35164 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

37165 SECTION 1. NEW LAW A new section of law to b e codified
38166 in the Oklahoma Statutes as Section 3-169 of Title 70, unless there
39167 is created a duplication in numb ering, reads as follows:

41168 A. Beginning with the 2023-2024 school year, prior to
42169 enrollment the parent or legal guardian of a student may disclose to
43170 the student’s resident district, as determined by Section 1-113 of
44171 Title 70 of the Oklahoma Statutes, if the student has received
45172 inpatient or emergency outpatient mental health services from a
46173 mental health facility in the previous twenty-four (24) months. For

47200 the purposes of this section, “mental health facility” shall have

50201 the same meaning as Section 5-502 of Title 43A of the Oklahoma
51202 Statutes.

53203 B. If a disclosure provided for in subsection A of this section
54-occurs, designated school personnel, which may include members of
55-the individualized education program (IEP) team, shall meet with the
56-parent or legal guardian of the student and representatives o f the
57-mental health facility prior to enrollment to determine whether the
58-student is in need of any accommodations including but not limited
59-to an IEP in accordance with the Individuals with Disabilities
60-Education Act (IDEA) or a Section 5 04 Plan as defined by the
61-Rehabilitation Act of 1973. The meeting required by this section
62-may take place in person, via teleconference, or via
63-videoconference.

210+Plan as defined by the R ehabilitation Act of 1973. The meeting
211+required by this section ma y take place in person, via
212+teleconference, or via videoconference.
65213 C. The disclosure and subsequent handling of personal health
66214 information and related student e ducation records pursuant to this
67215 section shall comply with the Family Educational Rights and Privacy
68216 Act of 1974 (FERPA) and the Health Insurance Portability and
69217 Accountability Act of 1996 (HIPAA).

71218 D. The State Board of Education shall promulgate rules t o
72219 implement the provisions of this section.

74220 SECTION 2. AMENDATORY 43A O.S. 2021, Sect ion 5-513, is
75221 amended to read as follows:

77222 Section 5-513. A. Within ten (10) days after the admission of
78223 a minor for inpatient treatment, the person in charge of the

79250 facility in which the minor is being treated shall ensure that an
80251 individualized treatmen t plan has been prepared by the person
81252 responsible for the treatment of the minor. The minor shall be
82253 involved in the preparation of the treatment plan to the maximum
83254 extent consistent with the ability of the minor to understand and
84255 participate. The pare nt or legal custodian of the minor or, if the
85256 minor is in the custody of the Department of Human Servic es or the
86257 Office of Juvenile Affairs, the designated representat ive of the
87258 applicable agency, shall be involved to the maximum extent
88259 consistent with the treatment needs of the minor.

90260 B. The facility shall discharge the minor when appropriate
91261 facility medical staff determine the minor no longer meets the

94262 admission or commitment criteria. If not previously discharged, a
95263 minor committed by a court for inpatient treatment shall be
96264 discharged upon the expirat ion of a court order committing the minor
97265 for inpatient treatment or an order of the court directing the
98266 discharge of the minor.

100267 C. Prior to the discharge of the minor from inpatient
101268 treatment, a dischar ge plan for the minor shall be prepared and
102269 explained to the minor and the parent or the person responsible for
103270 the supervision of the case. The plan shall include , but not be

106298 1. The services required by the minor in the community to meet
107299 the needs of the minor for treatment, education, housin g, and
108300 physical care and safety;

110301 2. Identification of the public or private agencies that will
111302 be involved in providing treatment and support to the minor;

113303 3. Information regarding medication which shou ld be prescribed
114304 to the minor; and
115-
116305 4. An appointment for follow-up outpatient treatment and
117306 medication management.

119307 D. Upon the discharge of the minor from inpatient treatment, a
120308 designee of the facility shall inform the parent or person
121309 responsible for the supervision of the case of the importance of
122310 disclosing the mental health needs of the minor to the minor’s
123311 resident school district as provided for in Section 1 of this act
124312 including disclosure in whole or in part of the minor’s discharge
125313 plan prepared pursuant to subsection C of this section as
126314 appropriate and consistent with applicable law.

128315 SECTION 3. This act shall become effective July 1, 2022.

130316 SECTION 4. It being immediate ly necessary for the preservation
131317 of the public peace, health, or safety, an emergency is her eby
132318 declared to exist, by reason whereof thi s act shall take effect and
133319 be in full force from and after its passage and approva l.
