9393 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
9494 SECTION 1. NEW LAW A new section of law to be codified
9595 in the Oklahoma Statutes as S ection 1431 of Title 10, unless there

148148 A. This section shall be known and may be cited as the
149149 “Independence and Opportunity for Persons with Disabilities Pilot
150150 Program Act”.
151151 B. There is hereby creat ed the Independence and Opportunity fo r
152152 Persons with Disabilities Pilot Program. Under the pilot program,
153153 fifteen intermediate care facilit ies for individuals with
154154 intellectual disabilities with twelve or fewer beds (ICF s/IID-12),
155155 shall be selected by the Oklahoma Health Care Authority a nd the
156156 Department of Human Services to convert to group homes for persons
157157 with developmental or physical disabilities.
158158 C. The Authority and the Department shall create an application
159159 and selection process for the pilot program that ensures the
160160 compliance of the selected facilities with applicable federal and
161161 state laws and rules. For the Department, the selection criteria
162162 and process shall, at a minimum, consist of a ll applicable licensing
163163 or contracting requirements of group homes, and requirements relat ed
164164 to minimum standards as provided in Section 1430.11 o f Title 10 of
165165 the Oklahoma Statutes and rules promulgated pursuant thereto . In
166166 selecting the pilot program participants, the Authority and the
167167 Department shall compare services offered by each applic ant and
168168 consider the desires, capabilities and needs of residents based on
169169 all available information including, but not limited to, the
170170 individual habilitation plan of each resident . The Authority and
171171 the Department may share information as necessary in a ccordance with

223223 applicable federal and state laws and rul es to carry out the
224224 provisions of this section. The Authority and the Department shall
225225 begin accepting applications ninety (90) calendar days , after the
226226 Authority receives federal approval for the pi lot program, and the
227227 application period shall close nine ty (90) calendar days thereafter.
228228 Not more than ninety (90) calendar days after the end of the
229229 application period, the Authority and the Department shall select
230230 the fifteen most qualified applic ants to participate in the pilot
231231 program.
232232 D. The Authority shall create and publish on the Authority ’s
233233 website a consent form that must be signed by each resident or, if
234234 the resident is incap acitated, the guardian of the resident of an
235235 applying ICF/IID-12, who intends to continue to reside in the
236236 facility if it is selected for the pilot program . The form shall
237237 signify the informed consent of the resident or guardian to the
238238 facility conversion and the understanding of the resident or
239239 guardian that the facility conversion will not take effect unless
240240 and until the facility is selected for the pilot program . In its
241241 application submission, the ICF/IID-12 shall:
242242 1. Include a copy of the signed consent form of each resident
243243 who intends to reside in the group h ome;
244244 2. Identify any current residents :
245245 a. who did not, or if incapacitated whose guardian did
246246 not, consent to the facility conversion, or

298298 b. who may need to remain in intermediate care facility -
299299 level care. The Developmental Disability Services
300300 Division of the Department of Human Services (DDS D)
301301 shall make the final determination for the appropriate
302302 level of care;
303303 3. Include a plan to transfer to another intermediate care
304304 facility for individuals with intellectual disab ilities (ICF/IID)
305305 each resident who did not, or if incapacitated whose guardian did
306306 not, consent to the facility conversion, or who the applying
307307 facility identifies as possibly needing to remain in intermediate
308308 care facility-level care; and
309309 4. Provide any additional information or document ation required
310310 by the Authority or the Department .
311311 E. Upon selection of the fifteen pilot program participants,
312312 the Department shall notify each selected facility of which, if any,
313313 of the facility’s residents have been determined by DDSD as needing
314314 to remain in intermediate care facility-level care. If any of the
315315 residents identified by DDSD were not previously identified by the
316316 facility in the application submission, the facility shall, not more
317317 than fourteen (14) calendar days after receipt of the notification,
318318 submit to the Authority and the Dep artment an addendum to the
319319 facility’s application submission of a plan to transfer each such
320320 resident. The Authority and the Department must approve the
321321 addendum before the facility may execute the transfer . All

373373 transfers of residents shall occur in a ti me period to be determined
374374 by the Authority and the Department. For any current resident as of
375375 the date of the application submission who did not, or if
376376 incapacitated whose guardian did not, consent to the facility
377377 conversion or who DDSD determines should remain in interme diate care
378378 facility-level care, the facility may fill the spot with another
379379 prospective resident that the facility reasonably believes will be
380380 determined by DDSD to meet the criteria of a group home setting.
381381 The prospective resident must be assessed by DDSD and approved for
382382 the group home setting in the same manner as all other residents
383383 prior to the completion of the facility conversion .
384384 F. Prior to the completion of the facility conversion, all
385385 residents of the ICF/IID-12 who are SoonerCare members shal l be
386386 assessed and approved for appropriate services through the
387387 Developmental Disability Services Division of the Department of
388388 Human Services (DDSD). No later than the date of completio n of the
389389 facility conversion, DDSD shall begin providing appropriate services
390390 to SoonerCare members. The Authority and the Department shall
391391 ensure there is no interruption in appropriate services for each
392392 SoonerCare member and no interruption in appropria te funding for the
393393 facility. The Authority and the Department shall coordinate with
394394 the Centers for Medicare and Medicaid Services to ensure , to the
395395 extent practicable, there is no interruption in appropriate services
396396 for SoonerCare members who also recei ve services through Medicare

448448 and no interruption in appropriate fundi ng for the facility. The
449449 process outlined in this subsection shall only apply to current
450450 residents of the ICF/IID -12 and prospective residents as provide d in
451451 subsection E of this section. All future residents of the group
452452 home shall be subject to the sta ndard DDSD approval process.
453453 G. Once the facility conversion is complete , the group home
454454 shall comply with all applicable state and federal laws and rule s
455455 including, but not limited to, the Group Homes for Persons with
456456 Developmental or Physical Disabiliti es Act and shall be subject to
457457 all provisions of the act. The Department shall grant a group home
458458 license to each facility selected for the pilot progr am in
459459 accordance with the Group Hom es for Persons with Developmental or
460460 Physical Disabilities Act and shall enter into a contract with each
461461 group home. The facility conversion shall be considered complete
462462 when:
463463 1. All necessary or authorized transfers h ave been executed;
464464 2. All residents of each selected facility have been assessed
465465 and approved for approp riate services as provided in subsection F of
466466 this section;
467467 3. The Department certifies that the facility is in compliance
468468 with all applicable federal and state laws and rules governing group
469469 homes; and
470470 4. The Department has granted a license to the grou p home and
471471 has entered into a contract with the group home .

523523 H. A facility selected for the pilot program may , with the
524524 approval of the Authority and t he Department, convert back to an
525525 ICF/IID-12. However, the ICF/IID-12 shall not be permitted to
526526 convert to a group home more than once. In the event the pilot
527527 program is not expanded into an unrestricted program or is
528528 considered unsuccessful, the group home shall not be required to
529529 convert back to an ICF/IID.
530530 I. One year following implementation of the pil ot program, the
531531 Department shall evaluate the effectiveness of the pilot program and
532532 submit a report to the President Pro Tempore of the Senate, the
533533 Speaker of the House of Representativ es and the Governor. Criteria
534534 for the evaluation shall include, but n ot be limited to:
535535 1. A questionnaire created by the Department to be administered
536536 by the facility before and after the conversion to each resident or,
537537 if applicable, guardian of the resident, gauging the following
538538 criteria: perceived independ ence, vocational opportunity, and
539539 feelings of inclusion;
540540 2. A scaled numerical rating by residents, guardians and staff
541541 on whether the facility conversion has increased the res ident’s
542542 ability to function autonomo usly and independently;
543543 3. A fiscal analysis of the pilot program including whether
544544 cost savings were achieved; and
545545 4. A survey created by the Department to be administered to
546546 residents and guardians of residents, gauging the following criteria

598598 regarding services received relative to services received before the
599599 facility conversion and services that the resident or guardian of
600600 the resident expected to receive after the facility conversion :
601601 a. vocational services,
602602 b. physical therapy,
603603 c. occupational therapy,
604604 d. speech and communication,
605605 e. nutritional services,
606606 f. psychological services,
607607 g. family counseling,
608608 h. habilitation training services, and
609609 i. case management services.
610610 J. The Authority shall seek any federal approval necessary to
611611 implement the provisions of this section. The Oklahoma Health Care
612612 Authority Board and the Director of the Department of Human Services
613613 shall promulgate such rules as are necessary to implement the
614614 provisions of this section.
615615 SECTION 2. This act shall be come effective November 1, 2021.
