Public
648+Safety. While an employee is attending a sc hool, the Commissioner
649+is authorized to permit the employee to use a stat e-owned vehicle
650+and to use a fuel-purchasing card for any expenses related to the
651+operation of the vehicle. In addition, while an employee i s
652+attending the FBI National Academy, a on e-time expense allowance of
653+Two Thousand Dollars ($2,000.00) for uniforms , fees, travel, room
654+and board, and other rela ted expenses shall be paid to the employee
655+by the Department; provided, the employee shall not be further
656+compensated through the State T ravel Reimbursement Act, and, if any
657+other agency reimburses the employee for any expenses, the
658+reimbursement shall be given to the Department. All purchases made
659+by the employee with the expense allowance shall b e considered
660+property of the employee.
661+H. J. 1. Any former commissioned officer of the Department
662+whose separation from the Department was at such officer's own
663+request and not a result of such officer 's own actions contrary to
664+the policy of the Departme nt or was not as a result of the
665+retirement of that officer from the Depar tment may make application
666+for reinstatement as a commissioned officer of the division or
667+section of the Department in which such officer was previously
668+

694+employed, provided such reins tated officer will be able to complete
695+twenty (20) years of credited servi ce by the time the reinstated
696+officer reaches sixty-two (62) years of age. The Commission er may
697+waive the requirements of possessing the number of semester hours or
698+degree as required in subsection B of this section for any former
699+commissioned officer mak ing application for reinstatement as a
700+commissioned officer of the Department. The Commis sioner may
701+require the applicant for reinstatement to attend selected courses
702+of instruction, as prescribed by the Commissioner.
703+2. In the event of future hostilitie s wherein the Congress of
704+the United States declares this nation in a state of war with a
705+foreign nation, including military service brought about by the
706+Vietnam War, any period of m ilitary service served by a commissioned
707+officer of the Department shall b e considered as continued service
708+with such Department, provided such commissioned officer returns to
709+duty with the Department within sixty (60) days after release from
710+military service.
711+SECTION 2. This act shall become effective July 1, 2022.
712+SECTION 3. It being immediately necessary for the preservation
713+of the public peace, health or safety, an emergency is hereby
714+declared to exist, by reason whereof this act shall take effect and
715+be in full force from and after its passage and approval."

806+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
807+SECTION 4. AMENDATORY 47 O.S. 2011, Section 2-102, as
808+amended by Section 1, Chapter 60, O.S.L. 2018 (47 O.S. Supp. 2020,
809+Section 2-102), is amended to read as follows:
810+Section 2-102. A. 1. The Department shall be under the
811+control of an executive officer to be known as the “Commissioner of
812+Public Safety”, who shall be appoint ed by the Governor with the
813+advice and consent of the Senate and shall serve at the pleasure of
814+the Governor and may be removed or r eplaced without cause.
815+Compensation for the Commissioner shall be determined by the
816+Governor. The Commissioner may be removed fro m office by a two-
817+thirds (2/3) vote of the members elected to and con stituting each
818+chamber of the Legislat ure.
819+2. The Commissioner of Public Safety shall be a professional
820+law enforcement officer with ten (10) years ’ experience in the field

855+4. The Commissioner shall be allowed the actual and necessary
856+expenses incurred in the perfo rmance of official duties of the
857+Commissioner while away from the office.
858+B. The Commissioner of Public Safety, after appointment and
859+before entering upon the discharge of duties, shall take and
860+subscribe to the oath of office required by the Constitution .
861+Bonding of the Commissioner of Pu blic Safety and other employees of
862+the Department will be provided under the provisions of Section

1060+c. for any such position in the Communications Division,
