15	46		Section 367.8, as amended by Section 11, Chapter 106,
16	47		O.S.L. 2018 (59 O.S. Supp. 2020, Section 367.8),
17	48		which relates to maintenance of drugs in emergency
18	49		medication kits by pharmacies; requiring pharmacy to
19	50		establish certain policy and procedures; specifying
20	51		entity that maintains emergency medication kits;
21	52		authorizing pharmacy to establish pharmacy designee
22	53		for specified purpose; requiring pharmacy to register
23	54		emergency medication kit as pharmacy location and
24	55		comply with certain requirements; providing limits
25	56		for controlled dangerous substances ; requiring
26	57		prescription and reporting; and providing an
27	58		effective date.

34	63		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

36	64		SECTION 1. AMENDATORY 59 O.S. 2011, Section 367.8, as
37	65		amended by Section 11, Chapter 106, O.S.L. 2018 (59 O.S. Supp. 2020,
38	66		Section 367.8), is amended to read as follows:

40	67		Section 367.8. A. A pharmacy may maintain drugs in an
41	68		emergency medication kit used at for dispensation in a facility as
42	69		provided by this section. The pharmacy shall establish a policy and

44	98		in accordance with the provisions of this section . The drugs may be
45	99		used only for the emergency medication needs of a resident at the

48	100		facility. A The pharmacy may shall maintain the drugs in an the
49	101		emergency medication kit for any the facility.

51	102		B. The pharmacy may establish a pharmacy designee at the
52	103		facility who shall be responsible for transmitting required
53	104		information for dispensation of controlled dangerous substances to
54	105		the central repository of the Oklahoma State Bureau of Narcotics and
55	106		Dangerous Drugs Control as provided by the Anti -Drug Diversion Act.

57	107		C. The pharmacy shall register the emergency medication kit as
58	108		a pharmacy location with the Oklahoma State Bureau of Narcotics and
59	109		Dangerous Drugs Control and shall comply with the requirements for
60	110		controlled dangerous substance s prescribed by rules of the Oklahoma
61	111		State Bureau of Narcotics and Dangerous Drugs Control Commission .

63	112		D. The State Board of Pharmacy shall promulgate rules relating
64	113		to emergency medication kits , including, but not limited to:
65		-
66	114		1. The amount and type of drugs that may be maintained in an
67	115		emergency medication kit . The total volume of each controlled
68	116		dangerous substance sh all be limited to the lesser of three doses
69	117		per licensed bed or sixty individual doses. Controlled dangerous
70	118		substances stored in emergency medication kits must be dispensed
71	119		pursuant to a valid prescription and shall be reported to the
72	120		registered pharmacy;

81	152		C. E. As used in this section, "facility" means a facility as
82	153		defined by the Nursing Home Care Act or an assisted living center as
83	154		defined by the Continuum of Care and Assisted Living Act.

85	155		SECTION 2. This act shall become effective November 1, 2021.
