6565 An Act relating to topical ophthalmic anesthetic

7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. NEW LAW A new section of law to be codified
7979 in the Oklahoma Statutes as Section 1-1432 of Title 63, unless there
8080 is created a duplication in numbering, reads as follows:
8181 A. As used in this section , “topical ophthalmic anesthetic
8282 drug” means a drug in the form of eyedrops, a gel or an ointment
8383 that contains a local anesthetic and is intended for administration
8484 directly into the eye for the treatment of ocular p ain or to numb
8585 the eye or eyes before surgery, after injury or before certain tests
8686 or procedures. Topical ophthalmic anesthetic may include, but shall
8787 not be limited to, an agent, formulation or solution that contains
8888 proparacaine, tetracaine or lidocaine.

140140 B. No person in this state shall prescribe any topical
141141 ophthalmic anesthetic drug to a patient. Only a healthcare
142142 practitioner duly authorized to administer a topical ophthalmic
143143 anesthetic drug may administer such drug to a patient, and only as
144144 provided in this section.
145145 C. A topical ophthalmic anesthetic drug may only be stored and
146146 administered to patients in a facility or portion of a facility
147147 licensed or certified by the State Department of Health as an
148148 emergency department or an urgent care clinic . The appropriate
149149 authority of the facility shall ensure that any topical ophthalmic
150150 anesthetic drugs and supplies are stored in a locked cabinet and are
151151 not visible to patients.
152152 D. The State Commissioner of Health shall promulgate rules to
153153 implement the provisions of this section.
154154 SECTION 2. This act shall become effective November 1, 2021.
