5387 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5488 SECTION 1. NEW LAW A new section of law to be codified
5589 in the Oklahoma Statutes as Section 6006 of Title 59, unless there
5690 is created a duplication in numbering, reads as follows:
5791 A. As used in this section:
5892 1. “Advertisement” means a communication, whether printed,
5993 electronic or oral, that names a health care provider and the
60-practice, profession or institution in which the provider is
61-employed, volunteers or otherwise provides health care ser vices.
62-Advertisement includes business cards, letterhead, patient
63-brochures, e-mail, Internet, audio and video communic ations and any
64-other communication; and

97155 B. Health care providers shall use the following license titles
98156 in advertisements and in professional identifications :
99157 1. A medical doctor or doctor of osteopathy shall use any of
100158 the following titles:
101159 a. “physician”, “doctor of medicine”, “medical doctor”,
102160 “M.D.”, or “doctor of osteopathic medicine”, “doctor
103161 of osteopathy”, “osteopathic physician ” or “D.O.”, or
104162 b. a specialist designation, if certified by the American
105163 Board of Medical Specialti es or an American
106164 Osteopathic Associat ion certifying board or if board-
107165 eligible including “surgeon”, “dermatologist”,
108166 “anesthesiologist”, or a similar title;
109167 2. A Registered Nurse shall only use the titles “Registered
110168 Nurse” or “R.N.”;
111-3. A Licensed Practical Nurse shall only use the titles
112-“Licensed Practical Nurse” or “L.P.N.”;
113-4. An Advanced Practice Registered Nurse shall only use the
114-titles “Advanced Practice Registered Nurse ” or “APRN”, and one of
115-the following role titles:

220+3. A Licensed Practical Nurse shall only use the titles
221+“Licensed Practical Nurse” or “L.P.N.”;
222+4. An Advanced Practice Registered Nurse shall only use the
223+titles “Advanced Practice Registered Nurse ” or “APRN”, and one of
224+the following role titles:
143225 a. for a Certified Registered Nurse Anesthetist,
144226 “Certified Registered Nurse Anesthetist” or “CRNA”,
145227 b. for a Clinical Nurse Specialist, “Clinical Nurse
146228 Specialist” or “CNS”,
147229 c. for a Certified Nurse Practitioner, “Certified Nurse
148230 Practitioner” or “CNP”, or
149231 d. for a Certified Nurse-Midwife, “Certified Nurse-
150232 Midwife” or “CNM”;
151233 5. A physician assistant shall only use the titles “physician
152234 assistant” or “P.A.”; and
153235 6. Any other health care practitioner shall use the appropriate
154236 title as indicated by the applicable statute.
155237 C. An advertisement by a health care provide r shall disclose
156238 only the applicable license, as provided in this section and by the
157239 applicable statute, under which the health care provider is
158240 authorized to provide services. The advertisement:
159241 1. Shall not include deceptive or misleading terms or fals e
160242 representations; and
161-2. Shall include the health care pr ovider’s name and the type
162-of license the provider holds, as provided in this section and by
163-the applicable statute, for the provider’s profession.
164-D. 1. A health care provider shall display a copy of the
165-provider’s license in a prominent place in an off ice area visible to
166-current and prospective patients. If the health care provider sees

294+2. Shall include the health care provider’s name and the type
295+of license the provider holds, as provided in this section and by
296+the applicable statute, for the provider’s profession.
297+D. 1. A health care provider shall display a copy of the
298+provider’s license in a prominent place in an office area visible to
299+current and prospective patients. If the health care provider sees
194300 patients in a setting outside of a licensed health care facility,
195301 the copy must be of sufficient size to be v isible and apparent to
196302 patients, except that a copy no smaller than the original license is
197303 deemed to be sufficient .
198304 2. A health care provider seeing patients on a face -to-face
199305 basis shall wear a name badge or some ot her form of identification
200306 that clearly discloses:
201307 a. the health care provider ’s name,
202308 b. the type of license, registration or certification the
203309 health care provider holds, as provided in this
204310 section and by the applicable statute, for the health
205311 care provider’s profession, and
206312 c. the health care provider’s medical staff position, if
207313 applicable.
208314 E. Except as provided in Section 725.2 of Title 59 of the
209315 Oklahoma Statutes, a person shall not u se, imply the use of, or
210316 publicly display a title in connection wi th a person’s name
211317 including “physician”, “doctor” or “surgeon” or any similar title or
212-description of services, or any other words, letters or
213-abbreviations or any co mbination thereof with the intent to
214-represent, or that i mply, that the person practices medicine.
215-Unless authorized to practi ce medicine by the State Board of Medical
216-Licensure and Supervision or the State Board of Os teopathic
217-Examiners, a person shall not u se, imply the use of, or publicly

307462 this state by any allopathic legend drugs, surgery, manual, or
308463 mechanical treatment unless otherwise authorized by law.
309464 B. A hospital or related institution as such terms are defined
310465 in Section 1-701 of Title 63 of the Oklahoma Statut es, which has the
311466 principal purpose or function of providing hospital or medical care ,
312467 including but not limited to any corporation, association, trust, or
313-other organization organiz ed and operated for such purpose, may
314-employ one or more persons who are d uly licensed to practice
315-medicine in this state without being regarded as itself practicing
316-medicine within the meaning and provisions of this section. Th e
317-employment by the hospita l or related institution of any person who
318-is duly licensed to practice me dicine in this state shall not, in
319-and of itself, be considered as an act of unprofessional conduct by

520+employ one or more persons who are d uly licensed to practice
521+medicine in this state without being regarded as itself practicing
522+medicine within the meaning and provisions of this section. Th e
523+employment by the hospita l or related institution of any per son who
524+is duly licensed to practice me dicine in this state shall not, in
525+and of itself, be considered as an act of unprofessional conduct by
347526 the person so employed. Nothing provided herein sha ll eliminate,
348527 limit, or restrict the liability for any act or failure to act of
349528 any hospital, any hos pital’s employees, or persons duly lice nsed to
350529 practice medicine.
351530 C. The definition of the practice of medicine and surgery shall
352531 include, but is not limi ted to:
353532 1. Advertising, holding out to the public, or represe nting in
354533 any manner that one is authori zed to practice medicine and surgery
355534 in this state;
356535 2. Any offer or attempt to prescribe, order, give, or
357536 administer any drug or medicine and surgery for the use of any other
358537 person, except as otherwise authorized by law;
359538 3. a. any offer or attempt, excep t as otherwise authorized
360539 by law, to prevent, diagnose, correct, or treat in any
361540 manner or by any means, methods, devises, or
362541 instrumentalities except for manual manipulation any
363542 disease, illness, pain, wound, fractur e, infirmity,
364-defect, or abnormal physi cal or mental condition of
365-any person, including the management of pregnancy and
366-parturition, except as otherwise authorized by law,
367-b. except as provided in subsection D of this sec tion,
368-performance by a person within or outside of this
369-state, through an ongoing regular arrangement, of
370-diagnostic or treatment services , including but not

595+any person, including the management of pregnancy and
596+parturition, except as otherwise authorized by law,
597+b. except as provided in subsection D of this sec tion,
598+performance by a person withi n or outside of this
599+state, through an ongoing regular arrangement, of
600+diagnostic or treatment services , including but not
398601 limited to, stroke prevention and treatment, through
399602 electronic communications for any patient who se
400603 condition is being diagnosed or treated within this
401604 state by a physician duly licensed and practicing in
402605 this state. A person who performs any of the
403606 functions covered by this subparagraph submits himself
404607 or herself to the ju risdiction of the courts of this
405608 state for the purposes of any cause of action
406609 resulting from the fun ctions performed, and
407610 c. nothing in the Oklahoma Allopathic Medical and
408611 Surgical Licensure and Supervision Act shall be
409612 construed to affect or give jurisdi ction to the Board
410613 over any person other than medical doctors or persons
411614 holding themselves out as me dical doctors;
412615 4. Any offer or attempt to perform any surgical operation upon
413616 any person, except as otherwise authorized by law; and
414-5. The use of the ti tle Doctor, Doctor of Medicine, Physician,
415-Surgeon, Physician and Surgeon, Dr., M.D. or any of the medical
416-specialty titles listed in subsec tion A of this section, or any
417-combination thereof, in the conduct of any occupation or profession
418-pertaining to the prevent ion, diagnosis, or treatment of human
419-disease or condition unless, where appropriate, such a designation
420-additionally contains the d escription of another branch of the

668+5. The use of the ti tle Doctor, Doctor of Medicine, Physician,
669+Surgeon, Physician and Surg eon, Dr., M.D. or any of the medical
670+specialty titles listed in subsec tion A of this section, or any
671+combination thereof, in the conduct of any occupation or profession
672+pertaining to the prevent ion, diagnosis, or treatment of human
673+disease or condition unless, where appropriate, such a designation
674+additionally contains the d escription of another branch of the
448675 healing arts for which on e holds a valid license in this state or as
449676 otherwise provided by law .
450677 D. The practice of medicine and surgery, as defined in this
451678 section, shall not inclu de:
452679 1. A student while engaged in trai ning in a medical school
453680 approved by the Board or while engaged in graduate medical training
454681 under the supervision of the medical st aff of a hospital or other
455682 health care facility approved by th e state medical board f or such
456683 training, except that a student engaged in graduate medical training
457684 shall hold a license issued by the Board for such train ing;
458685 2. Any person who provides medica l treatment in cases of
459686 emergency where no fee or other consid eration is contemplated ,
460687 charged or received;
461688 3. A commissioned medical officer of the armed forces of the
462689 United States or medical officer of the United States Public Health
463690 Service or the Department of Veterans Affairs of the United States
464691 in the discharge of official duties and/or or within federally
465-controlled facilities; and provided that such person shal l be fully
466-licensed to practice medicine and sur gery in one or more
467-jurisdictions of the United States; provided further that such
468-person who holds a medical license in thi s state shall be subject to
469-the provisions of the Oklahoma Allopathic Medical and Su rgical
470-Licensure and Supervision Act;

744+licensed to practice medicine and sur gery in one or more
745+jurisdictions of the United States; provided further that such
746+person who holds a medical license in thi s state shall be subject to
747+the provisions of the Oklahoma Allopathic Medical and Su rgical
748+Licensure and Supervision Act;
498749 4. Any person licensed under any other act when properly
499750 practicing in the healing art for which that person i s duly
500751 licensed;
501752 5. The practice of those who endeavor to pre vent or cure
502753 disease or suffering by spiritua l means or prayer;
503754 6. Any person administering a domestic or family remedy to a
504755 member of such person’s own family;
505756 7. Any person licensed to pract ice medicine and surger y in
506757 another state or territory of the United States who renders
507758 emergency medical treatment or briefly provides critical medical
508759 service at the specific lawful direction of a medical institution or
509760 federal agency that assumes full r esponsibility for that treatment
510761 or service and is approved by the Board;
511762 8. Any person who is licensed to practice medicine and surgery
512763 in another state or territory of the United States whose sole
513764 purpose and activity is limited to brief actual consulta tion with a
514765 specific physician who is licensed to practice med icine and surgery
515-by the Board, other than a person with a special or restricted
516-license; or
517-9. The practice of any other person as licensed by appropriate
518-agencies of this state, provided that such duties are consis tent
519-with the accepted standards of the person’s profession and the
520-person does not represent himself or herself as a Doctor, Doctor of
521-Medicine, Physician, Surgeon, Physician and Surgeon, Dr., M.D. or

552827 E. Nothing in the Oklahoma Allopathic Medical and Surgical
553828 Licensure and Supervision Act shall prohibit:
554829 1. The service rendered by a physician’s unlicensed trained
555830 assistant, if such service is rendered under t he supervision and
556831 control of a licensed physician pursuant to Board rules, provided
557832 such rules are not in conflict with the provisions of any other
558833 healing arts licensure act or rules promulgated pursuant to such
559834 act; or
560835 2. The service of any other perso n duly licensed or certified
561836 by the state to practice the healing arts.
562837 F. Nothing in the Oklahoma Allopathic Medical and Surgical
563838 Licensure and Supervision Act s hall prohibit services rendered by
564839 any person not licensed by the Board and practicing any
565840 nonallopathic healing practice.
566-G. Nothing in the Oklahoma Allopathic Medical and Surgical
567-Licensure and Supervision Act shall be construed as to require a
568-physician to secure a Maintenance of Certification (MOC) as a
569-condition of licensure, reimbursement, employment or admitting
570-privileges at a hospital in this state. For the purposes of this
571-subsection, “Maintenance of Certification (MOC) ” shall mean a

7011048 section or chapter of the Oklahoma Statutes, the word “doctor” or
7021049 “doctors” shall mean and include each of the nine classes of persons
7031050 listed in subsection A and the word “physician” or “physicians”, as
7041051 provided in subsection C of this section. Any other person using
7051052 the term doctor, or a ny abbreviation thereof, shall designate the
7061053 authority under which the title is used or the college or honorary
7071054 degree that gives rise to use of the title.
7081055 C. Unless otherwise specifically provided in a particular
7091056 section or chapter of the Oklahoma Statutes, the word “physician” or
7101057 “physicians” shall mean and include each of the classes of persons
7111058 listed in paragraphs 1 throug h 6 of subsection A and the word
7121059 “doctor” or “doctors” as provided in subsection B of this section.
7131060 The term “physician” shall not include any person specified in
7141061 paragraphs 7 through 9 of subsection A of this section unless such
7151062 person is otherwise autho rized to use such designation pursuant to
7161063 this section.
7171064 D. For purposes of this section, “provider” means and includes:

7521123 identify through written notice, which may include the wearing of a
7531124 name tag, the type of license under which the doctor is practicing,
7541125 utilizing the designations pro vided in subsections A, B and C of
7551126 this section. Each applicable licensing board is authorized by rule
7561127 to determine how its license holders may comply with this disclosure
7571128 requirement.
7581129 F. 1. Any advertisement for health care services naming a
7591130 provider shall:
7601131 a. identify the type of license of the doctor utilizing
7611132 the letters or words set forth in this section if the
7621133 person is one of the classes of persons listed in
7631134 subsection A of this section, and referred to in
7641135 subsections B and C of this section, or
7651136 b. utilize appropriate, accepted, and easily underst ood
7661137 words or letters, which clearly show and indicate the
7671138 branch of the healing art in which the person is
7681139 licensed to practice and is engaged in, if the person
769-is not one of the nine classes of persons li sted in
770-subsection A of this section, or referred to in
771-subsections B and C of this section.
772-2. The term “advertisement” includes any printed d ocument

8031198 G. 1. It shall be unlawful for any medical docto r, doctor of
8041199 osteopathic medicine, doctor of dental surgery, doctor of dental
8051200 medicine, doctor of optometry, doc tor of podiatry, or doctor of
8061201 chiropractic to make any deceptive or misleading statement, or
8071202 engage in any deceptive or misleading act, that dec eives or misleads
8081203 the public or a prospective or current patient, regarding the
8091204 training and the license under w hich the person is a uthorized to
8101205 practice.
8111206 2. The term “deceptive or misleading statement or act ”
8121207 includes, but is not limited to:
8131208 a. such statement or act in any advertising medium,
8141209 b. making a false statement regarding the education,
8151210 skills, training, or licensure of a person, or
8161211 c. in any other way des cribing the profession, skills,
8171212 training, expertise, education, or licensure of a
8181213 person in a fashion that causes the public, a
8191214 potential patient, or current patient to believe that
820-the person is a medical doctor, doctor of osteopathic
821-medicine, doctor of dental surgery , doctor of dental
822-medicine, doctor of optometry, doctor of podiatry, or
823-doctor of chiropractic when that person does not hold

8531272 person licensed in this state to perfo rm speech pathology or
8541273 audiology services is designated to be a practitioner of the healing
8551274 art for purposes of making a referral for speech pathology or
8561275 audiology services pursuant to the provisions of th e Individuals
8571276 with Disabilities Education Act, Amen dment of 1997, Public Law 105-
8581277 17, and Section 504 of the Rehabilitation Act of 1973.
859-SECTION 4. AMENDATORY 59 O.S. 20 21, Section 731.2, is

870-B. Nothing in this section shall be construed to prevent a

9141357 Oklahoma authorizing s uch person to practice the heali ng art covered
9151358 by such license and is practicing thereunder in the manner and
9161359 subject to the limitations provided by the laws of the State of
9171360 Oklahoma this state for the issuance of such license or certificate
9181361 for the practice thereunder.
919-SECTION 6. This act shall become effective November 1, 2022.
