39	65		An Act relating to traffic offense quotas;
40	66		prohibiting certain entities from making certain
41	67		plans based on certain criteria; prohibiting certain
42	68		entities from requiring or suggesting that there are
43	69		certain expectations relating to such citations;
44	70		providing that certain provisions do not pro hibit
45	71		municipalities from obtaining certain budgetary
46	72		information or estimates; stating certain violatio ns
47	73		are grounds for removal from office or from a
48	74		person’s position; providing for codification; and

55	81		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
56	82		SECTION 1. NEW LAW A new section of law to be codified
57	83		in the Oklahoma Statutes as Section 34 -109 of Title 11, unless there
58	84		is created a duplication in numbering, reads as follows:
59	85		A. A political subdivision or an ag ency of this state may n ot
60	86		establish or maintain, formally or informally, a plan to evaluate,
61	87		promote, compensate or discipline:
62	88		1. A peace officer according to the officer’s issuance of a
63	89		predetermined or specified number of any type or combination of
64	90		types of traffic citations ;

92	142		2. A peace officer according to the officer’s issuance of a
93	143		traffic citation for the purpose of generating revenue; or
94	144		3. A justice of the peace or a judge of a county court,
95	145		municipal court or municipal court of record accordin g to the amount
96	146		of money the justice or judge collects from persons convicted of a
97	147		traffic offense.
98	148		B. A political subdivision or an agency of this state may not
99	149		require or suggest to a peace officer, a ju stice of the peace or a
100	150		judge of a county court , municipal court or municipal court of
101	151		record:
102	152		1. That the peace officer is required or expected to issue a
103	153		predetermined or specified number of any type or combination of
104	154		types of traffic citations within a specified period;
105	155		2. That the peace officer is required or expected to i ssue a
106	156		traffic citation for the purpose of generating revenue; or
107	157		3. That the justice or judge is required or expected to collect
108	158		a predetermined amount of money from persons convicted of a traffic
109	159		offense within a specified period .
110	160		C. This section does not prohibit a municipality from obtaining
111	161		budgetary information from a municipal court or a munici pal court of
112	162		record including an estimate of the amount of money the court
113	163		anticipates will be collected in a budget year.
114	164		D. A violation of this section by an elected official is
115	165		misconduct and a ground for removal from office. A violation of
