248 | 248 | | 1. “Customer” means any person with whom a mobile food vendor |
---|
249 | 249 | | conducts his or her mobile vending busine ss, or any person who stops |
---|
250 | 250 | | to contemplate conducti ng such business with a mobile food vendor; |
---|
251 | 251 | | 2. “Department” means the State Depa rtment of Health; |
---|
252 | 252 | | 3. “Food vending vehicle” means any motorized, two -axle vehicle |
---|
253 | 253 | | used to sell food and beverages by a mobi le food vendor; |
---|
254 | 254 | | 4. “Local authority” means any local government including any |
---|
255 | 255 | | town, city, charter city, political subdivision or co unty; |
---|
256 | 256 | | 5. “Mobile food vendor” means any person who dispenses food or |
---|
257 | 257 | | beverages from a food vending vehicle for immediate se rvice or |
---|
258 | 258 | | consumption; |

259 | 259 | | 6. “Person” means any individual, group of individuals, firm, |
---|
260 | 260 | | partnership, company, corporation, trustee, ass ociation or any |
---|
261 | 261 | | public or private entity and includes the entity ’s employees or |

333 | 333 | | vendor. |

334 | 334 | | B. No local authority may prohibit a mobile food vendor from |

335 | 335 | | lawfully operating in its jurisdiction if the vendor holds a mobile |

336 | 336 | | food vending license and is in compliance with all other state laws |

396 | 396 | | B. The Department shall require an applicant to provide the |

397 | 397 | | following information, under oath, before issuing a license: |

398 | 398 | | 1. The name, permanent address and telephone number of the |
---|
399 | 399 | | applicant; |
---|
400 | 400 | | 2. The name, address and telephone number of any associated |
---|
401 | 401 | | entities or organizations that the applicant is representing and |
---|
402 | 402 | | copies of documents verifying that relationship ; |
---|
403 | 403 | | 3. A listing of all primary re sidences for the last five (5) |
---|
404 | 404 | | years; |
---|
405 | 405 | | 4. A statement of whether any employees or a gents will operate |
---|
406 | 406 | | with the applicant und er the license and whether the employees or |
---|
407 | 407 | | agents hold a current food safety certification; |
---|
408 | 408 | | 5. The nature of the food or beverages to be offered by the |
---|
409 | 409 | | applicant; and |
---|
410 | 410 | | 6. A statement of whether the applicant has p reviously been |
---|
411 | 411 | | denied a license to operat e as a mobile food vendor or if the |
---|
412 | 412 | | applicant has had a previous mobile food vending license suspended |
---|
413 | 413 | | or revoked in any state or lo cal jurisdiction and, if so, the |
---|
414 | 414 | | reasons or the circumstances surrounding the denia l, suspension or |
---|
415 | 415 | | revocation. |

468 | 468 | | require an applicant who will operate from a food vending vehicle to |

470 | 470 | | 1. A listing of all vehicle license numbers, vehicle |
---|
471 | 471 | | descriptions, vehicle identification numbers and vehicle |
---|
472 | 472 | | registration papers; |
---|
473 | 473 | | 2. Proof of automobile insura nce for the vehicle or vehicles |
---|
474 | 474 | | from which the applicant proposes to conduct busi ness; and |
---|
475 | 475 | | 3. A copy or proof of any additional licenses or permits |
---|
476 | 476 | | required by this state for certain commercial vehicles. |
---|
477 | 477 | | D. Any person who drives a food vending vehicle sh all hold a |
---|
478 | 478 | | current driver license to drive the food vending vehicle. |
---|
479 | 479 | | E. The applicant shall complete the application form and abide |
---|
480 | 480 | | by any request for information required by this act made by the |
---|
481 | 481 | | Department. The applicant may submit one application for a ll |
---|
482 | 482 | | vehicles which require a license. Failure to submit a complete |
---|
483 | 483 | | application form and provide all requested information may result in |
---|
484 | 484 | | denial of a license. |
---|
485 | 485 | | F. Within thirty (30) days of receiving a compl ete application, |
---|
486 | 486 | | the Department, or a local authori ty acting under a collaborative |
---|
487 | 487 | | agreement pursuant to Section 6 of this act, shal l conduct a health |
---|
488 | 488 | | inspection, if required by the Department, prior to issuing a mo bile |
---|
489 | 489 | | food vending license. The purpose o f the inspection is to ensure |
---|
490 | 490 | | the applicant’s vehicle is safe for preparing, handling and selling |
---|

553 | 553 | | Department shall issu e a mobile vending license to the applicant. |

554 | 554 | | Licenses shall be valid for one (1) year. |

555 | 555 | | I. Licenses are not transferable, nor shall a license authorize |

556 | 556 | | the activities of any person other than the person to whom it is |

557 | 557 | | issued, except that the sale of the sp ecific vehicle identified in a |

558 | 558 | | license application, when replaced by another vending vehicle on a |

629 | 629 | | L. It shall be a misdemeanor for any individual to |
---|
630 | 630 | | intentionally provide false information o r to intentionally omit |
---|
631 | 631 | | requested information on an application for any license issued |
---|
632 | 632 | | pursuant to this act. |

633 | 633 | | M. The Department shal l prepare a guide for applicants for a |
---|
634 | 634 | | mobile food vending license. The guide shal l include instructions |
---|
635 | 635 | | for applying for, obtaining and maintaining a mobile food vending |
---|
636 | 636 | | license and shall describe the standards used to inspect food |
---|

---|

774 | 774 | | vehicles along any street, sidewalk or parkway. |

775 | 775 | | D. When operating, a mobile food vendor shall: |
---|
776 | 776 | | 1. Maintain a food vending vehicle in good operati ng order and |
---|
777 | 777 | | visual appearance including the removal of any graffiti that is not |
---|
778 | 778 | | part of the overall design or art featured on the vehicle; |
---|
779 | 779 | | 2. Park so that its service window faces the sidewalk or away |
---|
780 | 780 | | from the street if the vehicle is parked along a stre et; |
---|
781 | 781 | | 3. Serve customers through a service window; |
---|
782 | 782 | | 4. Provide a waste receptacle fo r customers which is clearly |
---|
783 | 783 | | visible and request its use by customers; |
---|
784 | 784 | | 5. Remove and dispos e of all refuse within twenty -five (25) |
---|
785 | 785 | | feet of the vendor’s operating area at th e conclusion of operation; |
---|
786 | 786 | | 6. Submit to and pass any required health inspections; and |
---|
787 | 787 | | 7. Display the mobile food vendor li cense and required |
---|
788 | 788 | | inspection certificates or permi ts in a conspicuous location for |
---|

849 | 849 | | have a handwashing sink in his or her food vending vehicle; |

850 | 850 | | 5. Require a mobile food v endor to associate with a commissary |
---|
851 | 851 | | if the vendor carries all the equipment necess ary to comply with |
---|
852 | 852 | | health and safety stan dards and all applicable regulations; |

853 | 853 | | 6. Limit the number of mobile food vendor licenses issued ; |

854 | 854 | | 7. Require a mobile food vendor t o obtain any additional |
---|
855 | 855 | | permits from a local authority, unless the mobile food vend or seeks |

856 | 856 | | to operate in a local, public pa rk; |

857 | 857 | | 8. Require a mobile food vendor to be fingerpr inted; |

858 | 858 | | 9. Require a mobile food vendor to install a GPS tracking |

931 | 931 | | C. Upon receipt of a complete license application, the State |

932 | 932 | | Department of Health shall classify a mobile food vendor into one of |

933 | 933 | | the following three classificati ons for the purpose of conducting |
---|

1076 | 1076 | | suspend the mobile food vendor ’s license until the mobile food |

1078 | 1078 | | H. Upon completion of an inspection, the Departme nt, or local |
---|
1079 | 1079 | | authority operating under a collaborative agreement, shall issue a |
---|
1080 | 1080 | | certificate to the mobile food vendor displaying the vendor ’s letter |
---|
1081 | 1081 | | grade or achievement of excellence and record the grade in the |

1968 | 1968 | | lighting; construction, cleanliness and bactericidal treatment of |

1969 | 1969 | | equipment and utensils; cleanliness, wholesomeness, storage and |
---|
1970 | 1970 | | refrigeration of food and drink sold or served; cl eanliness and |
---|
1971 | 1971 | | hygiene of personnel; toile t facilities; disposal of waste; water |
---|
1972 | 1972 | | supply; and other items deemed necessary to safeguard the health, |
---|
1973 | 1973 | | comfort, and safety of customers. |
---|
