AS INTRODUCED 
 
An Act relating to a prison system trainin g program; 
providing for a hospice care training program within 
the state prison system; aut horizing the Department 
of Corrections, the State Department of Health and 
the Oklahoma Department of Career and Tech nology 
Education to determine training requirements; 
providing for review of applicants; providing for 
program completion c ertificates; providing authority 
for promulgation of rules; providing construing 
provision; providing for codification; and providing 
an effective date. 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new sec tion of law to be codified 
in the Oklahoma Statutes as Section 1-863 of Title 63, unless there 
is created a duplication in numb ering, reads as follows: 
A. The Department of Corrections may develop a hospi ce care 
training program within the state prison system.  The Department of 
Corrections, in cooperation with the State Department of Health and 
the Oklahoma Department of Career and Technology Education, may 
jointly partner in the program to determine the appropriate training 
for the purposes of obtaining licensure and/or certification

required for inmates se lected to participate in the program.  The 
State Department of Health shall consider program participants in 
the process of promulgating rules establishing the appropriate 
licensure or certification requirements. 
B. The State Department of Health shall review applicants to 
the program prior to enrollment to ensure there are no state or 
federal restrictions or prohibitions preventing the applicant from 
obtaining licensure upon completion of the program.  Inmates with 
convictions pursuant to the provisions of Section 1 -1950.1 of Title 
63 of the Oklahoma Statutes are prohibited from participation unless 
written permission to participate is granted by the State Department 
of Health. 
C. The Department of Corrections, the State Department of 
Health and the Oklahoma Department of C areer and Technology 
Education shall jointly approve prog ram curriculum for the trainin g 
of eligible inmates currently in the custody of the Department of 
Corrections.  The curriculum shall include required program credits 
for each subject and practical skills instruction .  Training shall 
be provided by a licensed physician, registered nurse or other 
appropriately licensed or trained health care professional, as 
determined by the State Department of Health and the Oklahoma 
Department of Career and Tech nology Education. 
D. Upon successful completion of the tra ining program provided 
for in subsection C of this section, the Department of Corrections

shall issue a program completion certificate to the inmate.  The 
Department of Corrections in cooperation with the State Department 
of Health and the Oklahoma Department of Career and Technology 
Education shall develop a process for submission of notice of 
training completion and applica tion for licensure or certification 
to the State Department of Health as prescribed by the State 
Department of Health. 
E. The State Department of Health, in consultation with the 
Department of Corrections shall have authority to promulgate rules 
for the implementation of the curriculum, as provided for in 
subsection C of this section, and for continuing education or 
training requirements necessary for ma intaining state certification 
in good standing. 
F.  Nothing in this Section shall be construed as establishing a 
right to employment with any licensed hospice provider. 
SECTION 2.  This act shall become effective November 1, 2021.
