33	59		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

35	60		SECTION 1. AMENDATORY Section 3, Chapter 202, O.S.L.
36	61		2018 (56 O.S. Supp. 2020, Section 1005.4), is ame nded to read as
37	62		follows:

39	63		Section 1005.4. A. No provider shall be eligible for
40	64		reimbursement through Medicaid or any other federal or state program
41	65		or any other funding from any political subdivision of this state
42	66		including but not limited to cities, town s, municipalities or
43	67		counties, directly or by subcontract with any other party, if that

44	95		provider, or any affiliate of that provider, has been found by a
45	96		court of law, either civilly or criminally, to have violated 42
46		-

48	97		U.S.C., Section 289g -2 (2010) or any other federal or state law
49	98		prohibiting trafficking in fetal body parts.

51	99		B. Any provider found to be ineligible for reimbursement or
52	100		other funding pursuant to this section shall be able to reapply
53	101		after a period of five (5) years and a showing that they and their
54	102		affiliates no longer participate in the trafficking of fetal body
55	103		parts.

57	104		C. Within sixty (60) calendar days of receipt of a complaint of
58	105		a violation under this section, the Oklahoma Health Care Authority
59	106		shall publish the findings of its investigati on of the complaint and
60	107		issue a determination of whether a provider has committed a
61	108		violation of the provisions of this section. Nothing in this act
62	109		the Defunding Fetal-Body-Parts Trafficking Act shall preclude other
63	110		law enforcement entities or a party in qui tam litigation from
64	111		initiating action regarding this section.

66	112		SECTION 2. This act shall become effective July 1, 2021.

68	113		SECTION 3. It being immediately necessary for the preservation
69	114		of the public peace, health or safe ty, an emergency is hereby
70	115		declared to exist, by reason whereof this act shall take effect and
71	116		be in full force from and after its passage and approval.
