4297 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

4498 SECTION 1. NEW LAW A new section of law to be codified
4599 in the Oklahoma Statutes as Section 1 -133 of Title 63, unless there

50101 A. As used in this section:

52102 1. "Health information exchange" means the electronic movement
53103 of health-related information among organizations according to
54104 nationally recognized standards for purposes including, but not
55105 limited to, payment, treatment and administration ;

57106 2. "Health information exchange organization " means an entity
58107 whose primary business activity is health information exchange; and
59-
60108 3. "Oklahoma State Health I nformation Network and Exchange" or
61109 "OKSHINE" means a health information exchange organization charged
62110 with facilitating the exchange of health information to and from
63111 authorized individuals and health care organizations in this state
64112 and shall serve as the state-designated entity for health
65113 information exchange.

67114 B. The Oklahoma Health Care Authority (OHCA) shall establish a
68115 health information exchange certification with input from
69116 stakeholders. Such certification shall be required in order for a
70117 health information exchange organization to qualify as an Oklahoma
71118 Statewide Health Information Exchange (OKHIE). Until such time as
72119 the health information exchange certification is established by
73120 OHCA, an OKHIE shall mean either OKSHINE or a health information

74147 exchange organization that was previously certifie d by the Oklahoma
75148 Health Information Exchange Trust.

77149 C. The Oklahoma State Health Information Network and Exchange
78150 (OKSHINE) shall be organized for the purpose of improving the health
79151 of residents of this state by:

81152 1. Promoting efficient and effective communication among
82153 multiple health care providers including, but not limited to,
83154 hospitals, physicians, payers, employers, pharmacies, laboratories ,
84155 and other health care entities or health information exchange
85156 networks and organizations;

87157 2. Creating efficiencies in health care costs by eliminating
88158 redundancy in data capture and storage and reducing administrative,
89159 billing, and data collection costs;

91160 3. Creating the ability to monitor community health status; and

95161 4. Providing reliable information to hea lth care consumers and
96162 purchasers regarding the quality of health care.

98163 D. 1. A person who participates in the services or information
99164 provided by OKSHINE or an OKHIE shall not be liable in any action
100165 for damages or costs of any nature that result solely from the
101166 person’s use or failure to use either an OKHIE or OKSHINE
102167 information or data that was entered or retrieved under relevant
103168 state or federal privacy laws, rules, regulations or policies
104169 including, but not limited to, the Health Insurance Portabili ty and
105170 Accountability Act of 1996.

107197 2. A person shall not be subject to antitrust or unfair
108198 competition liability based on participation in OKSHINE or an OKHIE
109199 as long as the participation provides an essential governmental
110200 function for the public health a nd safety and enjoys state action
111201 immunity.

113202 3. Participating in an OKHIE shall qualify as meeting any
114203 requirement to send data to OKSHINE.

116204 E. 1. A person who provides information and data to OKSHINE
117205 retains a property right in the information or data, b ut grants to
118206 the other participants or subscribers a nonexclusive license to
119207 retrieve and use that information or data under relevant state or
120208 federal privacy laws, rules, regulations or policies including, but
121209 not limited to, the Health Insurance Portabil ity and Accountability
122210 Act of 1996.

124211 2. All processes or software developed , designed, or purchased
125212 by OKSHINE shall remain the property of OKSHINE subject to use by
126213 participants or subscribers.

128214 F. Patient-specific protected health information shall only be
129215 disclosed in accordance with the patient’s authorization or in
130216 compliance with relevant state or federal privacy laws, rules,
131217 regulations or policies including, but not limited to, the Health
132218 Insurance Portability and Accountability Act of 1996.

134219 G. The Oklahoma Health Care Authority Board shall promulgate
135220 rules to implement the provisions of this section.

293+BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOM A:
294+SECTION 6. NEW LAW A new section of law to be codified
295+in the Oklahoma Statutes as Section 1 -133 of Title 63, unless there

297+A. As used in this section:
298+1. “Agency” has the same meaning as provided by Section 840 -1.3
299+of Title 74 of the Oklahoma Statutes;
300+2. “Health information exchange” means the electronic movement
301+of health-related information among organizations according to
302+nationally recognized standards for treatment purposes;
303+3. “Health information technology” means technology that allows
304+comprehensive management of medical information and its secure
305+exchange between health care consumers and providers for treatment
306+purposes; and
307+4. “Oklahoma State Health Informatio n Network and Exchange” or
308+“OKSHINE” means a unit of the Oklahoma Health Care Authority charged

336+authorized individuals and healthcare organizations in this state.
337+OKSHINE shall be comprised of a digital platform used for the
338+exchange of health information including, but not limited to,
339+software and data tools.
340+B. The Oklahoma State Health Information Network and Exchange
341+(OKSHINE) shall serve as the official health information exchange
342+for this state. OKSHINE shall be organized for the purpose of
343+improving the health of residents of this state by:
344+1. Promoting efficient and effective communication among
345+multiple health care providers including, but not limited to,
346+hospitals, physicians, pay ers, employers, pharmacies, laboratories ,
347+and other health care entities or health information exchange
348+networks and organizations;
349+2. Creating efficiencies in health care costs by eliminating
350+redundancy in data capture and storage and reducing administra tive,
351+billing, and data collection costs;
352+3. Creating the ability to monitor community health status; and
353+4. Providing reliable information to health care consumers and
354+purchasers regarding the quality of health care.
355+C. The Oklahoma Health Care Authori ty shall:
356+1. Coordinate the health information technology initiatives of
357+the state with relevant state agencies, nonprofit corporations and
358+institutions of higher education;

385+2. Assure the effective coordination and collaboration of
386+health information tec hnology planning, development, implementation
387+and financing;
388+3. Review and approve all health information technology -related
389+grant applications of state agencies before submission to funding
390+entities;
391+4. Accept, receive, retain, disburse and administer a ny state
392+or federal funds specifically appropriated for health information
393+technology; and
394+5. Establish reasonable fees for the use of the Oklahoma State
395+Health Information Network and Exchange (OKSHINE) to fund the
396+operational costs of OKSHINE. Fees est ablished under this paragraph
397+shall be set with the input and guidance of the users of OKSHINE,
398+stakeholders and other interested parties. Fees established under
399+this paragraph shall not exceed the total cost of operating OKSHINE,
400+not including staffing c osts for OKSHINE.
401+D. 1. A person who participates in the services or information
402+provided by OKSHINE shall not be liable in any action for damages or
403+costs of any nature that result solely from the person’s use or
404+failure to use OKSHINE information or da ta that was entered or
405+retrieved under relevant state or federal privacy laws, rules,
406+regulations or policies including, but not limited to, the Health
