7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.5 , as
8181 last amended by Section 1, Chapt er 202, O.S.L. 2017 (51 O.S. Supp.
8282 2020, Section 24A.5), is amended to read as follows:
8383 Section 24A.5. All records of public bodie s and public
8484 officials shall be open to any person for inspe ction, copying, or
8585 mechanical reproduction during regular busines s hours; provided:
8686 1. The Oklahoma Open Records Act, Sections 24A.1 through 24A.30
8787 of this title, does not apply to records specif ically required by
8888 law to be kept confidential including:

141141 such as the attorney-client privilege, the work
142142 product immunity from discovery and the identity of
143143 informer privileges,
144144 b. records of what tran spired during meetings of a public
145145 body lawfully closed to t he public such as executive
146146 sessions authorized under the Oklahom a Open Meeting
147147 Act,
148148 c. personal information within driver records as defined
149149 by the Driver’s Privacy Protection Act, 18 United
150150 States Code, Sections 2721 through 2725,
151151 d. information in the f iles of the Board of Medicolegal
152152 Investigations obtained pursuant to Sections 940 and
153153 941 of Title 63 of the Oklahoma Statutes that may be
154154 hearsay, preliminary unsubstantiated investigation -
155155 related findings, or confidential medical information,
156156 or
157157 e. any test forms, question banks and answe r keys
158158 developed for state lic ensure examinations, but
159159 specifically excluding test preparation materials or
160160 study guides;
161161 2. All Social Security numbers include d in a record may be
162162 confidential regardless of the person ’s status as a public employee

215215 release of the record by the public body;
216216 3. Any reasonably segregable portion of a record containing
217217 exempt material shall be provided after deletion of the exempt
218218 portions; provided, however, the Department of Public Safety shal l
219219 not be required to assemble for the requesting person specific
220220 information, in any format , from driving records relating to any
221221 person whose name and date of birth or whose driver license n umber
222222 is not furnished by the reque sting person.
223223 The Oklahoma State Bureau of Investigation shall not be required
224224 to assemble for the requesting person any criminal history records
225225 relating to persons whose names, dates of birth , and other
226226 identifying information required by the Oklahoma St ate Bureau of
227227 Investigation pursuant to administrative rule are not furnished by
228228 the requesting person;
229229 4. Any request for a record which contains individual re cords
230230 of persons, and the cost of copying, reproducing or ce rtifying each
231231 individual record is otherwise prescribed by state law, the cost may
232232 be assessed for each individual record , or portion thereof requested
233233 as prescribed by state law. Otherwise, a pu blic body may charge a
234234 fee only for recovery of the reasonab le, direct costs of record
235235 copying, or mechanical reproduction. Notwithstanding any state or
236236 local provision to the contrary, in no instance shall the record
237237 copying fee exceed twenty -five cents ($0.25) per page for records

289289 having the dimensions of eight and one-half (8 1/2) by fourteen (1 4)
290290 inches or smaller, or a max imum of One Dollar ($1.00) per copied
291291 page for a certified copy. However, if the request:
292292 a. is solely for commercial purpose, or
293293 b. would clearly cause excessive disruption of the
294294 essential functions of the public body,
295295 then the public body may charge a reasonable fee to recover the
296296 direct cost of record search and copying; however, publication in a
297297 newspaper or broadcast by news me dia for news purposes shall not
298298 constitute a resale or use o f a record for trade or commercial
299299 purpose and charges for provid ing copies of electronic data to the
300300 news media for a news purpose shall not exceed the direct cost of
301301 making the copy. The fee ch arged by the Department of Public Safety
302302 for a copy in a computerized format of a record of the Department
303303 shall not exceed the direct cost of making the copy unless the fee
304304 for the record is otherwise set by law.
305305 Any public body establishing fees under this act the Oklahoma
306306 Open Records Act shall post a written sc hedule of the fees at its
307307 principal office and with the county cl erk.
308308 In no case shall a search fee be charged when the release of
309309 records is in the public interest , including, but not limited to,
310310 release to the news media, sc holars, authors and taxpayers seeking
311311 to determine whether those entrusted with the affairs of the

363363 government are honestly, faithfully, and competently performing
364364 their duties as public servants.
365365 The fees shall not be used for the purpose of discouraging
366366 requests for information or as obstacles to disclosure of requeste d
367367 information;
368368 5. The land description tract index of all recorded instruments
369369 concerning real property required to be kept by the county clerk of
370370 any county shall be available for inspectio n or copying in
371371 accordance with the provisions of the Oklahoma Op en Records Act;
372372 provided, however, the index shall n ot be copied or mechanically
373373 reproduced for the purpose of sale of the information;
374374 6. A public body must provide prompt, reasonable acces s to its
375375 records but may estab lish reasonable procedures which pr otect the
376376 integrity and organi zation of its records and to prevent excessive
377377 disruptions of its essential functions. A delay in providing access
378378 to records shall be limited solely to the tim e required for
379379 preparing the requested documents and the avoidanc e of excessive
380380 disruptions of the public body’s essential functions. In no event
381381 may production of a current request for records be unreasonably
382382 delayed until after completion of a prior rec ords request that will
383383 take substantially longer than the current request. Any public body
384384 which makes the requested records available on the Internet shall
385385 meet the obligation of providing prompt, reasonable access to its
386386 records as required by this para graph; and

438438 7. A public body shall designate certain persons who are
439439 authorized to release reco rds of the public body for inspection,
440440 copying, or mechanical reproduction. At least one person shall be
441441 available at all times to release records during the re gular
442442 business hours of the pu blic body; and
443443 8. Upon request, any record of a public body that is excepted
444444 from confidentiality pursuant to this act and stored electronically
445445 shall be provided electronically ; provided, a public body shall not
446446 be required to convert a record that is maintained in a
447447 nonelectronic format into an electronic format for the purpose of
448448 this act.
449449 SECTION 2. This act shall become effective November 1, 2021.
