51	44		permitting certified copies to be made in accordance
52	45		with the Uniform Real Property Electronic Recording
53	46		Act; allowing fee to be charged for certified records
54	47		in accordance with certain fee s chedule; amending 19
55	48		O.S. 2011, Section 285, which relates to register of
56	49		deeds; allowing exception in accordance with the
57	50		Uniform Real Property Electronic Recording Act;

65	58		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
66	59		SECTION 1. AMENDATORY 19 O.S. 2011, Section 245, as last
67	60		amended by Section 1, Chapter 48, O.S.L. 2019 (1 9 O.S. Supp. 2020,
68	61		Section 245), is amended to read as follows:
69	62		Section 245. A. It shall be the duty of the county clerk t o
70	63		designate upon every account, which shall be audi ted and allowed by
	64	+	the board, the amount so allowed, and the clerk shall deliver to any
	65	+	person a copy certified or o therwise of any record in the clerk ’s
	66	+	office and any account on file thereon, upon receiv ing the fee

101	93		allowed pursuant to the Oklahoma Open R ecords Act or the county
102	94		clerk fee schedule, Section 32 of Title 28 of the Oklaho ma Statutes,
103	95		for every page contain ed in the copy. Upon demand, the clerk sha ll
104	96		furnish a certified copy in the form as it exists and at the
105	97		preference of the requestor as pr ovided by the Oklahoma Ope n Records
106	98		Act or the county clerk fee schedule. Certified copies may be
107	99		provided in paper or digital format in accordance with the Uniform
108	100		Real Property Electronic Recording Act.
109	101		B. If the clerk provides records in an electronic format, the
110	102		clerk may charge a reas onable fee for providing such records. For
111	103		purposes of this section, “reasonable fee” shall mean the fee
112	104		charged by the clerk shall not exceed twenty-five cents ($0.25) per
113	105		image or fifteen cents ($0.15) per image for p roviding more than
114	106		three thousand five hundred (3,500) images in an electronic fo rmat.
115	107		If the clerk provides certified records, the clerk may charge a fee
116	108		for the certification in accordance with the current fee schedule
117	109		found in subsection A of Section 32 of Title 28 of the Oklahoma
118	110		Statutes. All recording devices for providing reco rds in an
119	111		electronic format sh all be supplied by the county clerk. News medi a
120	112		obtaining records in an electronic format for a n ews purpose and
121	113		licensed abstractors performing their duties pursuant to state law
	114	+	shall be exempt from the fees provided for in this subsection.
	115	+	Nothing in this section shall be construed to allow county clerks to

150		-	Nothing in this section shall be construed to allow county clerks to
151	142		provide all or part of a tract index for use in any commercial
152	143		purpose.
153	144		SECTION 2. AMENDATORY 19 O.S. 2011, Sectio n 285, is
154	145		amended to read as follows:
155	146		Section 285. The register of deeds shall keep a seal, to be
156	147		furnished by the county, which seal shall contain the nam e of the
157	148		county, the words “Oklahoma” and “Register of Deeds.” He Except as
158	149		provided in the Unif orm Real Property Electronic Re cording Act, he
159	150		or she shall attach such seal to all instruments filed or rec orded
160	151		in his or her office, together with his or her signature and
161	152		certificate to all certified copies of any instrument on file or of
162	153		record in his or her office, which he or she is required to issue.
163	154		SECTION 3. This act shall become effec tive November 1, 2021.
