62-SECTION 1. AMENDATORY 42 O.S. 2021, Section 91A, is

98-b. This section applies to any vehicle, all -terrain
99-vehicle, utility vehicle, manufactured home,
10089 motorcycle, boat, outboard motor, or trailer that is
10190 excluded from covera ge under subsection A of Section
10291 91 of this title because the personal p roperty:
10392 (1) does not have a certificate of title,
10493 (2) has a certificate of title but does not have an
10594 active lien recorded on the certificate of title,
10695 (3) has a certificate of titl e that is not issued by
10796 the Oklahoma Tax Commission or by a federally
10897 recognized Indian tribe in the S tate of Oklahoma,
10998 or
11099 (4) is otherwise excluded by subparagraph b of
111100 paragraph 1 of subsection A of Section 91 of this
112101 title or subsection D of Section 91 of this
113102 title.
114103 c. If personal property has a certificate of title, or
115104 would be required to have a cert ificate of title under
116105 Oklahoma law, and is apparently covered both by this
117106 section and by Sections 191 through 200 of this t itle,
118107 the procedures set out in this section shall apply

147-personal property without a certificate of title and
148-not required to be titled under Oklahoma law is
149-covered both by this sectio n and Sections 191 through
150-200 of this title, the procedures set out in Sections
151139 191 through 200 of this title shall ap ply instead of
152140 this section.
153141 2. a. Any person who, while lawfully in p ossession of an
154142 article of personal property to which this section
155143 applies, renders any service to the owner the reof by
156144 furnishing storage, rental space, material, labor or
157145 skill for the protection, improvement, sa fekeeping,
158146 towing, right to occupy space, storage or carriage
159147 thereof, has a special lien thereon, dependent on
160148 possession, for the compensation, if any, which is due
161149 to such person from the owner for such service.
162150 Charges owed under a contract primarily for the
163151 purpose of storage or rental of sp ace shall be accrued
164152 only at the regular periodic rate for storage or
165153 rental as provided in the contract, adjust ed for
166154 partial periods of storage or rental.
167155 b. Except for Class AA licens ed wrecker towing charges,
168156 the special lien shall be subordinate to an y perfected
169157 security interest unless the claimant complies with
170158 the requirements of this section. Failure to co mply
159+with any requirements of this section shall result in
160+denial of any title application and cause t he special
161+lien to be subordinate to any p erfected lien. Upon
162+such denial, the applicant shall be entitled to one

201-such denial, the applicant shall be entitled t o one

249-c. Any person claiming a lien under this section shall
250-request, within five (5) busin ess days of performing
251-any service or work on the property, the Tax
252-Commission or other appropriate license a gency to
253239 furnish the name and address of the current owner of
254240 and any lienholder upon the property. The Motor
255241 Vehicle Division of the Tax Commissi on or appropriate
256242 license agency shall res pond in person or by mail to
257243 the lien claimant within ten (10) business days of the
258244 receipt of the request for i nformation. The Tax
259245 Commission shall render assistance to ascertain
260246 ownership, if needed. The lien c laimant shall send,
261247 within seven (7) busin ess days of receipt of the
262248 requested information from the Oklahoma Tax Commission
263249 or other license agency, a not ice of the location of
264250 the property by certified mail with return receipt
265251 requested, postage prepaid, to the owner and any
266252 lienholder of the veh icle at the addresses furnished.
267253 The lien claimant may charge Twenty Dollars ($20. 00)
268254 not more than Fifty Dolla rs ($50.00) for processing
269-plus the cost of postage if the notic e is timely sent
270-pursuant to the requirements of this subparagraph in
271-addition to fees regulated by the Oklahoma Corporation
272-Commission for license d wreckers. If the lien
255+plus including the cost of postage if the notic e is
256+timely sent pursuant to the requirements of this
257+subparagraph in addition to fees regulated by the
258+Oklahoma Corporation Commission for licensed wreckers.
259+If the lien claimant i s unable to meet the time

300-claimant is unable to meet the time requirements due
301-to a lack of or an altered vehi cle identification
302-number on the property, the lien claimant shall
303-proceed diligently to obtain the proper vehicle
304-identification number and shall meet the time
289+vehicle identification number and shall meet the time
305290 requirements on the n otice once the vehicle
306291 identification number is known. If the lien claima nt
307292 is required to send addit ional notices because of
308293 change of ownership or lienholder after it has timely
309294 complied with the requirements of this subparagraph,
310295 the lien claimant shal l remain in compliance if such
311296 additional notices are sent within the requ ired time
312297 periods from the date of discovery of the new owners
313298 or lienholders. The notice shall be in writing and
314299 shall contain, but not be limited to, the following:
315300 (1) a statement that the notice is a Notice of
316301 Possessory Lien,
317302 (2) the complete legal n ame, physical and mailing
318303 address, and telephone number of the claiman t,
319304 (3) the complete legal name, physical and mailing
320305 address of the person who requested that the
321306 claimant render service to the owner by
322307 furnishing material, labor or skill, storage , or
323308 rental space, or the date t he property was
309+abandoned if the claimant did not render any
310+other service,
311+(4) a description of the article of personal
312+property, and the complete physic al and mailing

353-(4) a description of the article of persona l
354-property, and the complete physical and mailing
355339 address of the location of the article of
356340 personal property,
357341 (5) the nature of the work , labor or service
358342 performed, material fur nished, or the storage or
359343 rental arrangement, and the date thereof, and
360344 written proof of authority to perform th e work,
361345 labor or service provided that, in the case of a
362346 law enforcement directed tow, the logbook ent ry
363347 prescribed in OAC 595:25 -5-5 or the tow ticket as
364348 defined by the Corporation Commission shall serve
365349 as written proof of authority,
366350 (6) the signature of the claimant which shall be
367351 notarized and, if applicable, the signature o f
368352 the claimant’s attorney. If the claimant is a
369353 business, the name of the contact person
370354 representing the business shall be shown. In
371355 place of an original signature and notary seal , a
372356 digital or electronic signature or seal shall be
373357 accepted, and
358+(7) an itemized statement describin g the date or
359+dates the labor or services were performed and
360+material furnished and the charges claimed for
361+each item, the totals of which shall equal the
362+total compensation claimed.

403-material furnished and the charges claimed for
404-each item, the totals of which shall equal the
405-total compensation claimed.
406389 The lien claimant shall not be required to se nd the
407390 notice required in th is subparagraph if the property
408391 is released to an interested party before the notice
409392 is mailed and no additional charges or fees continue
410393 to accrue. If a law enforcement agency has the
411394 property towed to a law enforcement facili ty, the
412395 person claiming a li en under this section shall not be
413396 required to send notice until the property is released
414397 by law enforcement to the claimant or the date which
415398 claimant starts charging storage, whichever is
416399 earlier. A lien claimant shall have a n extension of
417400 ten (10) business days to send the notice required in
418401 this subparagraph if a state of emergency has been
419402 declared in the county in which the property is
420403 located.
421404 d. Subparagraphs b and c of this paragraph shall not
422405 apply to salvage pools as defined in Section 591.2 of
423406 Title 47 of the Oklahoma Statutes.
407+3. The lien may be foreclosed by a sale of such personal
408+property upon the notice and in the manner following: The no tice
409+shall be in writing and shall contain, but not be limited to:

451-3. The lien may be foreclosed by a sale of such personal
452-property upon the notice a nd in the manner following: The notice
453-shall be in writing and shall contain, but not be limited to:
454-a. the names of the owner and any o ther known party or
455-parties who may claim any interest in the property,
456438 b. a description of the property to be sold, including a
457439 visual inspection or a ph otograph if the property is a
458440 motor vehicle, and the physical location of the
459441 property,
460442 c. the nature of the work, labor or service performed,
461443 material furnished, or the storage or rental
462444 arrangement, and the date thereof, and written proof
463445 of authority to perform the work, labor or service
464446 provided. In the case of a law enforc ement directed

506487 4. a. Such Notice of Sale shall be posted in two public
507488 places in the county where the property is to be sold
508489 at least ten (10) days before the time therein
509490 specified for such sale, and a copy of the no tice
510491 shall be mailed to the owner and any other party
511492 claiming any interest in the property, if known, at
512493 their last-known post office address, by certified
513494 mail, return receipt requeste d, at least ten (10) days
514495 before the time therein specified for such s ale. If
515496 the item of personal property is a manufactured home,
516497 notice shall also be sent by certified mail to th e
517498 county treasurer and to the county assessor of the
518499 county where the manu factured home is located.
519500 b. In the case of any item of personal prope rty without a
520501 certificate of title and not required to be titled
521502 under Oklahoma law, a party who claims any inte rest in
522503 the property shall include all owners of the property;
523504 any secured party who has an active fin ancing
524505 statement on file with the county c lerk of Oklahoma
525506 County listing one or more owners of the property by
507+legal name as debtors and indicating a col lateral
508+description that would include the property; and any
509+other person having any interest in the p ersonal
510+property, of whom the claimant has actual notice.

554-description that would include the property; and any
555-other person having any interest in the p ersonal
556-property, of whom the claimant has actual notice.
557537 c. In the case of personal property subject to this
558538 section for which a certificate of title has been
559539 issued by any jurisdiction, a party who claims any
560540 interest in the property shall include all ow ners of
561541 the article of personal property a s indicated by the
562542 certificate of title; lien debtors, if any, other than
563543 the owners; any lienholder whose lien is noted on the
564544 face of the certificate of title; and any other person
565545 having any interest in the arti cle of personal
566546 property, of whom the clai mant has actual notice.
567547 d. When the jurisdiction of titling for a vehicle, all -
568548 terrain vehicle, motorcycle, boat , outboard motor, or
569549 trailer that is five (5) model years old or newer, or
570550 a manufactured home that is fifteen (15) model years
571551 old or newer, cannot be determined by ordinary means,
572552 the claimant, the agent of the claimant, or the
573553 attorney of the claimant, shall request, in writing,
574554 that the Oklahoma Tax Commission Motor Vehicle
575555 Division ascertain the juris diction where the vehicle
576556 or manufactured home is titled. The Oklahoma Tax
557+Commission Motor Vehicle Division shall, within
558+fourteen (14) days from the da te the request is
559+received, provide information as to the jurisdiction
560+where the personal property is titled. If the

605-fourteen (14) days from the date the request is
606-received, provide information as to the jurisdiction
607-where the personal property is titled. If the
608587 Oklahoma Tax Commission Mo tor Vehicle Division is
609588 unable to provide the information, it shall provide
610589 notice that the record is not availa ble.
611590 e. When personal property is of a type that Oklahoma law
612591 requires to be titled, the owner of reco rd of that
613592 property is unknown, and the ju risdiction of titling
614593 and owner of record cannot be determined by ordinary
615594 means and also, if applicable, cannot be determined in
616595 accordance with the preceding subparagraph, then the
617596 special lien may be foreclosed by publication of a
618597 legal notice in a lega l newspaper in the county where
619598 the personal property is located, as defined in
620599 Section 106 of Title 25 of the O klahoma Statutes.
621600 Such notice shall include the description of the
622601 property by year, make, vehicle id entification number
623602 if available from the property, the name of the
624603 individual who may be contacted for information, and
625604 the telephone number of that pers on or the address
626605 where the vehicle is located. The legal notice shall
627606 be published once per week for three (3) consecutive
607+weeks. As soon as circumstances exist as described in
608+the first sentence of this subparagraph, the first
609+date of publication may o ccur even if the special lien
610+has not accrued for over thirty (30) days. The first

655-weeks. As soon as circumstances exist as described in
656-the first sentence of this subparagraph, the first
657-date of publication may occur even if the special lien
658-has not accrued for over thirty (30) days. The first
659637 date available for public sale of the vehicle is the
660638 day following publication of the final notice, but no
661639 fewer than thirty (30) days after the lien has
662640 accrued. When the owner of record is unknown, the
663641 Notice of Sale nevertheless must be compl eted and
664642 mailed to any known interested party by certified
665643 mail. For purposes of this paragraph, interested
666644 parties shall include all persons described in
667645 subparagraph b or subparag raph c of this paragraph,
668646 whichever is applicable, with the exception of a ny
669647 owner who is unknown. Ex cept in circumstances
670648 described in paragra ph 7 of this subsection that
671649 provide for a shorter time period, the Notice of Sale
672650 shall be posted in two public places in the county
673651 where the property is to be sold at least ten (10)
674652 days before the time therein specified for such sale,
675653 and the Notice of Sale shall not be mailed until at
676654 least thirty (30) days after the lien has accrued.
677655 5. The lienor or any othe r person may in good faith become a
678656 purchaser of the property sold.
657+6. Proceedings for foreclosure un der this act shall not be
658+commenced until thirty (30) days after the lien has accrued, except
659+as provided elsewhere in Oklahoma law.

706-6. Proceedings for foreclosure un der this act shall not be
707-commenced until thirty (30) days after the lien has accrued, except
708-as provided elsewhere in Oklahoma law.
709686 7. Notwithstanding a ny other provision of law, proceedings for
710687 foreclosures for the storage of junk vehicles towed and sto red
711688 pursuant to Section 955 of Title 47 of the Oklahoma Statutes by
712689 Class AA wreckers listed with the Motor Vehicle Division of the
713690 Department of Public S afety, may be commenced five (5) days after
714-the lien has accrued. For pur poses of this paragraph, "junk
715-vehicles" means any vehicle that is mor e than ten (10) years old if
691+the lien has accrued. For pur poses of this paragraph, junk
692+vehicles means any vehicle that is mor e than ten (10) years old if
716693 the cost of a comparable vehicle would be less than Three Hundred
717694 Dollars ($300.00) as quoted in the latest edition of the National
718695 Automobile Dealers Associ ation Official Used Car Guid e or latest
719696 monthly edition of any other n ationally recognized published
720697 guidebook, adjusting to the condition of the vehicle.
721698 B. 1. a. Any person who is induced by means of a check or other
722699 form of written order for immediate p ayment of money
723700 to deliver up possession of an article of personal
724701 property on which the person has a special lien
725702 created by subsection A of this section, which check
726703 or other written order is dishonored, or is not paid

862836 3. The enforcement of the lien shall be within six ty (60) days
863837 after filing the lien in the manner provided by law for enfor cing
864838 the lien of a security agreement and provided that the lien shall
865839 not affect the rights of innocent, intervening purchasers without
866840 notice.
867841 C. If the person who renders service to the owner of an article
868842 of personal property to which this section app lies relinquishes or
869843 loses possession of the article due to circumstan ces described in
870844 subparagraph a of paragraph 1 or subparagraph a of paragraph 2 of
871845 subsection B of this section, the person claiming the lien shall be
872846 entitled to possession of the artic le until the amount due is p aid,
873847 unless the article is possessed by a person who became a bona fide
874848 purchaser. Entitlement to possession shall be in accordance with
875849 the following:
876850 1. The claimant may take possession of an article pursuant to
877851 this subsection only if the person oblig ated under the contract for
878852 services has signed an acknowledgment of receipt of a notice that
879853 the article may be subject to repossession. The notice and
880854 acknowledgment pursuant to this subsection shall be:

915888 2. The claimant may require the person obligated under the
916889 contract for services to pay the costs of repossession as a
917890 condition for reclaiming the article only to the extent of the
918891 reasonable fair market value of the services required to take
919892 possession of the articl e;
920893 3. The claimant shall not transfer to a third party or to a
921894 person who performs repossession services, a che ck, money order, or
922895 credit card transaction that is received as payment fo r services
923896 with respect to an article and that is returned to the clai mant
924897 because of insufficient funds or no funds, because the person
925898 writing the check, issuing the money order, o r credit cardholder has
926899 no account or because the check, money order, or c redit card account
927900 has been closed. A person violating this paragraph shall be guilty
928901 of a misdemeanor; and
929902 4. An article that is repossessed pursuant to this subsection
930903 shall be promptly delivered to the location where the services were
931904 performed. The article shall remain at the services location at all
905+times until the article is lawfully returned to the record owner or
906+a lienholder or is disposed of pursuant to this section.

964936 federally recognized Indian tribe in Oklahoma, but there is no
965937 active lien recorded on the certificate of title.
966938 2. This section applies if a vehicle, all-terrain vehicle,
967939 utility vehicle, motorcycle, boat, outb oard motor or trailer has a
968940 certificate of title issued by the Tax Commission or by a federally
969941 recognized Indian tribe in Oklahoma, and there is an active lien
970942 recorded on the certifica te of title, but the lien is over fifteen
971943 (15) years old.
972944 3. This section applies if personal property to which Section
973945 91 of this title otherwise would apply has been registered by the
974946 Tax Commission or by a federally recognized Indian tribe in the
975947 State of Oklahoma, and there is a lien of record but no certificate
976948 of title has been issued.
977949 4. This section applies if personal property to which Section
978950 91 of this title otherwise wou ld apply has not been registered by
979951 either the Tax Commission or a federal ly recognized Indian tribe i n
980952 the State of Oklahoma, and no certificat e of title has been issued,
981953 but there is a lien of record.
954+5. This section applies to personal property that ot herwise
955+would be covered by Section 91 of this title, except that the

1016987 ordinary means or by th e Oklahoma Tax Commission Motor Vehicle
1017988 Division, as provided in subparagraphs d and e of paragraph 4 of
1018989 subsection A of this section, as applicable.
1019990 7. This section applies to items of personal property that are
1020991 not required by Oklahoma law to be titled, and that do not have a
1021992 certificate of title.
1022993 8. This section applies to salvage pools as defined in Section
1023994 591.2 of Title 47 of the Oklahoma Statutes.
1024995 9. This section applies to class AA licensed wrecker services
1025996 taking possession of a vehicle pursuant to an agreement with, or at
1026997 the direction of, or dispatched by a state or local law enforcement
1027998 or government agency, or pursuant to the abandoned vehicl e removal
1028999 provisions of Section 954A of Title 47 of the Oklahoma Statutes with
10291000 respect to all types of personal property, regardless of whether
10301001 that personal property has a certificate of title.
10311002 10. For a vehicle abandoned at a salvage pool, if the cost o f
10321003 repairing the vehicle for safe operation on the highway does not

10631033 E. A person who knowingly makes a false statement of a material
10641034 fact regarding the furnishi ng of storage, rental space, material,
10651035 labor or skill for the protecti on, improvement, safekeeping, towing,
10661036 right to occupy space, storage or carriage thereof in a proceeding
10671037 under this section, or attempts to use or uses the provisions of
10681038 this section to foreclose an owner or lienho lder’s interest in a
10691039 vehicle knowing that any of the statements made in the proceeding
10701040 are false, upon conviction, shall be guilty of a felony.
10711041 F. Upon receipt of notice of legal proceedings, the Tax
10721042 Commission shall cause the sale process to be put on ho ld until
10731043 notice of resolution of court pro ceedings is received from the
10741044 court. If such notice of commencement of court proceedings is not
10751045 filed with the Tax Commission, the possessory lien sale process may
10761046 continue.
10771047 G. No possessory lien sale shall be he ld on a Sunday.
10781048 H. For purposes of this s ection:

11241093 documentation, the procedures established by this section shall no t

1126-4. "Itemized charges" means total parts, total labor, total

11281097 any other fee groups, the sum total of which shall equal the

11631131 interested party may proceed against the pers on claiming such lien

11661134 notices required by this section shall be shown to be knowingly
11671135 false or fraudulent, the interested party sh all be entitled to
11681136 treble damages. The pr evailing party shall be entitled to all
11691137 costs, including reasonable attorney fees.
11701138 K. Any interested party shal l be permitted to visually inspect
11711139 and verify the services rendered by the claimant prior to the sale
11721140 of the article of property during normal b usiness hours. If the
11731141 claimant fails to allow any interested party to inspect the
11741142 property, the interested part y shall mail a request for inspection
11751143 by certified mail, return receipt re quested, to the claimant.
11761144 Within three (3) business days of receipt o f the request for
11771145 inspection, the claimant shall mail a photograph of the property, by
11781146 certified mail, return re ceipt requested, and a date of inspection
11791147 within five (5) business days fr om the date of the notice to
11801148 inspect. The lienholder shall be allowed to retrieve the property
11811149 without being required to bring the title into the lienholder ’s
11821150 name, if the lienholde r provides proof it is a lienholder and any
11831151 payment due the claimant for l awful charges where the clai mant has
11841152 complied with this section. Upon the release of personal property
