24	50		Act; amending 51 O.S. 2011, Section 253, which
25	51		relates to burden upon free exercise of religion;
26	52		prohibiting governmental declaration of religious
27	53		institution as nonessential; prohibiting closure or
28	54		restriction on religious institution under certain
29	55		circumstances; providing an effective date ; and

37	61		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

39	62		SECTION 1. AMENDATORY 51 O.S. 2011, Section 253, is
40	63		amended to read as follows:

42	64		Section 253. A. Except as provided in subsection B of this
43	65		section, no governmental entity shall substantially burden a
44	66		person’s free exercise of religion even if the burden results from a
45	67		rule of general applicability.

49	95		B. No governmental entity shall substantially burden a person ’s
50	96		free exercise of religion unless it demonstrates that application of
51	97		the burden to the person is:
52		-
53	98		1. Essential to further a compelling governmental interest; and
54		-
55	99		2. The least restrictive means of fur thering that compelling
56	100		governmental interest.

58	101		C. No governmental entity as defined pursuant to Section 252 of
59	102		this title shall declare or deem a religious institution and any
60	103		activity directly related to the institution ’s discharge of its
61	104		mission and purpose to be nonessential. No religious institution
62	105		shall be subject to a closure or restriction for the purposes of
63	106		health or security that is greater than that imposed upon any
64	107		private entity facing the same or similar health or security
65	108		conditions.

67	109		SECTION 2. This act shall become effective July 1, 2021.

69	110		SECTION 3. It being immediately necessary for the preservation
70	111		of the public peace, health or safety, an emergency is hereby
71	112		declared to exist, by reason whereof this res olution shall take
72	113		effect and be in full force from and after its passage and approval.
