5548 BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA:
5649 SECTION 1. AMENDATORY Section 2, Chapter 228, O.S.L.
5750 2017 (59 O.S. Supp. 2020, Section 478.1), is amended to read as
5851 follows:
5952 Section 478.1. A. Unless otherwise prohibited by law, a valid
6053 physician-patient relationship may be established by an allopathi c
6154 or osteopathic physician with a patient located in this st ate
6255 through telemedicine, provided that the physician:
6356 1. Holds a license to practice medicine in this state , a
6457 license issued by endorsement by the Sta te Board of Medical
6558 Licensure and Supervision under Section 493.3 of this title or a
59+license issued without exa mination by the State Board of Osteopathic
60+Examiners under Section 63 4 of this title;

93-license issued without examination by the State Board of Osteopathic
94-Examiners under Section 634 of this title ;
9587 2. Confirms with the patient the patient ’s identity and

9789 3. Provides the patie nt with the treating physician ’s identity
9890 and professional credentia ls.
9991 B. Telemedicine and store and forward technology encounters
10092 shall comply with the Health Insurance Portability and
10193 Accountability Act of 1996 and ensure that all patient
10294 communications and records are secure and confidential.
10395 C. Telemedicine encounte rs and encounters involving store and
10496 forward technologies in this st ate shall not be used to establish a
10597 valid physician-patient relationship for the purpose of prescribing
10698 opiates, synthetic opiates, semisynthetic opiates, benzod iazepine or
10799 carisprodol, but may be used to prescribe opioid antagonists or
108100 partial agonists pursuant to Sections 1 -2506.1 and 1-2506.2 of Title
109101 63 of the Oklahoma Statutes.
110102 D. A physician-patient relationship sh all not be created solely
111103 based on the receipt of patient health inf ormation by a physician.
112104 The duties and obligations created by a phy sician-patient
113105 relationship shall not apply until the physician affirmatively:
114106 1. Undertakes to diagnose and treat the patient; or
115107 2. Participates in the diagno sis and treatment of the patient.
