63	60		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
64	61		SECTION 1. NEW LAW A new section of law not to be
65	62		codified in the Oklahoma Statutes reads as follows:
66	63		This act shall be known and may be cited as the "Privacy and
67	64		Conscience Protection Act".

	66	+	in the Oklahoma Statutes as Section 191.1 of Title 40, unless there
	67	+	is created a duplication in numb ering, reads as follows:

95		-	SECTION 2. NEW LAW A new section of law to be codified
96		-	in the Oklahoma Statutes as Section 191.1 of Title 40, unless there
97		-	is created a duplication in numbering, reads as follows:
98	94		A. Any public or private employer operating in this state who
99	95		requires an employee or contractor to participate in vaccination or
100	96		immunization for COVID-19, as defined in Section 111 of Title 76 of
101	97		the Oklahoma Statutes, any variant, or future variants thereof as
102	98		part of an employer's policy, whether written or verbal, shall allow
103	99		for a privacy exemption for their employee or contractor to refuse
104	100		disclosure of his or her vaccination or immunization status. The
105	101		requirement of this subsection shall not be re quired of an employee
106	102		who can provide proof of natural immunity by presenting a positive
107	103		antibody test to his or her employer.
108	104		B. Every employee or contractor employed by a public or private
109	105		employer operating in this state shall be provided a certification
110	106		of disclosure exemption, which shall release the employee or
111	107		contractor from disclosing his or her vaccination or immunization
112	108		status due to an employer-mandated policy or regulation, whether
113	109		written or verbal, that involves or governs the vaccination or
114	110		immunization status for COVID-19, any variant, or future variants
115	111		thereof for employees or contractors. The certification of
116	112		disclosure exemption provided to an employee or contractor by the
117	113		employer, as required by this section, shall meet the following
118	114		requirements:
	115	+	1. Upon adoption of any policy or regulation by a public or
	116	+	private employer operating in this state, the employer shall provide
	117	+	immediate notice to all employees or contractors of the policy

146		-	1. Upon adoption of any policy or regulation by a public or
147		-	private employer operating in this state, the employer shall provide
148		-	immediate notice to all employees or contractors of the policy
149	144		adopted by the employer. Such notice shall include a certification
150	145		of disclosure exemption for the employee or contractor. An employee
151	146		seeking to refuse disclosure shall complete the employer-provided
152	147		certification of disclosure exemption;
153	148		2. Upon receipt of the certification of disclosure exemption,
154	149		the employee or contractor shall be given thirty (30) calendar days
155	150		to complete and submit the certification to the employer;
156	151		3. Upon submission of the completed certification of disclosure
157	152		exemption by the employee or contractor, the employer shall ac cept,
158	153		without question, the certification of exemption and shall sign the
159	154		document acknowledging receipt;
160	155		4. Upon submission of the completed certification of disclosure
161	156		exemption, the employer shall not disclose employees or contractors
162	157		who refused to disclose their vaccination or immunization status for
163	158		COVID-19, any variant, or future variants thereof; and
164	159		5. All public or private employers operating in this state
165	160		shall maintain a signed copy of an employe e's or contractor's
166	161		completed certification of disclosure exemption in the employee 's or
167	162		contractor's employment file and shall provide a signed copy to the
168	163		employee or contractor upon request.
	164	+	C. Any policy or regulation adopted by an employer to implement
	165	+	the provisions of this section shall not:

196		-	C. Any policy or regulation adopted by an employer to implement
197		-	the provisions of this section shall not:
198	192		1. Disclose their employee's or contractor's vaccination or
199	193		immunization status for COVID-19, any variant, or future variants
200	194		thereof;
201	195		2. Provide incentives, bonuses, or any other reward for
202	196		disclosing an employee's or contractor's vaccination or immunization
203	197		status for COVID-19, any variant, or future variants thereof;
204	198		3. Discriminate against employees or contactors on their
205	199		refusal to disclose their immunization or vaccination status for
206	200		COVID-19, any variant, or future variants thereof. Discrimination
207	201		includes, but is not limited to, harassment, different treatment,
208	202		denial of benefits, or retaliation against an employee or
209	203		contractor;
210	204		4. Terminate, discipline, deny employment benefits to, or
211	205		otherwise penalize an employee or contractor by a reduction in pay
212	206		or benefits based on the employee's or contractor's refusal to
213	207		disclose immunization or vaccination status for COVID-19, any
214	208		variant, or future variants thereof;
215	209		5. Segregate employees or contractors based on immunization or
216	210		vaccination status for COVID-19, any variant, or future variants
217	211		thereof; or
218	212		6. Require an employee or contractor to wear or display any
219	213		insignia or mark, or oth erwise directly or indirectly disclose his
	214	+	or her refusal to disclose vaccination or immunization status for
	215	+	COVID-19, any variant, or future variants thereof.

249	242		An employer may offer reasonable accommodations for those who
250	243		refuse to disclose and provid e an exemption from disclosure of
251	244		vaccination status. For the purposes of this section, "reasonable
252	245		accommodation" shall mean requiring the wearing of a mask when
253	246		interacting with or in close proximity of others or requiring
254	247		periodic testing not to exceed more than once weekly. Any costs
255	248		incurred by the implementation of these accommodations shall be paid
256	249		for by the employer.
257	250		D. An employee or contractor seeking an exemption from
258	251		disclosure of his or her vaccination or immunization status shall
259	252		complete the certification of exemption form included in this
260	253		subsection and deliver it to his or her employer.

356	347		SECTION 3. AMENDATORY 40 O.S. 2021, Section 192, is
357	348		amended to read as follows:
358	349		Section 192. A. Each and every violation of any provision of
359	350		Section 1 of this act 191 of this title shall constitute a
360	351		misdemeanor, punishable by a fine in any amount not excee ding One
361	352		Hundred Dollars ($100.00).
362	353		B. Each and every violation by an employer of any provision of
363	354		Section 2 of this act shall be under the jurisdiction of the Office
364	355		of the Attorney General.
365	356		SECTION 4. It being immediately necessary for the preservation
366	357		of the public peace, h ealth, or safety, an emergency is hereby
367	358		declared to exist, by reason whereof this act shall take effect and
368	359		be in full force from and after its passage an d approval.
