5752 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5853 SECTION 1. NEW LAW A new section of law to be codified
5954 in the Oklahoma Statutes as Secti on 5026.1 of Title 63, unless there
6055 is created a duplication in numbering, reads as follows:
6156 A. The Oklahoma Health Care Authority , to the extent
6257 permissible under federal law, shall provide Medicaid coverage for
6358 medically necessary pasteurized donor human milk in a home setting;
6459 provided:
60+1. A physician, physician assistant or Advanced Practice
61+Registered Nurse licensed in this state signs an order stating th at
62+such milk is medically necessary for an infant Medicaid beneficiary ;

92-1. A physician, physician assistant or Advanced Practice
93-Registered Nurse licensed in this state signs an order stating th at
94-such milk is medically necessary for an infant Medicaid beneficiary ;
9589 2. a. The infant is medically or physic ally unable to
9690 receive maternal breast mil k or participate in
9791 breastfeeding, or
9892 b. The infant’s mother is medically or physically unable
9993 to produce maternal breast milk in sufficient
10094 quantities; and
10195 3. Such milk is provided by a donor human milk bank that
10296 adheres to quality standards of and is ac credited by the Human Milk
10397 Banking Association of North America or such other standards or
10498 accreditation as may be required by the Authority.
10599 B. The Oklahoma Health Care Authority Board shall promulgate
106100 rules to implement the provisions of this section including, but not
107101 limited to, establishing infant birth weight and health conditions
108102 that may make the provision of pasteurized donor human milk
109103 medically necessary and time limits for Medicaid coverage of
110104 pasteurized donor human milk. The Board may adopt a policy or
111105 procedure to implement the provisions of this section while in the
112106 process of promulgating rules; provided, such policy or procedure is
113107 posted on the Internet web site of the Authority prior to adoption of
114108 the policy.
109+C. The Authority shall seek any federal approval necessary to
110+implement this section.
111+SECTION 2. This act shall become effective July 1, 2021.

142-C. The Authority shall seek any federal approval necessary to
143-implement this section.
144-SECTION 2. This act shall become effective July 1, 2021.
145138 SECTION 3. It being immediately necessary for the preservation
146139 of the public peace, health or safety, an emergency is hereby
147140 declared to exist, by reason whereof this act shall take effect and
148141 be in full force from and after its passage and approval.
