6354 BE IT ENACTED BY THE PEOPLE OF THE STA TE OF OKLAHOMA:
6455 SECTION 1. AMENDATORY 74 O.S. 2011, Section 20j, is
6556 amended to read as follows:
6657 Section 20j. A. The Attorney General is authorized and
6758 directed to negotiate the terms of a Memorandum of Understanding
6859 between the State of Oklahoma and the United States Department of
6960 Justice or the United States Department of Home land Security, as
61+provided by Section 1357 (g) of Title 8 of the United States Code,
62+concerning the enforcement of federal immigration and customs laws,
63+detention and removals, and investigations in the State of Okla homa.

98-concerning the enforcement of federal immigration and customs laws,
99-detention and removals, and investigations in the State of O klahoma.
10090 B. The Memorandum of Understanding negotiated pursuant to
10191 subsection A of this section shall be signed on behalf of this state
10292 by the Attorney General and the Governor or as otherwise required by
10393 the appropriate federal agency.
10494 C. No political subdivision or agency of the state or any local
10595 government, whether acting through its governing body or by an
10696 initiative, referendum, or any other process, shall enact or adopt
10797 any ordinance, sanctuary policy or other policy that limits or
10898 prohibits a law enforcement officer, local government official, or
10999 local government employee from comm unicating or cooperating with
110100 federal officials with regard to the immigration status of any
111101 person within this state. For the purposes of this section,
112102 “sanctuary policy” includes, but is not limited to, any o rdinance or
113103 policy that:
114104 1. Restricts or imposes conditions on compliance with a
115105 detainer or other request from United States Immigration and Customs
116106 Enforcement to maintain custody of an undocumented alien or to
117107 transfer custody of an undocumented alien to the United States
118108 Immigration and Custom s Enforcement;
109+2. Requires United States Immigration and Customs Enfo rcement
110+to obtain a warrant or court order before compliance with a detainer
111+or other request;
112+3. Prevents a law enforcement officer from inquir ies to a
113+person about his or her immigration status when specific and

147-to obtain a warrant or court order before compliance with a detainer
148-or other request;
149-3. Prevents a law enforcement officer from inquiries to a
150-person about his or her immigration status when specific and
151140 articulable facts support probable cause that the person is an
152141 undocumented alien; or
153142 4. Knowingly provides special benefits, privileges or support
154143 to an undocumented alien.
155144 D. Notwithstanding any other provision of law, no government
156145 entity or official within the State of Oklahoma may prohibit, or in
157146 any way restrict, any government entity or official from sending to,
158147 or receiving from, the United States Departme nt of Homeland
159148 Security, information regarding the citizenship or immigration
160149 status, lawful or unlawful, of any individual.
161150 E. Notwithstanding any other provision of law, no person or
162151 agency may prohibit, or in any way restrict, a public employee from
163152 doing any of the following with respect to information regarding the
164153 immigration status, lawful or unlawful, of any individual:
165154 1. Sending such information to, or requesting or receiving such
166155 information from, the United States Department of Homeland Securi ty;
167156 2. Maintaining such information; or
168157 3. Exchanging such i nformation with any other federal, state,
169158 or local government entity.
159+F. Upon request for an opinion pursuant to paragraph 5 of
160+subsection A of Section 18b of this title, t he Attorney General of
161+this state shall determine whether an ordinance or policy is in
162+violation of this section. A political subdivision or agency of the
163+state or any local government that enacts or adopts any ordi nance,

197-F. Upon request for an opinion pursuant to paragraph 5 of
198-subsection A of Section 18b of this title, th e Attorney General of
199-this state shall determine whether an ordinance or policy is in
200-violation of this section. A political subdivision or agency of the
201-state or any local government that enacts or adopts any ordinance,
202190 sanctuary policy or other policy in violation of this section shall
203191 be ineligible to receive any state appropriation or funding through
204192 a grant administered by any state agency or depar tment until such
205193 ordinance or policy is repealed or no longer in effect.
206194 G. The provisions of this section shall allow for a private
207195 right of action by any natural or legal person lawful ly domiciled in
208196 this state to file for a writ of mandamus to compel any
209197 noncooperating local or state governmental ag ency or political
210198 subdivision to comply with such reporting laws.
211199 H. An elected or appointed officia l who willfully violates the
212200 provisions of this section shall be subject to removal for official
213201 misconduct pursuant to Section 93 of Title 51 of the Oklahoma
214202 Statutes.
215203 SECTION 2. This act shall become effective November 1, 2021.
