5354 BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
5455 SECTION 1. AMENDATORY 63 O.S. 2011, Section 2 -106, as
5556 amended by Section 1, Chapter 340, O.S.L . 2013 (63 O.S. Supp. 2020,
5657 Section 2-106), is amended to read as follows:
5758 Section 2-106. A. The Director of the Oklahoma State Bureau of
5859 Narcotics and Dangerous Drugs Control shall, in addition to other
5960 powers and duties vested in the Director:
6061 1. Cooperate with federal and other state agencies in
6162 discharging the responsibilities concerning traffic in narcotics and
6263 dangerous substances and in suppressing the abuse of dangerous
6364 substances;

9191 2. Arrange for the exchange of information between governmental
9292 officials concerning the use and abuse of dange rous substances;
9393 3. Coordinate and cooperate in training programs on dangerous
9494 substances law enforcement at the local and state levels;
9595 4. Cooperate with the Oklahoma State Bureau of Narcotics and
9696 Dangerous Drugs Control by establishing a centralized un it which
9797 will accept, catalog, file and collect statistics, including records
9898 of drug-dependent persons and other dangerous substance law
9999 offenders within the state, and make such information available for
100100 federal, state and local law enforcement purposes; and may collect
101101 and furnish statistics for other appropriate purposes; and
102102 5. Coordinate and cooperate in programs of eradication aimed at
103103 destroying wild or illicit growth of plant species from which
104104 controlled dangerous substances may be extracted.
105105 B. Results, information and evidence received from the Oklahoma
106106 State Bureau of Narcotics and Dangerous Drugs Control relating to
107107 the regulatory functions of this act, including results of
108108 inspections conducted by that agency, may be relied upon and acted
109109 upon by the Director in conformance with the regulatory functions
110110 under this act.
111111 C. The Director is further authorized and directed to:
112112 1. Coordinate and cooperate in educational programs designed to
113113 prevent and deter misuse and abuse of controlled danger ous
114114 substances;

142141 2. Promote better recognition of the problems of misuse and
143142 abuse of controlled dangerous substances within the regulated
144143 industry and among interested groups and organizations;
145144 3. Assist the regulated industry, interested groups and
146145 organizations in contributing to the reduction of misuse and abuse
147146 of controlled dangerous substances;
148147 4. Consult with interested groups and organizations to aid them
149148 in solving administrative and organizational problems;
150149 5. Assist in evaluating procedures, projects, techniques and
151150 controls conducted or proposed as part of educational programs on
152151 misuse and abuse of controlled dangerous substances;
153152 6. Disseminate the results of research on misuse and abuse of
154153 controlled dangerous substances to promote a bett er public
155154 understanding of what problems exist and what can be done to combat
156155 them;
157156 7. Assist in the education and training of state and local law
158157 enforcement officials in their efforts to control misuse and abuse
159158 of controlled dangerous substances;
160159 8. Conduct an annual seminar to be attended by selected law
161160 enforcement officers in order to teach new techniques and advances
162161 in the investigation of violations of the Uniform Controlled
163162 Dangerous Substances Act; and
164163 9. Supervise and direct agents appointed in the performance of
165164 their function of enforcement of the provisions of this act.

193191 D. The Director is further authorized and directed to:
194192 1. Encourage research on misuse and abuse of controlled
195193 dangerous substances;
196194 2. Cooperate in establishing methods to assess accurately the
197195 effects of controlled dangerous substances and to identify and
198196 characterize controlled dangerous substances with potential for
199197 abuse; and
200198 3. Cooperate in making studies and in underta king programs of
201199 research to:
202200 a. develop new or improved approaches, techniques,
203201 systems, equipment and devices to strengthen the
204202 enforcement of this act,
205203 b. determine patterns of misuse and abuse of controlled
206204 dangerous substances and the social effects t hereof,
207205 and
208206 c. improve methods for preventing, predicting,
209207 understanding and dealing with the misuse and abuse of
210208 controlled dangerous substances.
211209 E. The Director shall prepare a yearly report on all deaths and
212210 nonfatal overdoses which were the result or probable result of abuse
213211 of a controlled danger ous substance. The yearly report shall be
214212 limited to statistical information including, but not limited to,
215213 the county where the death or nonfatal overdose occurred, age, race,
216214 gender, type of controlled dang erous substances involved in the

244241 death or nonfatal overdose, and the method in which the controlled
245242 dangerous substance was obtained by the person, when available.
246243 F. The Director may enter into contracts with public agencies,
247244 institutions of higher educa tion and private organizations or
248245 individuals for the purpose of conducting research, demonstrations
249246 or special projects which bear directly on misuse and abuse of
250247 controlled dangerous substances.
251248 G. The Director may enter into contracts for educational a nd
252249 research activities without performance bond s.
253250 H. The Director may authorize persons engaged in research or
254251 scientific activities on the use and effects of dangerous substances
255252 to withhold the names and other identifying characteristics of
256253 persons who are the subjects of such research. Persons who obtain
257254 this authorization may not be compelled in any state civil,
258255 criminal, administrative, legislative or other proceeding to
259256 identify the subjects of research for which such authorization was
260257 obtained.
261258 I. The Director may authorize the lawful possessi on,
262259 distribution and use of controlled dangerous substances by persons
263260 engaged in research or scientific activities; authorization for
264261 possession of controlled dangerous substances may be extended to
265262 persons engaged in a program of drug education or person s in the
266263 performance of an official duty. Persons who obtain this
267264 authorization shall be exempt from state prosecution for possession,

295291 distribution or use of dangerous substances to the extent authorized
296292 by the Director.
297293 J. The Director is authorized to accept gifts, bequests,
298294 devises, contributions and grants, public or private, including
299295 federal funds or funds from any other source for use in furthering
300296 the purpose of the office of the Director.
301297 K. The Director is authorized to purchase or sell real
302298 property, together with appurtenances, in the name of the Oklahoma
303299 State Bureau of Narcotics and Dangerous Drugs Control upon approval
304300 of the Oklahoma State Bureau of Narcotics and Dangerous Drugs
305301 Control Commission.
306302 L. The Director is authorized to purchas e and maintain motor
307303 vehicles and other equipment for use by the employees of the Bureau.
308304 M. The Director shall be in charge of all monies appropriated
309305 for or deposited to the credit of the office of the Dire ctor and is
310306 authorized to approve claims and pa yrolls as provided in Section
311307 41.26 of Title 62 of the Oklahoma Statutes.
312308 N. The Director shall have the authority of a peace officer and
313309 is authorized to commission assistants of the office as peace
314310 officers.
315311 O. Upon determining that a practitioner is p rescribing a
316312 controlled dangerous substance to a person engaged in fraudulent or
317313 deceptive efforts to fill or refill multiple prescriptions for
318314 controlled dangerous substances, the Director shall provide writt en

347342 possibility that the person may be unlawfully obtaining prescription
348343 drugs in violation of the Uniform Controlled Dangerous Substances
349344 Act.
350345 P. The Director may select and utilize an advisory c ouncil
351346 comprised of medical professionals as deemed necessary by the
352347 Director for the purpose of consultation and review to the benefi t
353348 of the Bureau.
354349 SECTION 2. This act shall become effective November 1, 2021.
