4645 BE IT ENACTED BY THE PEOPLE OF THE ST ATE OF OKLAHOMA:
4746 SECTION 1. AMENDATORY 59 O.S. 2011, Section 509, as last
4847 amended by Section 36, Chapter 161, O.S.L. 2020 (59 O.S. Supp. 2020,
4948 Section 509), is amended to read as follows:
5049 Section 509. The words “unprofessional conduct” as used in
5150 Sections 481 through 518.1 of this title are hereby dec lared to
5251 include, but shall not be limited to, the following:
5352 1. Procuring, aiding or abetting a criminal operation;
5453 2. The obtaining of any fee or offering to accept an y fee,
5554 present or other form of remune ration whatsoever, on the assurance
5655 or promise that a manifestly incurable disease can or will be cured;
5756 3. Willfully betraying a professional secret to the detriment
5857 of the patient;
5958 4. Habitual intemperance or the h abitual use of habit -forming
6059 drugs;

8787 5. Conviction or confession of, or plea of guilt y, nolo
8888 contendere, no contest or Alford plea to a felony or any offense
8989 involving moral turpitude;
9090 6. All advertising of medical busin ess in which statements are
9191 made which are grossly untrue or improbable a nd calculated to
9292 mislead the public;
9393 7. Conviction or confession of, or plea of guilty, nolo
9494 contendere, no contest or Alford plea to a crime involving v iolation
9595 of:
9696 a. the antinarcotic or prohibition laws and regulat ions
9797 of the federal government,
9898 b. the laws of this state,
9999 c. State Board of Health r ules, or
100100 d. a determination by a judge or jury;
101101 8. Dishonorable or immoral conduct which is likely to dece ive,
102102 defraud, or harm the public;
103103 9. The commission of any act which is a violation of the
104104 criminal laws of any state when such act is connected wit h the
105105 physician’s practice of medicine. A complaint, indictment or
106106 confession of a criminal violation shal l not be necessary for the
107107 enforcement of this provision. Proof of the commission of the act
108108 while in the practice of medicine or under the guise of the practice
109109 of medicine shall be unprofessional conduct;

136137 10. Failure to keep complete and accurate recor ds of purchase
137138 and disposal of controlled drugs or of narcotic d rugs;
138139 11. The writing of false or fic titious prescriptions for any
139140 drugs or narcotics declared by the laws of this state to be
140141 controlled or narcotic drugs;
141142 12. Prescribing or administering a drug or treatment without
142143 sufficient examination and the estab lishment of a valid physician -
143144 patient relationship and not prescribing in a safe, med ically
144145 accepted manner;
145146 13. The violation, or attempted violation, direct or indirect,
146147 of any of the provisions of the Oklahoma Allopat hic Medical and
147148 Surgical Licensure and Supervision Act, either as a princ ipal,
148149 accessory or accomplice;
149150 14. Aiding or abetting, directly or indirectly, the practice of
150151 medicine by any person not duly authorized under the laws of this
151152 state;
152153 15. The inability to practice medicine with reas onable skill
153154 and safety to patients by reason of age, illness, drunkenness,
154155 excessive use of drugs, narcotics, chemicals , or any other type of
155156 material or as a result of any mental or physical condition. In
156157 enforcing this section the State Board of Medica l Licensure and
157158 Supervision may, upon probable cause, request a physician to submit
158159 to a mental or physical examination by physicians designated by it.
159160 If the physician refuses to submit to t he examination, the Board

186188 shall issue an order requiring the phy sician to show cause why the
187189 physician will not submit to the examination and shall s chedule a
188190 hearing on the order within thirty (30) days after notice is served
189191 on the physician, exclusive o f the day of service. The ph ysician
190192 shall be notified by either personal service or by certified mail
191193 with return receipt requested. At the hearing , the physician and
192194 the physician’s attorney are entitled to present any testimony and
193195 other evidence to sh ow why the physician should n ot be required to
194196 submit to the examination. After a complete hearing, t he Board
195197 shall issue an order either requiring the physician to submit to the
196198 examination or withdrawing the request for examination. The medical
197199 license of a physician ordered to su bmit for examination may be
198200 suspended until the results of the examinatio n are received and
199201 reviewed by the Board;
200202 16. a. Prescribing, dispensing or administering of controlled
201203 substances or narcotic drugs in excess of the amou nt
202204 considered good medical pr actice,
203205 b. prescribing, dispensing or administering controlled
204206 substances or narcotic drugs without medical need in
205207 accordance with pertinent licensing board standards,
206208 or
207209 c. prescribing, dispensing or administering opioid drug s
208210 in excess of the maximum li mits authorized in Section
209211 2-309I of Title 63 of the Oklahoma Statutes;

236239 17. Engaging in physical conduct with a patient which is sexual
237240 in nature, or in any verbal behavior which is seductive or sexually
238241 demeaning to a patient ;
239242 18. Failure to maintain an office record for each patient whi ch
240243 accurately reflects the evaluation, treatment, and medical necessity
241244 of treatment of the patient;
242245 19. Failure to provide necessary ongoing medical treatment when
243246 a doctor-patient relationship has been established, whi ch
244247 relationship can be severed by e ither party providing a reasonable
245248 period of time is granted; or
246249 20. Failure to prov ide a proper and safe medical facility
247250 setting and qualified assistive personnel for a recognized medical
248251 act, including but not limited to an initial in-person patient
249252 examination, office surgery, diagnostic service or any other medical
250253 procedure or treatment. Adequate medical records to support
251254 diagnosis, procedure, treatment or prescribed medications must b e
252255 produced and maintained ; or
253256 21. Violation of the provisions o f the Heartbeat Informed
254257 Consent Act.
255258 SECTION 2. AMENDATORY 59 O.S. 2011, Section 637, as last
256259 amended by Section 42, Chapter 161, O.S.L. 2020 ( 59 O.S. Supp. 2020,

258261 Section 637. A. The State Board of Osteopathic Examiners may
259262 refuse to admit a person to an examination or may refuse to issue or

286290 reinstate or may suspend or revoke any licen se issued or reinstated
287291 by the Board upon proof that the applicant or holder of such a
288292 license:
289293 1. Has obtained a license, license renewal or authorization to
290294 sit for an examination, as the case may be, through fraud,
291295 deception, misrepresentation or bribe ry; or has been granted a
292296 license, license renewal or authorization to sit for an examination
293297 based upon a material mistake of fact;
294298 2. Has engaged in the use or employment of dishonest y, fraud,
295299 misrepresentation, fals e promise, false pretense, unethical conduct
296300 or unprofessional conduct, as may be determined by the Board, in the
297301 performance of the functions or duties of an osteopathic physi cian,
298302 including but not limited to the followin g:
299303 a. obtaining or attempting to obtain any fee, charge,
300304 tuition or other compensation by fraud, deceptio n or
301305 misrepresentation; willfully and continually
302306 overcharging or overtreating patients; or charging for
303307 visits to the physician’s office which did not occur
304308 or for services which were not rendered,
305309 b. using intimidation, coercion or deception to obtain or
306310 retain a patient or discourage the use of a second
307311 opinion or consultation,

335340 treatment, diagnostic tests or osteopathic medical or
336341 surgical services,
337342 d. delegating professional responsibilities to a pers on
338343 who is not qualified by training, skill, competency,
339344 age, experience or licensure to perform them, no ting
340345 that delegation may only occur within an a ppropriate
341346 doctor-patient relationship, wherein a proper patient
342347 record is maintained including, but not limited to, at
343348 the minimum, a current history and physical,
344349 e. misrepresenting that any disease, ailment , or
345350 infirmity can be cured by a method, proced ure,
346351 treatment, medicine or devic e,
347352 f. acting in a manner which result s in final disciplinary
348353 action by any professional society or association or
349354 hospital or medical staff of such hospital in this or
350355 any other state, whether agreed to voluntarily or not,
351356 if the action was in any way rela ted to professional
352357 conduct, professional competence, malpractice or any
353358 other violation of the Oklahoma Osteopathic Medicine
354359 Act,
355360 g. signing a blank prescription form; or disp ensing,
356361 prescribing, administering or otherwise distributing
357362 any drug, controlled substance or other treatment

385391 a physician-patient relationship, or for other than
386392 medically accepted therapeutic or expe rimental or
387393 investigational purpose duly author ized by a state or
388394 federal agency, or not in good faith to relieve pai n
389395 and suffering, or not to treat an ailment, physical
390396 infirmity or disease, or violating any state or
391397 federal law on controlled dangerous s ubstances
392398 including, but not limited to, prescr ibing, dispensing
393399 or administering opioid drugs in excess of the maxim um
394400 limits authorized in Section 2 -309I of Title 63 of the
395401 Oklahoma Statutes,
396402 h. engaging in any sexual activity within a physician -

398404 i. terminating the care of a pati ent without adequate

401407 j. failing to furnish a copy of a patient ’s medical
402408 records upon a proper request from the patient or
403409 legal agent of the patient or another physician; o r
404410 failing to comply with any othe r law relating to

434441 l. violating a probation agreement or order with this
435442 Board or any other agency, and
436443 m. failing to keep complete and accurate re cords of
437444 purchase and disposal of controlled drugs or narcotic
438445 drugs;
439446 3. Has engaged in gross negligence , gross malpractice or gross
440447 incompetence;
441448 4. Has engaged in repeated acts of negligence, malpractice o r
442449 incompetence;
443450 5. Has been finally adjudicate d and found guilty, or entered a
444451 plea of guilty or nolo contendere in a criminal prosecution, for any
445452 offense reasonably related to the qualifications, functions or
446453 duties of an osteopathic physician, whether or not sentence is
447454 imposed, and regardless of t he pendency of an appeal;
448455 6. Has had the authority to engage in the a ctivities regulated
449456 by the Board revoked, suspended, restricted, modified or limited, or
450457 has been reprimanded, warned or censured, probated or otherwise
451458 disciplined by any other state or federal agency whether or not
452459 voluntarily agreed to by the physician including, but not limited
453460 to, the denial of licensure, surrender of the license, permit or
454461 authority, allowing the license, permit or auth ority to expire or
455462 lapse, or discontinuing or l imiting the practice of osteopath ic
456463 medicine pending disposition of a complaint or completion of an
457464 investigation;

484492 7. Has violated, or failed to comply with provisions of any act
485493 or regulation administered by the Board;
486494 8. Is incapable, for medical or ps ychiatric or any other good
487495 cause, of discharging the functions of an osteopathic physician in a
488496 manner consistent with the public ’s health, safety and welfare;
489497 9. Has been guilty of advertising by means of k nowingly false
490498 or deceptive statements;
491499 10. Has been guilty of advertising, pra cticing, or attempting
492500 to practice under a name other than one ’s own;
493501 11. Has violated or refused to comply with a lawful order of
494502 the Board;
495503 12. Has been guilty of habitual drunkenness, or habitual
496504 addiction to the use o f morphine, cocaine or other habi t-forming
497505 drugs;
498506 13. Has been guilty of personal offensive behavior, wh ich would
499507 include, but not be limited to obscenity, lewdness and molestation;
500508 and
501509 14. Has been adjudica ted to be insane, or incompetent, or
502510 admitted to an institution for the treatmen t of psychiatric
503511 disorders; and
504512 15. Has violated the provisions of the Heartbeat Informed
505513 Consent Act.
506514 B. The State Board of Osteopathic Examiners shall neither
507515 refuse to renew, nor suspend, nor revoke any license, howeve r, for

534543 any of these causes, unless the person accused has been given a t
535544 least twenty (20) days ’ notice in writing of the charge against him
536545 or her and a public hearing by the Board provided, three -fourths
537546 (3/4) of a quorum present at a meeting may vote to suspend a license
538547 in an emergency situation if the licensee affected i s provided a
539548 public hearing within thirty (30) days of the emergency suspension.
540549 C. The State Board of Osteopathic Examiners shall have th e
541550 power to order or subpoena the attendance of witnesses, the
542551 inspection of records and premises and the production o f relevant
543552 books and papers for the investigation of matters that may come
544553 before them. The presiding officer of the Board shall have the
545554 authority to compel the giving of testimony as is conferred on
546555 courts of justice.
547556 D. Any osteopathic physician in th e State of Oklahoma whose
548557 license to practice osteopathic medicine is revoked or suspended
549558 under this section shall have the right to seek judicial review of a
550559 ruling of the Board pursua nt to the Administrative Procedures Act.
551560 E. The Board may enact rules and regulations pursuant to the
552561 Administrative Procedures Act setting out additional acts of
553562 unprofessional conduct; which acts shall be g rounds for refusal to
554563 issue or reinstate, or fo r action to condition, suspend or revoke a
555564 license.

582592 SECTION 3. AMENDATORY Section 4, Chapter 159, O.S.L.
583593 2012 (63 O.S. Supp. 20 20, Section 1-745.14), is amended to read as
584594 follows:
585595 Section 1-745.14. A. Any abortion provider who knowingly
586596 performs or induces any abortion shall com ply with the requirements
587597 of the Heartbeat Informed Consent Act.
588598 B. Prior to a woman giving informed consent to having any part
589599 of an abortion performed or induced, if the pregnancy is at least
590600 eight (8) six (6) weeks after fertilization, the abortion pro vider
591601 who is to perform or induce the abortion or an agent of the abortion
592602 provider shall tell the woman that it may be possible to make
593603 determine if the embryonic or fetal heartbeat of the unborn child is
594604 audible for the pregnant woman to hear and ask the woman if she
595605 would like to hear the heartbeat. If the woman would like to hear
596606 the heartbeat, the abortion provider shall, using a Doppler fetal
597607 heart rate monitor, make the embryonic or fetal heartbeat of the
598608 unborn child audible for the pregnant woman to hear. No physician
599609 shall perform an abortion if the physician determines the embryonic
600610 or fetal heartbeat is audible. An abortion provider , or an agent of
601611 the abortion provider shall not be in violat ion of the requirements
602612 of this subsection if:
603613 1. The provider or agent has attempted, consistent with
604614 standard medical practice, to make the embryonic or fetal heartbeat

632643 Doppler fetal heart rate monitor;
633644 2. That attempt does not result in the heartbeat being made
634645 audible; and
635646 3. The provider has offered to attempt to make the heartbeat
636647 audible at a subsequent date.
637648 C. Nothing in this sectio n shall be construed to prevent the
638649 pregnant woman from not listening to the sounds detected by the
639650 Doppler fetal heart rate monitor pursuant to the requirements of
640651 subsection B of this section.
641652 SECTION 4. AMENDATORY Section 6, Ch apter 159, O.S.L.
642653 2012 (63 O.S. Supp. 20 20, Section 1-745.16), is amended to read as
643654 follows:
644655 Section 1-745.16. A. Any person who intentionally or
645656 recklessly performs or induces an abortion in violation of the
646657 Heartbeat Informed Consent Act shall be guil ty of a misdemeanor. No
647658 penalty shall be asses sed against the woman upon whom the abortion
648659 is performed or induced or attempted to be performed or induced.
649660 B. Any woman upon whom an abortion has been performed or
650661 induced in violation of this act the Heartbeat Informed consent Act,
651662 or the father of the unborn child who was the subject of such an
652663 abortion, may maintain an action agains t the person who performed or
653664 induced the abortion in intentional or reckless violation of this
654665 act for actual and punitive damages. Any woman upon whom an

681693 abortion has been attempted in violation of this act may maintain an
682694 action against the person who attempted to perform or induce the
683695 abortion in an intentional or reckless violation of this act for
684696 actual and punitive dama ges.
685697 C. A cause of action for injunctive relief against any person
686698 who has intentionally or recklessly violated this act the Heartbeat
687699 Informed Consent Act may be maintained by the woman upon whom an
688700 abortion was performed or induced in violation of this act; by any
689701 person who is the spouse, parent, sibling , or guardian of, or a
690702 current or former licensed health care pr ovider of, the woman upon
691703 whom an abortion has bee n performed or induced in violation of this
692704 act; by a district attorney with appropriate jurisdiction; or by the
693705 Attorney General. The injunction shall prevent the a bortion
694706 provider from performing or indu cing further abortions in violation
695707 of this act in the state.
696708 D. If judgment is rendered in favor of the plaintiff in an
697709 action described in this section, the court shall also render
698710 judgment for a reasonable attorn ey fee in favor of the plaintiff
699711 against the defendant.
700712 E. If judgment is rendered in fav or of the defendant and the
701713 court finds that the plaintiff ’s suit was frivolous and broug ht in
702714 bad faith, the court shall also render judgment for a reasonable
703715 attorney fee in favor of the defendant against the plaintiff.

730743 F. No damages or attorney fee may be assessed against the woman
731744 upon whom an abortion was performed or attempted to be per formed or
732745 induced except in accordance with subsection E of this section.
733746 G. In addition to all other penalties pres cribed by this
734747 section, a physician who intentiona lly or recklessly performs or
735748 induces an abortion in violation of the Heartbeat Informed Consent

738751 Licensure and Supervision shall re voke the license of a medical
739752 doctor who intentionally or recklessly performs or induces an
740753 abortion in violation of the Heartbeat Informed Consent Act. The
741754 State Board of Osteopathic Examiners shall revok e the license of a
742755 doctor of osteopathy who intent ionally or recklessly performs or
743756 induces an abortion in violation of the Heartbeat Infor med Consent
744757 Act.
745758 SECTION 5. NEW LAW A new section of law to be codified
746759 in the Oklahoma Statu tes as Section 1-745.20 of Title 63, unless
747760 there is created a duplication in numbering, reads as follows:
748761 If some or all of the provisions of Section 1, 2, 3 or 4 of this
749762 act are ever temporarily or permanently rest rained or enjoined by
750763 court order, the remaining provisions of such section shall be
751764 enforced as though the restrained or enjoined provisions had not
752765 been adopted; provided, howev er, if such temporary or permanent
753766 restraining order or injunction is stayed or dissolved, or otherwise
