---|
147 | 147 | | 1. It is in the public benefit to provide family temporary |
---|
148 | 148 | | disability insurance benefits to workers to care for their family |
---|
149 | 149 | | members. The need for family temporary disability insurance |
---|
150 | 150 | | benefits has intensified as the participation o f both parents in the |
---|
151 | 151 | | workforce has increased, and the number of single parents in the |
---|
152 | 152 | | workforce has grown. The need for partial wage replacement for |
---|
153 | 153 | | workers taking family care leave will be exacerbated as the |
---|
154 | 154 | | population of those needing care, both childr en and parents of |
---|
155 | 155 | | workers, increases in relation to the number of working -age adults; |
---|
156 | 156 | | 2. Developing systems that help families adapt to the competing |
---|
157 | 157 | | interests of work and home not only benefits workers, but also |
---|
158 | 158 | | benefits employers by increasing worker pr oductivity and reducin g |
---|
159 | 159 | | employee turnover; |
---|
160 | 160 | | 3. The majority of workers in this state are un able to take |
---|
161 | 161 | | family care leave because they are unable to afford leave without |
---|
162 | 162 | | pay. When workers do not receive some form of wage replacement |
---|
163 | 163 | | during family care lea ve, families suffer from the worker ’s loss of |
---|
164 | 164 | | income, increasing the demand on the state un employment insurance |
---|
165 | 165 | | system and dependenc e on the state’s welfare system; and |
---|
166 | 166 | | 4. It is the intent of the Legislature to create a family |
---|
167 | 167 | | temporary disability insuran ce program to help reconcile the demands |
---|
168 | 168 | | of work and family. The family temporary disabili ty insurance |
---|
169 | 169 | | program shall be established by the Department of Labor and shall be |

229 | 229 | | A. The Department of Labor shall establish a family temporary |
---|
230 | 230 | | disability insurance program. Family temporary disability insurance |
---|
231 | 231 | | shall provide up to six (6) weeks of wage replacement benefits to |
---|
232 | 232 | | workers who take time off work to care for a seriously ill child, |
---|
233 | 233 | | spouse, parent, grandparent, grandchild, sibling or domestic |
---|
234 | 234 | | partner, or to bond with a mi nor child within one year of the birth |
---|
235 | 235 | | or placement of the child in connection with foster care or |
---|
236 | 236 | | adoption. |

237 | 237 | | B. An individual shall be eligible to receive family temporary |
---|
238 | 238 | | disability insurance benefits equal to sixty -five percent (65%) of |
---|
239 | 239 | | his or her weekly wage amount for each full day during which he or |
---|
240 | 240 | | she is unable to work due to caring for a seriously ill or injured |
---|
241 | 241 | | family member or bonding with a minor child within one year of the |
---|

306 | 306 | | consecutive day following the first compensable day with respect to |

307 | 307 | | which the claim is made for benefit s, which time shall be extended |

308 | 308 | | by the Department upon a showing of good cause. If a first claim is |

309 | 309 | | not complete, the claim form shall be returned to the claimant for |
---|
310 | 310 | | completion and it shall be completed and returned not later than the |
---|

984 | 984 | | C. The Department shall develop a certification form for |

985 | 985 | | bonding that is separate and distinct from the certificate required |

986 | 986 | | in subsection A of this section for an employee taking leave to bond |

1119 | 1119 | | A. Each worker shall pay worker contributions at the rate |

1120 | 1120 | | determined by the Department of Labor. On or before October 31 of |

1121 | 1121 | | each calendar year, the Department shall prepare a statement , which |

1122 | 1122 | | shall be a public record, declaring the rate of worker contributions |
---|
1123 | 1123 | | for the calendar year and shall notify promptly all employers of |
---|
1124 | 1124 | | employees covered for family temporary di sability insurance. |
---|
1125 | 1125 | | B. The rate of worker contributions shall be established by the |
---|
1126 | 1126 | | Department. |

1127 | 1127 | | C. There is created in the State Treasury a revolving fund for |
---|
1128 | 1128 | | the Department of Labor to be designated as the “Disability Trust |
---|
1129 | 1129 | | Fund”. The fund shall be a c ontinuing fund, not subject to fiscal |
---|
1130 | 1130 | | year limitations, and shall consist of all contributions, penalties, |
---|
1131 | 1131 | | and interest provided for in this act. All monies accruing to the |
---|
1132 | 1132 | | credit of the fund are hereby appropriated and may be bu dgeted and |
---|
1133 | 1133 | | expended by the Department of Labor to perform duties as prescribed |
---|
1134 | 1134 | | by this act. Expenditures from the fund shall be made upon warrants |
---|
1135 | 1135 | | issued by the State Treasurer against claims filed as prescribed by |
---|
1136 | 1136 | | law with the Department of Labor for approval and payment. All |
---|
1137 | 1137 | | benefits provided for in this act shall be payable from the fund. |
