5548 O.S. 2011, Section 285, which relates to register of

5750 Uniform Real Property Electronic Recording Act;

6558 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6659 SECTION 1. AMENDATORY 19 O.S. 2011, Section 245, as last
6760 amended by Section 1, Chapter 48, O.S.L. 2019 (1 9 O.S. Supp. 2020,
6861 Section 245), is amended to read as follows:
6962 Section 245. A. It shall be the duty of the county clerk t o
7063 designate upon every account, which shall be audi ted and allowed by
64+the board, the amount so allowed, and the clerk shall deliver to any
65+person a copy certified or o therwise of any record in the clerk ’s
66+office and any account on file thereon, upon receiv ing the fee

98-the board, the amount so allowed, and the clerk shal l deliver to any
99-person a copy certified or otherwise of any record in the clerk ’s
100-office and any account on file thereon, upon receiving the fee
10193 allowed pursuant to the Oklahoma Open R ecords Act or the county
10294 clerk fee schedule, Section 32 of Title 28 of the Oklaho ma Statutes,
10395 for every page contain ed in the copy. Upon demand, the clerk sha ll
10496 furnish a certified copy in the form as it exists and at the
10597 preference of the requestor as pr ovided by the Oklahoma Ope n Records
10698 Act or the county clerk fee schedule. Certified copies may be
10799 provided in paper or digital format in accordance with the Uniform
108100 Real Property Electronic Recording Act.
109101 B. If the clerk provides records in an electronic format, the
110102 clerk may charge a reas onable fee for providing such records. For
111103 purposes of this section, “reasonable fee” shall mean the fee
112104 charged by the clerk shall not exceed twenty-five cents ($0.25) per
113105 image or fifteen cents ($0.15) per image for p roviding more than
114106 three thousand five hundred (3,500) images in an electronic fo rmat.
115107 If the clerk provides certified records, the clerk may charge a fee
116108 for the certification in accordance with the current fee schedule
117109 found in subsection A of Section 32 of Title 28 of the Oklahoma
118110 Statutes. All recording devices for providing reco rds in an
119111 electronic format sh all be supplied by the county clerk. News medi a
120112 obtaining records in an electronic format for a n ews purpose and
121113 licensed abstractors performing their duties pursuant to state law
114+shall be exempt from the fees provided for in this subsection.
115+Nothing in this section shall be construed to allow county clerks to

149-shall be exempt from the fees provi ded for in this subsection.
150-Nothing in this section shall be construed to allow county clerks to
151142 provide all or part of a tract index for use in any commercial
152143 purpose.
153144 SECTION 2. AMENDATORY 19 O.S. 2011, Sectio n 285, is
154145 amended to read as follows:
155146 Section 285. The register of deeds shall keep a seal, to be
156147 furnished by the county, which seal shall contain the nam e of the
157148 county, the words “Oklahoma” and “Register of Deeds.” He Except as
158149 provided in the Unif orm Real Property Electronic Re cording Act, he
159150 or she shall attach such seal to all instruments filed or rec orded
160151 in his or her office, together with his or her signature and
161152 certificate to all certified copies of any instrument on file or of
162153 record in his or her office, which he or she is required to issue.
163154 SECTION 3. This act shall become effec tive November 1, 2021.
