51 | 50 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

52 | 51 | | SECTION 1. AMENDATORY Section 6, Chapter 11, O.S.L. |
---|

54 | 53 | | Supp. 2020, Section 427.6), is amended to read as follows: |

55 | 54 | | Section 427.6. A. The State Department of Health shall address |
---|
56 | 55 | | issues related to the medical marijuana program in Oklahoma this |
---|
57 | 56 | | state including, but not limited to, monitoring and disciplinary |
---|
58 | 57 | | actions as they relate to the medical marijuana program. |
---|
59 | 58 | | B. 1. The Department or it s designee may perform on-site |
---|
60 | 59 | | assessments of a licensee or applicant for any medical marijuana |
---|
61 | 60 | | business license issued pursuant to this act the Oklahoma Medical |
---|
62 | 61 | | Marijuana and Patient Protection Act to determine compliance with |
---|
91 | 89 | | Department may enter the licensed premises of a medical marijuana |
---|
92 | 90 | | business licensee or applicant to assess or monitor compliance. |
---|
93 | 91 | | 2. Inspections shall be limited to twice per calendar year and |
---|
94 | 92 | | twenty-four (24) hours of noti ce shall be provided to a medical |
---|
95 | 93 | | marijuana business applicant or licensee prior to an o n-site |
---|
96 | 94 | | assessment. However, additional inspections may occur when the |
---|
97 | 95 | | Department shows that an additional inspection is necessary due to a |
---|
98 | 96 | | violation of this act the Oklahoma Medical Marijuana and Patient |
---|
99 | 97 | | Protection Act. Such inspection may be without notice if the |
---|
100 | 98 | | Department believes that such notice will resul t in the destruction |
---|
101 | 99 | | of evidence. |

102 | 100 | | 3. The Department may review relevant records of a licensed |
---|
103 | 101 | | medical marijuana business, licensed medical marijuana rese arch |
---|
104 | 102 | | facility or licensed medical marijuana education facility, and may |
---|
105 | 103 | | require and conduct interviews with such persons or entities and |
---|
106 | 104 | | persons affiliated with such entities, for the pu rpose of |
---|
107 | 105 | | determining compliance with Department requirements and appli cable |
---|
108 | 106 | | laws. However, prior to conducting any interviews with the medical |
---|
109 | 107 | | marijuana business, research facility or education facility, the |
---|
110 | 108 | | licensee shall be afforded sufficient time to s ecure legal |
---|
111 | 109 | | representation during such questioning if requested by the business |
---|
112 | 110 | | or facility or any of its agents or employees or contractors. |

147 | 144 | | D. Disciplinary actions may include revocation, suspension or |
---|
148 | 145 | | denial of an application, license or final aut horization and other |
---|
149 | 146 | | action deemed appropriate by the Department. |
---|
150 | 147 | | E. Disciplinary actions may be imposed upon a medical marijuana |
---|
151 | 148 | | business licensee for: |
---|
152 | 149 | | 1. Failure to comply with or satisfy any provision of this |
---|
153 | 150 | | section; |
---|
154 | 151 | | 2. Falsification or misrepresent ation of any material or |
---|
155 | 152 | | information submitted to the Department; |
---|
156 | 153 | | 3. Failing to allow or impeding a monitoring visit by |
---|
157 | 154 | | authorized representatives of the Department; |
---|
158 | 155 | | 4. Failure to adhere to any acknowledgement, verification or |
---|
159 | 156 | | other representation made t o the Department; |
---|
160 | 157 | | 5. Failure to submit or disclose information required by th is |
---|
161 | 158 | | section or otherwise requested by the Department; |
---|
162 | 159 | | 6. Failure to correct any violation of this section cited as a |
---|

203 | 199 | | G. Penalties In addition to any other penalties provided by |
---|
204 | 200 | | law, penalties for sales by a medical marijuana business to persons |
---|
205 | 201 | | other than those allowed b y law occurring within any two -year time |
---|
206 | 202 | | period may include an ini tial administrative fine of One Thousand |
---|
207 | 203 | | Dollars ($1,000.00) for a first violation and a an administrative |
---|
208 | 204 | | fine of Five Thousand Dollars ($5,000.00) for any subsequent |
---|
209 | 205 | | violation. The medical marijuana busine ss may be subject to a |

252 | 247 | | administrative fine of not to exceed Five Hu ndred Dollars ($500.00) |
---|
253 | 248 | | and may result in revocation of the license upon a showing that the |
---|
254 | 249 | | violation was willful or grossly negligent. |
---|
255 | 250 | | I. The following persons or e ntities may request a hearing to |
---|
256 | 251 | | contest an action or proposed action of the Department: |
---|
257 | 252 | | 1. A medical marijuana business, research facility or education |
---|
258 | 253 | | facility licensee whose license has been summ arily suspended or who |
---|
259 | 254 | | has received a notice of contempla ted action to suspend or revoke a |
---|
260 | 255 | | license or take other disciplinary action; and |
---|
261 | 256 | | 2. A patient or caregiver licensee whose license has been |
---|
262 | 257 | | summarily suspended or who has received notice of contempla ted |
---|
263 | 258 | | action to suspend or revoke a license or take other d isciplinary |
---|
264 | 259 | | action. |
