7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 62 O.S. 2011, Section 34.42, as
8181 amended by Section 372 , Chapter 304, O.S.L. 2012 (62 O.S. Supp.
8282 2020, Section 34.42), is amended to read as follows:
8383 Section 34.42. A. On or before the first day of June in each
8484 year, or as soon thereafter as possible, all ag encies shall file
8585 agency budgets with the Director of the Office of Management and
8686 Enterprise Services. Copies of all agency b udgets shall also be
8787 made available electronically to the staff of the Joint Legislative
8888 Committee on Budget and Program Oversigh t.

140140 B. The required instructions, content and forma t of agency
141141 budgets shall be developed by the staff of the Budget Division o f
142142 the Office of Management and Enterprise Services.
143143 C. 1. The agency budget shall include a description of all
144144 funds available to the agency for expenditure and set out allotment s
145145 requested by the agency by quarter and the entire fiscal year. The
146146 description shall include , but not be limited to, information on
147147 federal funds which are under the agency’s control and subject to
148148 the disclosure requirements of Section 34.42.1 of this title.
149149 2. The agency budget shall be accompanied by an organizational
150150 chart of the agency, a statement of agency mission and program
151151 objectives.
152152 3. The agency budget shall delineate agency spending by su ch
153153 categories and with at least as much detail as i s specified in the
154154 legislative appropriation and as prescribed by the Director of the
155155 Office of Management and Enterprise Services.
156156 4. Agency budgets shall be signed by the executive officer of
157157 each agency.
158158 D. A “request officer” shall be designated by e ach state agency
159159 for the purpose of making program and allotment requests.
160160 E. Executive officers of ag encies shall cooperate with the
161161 Office of Management and Enterpr ise Services staff and Joint
162162 Committee staff in developing program budgeting categories.

214214 F. All funds available or expected to be made available to any
215215 agency, including nonfiscal appropriati ons, shall not be available
216216 for expenditure until the request of ficer of the agency has complied
217217 with the applicable provisions of the Oklahoma State Fin ance Act and
218218 has received approval of such request for funds from the Director of
219219 the Office of Managem ent and Enterprise Services.
220220 G. The provisions of this section shall not apply to CompSource
221221 Oklahoma if CompSource Oklahoma is operating pursuant to a pilot
222222 program authorized by Sections 3316 and 3317 of Title 74 of the
223223 Oklahoma Statutes.
224224 SECTION 2. AMENDATORY Section 1, Chapter 210, O.S.L.
225225 2019 (62 O.S. Supp. 2020, Section 34. 42.1), is amended to read as
226226 follows:
227227 Section 34.42.1. A. Except as provided in subsection C of this
228228 section, all agencies and political subdivis ions of the state that
229229 maintain a website shall make an annual disclosu re pursuant to a
230230 separate written repo rt and information available through a website
231231 maintained by or on behalf of the entity of all federal funds under
232232 the control of the entity and the programs for which the federal
233233 funds are used by distinct expenditure categories and shall identify
234234 the priority or rank of the federal funds in descending order with
235235 the funding source the agency relies or political subdivisions of
236236 the state that maintain a website rely on to the greatest extent
237237 listed first and the fundin g source the agency relies or political

289289 subdivisions of the state that maintain a website rely on to the
290290 least extent listed last. The information required by this
291291 subsection shall include, but shall not be lim ited to:
292292 1. A description of any action requ ired to be taken by the
293293 state government entity or political subdivisions of the state th at
294294 maintain a website as a condition for the receipt or continued
295295 receipt of federal funds;
296296 2. A description of any action prohibited to be taken by the
297297 state government entity or political subdivisions o f the state that
298298 maintain a website as a condition for the receipt or continued
299299 receipt of federal funds;
300300 3. A description of any action required to be taken by any
301301 individual or lawfully recognized business entity or other entity as
302302 a condition for the b enefits purported to be conferred on the
303303 individual or other legal entity as a result of the use of the
304304 federal funds; and
305305 4. A description of any action prohibited to be taken by any
306306 individual or lawfully recognized business entity or other entity as
307307 a condition for the benefits purported to be conferred on the
308308 individual or other legal entity as a result of the use of the
309309 federal funds.
310310 B. Every entity subject to the requirements of this section
311311 shall make an annual disclosure, either pursuant to a sep arate
312312 written report, information available through a website maintained

364364 by or on behalf of the entity or both, of the federal funds for
365365 which the agency or political subdivisions of the state that
366366 maintain a website must incur costs to implement and shall provide
367367 such information in descending order with the most costly federal
368368 funds listed first and the leas t costly federal funds listed last.
369369 C. Any agency or political subdivisions of the state that
370370 maintain a website receiving and administering federal funds that
371371 require the receiving agency to maintain any level of security
372372 clearance in order to administer those funds shall be exempt from
373373 the provisions of this sectio n.
374374 SECTION 3. This act shall bec ome effective November 1, 2021.
