79	79	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
80	80	SECTION 1. AMENDATORY 62 O.S. 2011, Section 34.42, as
81	81	amended by Section 372 , Chapter 304, O.S.L. 2012 (62 O.S. Supp.
82	82	2020, Section 34.42), is amended to read as follows:
83	83	Section 34.42. A. On or before the first day of June in each
84	84	year, or as soon thereafter as possible, all ag encies shall file
85	85	agency budgets with the Director of the Office of Management and
86	86	Enterprise Services. Copies of all agency b udgets shall also be
87	87	made available electronically to the staff of the Joint Legislative
88	88	Committee on Budget and Program Oversigh t.

140	140	B. The required instructions, content and forma t of agency
141	141	budgets shall be developed by the staff of the Budget Division o f
142	142	the Office of Management and Enterprise Services.
143	143	C. 1. The agency budget shall include a description of all
144	144	funds available to the agency for expenditure and set out allotment s
145	145	requested by the agency by quarter and the entire fiscal year. The
146	146	description shall include , but not be limited to, information on
147	147	federal funds which are under the agency’s control and subject to
148	148	the disclosure requirements of Section 34.42.1 of this title.
149	149	2. The agency budget shall be accompanied by an organizational
150	150	chart of the agency, a statement of agency mission and program
151	151	objectives.
152	152	3. The agency budget shall delineate agency spending by su ch
153	153	categories and with at least as much detail as i s specified in the
154	154	legislative appropriation and as prescribed by the Director of the
155	155	Office of Management and Enterprise Services.
156	156	4. Agency budgets shall be signed by the executive officer of
157	157	each agency.
158	158	D. A “request officer” shall be designated by e ach state agency
159	159	for the purpose of making program and allotment requests.
160	160	E. Executive officers of ag encies shall cooperate with the
161	161	Office of Management and Enterpr ise Services staff and Joint
162	162	Committee staff in developing program budgeting categories.

215	215	agency, including nonfiscal appropriati ons, shall not be available
216	216	for expenditure until the request of ficer of the agency has complied
217	217	with the applicable provisions of the Oklahoma State Fin ance Act and
218	218	has received approval of such request for funds from the Director of
219	219	the Office of Managem ent and Enterprise Services.
220	220	G. The provisions of this section shall not apply to CompSource
221	221	Oklahoma if CompSource Oklahoma is operating pursuant to a pilot
222	222	program authorized by Sections 3316 and 3317 of Title 74 of the
223	223	Oklahoma Statutes.
224	224	SECTION 2. AMENDATORY Section 1, Chapter 210, O.S.L.
225	225	2019 (62 O.S. Supp. 2020, Section 34. 42.1), is amended to read as
226	226	follows:
227	227	Section 34.42.1. A. Except as provided in subsection C of this
228	228	section, all agencies and political subdivis ions of the state that
229	229	maintain a website shall make an annual disclosu re pursuant to a
230	230	separate written repo rt and information available through a website
231	231	maintained by or on behalf of the entity of all federal funds under
232	232	the control of the entity and the programs for which the federal
233	233	funds are used by distinct expenditure categories and shall identify
234	234	the priority or rank of the federal funds in descending order with
235	235	the funding source the agency relies or political subdivisions of
236	236	the state that maintain a website rely on to the greatest extent
237	237	listed first and the fundin g source the agency relies or political

291	291	subsection shall include, but shall not be lim ited to:
292	292	1. A description of any action requ ired to be taken by the
293	293	state government entity or political subdivisions of the state th at
294	294	maintain a website as a condition for the receipt or continued
295	295	receipt of federal funds;
296	296	2. A description of any action prohibited to be taken by the
297	297	state government entity or political subdivisions o f the state that
298	298	maintain a website as a condition for the receipt or continued
299	299	receipt of federal funds;
300	300	3. A description of any action required to be taken by any
301	301	individual or lawfully recognized business entity or other entity as
302	302	a condition for the b enefits purported to be conferred on the
303	303	individual or other legal entity as a result of the use of the
304	304	federal funds; and
305	305	4. A description of any action prohibited to be taken by any
306	306	individual or lawfully recognized business entity or other entity as
307	307	a condition for the benefits purported to be conferred on the
308	308	individual or other legal entity as a result of the use of the
309	309	federal funds.
310	310	B. Every entity subject to the requirements of this section
311	311	shall make an annual disclosure, either pursuant to a sep arate
312	312	written report, information available through a website maintained

365	365	which the agency or political subdivisions of the state that
366	366	maintain a website must incur costs to implement and shall provide
367	367	such information in descending order with the most costly federal
368	368	funds listed first and the leas t costly federal funds listed last.
369	369	C. Any agency or political subdivisions of the state that
370	370	maintain a website receiving and administering federal funds that
371	371	require the receiving agency to maintain any level of security
372	372	clearance in order to administer those funds shall be exempt from
373	373	the provisions of this sectio n.
374	374	SECTION 3. This act shall bec ome effective November 1, 2021.
