187187 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
188188 SECTION 1. NEW LAW A n ew section of law to be codi fied
189189 in the Oklahoma Statutes as Section 1-1150 of Title 63, unless there
190190 is created a duplication in numbering, reads as follows:
191191 This act shall be known and may be cited a s the “Mobile Food

247247 As used in the Mobile Food Vendor Act:
248248 1. “Customer” means any person with whom a mobile food vendor
249249 conducts his or her mobile vending busine ss, or any person who stops
250250 to contemplate conducti ng such business with a mobile food vendor;
251251 2. “Department” means the State Depa rtment of Health;
252252 3. “Food vending vehicle” means any motorized, two -axle vehicle
253253 used to sell food and beverages by a mobi le food vendor;
254254 4. “Local authority” means any local government including any
255255 town, city, charter city, political subdivision or co unty;
256256 5. “Mobile food vendor” means any person who dispenses food or
257257 beverages from a food vending vehicle for immediate se rvice or
258258 consumption;
259259 6. “Person” means any individual, group of individuals, firm,
260260 partnership, company, corporation, trustee, ass ociation or any
261261 public or private entity and includes the entity ’s employees or
262262 agents;
263263 7. “Prepackaged food” means any commercially labeled and
264264 processed food prepackaged to prevent direct human contact with the
265265 food product upon distribution from the ma nufacturer, a food
266266 facility or other approved source;

318318 8. “Public property” means any property owned and operated by
319319 this state or a local authority for the benefit of the pub lic and
320320 includes all rights-of-way contained wholly within any state or
321321 local authority parks; and
322322 9. “Sell” means to transfer or exchange for value, to expose,
323323 display or offer for sale or exchange, or t o procure, store, keep or
324324 have on hand or in one ’s possession or control for the purpose of
325325 selling.
326326 SECTION 3. NEW LAW A new section of law to be codified
327327 in the Oklahoma Statutes as Section 1-1152 of Title 63, unless there
328328 is created a duplication in numbering, reads as follows:
329329 A. No person may operate as a mobile food vendor in this state
330330 without obtaining a mobile food vending license from the State
331331 Department of Health. A separate mobi le food license shall be
332332 required for every food vending vehicle used by a mobile food
333333 vendor.
334334 B. No local authority may prohibit a mobile food vendor from
335335 lawfully operating in its jurisdiction if the vendor holds a mobile
336336 food vending license and is in compliance with all other state laws
337337 and local laws not in conflict with this act.
338338 SECTION 4. NEW LAW A new section of law to be codified
339339 in the Oklahoma Statutes as Section 1-1153 of Title 63, unless there

392392 A. The State Department of Health shall prepare a written
393393 application for a statewide mobile food vending license. The
394394 Department shall mak e the mobile food vending license application
395395 available to applicants in person and on the Department’s website.
396396 B. The Department shall require an applicant to provide the
397397 following information, under oath, before issuing a license:
398398 1. The name, permanent address and telephone number of the
399399 applicant;
400400 2. The name, address and telephone number of any associated
401401 entities or organizations that the applicant is representing and
402402 copies of documents verifying that relationship ;
403403 3. A listing of all primary re sidences for the last five (5)
404404 years;
405405 4. A statement of whether any employees or a gents will operate
406406 with the applicant und er the license and whether the employees or
407407 agents hold a current food safety certification;
408408 5. The nature of the food or beverages to be offered by the
409409 applicant; and
410410 6. A statement of whether the applicant has p reviously been
411411 denied a license to operat e as a mobile food vendor or if the
412412 applicant has had a previous mobile food vending license suspended
413413 or revoked in any state or lo cal jurisdiction and, if so, the
414414 reasons or the circumstances surrounding the denia l, suspension or
415415 revocation.

467467 C. In addition to the written application, the Department shal l
468468 require an applicant who will operate from a food vending vehicle to
469469 provide the following:
470470 1. A listing of all vehicle license numbers, vehicle
471471 descriptions, vehicle identification numbers and vehicle
472472 registration papers;
473473 2. Proof of automobile insura nce for the vehicle or vehicles
474474 from which the applicant proposes to conduct busi ness; and
475475 3. A copy or proof of any additional licenses or permits
476476 required by this state for certain commercial vehicles.
477477 D. Any person who drives a food vending vehicle sh all hold a
478478 current driver license to drive the food vending vehicle.
479479 E. The applicant shall complete the application form and abide
480480 by any request for information required by this act made by the
481481 Department. The applicant may submit one application for a ll
482482 vehicles which require a license. Failure to submit a complete
483483 application form and provide all requested information may result in
484484 denial of a license.
485485 F. Within thirty (30) days of receiving a compl ete application,
486486 the Department, or a local authori ty acting under a collaborative
487487 agreement pursuant to Section 6 of this act, shal l conduct a health
488488 inspection, if required by the Department, prior to issuing a mo bile
489489 food vending license. The purpose o f the inspection is to ensure
490490 the applicant’s vehicle is safe for preparing, handling and selling

543543 regulations.
544544 G. The Department may establish a reas onable schedule of fees
545545 not to exceed Two Hundred Dollars ($200.00) for a mobile food
546546 vending license or for renewal of a mobile food vending license.
547547 The Department may al so establish an inspection fee that covers the
548548 average cost of conducting health in spections for the vendor and
549549 charge that fee in conjunction with a mobile food vending licen se
550550 fee or the renewal fee of a mobile food vending license.
551551 H. Upon a receipt of a complete application and an applicant
552552 passing initial inspection if required by the Department, the
553553 Department shall issu e a mobile vending license to the applicant.
554554 Licenses shall be valid for one (1) year.
555555 I. Licenses are not transferable, nor shall a license authorize
556556 the activities of any person other than the person to whom it is
557557 issued, except that the sale of the sp ecific vehicle identified in a
558558 license application, when replaced by another vending vehicle on a
559559 one-for-one basis, will not invali date the original license nor
560560 cause a new license to be required. When replacing a vending
561561 vehicle on a one-for-one basis, the licensee shall notify the
562562 Department of the inf ormation required by subsection C of this
563563 section. If the Department determines an inspection of the new
564564 vehicle is required, the inspection shall take place as so on as

616616 practicable but no later than fourt een (14) calendar days from
617617 receipt of the informat ion required by subsection C of this section.
618618 J. If a mobile food vendor transfe rs its mobile food vending
619619 business assets, the recipient of the assets shall, befo re operating
620620 in the state, apply for and obtain a new mobile food vending
621621 license.
622622 K. Licenses shall be renewed on an annual basis. The
623623 Department shall send notice to the licensee. It is the
624624 responsibility of the licensee to submit the renewal applicat ion
625625 annually, at least fourteen (14) days prior to the license’s
626626 expiration date. While an application for renewal is pending with
627627 the Department, a licensee may continue m obile food vending
628628 operations.
629629 L. It shall be a misdemeanor for any individual to
630630 intentionally provide false information o r to intentionally omit
631631 requested information on an application for any license issued
632632 pursuant to this act.
633633 M. The Department shal l prepare a guide for applicants for a
634634 mobile food vending license. The guide shal l include instructions
635635 for applying for, obtaining and maintaining a mobile food vending
636636 license and shall describe the standards used to inspect food
637637 vending vehicles. The guide shall be made available for applicants
638638 in person at the Department ’s office and on the Department’s
639639 website.

694694 A. Mobile food vendors shall follow all state and local la ws
695695 and regulations governing operations in the juri sdiction where the
696696 vendor is operating including without limitation all fire code s,
697697 zoning codes, occupational tax codes and any other applicable state
698698 and local authority codes and laws not in conflict wi th the
699699 provisions of this act.
700700 B. A mobile food ve ndor may operate in the following locations:
701701 1. On public property, except as pr ovided in paragraph 3 of
702702 subsection A of Section 7 of this act, so long as the vend ing
703703 vehicle is not parked within twenty ( 20) feet of an intersection. A
704704 mobile vendor may operate from legal parking spaces on the public
705705 right-of-way including metered spa ces upon payment of appropriate
706706 fees. When operating on public property, a mobile vendor is subject
707707 to the same parking rul es, restrictions and obligations that a
708708 commercial vehicle would be subject to if not used by a mobile food
709709 vendor; and
710710 2. On private property under the following circumstances:
711711 a. the property is located in an ind ustrial, commercial
712712 or institutional zoni ng district, and the vendor has
713713 permission of the property owner or designee or a
714714 lessor, and

766766 b. the property is located in a reside ntial zoning
767767 district, and the mobile food vendor has been invited
768768 by a resident or group of residents in that district
769769 to operate on their property for the purpose of
770770 serving food to that resident, group of residents or
771771 their guests.
772772 C. A mobile food ven dor shall not operate in any manner which
773773 will interfere with or obstruct the free passage of pedestrians or
774774 vehicles along any street, sidewalk or parkway.
775775 D. When operating, a mobile food vendor shall:
776776 1. Maintain a food vending vehicle in good operati ng order and
777777 visual appearance including the removal of any graffiti that is not
778778 part of the overall design or art featured on the vehicle;
779779 2. Park so that its service window faces the sidewalk or away
780780 from the street if the vehicle is parked along a stre et;
781781 3. Serve customers through a service window;
782782 4. Provide a waste receptacle fo r customers which is clearly
783783 visible and request its use by customers;
784784 5. Remove and dispos e of all refuse within twenty -five (25)
785785 feet of the vendor’s operating area at th e conclusion of operation;
786786 6. Submit to and pass any required health inspections; and
787787 7. Display the mobile food vendor li cense and required
788788 inspection certificates or permi ts in a conspicuous location for
789789 public view.

841841 E. The State Department of Health may promulgate rules to
842842 enforce the provisions of this act. Rules adopted shall no t:
843843 1. Require a mobile food vendor to op erate a specific distance
844844 from the perimeter of an existing commercial establishment;
845845 2. Require a mobile food vendor to enter into any agreement
846846 with a commercial establishment;
847847 3. Restrict the operating hours of a mobile food vendor;
848848 4. Require a mobile food vendor that does not prepare food to
849849 have a handwashing sink in his or her food vending vehicle;
850850 5. Require a mobile food v endor to associate with a commissary
851851 if the vendor carries all the equipment necess ary to comply with
852852 health and safety stan dards and all applicable regulations;
853853 6. Limit the number of mobile food vendor licenses issued ;
854854 7. Require a mobile food vendor t o obtain any additional
855855 permits from a local authority, unless the mobile food vend or seeks
856856 to operate in a local, public pa rk;
857857 8. Require a mobile food vendor to be fingerpr inted;
858858 9. Require a mobile food vendor to install a GPS tracking
859859 device on the vendor’s vehicle;
860860 10. Require a mobile food vendor to stay in constant motion
861861 except for when serving customers;
862862 11. Require a mobile food vendor to maintain insurance that
863863 names a local authority as an additional insured unless the vendor
864864 is attending an event sponsored by the local authority; and

916916 12. Require a mobile food vendor to s ubmit to inspections
917917 beyond health inspec tions conducted by the Department or by a local
918918 authority under a collaborative agreement with the Department,
919919 unless the Department is investigating a reported foodborne illness .
920920 SECTION 6. NEW LAW A new section of law to be codifi ed
921921 in the Oklahoma Statutes as Se ction 1-1155 of Title 63, unless there
922922 is created a duplication in numbering, reads as follows:
923923 A. Mobile food vendors shall adhere to all laws and regulations
924924 of the Oklahoma Admin istrative Code pertaining to the preparat ion
925925 and handling of food.
926926 B. Any person preparing food or beverages in a food vending
927927 vehicle shall hold a current food safety cert ification recognized by
928928 this state. At all times at least one person working in a food
929929 vending vehicle must hold a current food safety certification
930930 recognized by this state.
931931 C. Upon receipt of a complete license application, the State
932932 Department of Health shall classify a mobile food vendor into one of
933933 the following three classificati ons for the purpose of conducting
934934 inspections:
935935 1. If a vendor dispenses p repackaged foods or non-
936936 time/temperature control for safety food, as defined in 310:257 -1-2
937937 of the Oklahoma Administrative Code, beverages or poses a low risk
938938 of harm to the public, it shall be classified as a Mobile Food T ype

991991 2. If a vendor dispenses food that requires limited handling
992992 and preparation, it shall be classified as a Mobile Food Type II
993993 Vendor; and
994994 3. If a vendor prepares, cooks, holds and serves food from th e
995995 vehicle, it shall be classified as a Mo bile Food Type III Vendor.
996996 D. The Department shall specify the categories of foods or
997997 beverages that mobile vendors in each classif ication may serve. If
998998 a mobile food vendor seeks to serve food or beverages that m ay
999999 require the vendor to be reclassified, the mobile food vendor shall
10001000 notify the Department of the nature of the food or beverages to be
10011001 sold, and the Department shall recl assify the mobile food vendor.
10021002 E. For the purpose of protecting public health and safety, the
10031003 Department shall ensure that mobile food vendors are inspected on an
10041004 ongoing, randomized basis pursuant to the frequency set forth in
10051005 subsection I of this section based on their classification and
10061006 inspection grade. The Department, upon a local authority’s request,
10071007 may enter into a collaborative agreement with the lo cal authority
10081008 for conducting health inspections. The Department shall reimburse
10091009 the local authority acting under a collaborative agreement for the
10101010 cost of conducting inspections usi ng funds from inspection fees
10111011 collected from licensees pursuant to subsection K of this section.
10121012 F. The Department shall establish and maintain a statewide

10671067 G. Health inspections shall be conducted by the Department
10681068 or a local authority acting under a collaborative agreement using
10691069 statewide inspection criteria and a score -based grading system
10701070 established by the Department based on objective facto rs. The
10711071 inspection criteria shal l provide a letter-grade format that rates
10721072 the vendor with an “A,” “B,” “C” or “F” grade, based on the score
10731073 received during the inspection. If a vendor receives two
10741074 consecutive “A” grades, it shall be given a certificate of
10751075 excellence. If a vendor recei ves an “F” grade, the Department may
10761076 suspend the mobile food vendor ’s license until the mobile food
10771077 vendor corrects the violations.
10781078 H. Upon completion of an inspection, the Departme nt, or local
10791079 authority operating under a collaborative agreement, shall issue a
10801080 certificate to the mobile food vendor displaying the vendor ’s letter
10811081 grade or achievement of excellence and record the grade in the
10821082 Department’s database. The mobile food vend or shall display its
10831083 certificate indicati ng its letter grade or achievement of excellence
10841084 in a conspicuous place for public view.
10851085 I. Health inspections shall occur on a ran domized basis,
10861086 pursuant to the following frequency, based on the mobile food

11391139 1. A Mobile Food Type I Vendor shall be inspected only upon the
11401140 Department or a local authority being notified of a public health or
11411141 safety complaint reg arding the vendor. If the inspection reveals a
11421142 violation of law or rule, the vendo r shall become subject to
11431143 inspections at the frequency set for a Mobile Food Type II Vendor
11441144 until the vendor obtains a certificate of excellence;
11451145 2. Mobile Food Type II Ven dors shall be inspected once per
11461146 calendar year. If a Mobile Food Type II Vendor re ceives a
11471147 certificate of excellence, it sh all become subject to inspections at
11481148 the frequency set for Mobile Food Type I Vendors. If a Mobile Food
11491149 Type II Vendor holding a ce rtificate of excellence receives a score
11501150 lower than an “A” on a subsequent inspecti on, the vendor shall lose
11511151 its certificate of excellence and return to bein g inspected once per
11521152 year; and
11531153 3. Mobile Food Type III Vendors shall be inspected twice per
11541154 calendar year. If a Mobile Food Type III Vendor receives a
11551155 certificate of excellence, it shall be inspected at the frequency
11561156 set for Mobile Food Type II Vendors. If a Mobile Food Type III
11571157 Vendor holding a certificate of excellence receives a score lower
11581158 than an “A” on a subsequent inspection, the vendor shall lose its
11591159 certificate of excellen ce and return to being inspected twice pe r
11601160 calendar year.
11611161 J. The Department, or local authority acting under a

12211221 the Department or local authority.
12221222 K. The Department shall calculate the average cost of providing
12231223 notice of and conducti ng a health inspection. If the Departmen t has
12241224 entered into a collaborative agreement with a local authority, the
12251225 Department shall consult with the local authority and deter mine the
12261226 average cost of providing notice of and conducting health
12271227 inspections in that jurisdiction. The Department shall c harge the
12281228 mobile food vendor an i nspection fee at the time the mobile vendor
12291229 applies for or renews a license, based on the average c ost of
12301230 providing notice of and conducting an inspection, multiplied by the
12311231 number of annual inspections required for the upc oming year as
12321232 required by this section. A mobile food vendor may request
12331233 reimbursement for an inspection that was not conducted at the
12341234 expiration of its mobile vending license or when the vendor renews a
12351235 license. The Department shall reimburse the vendor for any

15971597 safety, the Department may immedi ately suspend or revoke a mobile
15981598 food vending license. The mobile food vendor may request a hearing
15991599 regarding the suspensio n or revocation within fourteen ( 14) calendar
16001600 days of receiving notice of the suspension or revocation. Any
16011601 hearing regarding the s ummary suspension or revocation of a license
16021602 shall be given priority over all poten tial license denial,
16031603 suspension or revoca tion proceedings and shall be hel d within seven
16041604 (7) calendar days from the date the Department receives a mobile
16051605 food vendor’s request for a hearing, and the Department shall issue
16061606 findings of fact, conclusions of l aw and a decision at the
16071607 conclusion of the hearing.
16081608 D. It shall be a misdemeanor for a licensee whose license has
16091609 been suspended or revoked to continue business operations. If the

17551755 religious organization ’s bake sale;
17561756 4. An area where food that is prepared as specified in
17571757 paragraph 3 of this subsection is sold or offered for huma n

18241824 9. Day care centers or family day care ce nters, and all other
18251825 child care facilitie s as defined and licensed pursuan t to the
18261826 provisions of the Oklahoma Child Care Facilities Licensing Act;
18271827 10. Nursing facilities and specialized facilities, as defined
18281828 in and licensed pursuant to the provisions of the Nursing Home Care
18291829 Act, residential care homes as defined by the Reside ntial Care Act,
18301830 adult day care centers as defined by the Adult Day Care Act, and
18311831 assisted living centers and continuum of care facilities licensed
18321832 pursuant to the Continuum of Care a nd Assisted Living Act; and

18861886 12. Mobile food vendors licensed pu rsuant to Section 3 of this
18871887 act.
18881888 B. Each license shall expire one (1) year following the date o f
18891889 its issuance. The State Department of Health shall charge and
18901890 collect for each such license an annual fee to be fixed by the State
18911891 Board of Health.
18921892 1. The Board may provide by rule for a fee-exempt license for a
18931893 food establishment operated by a nonprof it, civic, charitable or
18941894 religious organization that uses unpaid persons t o sell or offer
18951895 food on a more frequent basis than the occasional fund -raising
18961896 event. A fee-exempt license shall not expire but shall remain in
18971897 full force and effect until affirmati vely revoked, suspended,
18981898 annulled or withdrawn by the Department in accord ance with
18991899 applicable law.
19001900 2. The Board may by rule also provide that licenses for
19011901 establishments serving events of limited duration or operating on a
19021902 seasonal basis shall extend onl y for the term of the event or
19031903 season, and may by rule adjust the fees for such licenses
19041904 accordingly.
19051905 3. The Board shall provide by rule a three -day license for
19061906 vendors who only sell at farmers markets as defined in 310:257 -1-2
19071907 of the Oklahoma Administrat ive Code or at county fairs. Licenses
19081908 for vendors who only sell at farmers markets or county fairs shall
19091909 not exceed Fifty Dollars ($50.00). Vendors who do not sell food and

19611961 vendors who meet the exceptions provided in subsection A of this
19621962 section shall not be required to obtain a three -day license or a
19631963 food establishment licens e.
19641964 C. The State Board of Health shall promulgate reasonable
19651965 standards and rules for s anitation of establishments required to be
19661966 licensed, which shall include the following: building s, vehicles,
19671967 and appurtenances thereto , including plumbing, ventilation an d
19681968 lighting; construction, cleanliness and bactericidal treatment of
19691969 equipment and utensils; cleanliness, wholesomeness, storage and
19701970 refrigeration of food and drink sold or served; cl eanliness and
19711971 hygiene of personnel; toile t facilities; disposal of waste; water
19721972 supply; and other items deemed necessary to safeguard the health,
19731973 comfort, and safety of customers.
19741974 SECTION 14. This act shall become effective November 1, 202 1.
