3965 An Act relating to traffic offense quotas;
4066 prohibiting certain entities from making certain
4167 plans based on certain criteria; prohibiting certain
4268 entities from requiring or suggesting that there are
4369 certain expectations relating to such citations;
4470 providing that certain provisions do not pro hibit
4571 municipalities from obtaining certain budgetary
4672 information or estimates; stating certain violatio ns
4773 are grounds for removal from office or from a
4874 person’s position; providing for codification; and

5581 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
5682 SECTION 1. NEW LAW A new section of law to be codified
5783 in the Oklahoma Statutes as Section 34 -109 of Title 11, unless there
5884 is created a duplication in numbering, reads as follows:
5985 A. A political subdivision or an ag ency of this state may n ot
6086 establish or maintain, formally or informally, a plan to evaluate,
6187 promote, compensate or discipline:
6288 1. A peace officer according to the officer’s issuance of a
6389 predetermined or specified number of any type or combination of
6490 types of traffic citations ;

92142 2. A peace officer according to the officer’s issuance of a
93143 traffic citation for the purpose of generating revenue; or
94144 3. A justice of the peace or a judge of a county court,
95145 municipal court or municipal court of record accordin g to the amount
96146 of money the justice or judge collects from persons convicted of a
97147 traffic offense.
98148 B. A political subdivision or an agency of this state may not
99149 require or suggest to a peace officer, a ju stice of the peace or a
100150 judge of a county court , municipal court or municipal court of
101151 record:
102152 1. That the peace officer is required or expected to issue a
103153 predetermined or specified number of any type or combination of
104154 types of traffic citations within a specified period;
105155 2. That the peace officer is required or expected to i ssue a
106156 traffic citation for the purpose of generating revenue; or
107157 3. That the justice or judge is required or expected to collect
108158 a predetermined amount of money from persons convicted of a traffic
109159 offense within a specified period .
110160 C. This section does not prohibit a municipality from obtaining
111161 budgetary information from a municipal court or a munici pal court of
112162 record including an estimate of the amount of money the court
113163 anticipates will be collected in a budget year.
114164 D. A violation of this section by an elected official is
115165 misconduct and a ground for removal from office. A violation of
