104 | 162 | | b. a specialist designation, if certified by the American |

105 | 163 | | Board of Medical Specialti es or an American |
---|
106 | 164 | | Osteopathic Associat ion certifying board or if board- |
---|
107 | 165 | | eligible including “surgeon”, “dermatologist”, |

109 | 167 | | 2. A Registered Nurse shall only use the titles “Registered |

154 | 236 | | title as indicated by the applicable statute. |
---|
155 | 237 | | C. An advertisement by a health care provide r shall disclose |
---|
156 | 238 | | only the applicable license, as provided in this section and by the |
---|
157 | 239 | | applicable statute, under which the health care provider is |
---|
158 | 240 | | authorized to provide services. The advertisement: |
---|
159 | 241 | | 1. Shall not include deceptive or misleading terms or fals e |
---|
160 | 242 | | representations; and |
---|
194 | 300 | | patients in a setting outside of a licensed health care facility, |
---|
195 | 301 | | the copy must be of sufficient size to be v isible and apparent to |
---|
196 | 302 | | patients, except that a copy no smaller than the original license is |
---|
197 | 303 | | deemed to be sufficient . |

198 | 304 | | 2. A health care provider seeing patients on a face -to-face |
---|
199 | 305 | | basis shall wear a name badge or some ot her form of identification |
---|
200 | 306 | | that clearly discloses: |

201 | 307 | | a. the health care provider ’s name, |
---|
202 | 308 | | b. the type of license, registration or certification the |
---|
203 | 309 | | health care provider holds, as provided in this |
---|
204 | 310 | | section and by the applicable statute, for the health |
---|
205 | 311 | | care provider’s profession, and |
---|
206 | 312 | | c. the health care provider’s medical staff position, if |
---|

208 | 314 | | E. Except as provided in Section 725.2 of Title 59 of the |

209 | 315 | | Oklahoma Statutes, a person shall not u se, imply the use of, or |

309 | 464 | | B. A hospital or related institution as such terms are defined |
---|
310 | 465 | | in Section 1-701 of Title 63 of the Oklahoma Statut es, which has the |
---|
311 | 466 | | principal purpose or function of providing hospital or medical care , |
---|
312 | 467 | | including but not limited to any corporation, association, trust, or |
---|
313 | | - | other organization organiz ed and operated for such purpose, may |
---|
314 | | - | employ one or more persons who are d uly licensed to practice |
---|
315 | | - | medicine in this state without being regarded as itself practicing |
---|
316 | | - | medicine within the meaning and provisions of this section. Th e |
---|
317 | | - | employment by the hospita l or related institution of any person who |
---|
318 | | - | is duly licensed to practice me dicine in this state shall not, in |
---|
319 | | - | and of itself, be considered as an act of unprofessional conduct by |
---|
| 519 | + | other organization organiz ed and operated for such purpose, m ay |

| 520 | + | employ one or more persons who are d uly licensed to practice |

---|
351 | 530 | | C. The definition of the practice of medicine and surgery shall |
---|
352 | 531 | | include, but is not limi ted to: |
---|
353 | 532 | | 1. Advertising, holding out to the public, or represe nting in |
---|
354 | 533 | | any manner that one is authori zed to practice medicine and surgery |
---|
355 | 534 | | in this state; |
---|
356 | 535 | | 2. Any offer or attempt to prescribe, order, give, or |
---|
357 | 536 | | administer any drug or medicine and surgery for the use of any other |
---|
358 | 537 | | person, except as otherwise authorized by law; |
---|
359 | 538 | | 3. a. any offer or attempt, excep t as otherwise authorized |
---|
360 | 539 | | by law, to prevent, diagnose, correct, or treat in any |
---|
361 | 540 | | manner or by any means, methods, devises, or |
---|
362 | 541 | | instrumentalities except for manual manipulation any |
---|
363 | 542 | | disease, illness, pain, wound, fractur e, infirmity, |
---|
364 | | - | defect, or abnormal physi cal or mental condition of |
---|
365 | | - | any person, including the management of pregnancy and |
---|
366 | | - | parturition, except as otherwise authorized by law, |
---|
367 | | - | b. except as provided in subsection D of this sec tion, |
---|
368 | | - | performance by a person within or outside of this |
---|
369 | | - | state, through an ongoing regular arrangement, of |
---|
370 | | - | diagnostic or treatment services , including but not |
---|

403 | 606 | | functions covered by this subparagraph submits himself |
---|
404 | 607 | | or herself to the ju risdiction of the courts of this |
---|
405 | 608 | | state for the purposes of any cause of action |
---|
406 | 609 | | resulting from the fun ctions performed, and |
---|
407 | 610 | | c. nothing in the Oklahoma Allopathic Medical and |
---|
408 | 611 | | Surgical Licensure and Supervision Act shall be |
---|
409 | 612 | | construed to affect or give jurisdi ction to the Board |
---|
410 | 613 | | over any person other than medical doctors or persons |
---|
411 | 614 | | holding themselves out as me dical doctors; |
---|
412 | 615 | | 4. Any offer or attempt to perform any surgical operation upon |
---|
413 | 616 | | any person, except as otherwise authorized by law; and |
---|
414 | | - | 5. The use of the ti tle Doctor, Doctor of Medicine, Physician, |
---|
415 | | - | Surgeon, Physician and Surgeon, Dr., M.D. or any of the medical |
---|
416 | | - | specialty titles listed in subsec tion A of this section, or any |
---|
417 | | - | combination thereof, in the conduct of any occupation or profession |
---|
418 | | - | pertaining to the prevent ion, diagnosis, or treatment of human |
---|
419 | | - | disease or condition unless, where appropriate, such a designation |
---|
420 | | - | additionally contains the d escription of another branch of the |
---|

451 | 678 | | section, shall not inclu de: |
---|
452 | 679 | | 1. A student while engaged in trai ning in a medical school |
---|
453 | 680 | | approved by the Board or while engaged in graduate medical training |
---|
454 | 681 | | under the supervision of the medical st aff of a hospital or other |
---|
455 | 682 | | health care facility approved by th e state medical board f or such |
---|
456 | 683 | | training, except that a student engaged in graduate medical training |
---|
457 | 684 | | shall hold a license issued by the Board for such train ing; |
---|
458 | 685 | | 2. Any person who provides medica l treatment in cases of |
---|
459 | 686 | | emergency where no fee or other consid eration is contemplated , |
---|
460 | 687 | | charged or received; |
---|
461 | 688 | | 3. A commissioned medical officer of the armed forces of the |
---|
462 | 689 | | United States or medical officer of the United States Public Health |
---|
463 | 690 | | Service or the Department of Veterans Affairs of the United States |
---|
464 | 691 | | in the discharge of official duties and/or or within federally |
---|
498 | 749 | | 4. Any person licensed under any other act when properly |
---|
499 | 750 | | practicing in the healing art for which that person i s duly |
---|
500 | 751 | | licensed; |
---|
501 | 752 | | 5. The practice of those who endeavor to pre vent or cure |
---|
502 | 753 | | disease or suffering by spiritua l means or prayer; |
---|
503 | 754 | | 6. Any person administering a domestic or family remedy to a |
---|
504 | 755 | | member of such person’s own family; |
---|
505 | 756 | | 7. Any person licensed to pract ice medicine and surger y in |
---|
506 | 757 | | another state or territory of the United States who renders |
---|
507 | 758 | | emergency medical treatment or briefly provides critical medical |
---|
508 | 759 | | service at the specific lawful direction of a medical institution or |
---|
509 | 760 | | federal agency that assumes full r esponsibility for that treatment |
---|
510 | 761 | | or service and is approved by the Board; |
---|
511 | 762 | | 8. Any person who is licensed to practice medicine and surgery |
---|
512 | 763 | | in another state or territory of the United States whose sole |
---|
513 | 764 | | purpose and activity is limited to brief actual consulta tion with a |
---|
514 | 765 | | specific physician who is licensed to practice med icine and surgery |
---|
515 | | - | by the Board, other than a person with a special or restricted |
---|
516 | | - | license; or |
---|
517 | | - | 9. The practice of any other person as licensed by appropriate |
---|
518 | | - | agencies of this state, provided that such duties are consis tent |
---|
519 | | - | with the accepted standards of the person’s profession and the |
---|
520 | | - | person does not represent himself or herself as a Doctor, Doctor of |
---|
521 | | - | Medicine, Physician, Surgeon, Physician and Surgeon, Dr., M.D. or |
---|
| 817 | + | by the Board, other than a person with a special or restricted |
---|
| 818 | + | license; or |
---|
| 819 | + | 9. The practice of any other person as licensed by appropriate |
---|
| 820 | + | agencies of this state, provided that such duties are consis tent |

552 | 827 | | E. Nothing in the Oklahoma Allopathic Medical and Surgical |
---|
553 | 828 | | Licensure and Supervision Act shall prohibit: |
---|
554 | 829 | | 1. The service rendered by a physician’s unlicensed trained |
---|
555 | 830 | | assistant, if such service is rendered under t he supervision and |
---|
556 | 831 | | control of a licensed physician pursuant to Board rules, provided |
---|
557 | 832 | | such rules are not in conflict with the provisions of any other |
---|
558 | 833 | | healing arts licensure act or rules promulgated pursuant to such |
---|
559 | 834 | | act; or |
---|
560 | 835 | | 2. The service of any other perso n duly licensed or certified |
---|
561 | 836 | | by the state to practice the healing arts. |
---|
562 | 837 | | F. Nothing in the Oklahoma Allopathic Medical and Surgical |
---|
563 | 838 | | Licensure and Supervision Act s hall prohibit services rendered by |
---|
564 | 839 | | any person not licensed by the Board and practicing any |
---|
565 | 840 | | nonallopathic healing practice. |
---|
566 | | - | G. Nothing in the Oklahoma Allopathic Medical and Surgical |
---|
567 | | - | Licensure and Supervision Act shall be construed as to require a |
---|
568 | | - | physician to secure a Maintenance of Certification (MOC) as a |
---|
569 | | - | condition of licensure, reimbursement, employment or admitting |
---|
570 | | - | privileges at a hospital in this state. For the purposes of this |
---|
571 | | - | subsection, “Maintenance of Certification (MOC) ” shall mean a |
---|
572 | | - | continuing education program measuring core competencies in the |
---|

710 | 1057 | | “physicians” shall mean and include each of the classes of persons |
---|
711 | 1058 | | listed in paragraphs 1 throug h 6 of subsection A and the word |

712 | 1059 | | “doctor” or “doctors” as provided in subsection B of this section. |

717 | 1064 | | D. For purposes of this section, “provider” means and includes: |

750 | 1121 | | E. Persons in each of the nine clas ses listed in subsec tion A, |
---|
751 | 1122 | | and referred to in subs ections B and C, of this section shall |
---|
752 | 1123 | | identify through written notice, which may include the wearing of a |
---|
753 | 1124 | | name tag, the type of license under which the doctor is practicing, |
---|
754 | 1125 | | utilizing the designations pro vided in subsections A, B and C of |
---|
755 | 1126 | | this section. Each applicable licensing board is authorized by rule |
---|
756 | 1127 | | to determine how its license holders may comply with this disclosure |
---|
757 | 1128 | | requirement. |
---|
758 | 1129 | | F. 1. Any advertisement for health care services naming a |
---|
759 | 1130 | | provider shall: |
---|
760 | 1131 | | a. identify the type of license of the doctor utilizing |
---|
761 | 1132 | | the letters or words set forth in this section if the |
---|
762 | 1133 | | person is one of the classes of persons listed in |
---|
763 | 1134 | | subsection A of this section, and referred to in |
---|
764 | 1135 | | subsections B and C of this section, or |
---|
765 | 1136 | | b. utilize appropriate, accepted, and easily underst ood |
---|
766 | 1137 | | words or letters, which clearly show and indicate the |
---|
767 | 1138 | | branch of the healing art in which the person is |
---|
768 | 1139 | | licensed to practice and is engaged in, if the person |
---|
801 | 1196 | | at the direction of the provider or providers and advert ised for the |
---|
802 | 1197 | | purpose of promoting the services of the doctor or provider. |
---|
803 | 1198 | | G. 1. It shall be unlawful for any medical docto r, doctor of |
---|
804 | 1199 | | osteopathic medicine, doctor of dental surgery, doctor of dental |
---|
805 | 1200 | | medicine, doctor of optometry, doc tor of podiatry, or doctor of |
---|
806 | 1201 | | chiropractic to make any deceptive or misleading statement, or |
---|
807 | 1202 | | engage in any deceptive or misleading act, that dec eives or misleads |
---|
808 | 1203 | | the public or a prospective or current patient, regarding the |
---|
809 | 1204 | | training and the license under w hich the person is a uthorized to |
---|
810 | 1205 | | practice. |

811 | 1206 | | 2. The term “deceptive or misleading statement or act ” |
---|
812 | 1207 | | includes, but is not limited to: |
---|
813 | 1208 | | a. such statement or act in any advertising medium, |
---|
814 | 1209 | | b. making a false statement regarding the education, |
---|
815 | 1210 | | skills, training, or licensure of a person, or |
---|
816 | 1211 | | c. in any other way des cribing the profession, skills, |
---|
817 | 1212 | | training, expertise, education, or licensure of a |
---|
818 | 1213 | | person in a fashion that causes the public, a |
---|
819 | 1214 | | potential patient, or current patient to believe that |
---|

854 | 1273 | | audiology services is designated to be a practitioner of the healing |
