70	70	facilities; requiring certain storage procedures;

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
78	78	SECTION 1. NEW LAW A new section of law to be codified
79	79	in the Oklahoma Statutes as Section 1-1432 of Title 63, unless there
80	80	is created a duplication in numbering, reads as follows:
81	81	A. As used in this section , “topical ophthalmic anesthetic
82	82	drug” means a drug in the form of eyedrops, a gel or an ointment
83	83	that contains a local anesthetic and is intended for administration
84	84	directly into the eye for the treatment of ocular p ain or to numb
85	85	the eye or eyes before surgery, after injury or before certain tests
86	86	or procedures. Topical ophthalmic anesthetic may include, but shall
87	87	not be limited to, an agent, formulation or solution that contains
88	88	proparacaine, tetracaine or lidocaine.

140	140	B. No person in this state shall prescribe any topical
141	141	ophthalmic anesthetic drug to a patient. Only a healthcare
142	142	practitioner duly authorized to administer a topical ophthalmic
143	143	anesthetic drug may administer such drug to a patient, and only as
144	144	provided in this section.
145	145	C. A topical ophthalmic anesthetic drug may only be stored and
146	146	administered to patients in a facility or portion of a facility
147	147	licensed or certified by the State Department of Health as an
148	148	emergency department or an urgent care clinic . The appropriate
149	149	authority of the facility shall ensure that any topical ophthalmic
150	150	anesthetic drugs and supplies are stored in a locked cabinet and are
151	151	not visible to patients.
152	152	D. The State Commissioner of Health shall promulgate rules to
153	153	implement the provisions of this section.
154	154	SECTION 2. This act shall become effective November 1, 2021.
