55	79		BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
56	80		SECTION 1. AMENDATORY 82 O.S. 2011, Section 105.11, as
57	81		amended by Section 1, Chapter 411, O.S.L. 2019 (82 O.S. Supp. 2020,
58	82		Section 105.11), is amended t o read as follows:
59	83		Section 105.11. A. Except as otherwise provided by Sectio n
60	84		105.13 of this title for limited quantity stream water permits, upon
61	85		the acceptance of an appli cation which complies with the provisions
62	86		of Chapter 1 of this title, and the rules promulgated by the
63	87		Oklahoma Water Resources Board pursuant thereto, the Boa rd shall
64	88		instruct the applicant to publish , a notice of the application
65	89		within the time required by the Board, a notice thereof,. The

93	141		notice shall be at the applicant’s expense, and in a form prescribed
94	142		by the Board in a newspaper of general circulation in the county of
95	143		the point of diversion, and in a newsp aper of general circulation
96	144		published within the adjacent downstream county and any other
97	145		counties designated by the Board once a week for two (2) c onsecutive
98	146		weeks. The applicant shall also provide notice of the application ,
99	147		via certified mail, to the owner or owners of each tract of land
100	148		adjacent to the stream identified in the permit application for a
101	149		distance of one (1) mile upstream and one (1) mile downstream from
102		-	the proposed diversion point or points and to every stream water
103		-	permit holder and to any person or entity with a pending stream
104		-	water permit application received by the Board prior to the
105		-	notifying applicant’s application for a distance of one (1) mile
106		-	upstream and one (1) mile downstream from the proposed diversion
107		-	point or points.

108	155		B. Such notice shall give all the essential facts as to the
109	156		proposed appropriation, among them being the places of appropriation
110	157		and of use, amount of water, the pur pose for which it is to be used,
111	158		name and address of applicant, the hearing date, time and place if a
112	159		hearing is scheduled by the Board before i nstructions to publish
113	160		notice are given, and a thirty-day protest period, as well as the
114	161		manner in which a protes t to the application may be made. At the
115	162		time the Board provides the notice of application to the applicant,
116	163		the Board shall publish on its we bsite the applications and

145	216		prepared by the Board . The website publishing is in addition to,
146	217		and not in lieu of, the requirement for applic ants to publish notice
147	218		in the newspaper. The time to protest shall run from the date of
148	219		the first newspaper publication.
149	220		B. C. In case of failure to give such notice in accordance with
150	221		the rules and regulations applicable thereto within the time
151	222		required, or if such notice is defective, the priority of
152	223		application shall be lost; however, if proper notice is given within
153	224		thirty (30) days after the Board has notified the ap plicant of his
154	225		or her failure to give effective and proper notice, the applicati on
155	226		shall thereafter carry the original date of filing, a nd shall
156	227		supersede any subsequent application to th e same source of water
157	228		supply. Any interested party shall have the r ight to protest said
158	229		the application and present evidence and testimony in support o f
159	230		such protest.
160	231		C. D. If the Board does not schedul e a hearing on the
161	232		application before instructing t he applicant to publish notice, a
162	233		hearing shall be scheduled by the Board u pon receipt of a protest
163	234		which meets the requirements of the Board ’s rules, the Board shall
164	235		notify the applicant and protestant of such hearing.
165	236		SECTION 2. This act shall become effective November 1, 2021.
