41	67		state agencies; authorizing the Legis lature to
42	68		disapprove implementation of certain rules and
43	69		regulations; prohibiting certain conduct upon certain
44	70		disapproval; stating when certain rules and
45	71		regulations are operative; providing for certain
46	72		exemption from liability; clarifying application to
47	73		certain rights, privileges or interests gained by
48	74		certain persons; providing for codification; and

53	81		BE IT ENACTED BY THE PE OPLE OF THE STATE OF OKLAHOMA:
54	82		SECTION 1. NEW LAW A new section of l aw to be codified
55	83		in the Oklahoma Statutes as Section 308b of Title 75, unless there
56	84		is created a duplication in numbering, reads as follows:
57	85		A. Upon receipt by a state agency of a requirement for an
58	86		agency to adopt, follow or otherwise submit to any new federal rule
59	87		or regulation or change to an existing federal rule or regulation,
60	88		or interpretation of any rule or regulation, that agency shall send
61	89		the federal rule or regulation by electronic mail to all members of
62	90		the Legislature and the Governor.

90	142		B. By the adoption of a joint resolution, the Legislature may
91	143		disapprove the implementation of any federal rule or regulation
92	144		imposed on a state agency.
93	145		C. Unless otherwise authorized by the Legislature, wh enever a
94	146		rule or regulation is disapproved as provided in subsection B of
95	147		this section, the agency subject to such rules or regulations shall
96	148		not have authority to follow, interpret or abide by any require ments
97	149		of the rule or regulation as specified by the Legislature. Any
98	150		effective rule or regulation which would have been imposed on an
99	151		agency when the Legislature was not in session shall be deemed null
100	152		and void on the date the Legislature disapproves the rule or
101	153		regulation by a resolution as provided for in subsection B of this
102	154		section. Federal rules and re gulations imposed on state agencies
103	155		may be disapproved in part or in whole by the Legislature. Upon
104	156		enactment of any joint resolution disapproving a r ule or regulation,
105	157		the agency shall file notice of such legislative disapproval with
106	158		the Attorney General.
107	159		D. A federal rule or regulation shall be deemed authorized for
108	160		state agency compliance, if disappr oved by a joint resolution
109	161		pursuant to subsection B of this section which has been vetoed by
110	162		the Governor in accordance with Section 11 of Article VI of th e
111	163		Oklahoma Constitution and the veto has not been overridden.

139	215		E. State agencies and their employees complying with the
140	216		provisions of this section shall be exempt from liability pursuant
141	217		to Section 155 of Title 51 of the Oklahoma Statutes.
142	218		F. Any rights, privileges or interests gained by any person by
143	219		operation of a federal rule or regulation applied pri or to the
144	220		adoption of a joint resolution pursuant to this section, shall not
145	221		be affected by reason of any subsequent disapproval or rejection of
146	222		such rule or regulation by either house of the Legislature.
147	223		SECTION 2. This act shall become e ffective November 1, 20 21.
