5150 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5251 SECTION 1. AMENDATORY Section 6, Chapter 11, O.S.L.
5352 2019, as amended by Section 7, Chapter 477, O.S.L. 2019 (63 O.S.
5453 Supp. 2020, Section 427.6), is amended to read as follows:
5554 Section 427.6. A. The State Department of Health shall address
5655 issues related to the medical marijuana program in Oklahoma this
5756 state including, but not limited to, monitoring and disciplinary
5857 actions as they relate to the medical marijuana program.
5958 B. 1. The Department or it s designee may perform on-site
6059 assessments of a licensee or applicant for any medical marijuana
6160 business license issued pursuant to this act the Oklahoma Medical
6261 Marijuana and Patient Protection Act to determine compliance with
62+this act or submissions made pursuant to this section. The

90-this act or submissions made pursuant to this section. The
9189 Department may enter the licensed premises of a medical marijuana
9290 business licensee or applicant to assess or monitor compliance.
9391 2. Inspections shall be limited to twice per calendar year and
9492 twenty-four (24) hours of noti ce shall be provided to a medical
9593 marijuana business applicant or licensee prior to an o n-site
9694 assessment. However, additional inspections may occur when the
9795 Department shows that an additional inspection is necessary due to a
9896 violation of this act the Oklahoma Medical Marijuana and Patient
9997 Protection Act. Such inspection may be without notice if the
10098 Department believes that such notice will resul t in the destruction
10199 of evidence.
102100 3. The Department may review relevant records of a licensed
103101 medical marijuana business, licensed medical marijuana rese arch
104102 facility or licensed medical marijuana education facility, and may
105103 require and conduct interviews with such persons or entities and
106104 persons affiliated with such entities, for the pu rpose of
107105 determining compliance with Department requirements and appli cable
108106 laws. However, prior to conducting any interviews with the medical
109107 marijuana business, research facility or education facility, the
110108 licensee shall be afforded sufficient time to s ecure legal
111109 representation during such questioning if requested by the business
112110 or facility or any of its agents or employees or contractors.

140137 4. The Department shall refer complaints alleging criminal
141138 activity that are made against a licensee to appropria te Oklahoma
142139 state or local law enforcement authorities.
143140 C. Disciplinary action may be taken against an applicant or
144141 licensee under this act the Oklahoma Medical Marijuana and Patient
145142 Protection Act for not adhering to the law pur suant to the terms,
146143 conditions and guidelines set fo rth in this act.
147144 D. Disciplinary actions may include revocation, suspension or
148145 denial of an application, license or final aut horization and other
149146 action deemed appropriate by the Department.
150147 E. Disciplinary actions may be imposed upon a medical marijuana
151148 business licensee for:
152149 1. Failure to comply with or satisfy any provision of this
153150 section;
154151 2. Falsification or misrepresent ation of any material or
155152 information submitted to the Department;
156153 3. Failing to allow or impeding a monitoring visit by
157154 authorized representatives of the Department;
158155 4. Failure to adhere to any acknowledgement, verification or
159156 other representation made t o the Department;
160157 5. Failure to submit or disclose information required by th is
161158 section or otherwise requested by the Department;
162159 6. Failure to correct any violation of this section cited as a
163160 result of a review or audit of financial records or other mat erials;

191187 7. Failure to comply with requested access by the Department to
192188 the licensed premises or materials;
193189 8. Failure to pay a required monetary penalty;
194190 9. Diversion of medical marijuana or any medical marijuana
195191 product, as determined by the Departmen t;
196192 10. Threatening or harming a patient, a medical practitioner or
197193 an employee of the Department; and
198194 11. Any other basis indica ting a violation of the applicable
199195 laws and regulations as identified by the Department.
200196 F. Disciplinary actions against a li censee may include the
201197 imposition of monetary penalties, which may be assessed by the
202198 Department.
203199 G. Penalties In addition to any other penalties provided by
204200 law, penalties for sales by a medical marijuana business to persons
205201 other than those allowed b y law occurring within any two -year time
206202 period may include an ini tial administrative fine of One Thousand
207203 Dollars ($1,000.00) for a first violation and a an administrative
208204 fine of Five Thousand Dollars ($5,000.00) for any subsequent
209205 violation. The medical marijuana busine ss may be subject to a
210206 revocation of any license granted pursua nt to this act the Oklahoma
211207 Medical Marijuana and Pa tient Protection Act upon a showing that the
212208 violation was willful or grossly negligent.
213209 H. 1. First In addition to any other penalties provided under
214210 the Uniform Controlled Dan gerous Substance Act , a first offense for

242237 intentional and impermissible diver sion of medical marijuana,
243238 concentrate, or products by a patient or caregiver to an
244239 unauthorized person shall not be punished unde r a criminal statute
245240 but may be subject to a an administrative fine of Two Hundred
246241 Dollars ($200.00).
247242 2. The In addition to any other penalties provided under the
248243 Uniform Controlled Dangerous Substance Act, the second offense for
249244 impermissible diversion of medical marijuana, concentrate, or
250245 products by a patient or caregiv er to an unauthorized person shall
251246 not be punished under a criminal statute but may be subject to a an
252247 administrative fine of not to exceed Five Hu ndred Dollars ($500.00)
253248 and may result in revocation of the license upon a showing that the
254249 violation was willful or grossly negligent.
255250 I. The following persons or e ntities may request a hearing to
256251 contest an action or proposed action of the Department:
257252 1. A medical marijuana business, research facility or education
258253 facility licensee whose license has been summ arily suspended or who
259254 has received a notice of contempla ted action to suspend or revoke a
260255 license or take other disciplinary action; and
261256 2. A patient or caregiver licensee whose license has been
262257 summarily suspended or who has received notice of contempla ted
263258 action to suspend or revoke a license or take other d isciplinary

292286 J. All hearings held pu rsuant to this section shall be in
293287 accordance with the Oklahoma Administrative Procedures Act, Section
294288 250 et seq. of Title 75 of the Oklahoma Statutes.
295289 SECTION 2. This act shall become effective November 1, 2021.
