79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 51 O.S. 2011, Section 24A.5 , as
81	81	last amended by Section 1, Chapt er 202, O.S.L. 2017 (51 O.S. Supp.
82	82	2020, Section 24A.5), is amended to read as follows:
83	83	Section 24A.5. All records of public bodie s and public
84	84	officials shall be open to any person for inspe ction, copying, or
85	85	mechanical reproduction during regular busines s hours; provided:
86	86	1. The Oklahoma Open Records Act, Sections 24A.1 through 24A.30
87	87	of this title, does not apply to records specif ically required by
88	88	law to be kept confidential including:

141	141	such as the attorney-client privilege, the work
142	142	product immunity from discovery and the identity of
143	143	informer privileges,
144	144	b. records of what tran spired during meetings of a public
145	145	body lawfully closed to t he public such as executive
146	146	sessions authorized under the Oklahom a Open Meeting
147	147	Act,
148	148	c. personal information within driver records as defined
149	149	by the Driver’s Privacy Protection Act, 18 United
150	150	States Code, Sections 2721 through 2725,
151	151	d. information in the f iles of the Board of Medicolegal
152	152	Investigations obtained pursuant to Sections 940 and
153	153	941 of Title 63 of the Oklahoma Statutes that may be
154	154	hearsay, preliminary unsubstantiated investigation -
155	155	related findings, or confidential medical information,
156	156	or
157	157	e. any test forms, question banks and answe r keys
158	158	developed for state lic ensure examinations, but
159	159	specifically excluding test preparation materials or
160	160	study guides;
161	161	2. All Social Security numbers include d in a record may be
162	162	confidential regardless of the person ’s status as a public employee

215	215	release of the record by the public body;
216	216	3. Any reasonably segregable portion of a record containing
217	217	exempt material shall be provided after deletion of the exempt
218	218	portions; provided, however, the Department of Public Safety shal l
219	219	not be required to assemble for the requesting person specific
220	220	information, in any format , from driving records relating to any
221	221	person whose name and date of birth or whose driver license n umber
222	222	is not furnished by the reque sting person.
223	223	The Oklahoma State Bureau of Investigation shall not be required
224	224	to assemble for the requesting person any criminal history records
225	225	relating to persons whose names, dates of birth , and other
226	226	identifying information required by the Oklahoma St ate Bureau of
227	227	Investigation pursuant to administrative rule are not furnished by
228	228	the requesting person;
229	229	4. Any request for a record which contains individual re cords
230	230	of persons, and the cost of copying, reproducing or ce rtifying each
231	231	individual record is otherwise prescribed by state law, the cost may
232	232	be assessed for each individual record , or portion thereof requested
233	233	as prescribed by state law. Otherwise, a pu blic body may charge a
234	234	fee only for recovery of the reasonab le, direct costs of record
235	235	copying, or mechanical reproduction. Notwithstanding any state or
236	236	local provision to the contrary, in no instance shall the record
237	237	copying fee exceed twenty -five cents ($0.25) per page for records

289	289	having the dimensions of eight and one-half (8 1/2) by fourteen (1 4)
290	290	inches or smaller, or a max imum of One Dollar ($1.00) per copied
291	291	page for a certified copy. However, if the request:
292	292	a. is solely for commercial purpose, or
293	293	b. would clearly cause excessive disruption of the
294	294	essential functions of the public body,
295	295	then the public body may charge a reasonable fee to recover the
296	296	direct cost of record search and copying; however, publication in a
297	297	newspaper or broadcast by news me dia for news purposes shall not
298	298	constitute a resale or use o f a record for trade or commercial
299	299	purpose and charges for provid ing copies of electronic data to the
300	300	news media for a news purpose shall not exceed the direct cost of
301	301	making the copy. The fee ch arged by the Department of Public Safety
302	302	for a copy in a computerized format of a record of the Department
303	303	shall not exceed the direct cost of making the copy unless the fee
304	304	for the record is otherwise set by law.
305	305	Any public body establishing fees under this act the Oklahoma
306	306	Open Records Act shall post a written sc hedule of the fees at its
307	307	principal office and with the county cl erk.
308	308	In no case shall a search fee be charged when the release of
309	309	records is in the public interest , including, but not limited to,
310	310	release to the news media, sc holars, authors and taxpayers seeking
311	311	to determine whether those entrusted with the affairs of the

363	363	government are honestly, faithfully, and competently performing
364	364	their duties as public servants.
365	365	The fees shall not be used for the purpose of discouraging
366	366	requests for information or as obstacles to disclosure of requeste d
367	367	information;
368	368	5. The land description tract index of all recorded instruments
369	369	concerning real property required to be kept by the county clerk of
370	370	any county shall be available for inspectio n or copying in
371	371	accordance with the provisions of the Oklahoma Op en Records Act;
372	372	provided, however, the index shall n ot be copied or mechanically
373	373	reproduced for the purpose of sale of the information;
374	374	6. A public body must provide prompt, reasonable acces s to its
375	375	records but may estab lish reasonable procedures which pr otect the
376	376	integrity and organi zation of its records and to prevent excessive
377	377	disruptions of its essential functions. A delay in providing access
378	378	to records shall be limited solely to the tim e required for
379	379	preparing the requested documents and the avoidanc e of excessive
380	380	disruptions of the public body’s essential functions. In no event
381	381	may production of a current request for records be unreasonably
382	382	delayed until after completion of a prior rec ords request that will
383	383	take substantially longer than the current request. Any public body
384	384	which makes the requested records available on the Internet shall
385	385	meet the obligation of providing prompt, reasonable access to its
386	386	records as required by this para graph; and

438	438	7. A public body shall designate certain persons who are
439	439	authorized to release reco rds of the public body for inspection,
440	440	copying, or mechanical reproduction. At least one person shall be
441	441	available at all times to release records during the re gular
442	442	business hours of the pu blic body; and
443	443	8. Upon request, any record of a public body that is excepted
444	444	from confidentiality pursuant to this act and stored electronically
445	445	shall be provided electronically ; provided, a public body shall not
446	446	be required to convert a record that is maintained in a
447	447	nonelectronic format into an electronic format for the purpose of
448	448	this act.
449	449	SECTION 2. This act shall become effective November 1, 2021.
