55 | 48 | | BE IT ENACTED BY THE PEOPLE OF THE STATE O F OKLAHOMA: |

56 | 49 | | SECTION 1. AMENDATORY Section 2, Chapter 228, O.S.L. |

57 | 50 | | 2017 (59 O.S. Supp. 2020, Section 478.1), is amended to read as |

59 | 52 | | Section 478.1. A. Unless otherwise prohibited by law, a valid |
---|
60 | 53 | | physician-patient relationship may be established by an allopathi c |
---|
61 | 54 | | or osteopathic physician with a patient located in this st ate |
---|
62 | 55 | | through telemedicine, provided that the physician: |
---|
63 | 56 | | 1. Holds a license to practice medicine in this state , a |
---|
64 | 57 | | license issued by endorsement by the Sta te Board of Medical |
---|
65 | 58 | | Licensure and Supervision under Section 493.3 of this title or a |
---|
95 | 87 | | 2. Confirms with the patient the patient ’s identity and |
---|
96 | 88 | | physical location; and |
---|
97 | 89 | | 3. Provides the patie nt with the treating physician ’s identity |
---|
98 | 90 | | and professional credentia ls. |

99 | 91 | | B. Telemedicine and store and forward technology encounters |
---|
100 | 92 | | shall comply with the Health Insurance Portability and |
---|
101 | 93 | | Accountability Act of 1996 and ensure that all patient |
---|
102 | 94 | | communications and records are secure and confidential. |

103 | 95 | | C. Telemedicine encounte rs and encounters involving store and |
---|
104 | 96 | | forward technologies in this st ate shall not be used to establish a |
---|
105 | 97 | | valid physician-patient relationship for the purpose of prescribing |
---|
106 | 98 | | opiates, synthetic opiates, semisynthetic opiates, benzod iazepine or |
---|
107 | 99 | | carisprodol, but may be used to prescribe opioid antagonists or |
---|
108 | 100 | | partial agonists pursuant to Sections 1 -2506.1 and 1-2506.2 of Title |
---|
109 | 101 | | 63 of the Oklahoma Statutes. |

110 | 102 | | D. A physician-patient relationship sh all not be created solely |
---|
111 | 103 | | based on the receipt of patient health inf ormation by a physician. |
---|
112 | 104 | | The duties and obligations created by a phy sician-patient |
---|
113 | 105 | | relationship shall not apply until the physician affirmatively: |

114 | 106 | | 1. Undertakes to diagnose and treat the patient; or |

115 | 107 | | 2. Participates in the diagno sis and treatment of the patient. |
