57	52		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
58	53		SECTION 1. NEW LAW A new section of law to be codified
59	54		in the Oklahoma Statutes as Secti on 5026.1 of Title 63, unless there
60	55		is created a duplication in numbering, reads as follows:
61	56		A. The Oklahoma Health Care Authority , to the extent
62	57		permissible under federal law, shall provide Medicaid coverage for
63	58		medically necessary pasteurized donor human milk in a home setting;
64	59		provided:
	60	+	1. A physician, physician assistant or Advanced Practice
	61	+	Registered Nurse licensed in this state signs an order stating th at
	62	+	such milk is medically necessary for an infant Medicaid beneficiary ;

92		-	1. A physician, physician assistant or Advanced Practice
93		-	Registered Nurse licensed in this state signs an order stating th at
94		-	such milk is medically necessary for an infant Medicaid beneficiary ;
95	89		2. a. The infant is medically or physic ally unable to
96	90		receive maternal breast mil k or participate in
97	91		breastfeeding, or
98	92		b. The infant’s mother is medically or physically unable
99	93		to produce maternal breast milk in sufficient
100	94		quantities; and
101	95		3. Such milk is provided by a donor human milk bank that
102	96		adheres to quality standards of and is ac credited by the Human Milk
103	97		Banking Association of North America or such other standards or
104	98		accreditation as may be required by the Authority.
105	99		B. The Oklahoma Health Care Authority Board shall promulgate
106	100		rules to implement the provisions of this section including, but not
107	101		limited to, establishing infant birth weight and health conditions
108	102		that may make the provision of pasteurized donor human milk
109	103		medically necessary and time limits for Medicaid coverage of
110	104		pasteurized donor human milk. The Board may adopt a policy or
111	105		procedure to implement the provisions of this section while in the
112	106		process of promulgating rules; provided, such policy or procedure is
113	107		posted on the Internet web site of the Authority prior to adoption of
114	108		the policy.
	109	+	C. The Authority shall seek any federal approval necessary to
	110	+	implement this section.
	111	+	SECTION 2. This act shall become effective July 1, 2021.

142		-	C. The Authority shall seek any federal approval necessary to

144		-	SECTION 2. This act shall become effective July 1, 2021.
145	138		SECTION 3. It being immediately necessary for the preservation
146	139		of the public peace, health or safety, an emergency is hereby
147	140		declared to exist, by reason whereof this act shall take effect and
148	141		be in full force from and after its passage and approval.
