AS INTRODUCED 
 
An Act relating to topical ophthalmic anesthetic 
drugs; defining term; prohibiting prescription of 
topical ophthalmic anesthetic drug; limiting 
administration of topical ophthalmic anesthetic drug 
to certain health care practitioners and certain 
facilities; requiring certain storage procedures; 
directing promulgation of rules; providing for 
codification; and providing an effective date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 1-1432 of Title 63, unless there 
is created a duplication in numbering, reads as follows: 
A. As used in this section , “topical ophthalmic anesthetic 
drug” means a drug in the form of eyedrops, a gel or an ointment 
that contains a local anesthetic and is intended for administration 
directly into the eye for the treatment of ocular p ain or to numb 
the eye or eyes before surgery, after injury or before certain tests 
or procedures.  Topical ophthalmic anesthetic may include, but shall 
not be limited to, an agent, formulation or solution that contains 
proparacaine, tetracaine or lidocaine.

B. No person in this state shall prescribe any topical 
ophthalmic anesthetic drug to a patient.  Only a healthcare 
practitioner duly authorized to administer a topical ophthalmic 
anesthetic drug may administer such drug to a patient, and only as 
provided in this section. 
C. A topical ophthalmic anesthetic drug may only be stored and 
administered to patients in a facility or portion of a facility 
licensed or certified by the State Department of Health as an 
emergency department or an urgent care clinic . The appropriate 
authority of the facility shall ensure that any topical ophthalmic 
anesthetic drugs and supplies are stored in a locked cabinet and are 
not visible to patients. 
D.  The State Commissioner of Health shall promulgate rules to 
implement the provisions of this section. 
SECTION 2.  This act shall become effective November 1, 2021.
