8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new sec tion of law to be codified
8383 in the Oklahoma Statutes as Section 1-863 of Title 63, unless there
8484 is created a duplication in numb ering, reads as follows:
8585 A. The Department of Corrections may develop a hospi ce care
8686 training program within the state prison system. The Department of
8787 Corrections, in cooperation with the State Department of Health and
8888 the Oklahoma Department of Career and Technology Education, may
8989 jointly partner in the program to determine the appropriate training

142142 required for inmates se lected to participate in the program. The
143143 State Department of Health shall consider program participants in
144144 the process of promulgating rules establishing the appropriate
145145 licensure or certification requirements.
146146 B. The State Department of Health shall review applicants to
147147 the program prior to enrollment to ensure there are no state or
148148 federal restrictions or prohibitions preventing the applicant from
149149 obtaining licensure upon completion of the program. Inmates with
150150 convictions pursuant to the provisions of Section 1 -1950.1 of Title
151151 63 of the Oklahoma Statutes are prohibited from participation unless
152152 written permission to participate is granted by the State Department
153153 of Health.
154154 C. The Department of Corrections, the State Department of
155155 Health and the Oklahoma Department of C areer and Technology
156156 Education shall jointly approve prog ram curriculum for the trainin g
157157 of eligible inmates currently in the custody of the Department of
158158 Corrections. The curriculum shall include required program credits
159159 for each subject and practical skills instruction . Training shall
160160 be provided by a licensed physician, registered nurse or other
161161 appropriately licensed or trained health care professional, as
162162 determined by the State Department of Health and the Oklahoma
163163 Department of Career and Tech nology Education.
164164 D. Upon successful completion of the tra ining program provided
165165 for in subsection C of this section, the Department of Corrections

217217 shall issue a program completion certificate to the inmate. The
218218 Department of Corrections in cooperation with the State Department
219219 of Health and the Oklahoma Department of Career and Technology
220220 Education shall develop a process for submission of notice of
221221 training completion and applica tion for licensure or certification
222222 to the State Department of Health as prescribed by the State
223223 Department of Health.
224224 E. The State Department of Health, in consultation with the
225225 Department of Corrections shall have authority to promulgate rules
226226 for the implementation of the curriculum, as provided for in
227227 subsection C of this section, and for continuing education or
228228 training requirements necessary for ma intaining state certification
229229 in good standing.
230230 F. Nothing in this Section shall be construed as establishing a
231231 right to employment with any licensed hospice provider.
232232 SECTION 2. This act shall become effective November 1, 2021.
