6565 An Act relating to school support employees ; amending

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 70 O.S. 2011, Section 6 -104, as
7979 amended by Section 1, Chapter 21, O.S.L. 2017 (70 O.S. Supp. 2020,
8080 Section 6-104), is amended to read as fo llows:
8181 Section 6-104. A. 1. The board of education of each school
8282 district in the state shall provide for sick leave for all teachers
8383 employed in the district and shall pay such teachers the full amount
8484 of their contract salarie s during any absence from their regular
8585 school duties for a period of time and under such conditions as the
8686 board may determine, but not less than the minimum benefits
8787 hereafter specified. Payment for sick leave shall be made on the
8888 basis of the current s alary rate then in effect for the teacher

140140 receiving the payment. The plan shall provide that a teacher may be
141141 absent from his or her duties due to personal accidental injury,
142142 illness or pregnancy, or accidental injury or illness in the
143143 immediate family without the loss of salary for not to exceed ten
144144 (10) days during each school year, except that said the absence
145145 without loss of salary for teachers employed on an eleven -month
146146 contract shall not exceed eleven (11) days durin g each school year
147147 and for those teachers employed on a twelve-month contract shall not
148148 exceed twelve (12) days during each school year, if said the
149149 contract is for the work period, and not merely for pay purposes.
150150 The right to such leave shall vest at the be ginning of the school
151151 year. Each school district shall provide for all teachers a minimum
152152 of three (3) days for personal business leave, upon the request of
153153 the teacher. Salary deductions for such leave shall not exc eed the
154154 salary level for substitute te achers. Provided further, that these
155155 terms for personal business leave shall not negate any locally
156156 negotiated leave policies which exceed the minimum benefits stated
157157 above. Each school district may provide not more than five (5) days
158158 each year for emergency leave. Each school district wil l determine
159159 the purposes for which emergency leave can be used. Those days
160160 shall not be chargeable to sick leave and will be noncumulative.
161161 Unused sick leave shall be cumulative u p to a total of sixty (60)
162162 days, and cumulative sick leave shall be transfe rable to another
163163 school district or to the Oklahoma School for the Blind or the

215215 Oklahoma School for the Deaf where the teacher is employed the next
216216 succeeding school year, provided that the number of days transferred
217217 shall not exceed the maximum days permi tted by the receiving school
218218 and that such transferred days shall be used first in case of
219219 illness and, provided further, that if the receiving school pays
220220 teachers for unused sick leave upon retirement or termination o f
221221 contract, then said the payments shall be for only those days
222222 accumulated in the receiving school. The school board of the
223223 sending district shall certify the exact number of days eligible for
224224 transfer.
225225 2. If a teacher is employed at the Oklahoma School fo r the
226226 Blind or the Oklahoma School for the Deaf after July 1, 2017, any
227227 unused sick leave up to a total of sixty (60) days that is
228228 accumulated at a school district prior to such date shall be
229229 transferable.
230230 B. The plan of each school district for sick leav e benefits may
231231 include other terms and conditions, but shall not provide less sick
232232 leave benefits than those prescribed herein. Hospital and medical
233233 proceeds may not be charged against sick leave benefits, but the
234234 proceeds received by the teacher from any insurance provided by the
235235 district for loss of compensable time may be charged against sick
236236 leave benefits. Provided the board of education may provide all or
237237 part of hospital and medical benefits, and sickness, a ccident,
238238 health and life insurance or any of the aforesaid for any or all of

290290 its employees. On authorization of the teacher, the district may
291291 approve payroll deductions for such teacher ’s portion of the
292292 aforesaid.
293293 C. Each school district shall grant a te acher leave for jury
294294 service or as a witn ess subpoenaed in a criminal, civil or juvenile
295295 proceeding and shall pay the teacher during such service the full,
296296 current contract salary. Provided that the district may deduct any
297297 compensation received for servin g as a juror or witness from the
298298 teacher’s salary during such service.
299299 D. 1. A school district shall also provide for benefits for
300300 personnel other than teachers. Benefits for support personnel
301301 employees shall include provisions for paid sick leave of at least
302302 one (1) day per month of employmen t not to exceed the number of
303303 hours per day for which they are regularly employed cumulative to a
304304 total of sixty (60) days and cumulative sick leave shall be
305305 transferable to another school district where the person is employed
306306 the next succeeding school ye ar; provided, that the number of days
307307 transferred shall not exceed the maximum days permitted by the
308308 receiving district and that such transferred days shall be used
309309 first in case of illness up to a maximum of ten (1 0) transferred
310310 days per school year unles s the local board of education authori zes
311311 the use of additional transferred days during the school year in an
312312 amount set by the board and, provided further, that if the receiving
313313 district pays such person for unused sick leave upon retirement or

365365 termination of employment, then said the payments shall be for only
366366 those days accumulated in the receiving district. The school board
367367 of the sending district shall certify the exact number of days
368368 eligible for transfer. Ea ch school district shall provide for all
369369 support employees, a minimum of three (3) days for personal business
370370 leave, upon the request of the support employee. Salary deductions
371371 for personal business leave shall not exceed an amount necessary to
372372 cover the costs of services provided to the distric t by the support
373373 employee and shall not ex ceed the salary of the support employee.
374374 The terms for personal business leave provided by this subsection
375375 shall not negate any locally negotiated leave policies which exce ed
376376 the minimum benefits stated above. Pa yment for such leave shall be
377377 calculated with regard to the definition of “support employee”
378378 provided by Section 6 -101.40 of this title. Provided that such
379379 benefits shall not exceed those authorized for teachers he reunder.
380380 2. Support employees, as define d by Section 6-101.40 of this
381381 title, shall be entitled to pay for any time lost when a school
382382 district is closed because of an epidemic or when an order for such
383383 closing has been issued by a health officer authorized by law to
384384 issue the order.
385385 SECTION 2. This act shall becom e effective July 1, 2021.
386386 SECTION 3. It being immediately necessary for the preservation
387387 of the public peace, health or safety, an emergency is hereby
