77	131		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

79	132		SECTION 1. AMENDATORY 10 O.S. 2011, Section 175.12, as
80	133		amended by Section 32, Chapter 304, O.S.L. 2012 (10 O.S. Supp. 2020,
81	134		Section 175.12), is amended to read as follows:
82		-
83	135		Section 175.12. (a) A. The Oklahoma Children’s Hospital of
84	136		Oklahoma, including its clinics and laboratories , is hereby
85	137		designated as a service institution for the physically handicapped
86	138		children of this state, which also serves persons under twenty -one
87	139		(21) years of age and shall have the authority to extend services to
88	140		persons twenty-one (21) years or older. The Oklahoma Children ’s

89	168		Hospital shall also serve as a teaching and training hospital for
90	169		the School of Medicine of the University of Oklahoma . Payment for

93	170		services by the Commission to the Children ’s Hospital of Oklahoma
94	171		shall be based on the actual per diem cost of patient care exclusive
95	172		of professional instructional expense. In the eve nt that the
96	173		Commission and Board of Regents of the University of Oklahoma cannot
97	174		agree on a per diem charge for patients of the Commission, the
98	175		Director of the Office of Management and Enterprise Services, with
99	176		the approval of the Governor, is hereby autho rized to establish a
100	177		rate of pay which shall prevail. The Children ’s Hospital of
101	178		Oklahoma shall grant the Commission a priority in the assignment of
102	179		hospital services, which are to be distributed as equitably as is
103	180		possible among the counties of this stat e.

105	181		(b) B. The Commission University Hospitals Authority shall be
106	182		obligated, insofar as practicable, to use the available facilities
107	183		of the Oklahoma Children’s Hospital of Oklahoma to a degree that
108	184		will enable the University of Oklahoma School of Medicine to
109	185		maintain its proper patient ratio for accreditation; Provided
110	186		provided, that this provision shall not cause undue hardship to a
111	187		patient.

220	368		B. Every two (2) years the Board shall elect from among its
221	369		membership a chair and a vice -chair. The Board shall meet at least
222	370		quarterly and may meet more frequently as necessary as determined by

226	372		reimbursed for necessary travel out of funds available to the
227	373		Commission pursuant to the State Travel Reimbursement Act; provided,

231	376		C. With funds appropriated or otherwise available for that
232	377		purpose, the Commission shall provide administra tive assistance and
233	378		services to the Child Death Review Board.

235	379		SECTION 3. AMENDATORY 56 O.S. 2011, Section 300, is
236	380		amended to read as follows:

238	381		Section 300. The Oklahoma Medical Center shall include the
239	382		University Hospital, the Oklahoma Children’s Hospital of Oklahoma,
240	383		the O’Donaghue Rehabilitation Institution, the Child Study Center ,
241	384		and any other institutions operated by a private entity under a
242	385		joint operating agreement in which any of the state institutions
243	386		listed in this sectio n are leased to a private entity pursuant to
244	387		the University Hospitals Authority Act . The University Hospitals
245	388		Authority may, at its discretion, designate other names under which
246	389		the Oklahoma Medical Center may operate .

248	390		SECTION 4. AMENDATORY 57 O.S. 2011, Section 509.6, is

251	419		Section 509.6. The Department of Corrections is authorized,
252	420		pursuant to the Board of Corrections resolution on May 22, 1998 and
253	421		subject to legislative appropriation, to establish a sp ecial
254	422		correctional unit expansion at the Joseph Harp Correctional Center
255	423		in Lexington, Oklahoma, designed solely for the imprisonment of
256	424		elderly persons, physically disabled persons, persons in need of
257	425		infirmary care, and persons in need of specialized car e or treatment
258	426		as an outpatient in the Oklahoma City Metropolitan area in the
259	427		custody of the Department. The Department shall consider the unique
260	428		needs of the elderly offender and the physically disabled offender
261	429		when designing the unit or renovating an e xisting unit for this
262	430		purpose and when implementing any program or service for such
263	431		persons.

265	432		Only the following offenders shall be eligible for placement in
266	433		the facility:

270	434		1. Persons age fifty -five (55) years or older who are deemed
271	435		not suitable for placem ent in the general population of another
272	436		facility;

274	437		2. Persons who are physically disabled upon reception into the
275	438		custody of the Department, or who become physically disabled during
276	439		the term of their incarceration within the custody of the
277	440		Department, and whose disability requires the continuous use of a
278	441		wheelchair or other special equipment, or whose disability requires

288	476		Oklahoma City metropo litan area and that are coming from and
289	477		returning to other Department correctional facilities.

291	478		SECTION 5. AMENDATORY 63 O.S. 2011, Section 2654.2, is
292	479		amended to read as follows:

294	480		Section 2654.2. There is hereby created the Oklahom a Poison
295	481		Control Center within Children’s Hospital of Oklahoma. The
296	482		University Hospitals Authority shall contract with the University of
297	483		Oklahoma Health Sciences Center College of Pharmacy for the
298	484		implementation of this act . The purpose of the center is to
299	485		implement a statewide emergency poison and drug information program
300	486		designed and structured to deliver reliable, accurate, qualified
301	487		professional judgments and responses to requests for emergency
302	488		poison and drug information data.

317	525		outpatient hospital and clinical facilities and office and research
318	526		buildings, facilities or property owned by or under the management
319	527		and control of the University Hospitals Authority or the University

322	529		2. “Authority” means the University Hospitals Autho rity;

324	530		3. “Department” means the Department of Human Services;

326	531		4. “Commission” means the Commission for Human Services or the

329	533		5. “University Hospital” means Everett Tower and the North
330	534		Pavilion, which have been renamed as Children’s Hospital at the
331	535		University of Oklahoma Medical Center the inpatient and outpatient
332	536		hospital and clinical facilities and office and research buildings,
333	537		facilities or property assigned for the use of University Hospital
334	538		by the University Hospi tals Authority; and

336	539		6. “Oklahoma Children’s Hospital of Oklahoma” means the
337	540		Bielstein, Garrison, Nicholson and MRI towers which are no longer
338	541		being used as hospitals inpatient and outpatient hospital and
339	542		clinical facilities and office and research buildin gs, facilities or

346	575		B. The University Hospitals Authority may assign any inpatient
347	576		and outpatient hospital and clinical facilities, research buildings,
348	577		facilities or property and any other buildings, facilities or
349	578		property under its owne rship or management and control to University
350	579		Hospital, Oklahoma Children ’s Hospital or any other division or
351	580		entity which is part of University Hospitals.

353	581		C. No person or entity shall use the title “Oklahoma Children’s
354	582		Hospital” or “Children’s Hospital of Oklahoma” for any purpose
355		-

357	583		without the express permission of the University Hospitals Trust.
358	584		No person or entity shall use the title “Children’s Hospital” with
359	585		respect to Children’s Hospital of Oklahoma as defined in this
360	586		section without the express perm ission of the University Hospitals
361	587		Trust.

363	588		SECTION 7. AMENDATORY 63 O.S. 2011, Section 3204, as
364	589		amended by Section 3, Chapter 495, O.S.L. 2019 (63 O.S. Supp. 2020,
365	590		Section 3204), is amended to read as follows:

367	591		Section 3204. A. Until July 1, 1993, the University Hospitals
368	592		shall be under the jurisdiction, supervision, management and control

372	622		B. Effective July 1, 1993, the University Hospitals are hereby
373	623		transferred from the Department of Human Services and the Commission
374	624		for Human Services to the University Hospitals Authority.

376	625		C. The transfer shall include:

378	626		1. All powers, duties, responsibilities, properties, assets,
379	627		fund balances, encumbrances, obligations , records, personnel and
380	628		liabilities, including, but not limited to, liability for all
381	629		University Hospital employees ’ sick leave, annual leave, holidays,
382	630		unemployment benefits and workers ’ compensation benefits accruing to
383	631		employees prior to July 1, 1993, which are attributable to the
384	632		University Hospitals; provided, however, that any claims arising
385	633		under the Governmental Tort Claims Act and filed prior to July 1,
386	634		1993, and from any other actions filed prior to July 1, 1993, shall
387	635		remain the responsibility o f the Department of Human Services and
388	636		the Commission for Human Services. All claims arising prior to July
389	637		1, 1993 and for which no action has been filed shall be paid by the
390	638		Risk Management Program;
391		-
392	639		2. Oklahoma Children’s Hospital of Oklahoma and all buildings
393	640		and appurtenances located on land which is described as follows:
394	641		Blocks B, 3, 4, 12 and 13, and the North 30 feet of Block 14; and
395	642		Lots 6 through 15, Block 21, CULBERTSON HEIGHTS ADDITION less and
396	643		except the West 7 feet of Lot 5 and all of Lots 6 through 19, and

650	1095		D. In the event the Trust enters into a joint venture or
651	1096		acquires an interest in a not -for-profit entity to effectuate the
652	1097		administration of the mission of the Trust, that entity shall not be

654	1099		Records Act. Any information submitted to or compiled by the Trust

671	1140		beneficiary public trusts organized under Section 176 et seq. of
672	1141		Title 60 of the Oklahoma Statutes, the Trust shall possess all the
673	1142		statutory powers and exemptions provid ed to the University Hospitals
674	1143		Authority.

676	1144		F. The Trust shall have the authority or may contract with a
677	1145		joint operator or with a foundation supporting the programs of
678	1146		Oklahoma Children’s Hospital to sell naming rights to property owned
679	1147		or leased by the Tru st, provided proceeds from the sale of naming
680	1148		rights are used to effectuate the purposes of the University
681	1149		Hospitals Authority as established in the University Hospitals
682	1150		Authority Act and are specifically approved by the Trust, which

917	1494		D. For the purpose of state salary increments and retirement,
918	1495		no teacher shall be granted credit for more than five (5) years of
919	1496		active duty in the military service or out -of-state or out-of-
920	1497		country teaching experience as a certified teacher or its
921	1498		equivalent. Nothing in this section shall prohibit boards of
922	1499		education from crediting more years of experience on district salary
923	1500		schedules than those allowed for state purposes.

1005	1645		ancillary facilities as may be necessary for its operation .;

1008	1647		Neurology Service.;

1010	1648		(5) 5. “School of Medicine” shall mean the School of Medicine
1011	1649		of the University of Oklahoma Medical Center .; and

1036	1694		(1) He shall be licensed 1. Licensed to practice medicine in
1037	1695		this state and shall be qualified to supervise residency training
1038	1696		and shall meet the standards established by the American Board of
1039	1697		Psychiatry and Neurology or its su ccessor.;
1040		-
1041	1698		(2) He shall be appointed 2. Appointed as a member of the
1042	1699		faculty of the School of Medicine in the Department of Psychiatry
1043	1700		and Neurology.; and
1044		-
1045	1701		(3) He shall be in 3. In charge of the Psychiatry and Neurology
1046	1702		Service, subject to the general poli cies and direction of the
1047	1703		University Hospital administration.

1049	1704		(d) F. The admission of patients to the University Hospital
1050	1705		Psychiatry and Neurology Service and the trial release of patients
1051	1706		shall be based on the following criteria .:

1053	1707		(1) 1. Admission shall be on the basis of the teaching needs,
1054	1708		and requirements of the School of Medicine, in accordance with
1055	1709		regulations approved by the Board .;

1070	1746		relative or guardian within one week after written notice from the
1071	1747		Chief, the patient may be committed or transferred by the Director
1072	1748		of the Department of Mental Health and Substance Abuse Services to
1073	1749		the appropriate state mental hospital.

1075	1750		(e) G. 1. Authority is hereby provided for the transfer of any
1076	1751		patient of the psychiatric and neurological facilities a nd services
1077	1752		of the University Hospital to a component facility of the Department
1078	1753		of Mental Health and Substance Abuse Services and for the transfer
1079	1754		of any patient of a component facility of that Department to the
1080	1755		University Hospital psychiatric and neurolo gical facilities and
1081	1756		services under such procedures as the Department and the School of
1082	1757		Medicine may adopt, subject to the provisions of this section and
1083	1758		the mental health laws of this state.

1085	1759		(1) 2. The transfer of such patients shall be for the following

1105	1800		by the Director of the Department of Mental Health and Substance
1106	1801		Abuse Services, the Superintendent of the University Hospital, and

1109	1803		(f) H. The discharge of certified patients from the Psychiatry
1110	1804		and Neurology Service shall be determined by the consensus of a
1111	1805		board of three (3) members from the Department of Psychiatry and
1112	1806		Neurology, including the Chief. The Chief shall notify the court,
1113	1807		which certified the patient originally, that the Board has concluded
1114	1808		that the patient so certified is mentally well and is being
1115	1809		discharged.
