5144 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
5245 SECTION 1. AMENDATORY 51 O.S. 2011, Section 155, as last
5346 amended by Section 3, Chapter 273, O.S.L. 2016 (51 O.S. Supp. 2020,
5447 Section 155), is amended to read as follows:
5548 Section 155. The state or a political subdivision s hall not be
5649 liable if a loss or claim results from:
5750 1. Legislative functions;
5851 2. Judicial, quasi-judicial, or prosecutorial functions, oth er
5952 than claims for wrongful criminal fel ony conviction resulting in
6053 imprisonment provided for in Section 154 of this title;
6154 3. Execution or enforcement of the lawful orders of any court;
6255 4. Adoption or enforcement of or failure to adopt or enforce a
6356 law, whether valid or invalid , including, but not limited to, any
57+statute, charter provision, ordinance, resolution, rul e, regulation
58+or written policy;

113105 refusal to issue, deny, suspend or revoke any permit, license,

142-13. Inspection powers or functions , including failure to make
143-an inspection, review or approval, or making an inadequate or
144135 negligent inspection, review or approval of any property, real or
145136 personal, to determine whether the property com plies with or
146137 violates any law or contai ns a hazard to health or safety, o r fails
147138 to conform to a recognized standar d;
148139 14. Any loss to any person covered by any workers ’ compensation
149140 act or any employer’s liability act;
150141 15. Absence, condition, location o r malfunction of any traffic
151142 or road sign, signal or warning device unless the absence,
152143 condition, location or malfu nction is not corrected by the state or
153144 political subdivision responsible within a reasonable time after
154145 actual or constructive notice or th e removal or destruction of such
155146 signs, signals or warning devices by thir d parties, action of
156147 weather elements or a s a result of traffic collision except on
157148 failure of the state or political subdivision to correct the same
158149 within a reasonable time after a ctual or constructive notice.
159150 Nothing herein shall give rise to liability arising from the failure
160151 of the state or any political subdivision to initially place any of
161152 the above signs, signals or warning devices. The signs, signals and
162153 warning devices referred to herein are those used in connec tion with
163154 hazards normally connect ed with the use of roadways or public ways
164155 and do not apply to the duty to warn of special defects such as
165156 excavations or roadway obstructions;
157+16. Any claim which is limited or bar red by any other law;
158+17. Misrepresentation, if unintentional;

193-16. Any claim which is limited or barred by any other law;
194-17. Misrepresentation, if unintentional;
195185 18. An act or omission of an independent contractor or
196186 consultant or his or her employees, agents, subcontractors or
197187 suppliers or of a person other than an employee of the state or
198188 political subdivision at the time the act or omiss ion occurred;
199189 19. Theft by a thir d person of money in the custody of an
200190 employee unless the loss was sustained because of the negligence or
201191 wrongful act or omission of the employee;
202192 20. Participation in or practice for any interscholastic or
203193 other athletic contest sponsored or conducted by or on the property
204194 of the state or a po litical subdivision;
205195 21. Participation in any activity approved by a local board of
206196 education and held within a building or on the grounds of the school
207197 district served by that lo cal board of education before or a fter
208198 normal school hours or on weekends;
209199 22. Use of indoor or outdoor school property and facilities
210200 made available for public recreation before or after normal school
211201 hours or on weekends or school vacations, except thos e claims
212202 resulting from willful an d wanton acts of negligence. For purposes
213203 of this paragraph:
214204 a. “public” includes, but is not limited to, students
215205 during nonschool hours and school staff when not
216206 working as employees of the school, and
207+b. “recreation” means any indoor or outdoor physica l
208+activity, either organized or unorganize d, undertaken

244-b. “recreation” means any indoor or outdoor physical
245-activity, either organized or unorganized, undertaken
246235 for exercise, relaxation, diversion, sport or
247236 pleasure, and that is not otherwise covered by
248237 paragraph 20 or 21 of this sectio n;
249238 23. Any court-ordered, Department of Corrections or county
250239 approved work release program; provided, however, thi s provision
251240 shall not apply to claims from individuals not in the custody of the
252241 Department of Corrections based on accidents involving moto r
253242 vehicles owned or operated by the Depa rtment of Corrections;
254243 24. The activities of the National Guard, the militi a or other
255244 military organization administered by the Military Department of the
256245 state when on duty pursuant to the lawful orders of competen t
257246 authority:
258247 a. in an effort to quell a riot,
259248 b. in response to a natural disaster or military attack,
260249 or
261250 c. if participating in a military mentor program ordered
262251 by the court;
263252 25. Provision, equipping, operation or maintenance of any
264253 prison, jail or corr ectional facility, or injuries resulting from
265254 the parole or escape of a pr isoner or injuries by a prisoner to any
266255 other prisoner; provided, however, this provision shall not apply to
267256 claims from individuals not in the custody of the Department of
257+Corrections based on accidents involving motor ve hicles owned or
258+operated by the Department of Corrections;

295-Corrections based on accidents involv ing motor vehicles owned or
296-operated by the Department of Corrections;
297285 26. Provision, equipping, operation or maintenance of any
298286 juvenile detention facility, or injuries resulting from the escape
299287 of a juvenile detainee, or inju ries by a juvenile detainee to any
300288 other juvenile detainee;
301289 27. Any claim or action based on the theory of manufact urer’s
302290 products liability or breach of warranty, either expressed or
303291 implied;
304292 28. Any claim or action based on the theory of indemnificatio n
305293 or subrogation;
306294 29. Any claim based u pon an act or omission of an emplo yee in
307295 the placement of children;
308296 30. Acts or omissions done in conformance with then current
309297 recognized standards;
310298 31. Maintenance of the state highway system or any portion
311299 thereof unless the claimant presents evidence which establishes
312300 either that the state failed to warn of the unsafe condit ion or that
313301 the loss would not have occurred but for a negligent affirmative act
314302 of the state;
315303 32. Any confirmation of the existence or non existence of any
316304 effective financing sta tement on file in the office of th e Secretary
317305 of State made in good faith by an employee of the office of the
306+Secretary of State as required by the provisions of Section 1 -9-
307+320.6 of Title 12A of the Oklahoma Statute s;
308+33. Any court-ordered community sent ence;

345-Secretary of State as required by the provisions of Section 1 -9-
346-320.6 of Title 12A of the Oklahoma Statutes;
347-33. Any court-ordered community sentence;
348335 34. Remedial action and any subsequent related maintenance of
349336 property pursuant to and in compliance with an authorized
350337 environmental remediation program, order , or requirement of a
351338 federal or state environmen tal agency;
352339 35. The use of necessary an d reasonable force by a school
353340 district employee to control and discipline a student during the
354341 time the student is in attendance or in transit to and from the
355342 school, or any other function authorized by the school d istrict;
356343 36. Actions taken in good fait h by a school district employee
357344 for the out-of-school suspension of a studen t pursuant to applicable
358345 Oklahoma Statutes; or
359346 37. Use of a public facility opened to the general public
360347 during an emergency; or
361348 38. A sanitary sewer overflow occurring on private property;
362349 provided, however, such exception shall not apply to claims for loss
363350 of property.
364351 SECTION 2. This act shall become effective November 1, 2021.
