8989 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9090 SECTION 1. NEW LAW A new section of law to be codified
9191 in the Oklahoma Statutes as Section 901 of Title 40, u nless there is
9292 created a duplication in numbering, reads as follows:
9393 A. This act shall be known and may be cited as the “Paid Family
9494 Leave Act”.

146146 B. The Legislature finds the following:
147147 1. It is in the public benefit to provide family temporary
148148 disability insurance benefits to workers to care for their family
149149 members. The need for family temporary disability insurance
150150 benefits has intensified as the participation o f both parents in the
151151 workforce has increased, and the number of single parents in the
152152 workforce has grown. The need for partial wage replacement for
153153 workers taking family care leave will be exacerbated as the
154154 population of those needing care, both childr en and parents of
155155 workers, increases in relation to the number of working -age adults;
156156 2. Developing systems that help families adapt to the competing
157157 interests of work and home not only benefits workers, but also
158158 benefits employers by increasing worker pr oductivity and reducin g
159159 employee turnover;
160160 3. The majority of workers in this state are un able to take
161161 family care leave because they are unable to afford leave without
162162 pay. When workers do not receive some form of wage replacement
163163 during family care lea ve, families suffer from the worker ’s loss of
164164 income, increasing the demand on the state un employment insurance
165165 system and dependenc e on the state’s welfare system; and
166166 4. It is the intent of the Legislature to create a family
167167 temporary disability insuran ce program to help reconcile the demands
168168 of work and family. The family temporary disabili ty insurance
169169 program shall be established by the Department of Labor and shall be

222222 administered in accordance wit h the policies of the state disa bility
223223 insurance program created pursuant to this a ct. Initial and ongoing
224224 administrative costs associated with the family temporary disability
225225 insurance program shall be payable from the Disability Trust Fund.
226226 SECTION 2. NEW LAW A new section of law to be codified
227227 in the Oklahoma Statutes as Section 902 of Title 40, unless there is
228228 created a duplication in numbering, reads as follows:
229229 A. The Department of Labor shall establish a family temporary
230230 disability insurance program. Family temporary disability insurance
231231 shall provide up to six (6) weeks of wage replacement benefits to
232232 workers who take time off work to care for a seriously ill child,
233233 spouse, parent, grandparent, grandchild, sibling or domestic
234234 partner, or to bond with a mi nor child within one year of the birth
235235 or placement of the child in connection with foster care or
236236 adoption.
237237 B. An individual shall be eligible to receive family temporary
238238 disability insurance benefits equal to sixty -five percent (65%) of
239239 his or her weekly wage amount for each full day during which he or
240240 she is unable to work due to caring for a seriously ill or injured
241241 family member or bonding with a minor child within one year of the
242242 birth or placement of the child in con nection with foster care or
243243 adoption.

295295 C. The maximum amount payable to an individua l during any
296296 disability benefit period for family temporary disability insurance
297297 shall be six (6) times his or her weekly benefit amount, but in no
298298 case shall the total amo unt of benefits payable be more t han the
299299 total wages paid to the individual during h is or her disability base
300300 period. If the benefit is not a multiple of One Dollar ($1.00), it
301301 shall be computed to the next higher multiple of One Dollar ($1.00).
302302 D. No more than six (6) weeks of family temporary disability
303303 insurance benefits shall be pai d within any twelve-month period.
304304 E. An individual shall file a claim for family temporary
305305 disability insurance benefits not later than the forty -first
306306 consecutive day following the first compensable day with respect to
307307 which the claim is made for benefit s, which time shall be extended
308308 by the Department upon a showing of good cause. If a first claim is
309309 not complete, the claim form shall be returned to the claimant for
310310 completion and it shall be completed and returned not later than the
311311 tenth consecutive day after the date it was mailed by the Department
312312 to the claimant, except that such time shall be extended by the
313313 Department upon a showing of good cause.

369369 1. “Care recipient” means the family member who is receiving
370370 care for a serious health condition or the new child wi th whom the
371371 care provider is bonding;
372372 2. “Care provider” means the family member who is providing the
373373 required care for a serious health condition or the family member
374374 who is bonding with the new child;
375375 3. “Child” means a biological, adopted or foster son or
376376 daughter, a stepson or stepdaughter, a legal ward, a son or daughter
377377 of a domestic partner or the person to whom the employee stands in
378378 loco parentis;
379379 4. “Department” means the “Department of Labor”;
380380 5. “Family care leave” means any of the following :
381381 a. leave to bond with a minor child within the first year
382382 of the child’s birth or placement in connection with
383383 foster care or adoption, or
384384 b. leave to care for a child, parent, grandparent,
385385 grandchild, sibling, spouse or domestic partner who
386386 has a serious health condition;
387387 6. “Family member” means child, parent, grandparent,
388388 grandchild, sibling, spouse or domestic partner as defined in this
389389 section;
390390 7. “Grandchild” means a child of the employee ’s child;
391391 8. “Grandparent” means a parent of the employee ’s parent;

443443 9. “Parent” means a biological, foster or adoptive parent, a
444444 parent-in-law, a stepparent, a legal guardian or other person who
445445 stood in loco parentis to the employee when the employee was a
446446 child;
447447 10. “Parent-in-law” means the parent of a spouse or a domestic
448448 partner;
449449 11. “Serious health condition ” means an illness, injury,
450450 impairment, or physical or mental condition that involves inpatient
451451 care in a hospital, hospice or residential health care facility, or
452452 continuing treatment or continuing sup ervision by a health care
453453 provider;
454454 12. “Sibling” means a person related to another person by
455455 blood, adoption or affinity through a co mmon biological or legal
456456 parent;
457457 13. “Spouse” means a partner to a lawful marriage;
458458 14. “Valid claim” means any claim for family temporary
459459 disability insurance benefits made in accordance with the provisions
460460 of this code, and any rules and regulations adopted thereunder, if
461461 the individual claiming benefits is unemployed a nd has been paid the
462462 necessary wages in employment f or employers to qualify for benefits
463463 and is caring for a seriously ill family member, or bonding with a
464464 minor child during the first year after the birth or placeme nt of
465465 the child in connecti on with foster care or adoption; and

517517 15. “Twelve-month period,” with respect to any individual,
518518 means the three hundred sixty-five (365) consecutive days that begin
519519 with the first day the individual first establishes a valid cla im
520520 for family temporary disability benef its.
521521 SECTION 4. NEW LAW A ne w section of law to be codified
522522 in the Oklahoma Statutes as Section 904 of Title 40, unless there is
523523 created a duplication in numbering, reads as follows:
524524 A. “Disability benefit period ” with respect to any individual
525525 means the period of unemployment begin ning with the first day an
526526 individual establishes a valid claim for family temporary disability
527527 insurance benefits to care fo r a seriously ill family member or to
528528 bond with a minor child during the first year after the birth or
529529 placement of the child in co nnection with foster care or adoption.
530530 B. Periods of family care leave for the same care recipient
531531 within a twelve-month period shall be considered one disability
532532 benefit period.
533533 C. Periods of disability for pregnancy and periods of family
534534 care leave for bonding associated with the birth of that child shall
535535 be considered one disability benefit period.
536536 SECTION 5. NEW LAW A new section of law to be codified
537537 in the Oklahoma Statutes as Section 905 of Title 40, unless there is
538538 created a duplication in numbering, reads as follows:
539539 An individual shall be deemed eligible for family temporary
540540 disability insurance benefits equal to sixty -five percent (65%) of

592592 his or her weekly benefit amoun t on any day in which he or she is
593593 unable to perform his or her regular or customary work because he or
594594 she is bonding with a minor child during the first year after the
595595 birth or placement of the child in connection with foster care or
596596 adoption or caring f or a seriously ill child, parent, grandparent,
597597 grandchild, sibling, spouse or domestic partner, only if the
598598 Department of Labor finds all of the following:
599599 1. The individual has made a claim for temporary disabilit y
600600 benefits as required by authorized reg ulations; and
601601 2. The individual has been unable to p erform his or her regular
602602 or customary work for a seven -day waiting period during each
603603 disability benefit period, with respect to which waiting period no
604604 family temporary disability insurance benefits ar e payable; and
605605 3. The individual has filed a certifi cate pursuant to
606606 subsection B of Section 11 of this act .
607607 SECTION 6. NEW LAW A new section of law to be codified
608608 in the Oklahoma Statutes as Section 906 of Title 40, unless there i s
609609 created a duplication in numbering, reads as follow s:
610610 A. An individual shall not be eligible for family temporary
611611 disability insurance benefits with respect to any day that any of
612612 the following apply:
613613 1. The individual has received, or is entitled to r eceive,
614614 unemployment compensation benefits or is under an unemployment
615615 compensation act of any other state or of the federal government; or

667667 2. Another family member is ready, willing, able and available
668668 to provide care for the same period of time in a day that the
669669 individual is providing the required care.
670670 B. An individual who is entitled to leave under the Family and
671671 Medical Leave Act of 1993 must take family temporary disability
672672 insurance leave concurrent with leave taken und er the Family and
673673 Medical Leave Act of 1993.
674674 C. As a condition of an employee’s initial receipt of family
675675 temporary disability insurance benefits during any twelve -month
676676 period in which an employee is eligible for these benefits, an
677677 employer may require an employee t o take up to two (2) weeks of
678678 earned but unused vacation leave prior to the employee’s initial
679679 receipt of these benefits. If an employer requires an employee to
680680 take vacation leave, that portion of the vacation leave that does
681681 not exceed one (1) week shall be applied to the waiting period
682682 required pursuant to section 5 of this act.
683683 SECTION 7. NEW LAW A new section of law to be codified
684684 in the Oklahoma Statutes as Section 907 of Title 40, unless there is
685685 created a duplication in numb ering, reads as follows:
686686 If the Department of Labor finds that any individual falsely
687687 certifies the medical condition of any person in order to obtain
688688 family temporary disability insurance benefits, with the intent to
689689 defraud, whether for the maker or for any other person, the
690690 Department shall assess a penalty against the individual for the

743743 result of the false certification. In addition, the employee shall
744744 be liable to the Department for a ny benefits paid as a result of the
745745 false certification. Penalties collected under this section sh all
746746 be deposited in the Disability Trust Fund.
747747 SECTION 8. NEW LAW A new section of law to be codified
748748 in the Oklahoma Statutes as Sec tion 908 of Title 40, unless there is
749749 created a duplication in numbering, reads as follows:
750750 A. The Department of Labor may request additional medical
751751 evidence to supplement the first or any continued claim if the
752752 additional evidence can be procured withou t additional cost to the
753753 care recipient. The Department may require that the additional
754754 evidence include any or all of the following information:
755755 1. Identification of diagnoses;
756756 2. Identification of symptoms; and
757757 3. A statement setting forth the facts of the care recipient’s
758758 serious health condition that warrants the participation of the
759759 employee. The statement shall be completed and signed by any of the
760760 following:
761761 a. the physician or practitio ner treating the care
762762 recipient,
763763 b. the registrar, authoriz ed medical officer or other
764764 duly authorized official of the hospital or health
765765 facility treating the care recipient, or

818818 Department.
819819 B. The Department may require the care recipient to submit to
820820 reasonable examinations for the purpose of determining all the
821821 following:
822822 1. Whether a serious health condition exists;
823823 2. Whether a care provid er’s participation is warranted; and
824824 3. The period of time that the care provider ’s participation is
825825 warranted.
826826 SECTION 9. NEW LAW A new section of law to be codified
827827 in the Oklahoma Statutes as Section 909 of Title 40, unless there is
828828 created a duplication in numbering, reads as follows:
829829 The Department shall issue the initial payment for family
830830 temporary disability insurance benefits to a monetarily eligible
831831 claimant who is otherwise d etermined eligible by the department
832832 under applicable law and regulation within fourteen (14) days after
833833 receipt of his or her properly completed disability claim.
834834 SECTION 10. NEW LAW A new section of law to be codified
835835 in the Oklahoma Statutes as Section 910 of Title 40, unless there is
836836 created a duplication in numbering, reads as follows:
837837 Claims for disability benefits shall be made in accordance with
838838 promulgated rules of the Department of Labor. Each employer shall
839839 post and maintain in places readily accessible to individuals in his
840840 or her service printed statements concerning such regulations and

893893 statements, regulations or matters relating to claims for disability
894894 benefits as the Department may prescribe. Such printed statements
895895 shall be supplied to each employer by the Department without cost to
896896 the employer.
897897 SECTION 11. NEW LAW A new section of law to be codified
898898 in the Oklahoma Statutes a s Section 911 of Title 40, unless there is
899899 created a duplication in numbering, reads as follows:
900900 A. In accordance with the rules promulgated by the Departme nt
901901 of Labor, a claimant shall establish medical eligibility for each
902902 uninterrupted period of disabi lity by filing a first claim for
903903 disability benefits supported by the certificate of a treating
904904 physician or practitioner that establishes the sickness, inju ry or
905905 pregnancy of the employee, or the condition of the family member
906906 that warrants the care of t he employee.
907907 B. An employee shall be required to file a certificate to
908908 establish eligibility when taking leave to care for a family member
909909 with a serious health condition. The certificate shall be developed
910910 by the department. In order to establish medic al eligibility of the
911911 serious health condition of the family member that warrants the care
912912 of the employee, the information shall be within the physician ’s or
913913 practitioner’s knowledge and shall be based on a physical
914914 examination and documented medical hist ory of the family member and
915915 shall contain all of the following:

967967 1. A diagnosis and diagnostic code prescribed in the
968968 International Classification of Diseas es, or, if no diagnosis has
969969 yet been obtained, a detailed statement of symptoms;
970970 2. The date, if known, on which the condition commenced;
971971 3. The probable duration of the condition;
972972 4. An estimate of the amount of time that the physician or
973973 practitioner believes the employee n eeds to care for the child,
974974 parent, grandparent, grandchild, sibling, spouse or domestic
975975 partner; and
976976 5. A statement that the serious health condition warrants the
977977 participation of the employee to provide care for his or her child,
978978 parent, grandparent, gr andchild, sibling, spouse or domestic
979979 partner. “Warrants the participatio n of the employee” includes, but
980980 is not limited to, providing psychologica l comfort, and arranging
981981 “third-party” care for the child, parent, grandparent, gra ndchild,
982982 sibling, spouse or domestic partner, as well as directly providing,
983983 or participating in, the medical care.
984984 C. The Department shall develop a certification form for
985985 bonding that is separate and distinct from the certificate required
986986 in subsection A of this section for an employee taking leave to bond
987987 with a minor child within the first year of the child’s birth or
988988 placement in connection with foster care or adoption.
989989 D. The first and any continuing claim of an individual who
990990 obtains care and trea tment outside this state s hall be supported by

10431043 or certified by the state or foreign country in which the claimant
10441044 is receiving the care and treatment. If a physician or practitioner
10451045 licensed by and practicing in a foreign country is under
10461046 investigation by the Department for filing fals e claims and the
10471047 Department does not have legal remedies to conduct a criminal
10481048 investigation or prosecution in that country, the D epartment may
10491049 suspend the processing of all further c ertifications until the
10501050 physician or practitioner fully cooperates, and c ontinues to
10511051 cooperate, with the investigation. A physician or practitioner
10521052 licensed by, and practicing in, a foreign country who has been
10531053 convicted of filing false claims with the D epartment may not file a
10541054 certificate in support of a claim for disability benefits for a
10551055 period of five (5) years.
10561056 SECTION 12. NEW LAW A new section of law to be codified
10571057 in the Oklahoma Statutes as Section 9 12 of Title 40, unless the re is
10581058 created a duplication in numbering, reads as follows:
10591059 All medical records of the Department obtained pursuant to the
10601060 Paid Family Leave Act, except to the extent necessary for the proper
10611061 administration of this act, or as prov ided elsewhere in law shal l be
10621062 confidential and shall not be published or be open to public
10631063 inspection in any manner revealing the identity of the claimant or
10641064 family member, or the nature or cause of his or her disability.

11161116 SECTION 13. NEW LAW A new section of law to be codified
11171117 in the Oklahoma Statutes as Section 913 of Title 40, unless there is
11181118 created a duplication in numbering, reads as follows:
11191119 A. Each worker shall pay worker contributions at the rate
11201120 determined by the Department of Labor. On or before October 31 of
11211121 each calendar year, the Department shall prepare a statement , which
11221122 shall be a public record, declaring the rate of worker contributions
11231123 for the calendar year and shall notify promptly all employers of
11241124 employees covered for family temporary di sability insurance.
11251125 B. The rate of worker contributions shall be established by the
11261126 Department.
11271127 C. There is created in the State Treasury a revolving fund for
11281128 the Department of Labor to be designated as the “Disability Trust
11291129 Fund”. The fund shall be a c ontinuing fund, not subject to fiscal
11301130 year limitations, and shall consist of all contributions, penalties,
11311131 and interest provided for in this act. All monies accruing to the
11321132 credit of the fund are hereby appropriated and may be bu dgeted and
11331133 expended by the Department of Labor to perform duties as prescribed
11341134 by this act. Expenditures from the fund shall be made upon warrants
11351135 issued by the State Treasurer against claims filed as prescribed by
11361136 law with the Department of Labor for approval and payment. All
11371137 benefits provided for in this act shall be payable from the fund.
11381138 All benefits shall be paid in accordance with the rules as the
11391139 Department of Labor may prescribe.
