35	164		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37	165		SECTION 1. NEW LAW A new section of law to b e codified
38	166		in the Oklahoma Statutes as Section 3-169 of Title 70, unless there
39	167		is created a duplication in numb ering, reads as follows:

41	168		A. Beginning with the 2023-2024 school year, prior to
42	169		enrollment the parent or legal guardian of a student may disclose to
43	170		the student’s resident district, as determined by Section 1-113 of
44	171		Title 70 of the Oklahoma Statutes, if the student has received
45	172		inpatient or emergency outpatient mental health services from a
46	173		mental health facility in the previous twenty-four (24) months. For

53	203		B. If a disclosure provided for in subsection A of this section
54		-	occurs, designated school personnel, which may include members of
55		-	the individualized education program (IEP) team, shall meet with the
56		-	parent or legal guardian of the student and representatives o f the
57		-	mental health facility prior to enrollment to determine whether the
58		-	student is in need of any accommodations including but not limited
59		-	to an IEP in accordance with the Individuals with Disabilities
60		-	Education Act (IDEA) or a Section 5 04 Plan as defined by the
61		-	Rehabilitation Act of 1973. The meeting required by this section
62		-	may take place in person, via teleconference, or via
63		-	videoconference.

67	215		section shall comply with the Family Educational Rights and Privacy
68	216		Act of 1974 (FERPA) and the Health Insurance Portability and
69	217		Accountability Act of 1996 (HIPAA).

71	218		D. The State Board of Education shall promulgate rules t o
72	219		implement the provisions of this section.

74	220		SECTION 2. AMENDATORY 43A O.S. 2021, Sect ion 5-513, is

80	251		individualized treatmen t plan has been prepared by the person
81	252		responsible for the treatment of the minor. The minor shall be
82	253		involved in the preparation of the treatment plan to the maximum
83	254		extent consistent with the ability of the minor to understand and
84	255		participate. The pare nt or legal custodian of the minor or, if the
85	256		minor is in the custody of the Department of Human Servic es or the
86	257		Office of Juvenile Affairs, the designated representat ive of the
87	258		applicable agency, shall be involved to the maximum extent
88	259		consistent with the treatment needs of the minor.

90	260		B. The facility shall discharge the minor when appropriate
91	261		facility medical staff determine the minor no longer meets the
92		-

94	262		admission or commitment criteria. If not previously discharged, a
95	263		minor committed by a court for inpatient treatment shall be
96	264		discharged upon the expirat ion of a court order committing the minor
97	265		for inpatient treatment or an order of the court directing the
98	266		discharge of the minor.

100	267		C. Prior to the discharge of the minor from inpatient
101	268		treatment, a dischar ge plan for the minor shall be prepared and
102	269		explained to the minor and the parent or the person responsible for
103	270		the supervision of the case. The plan shall include , but not be

116	305		4. An appointment for follow-up outpatient treatment and

119	307		D. Upon the discharge of the minor from inpatient treatment, a
120	308		designee of the facility shall inform the parent or person
121	309		responsible for the supervision of the case of the importance of
122	310		disclosing the mental health needs of the minor to the minor’s
123	311		resident school district as provided for in Section 1 of this act
124	312		including disclosure in whole or in part of the minor’s discharge
125	313		plan prepared pursuant to subsection C of this section as
126	314		appropriate and consistent with applicable law.

128	315		SECTION 3. This act shall become effective July 1, 2022.

130	316		SECTION 4. It being immediate ly necessary for the preservation
131	317		of the public peace, health, or safety, an emergency is her eby
132	318		declared to exist, by reason whereof thi s act shall take effect and
