53	54		BE IT ENACTED BY THE PEOPLE OF THE STAT E OF OKLAHOMA:
54	55		SECTION 1. AMENDATORY 63 O.S. 2011, Section 2 -106, as
55	56		amended by Section 1, Chapter 340, O.S.L . 2013 (63 O.S. Supp. 2020,
56	57		Section 2-106), is amended to read as follows:
57	58		Section 2-106. A. The Director of the Oklahoma State Bureau of
58	59		Narcotics and Dangerous Drugs Control shall, in addition to other
59	60		powers and duties vested in the Director:
60	61		1. Cooperate with federal and other state agencies in
61	62		discharging the responsibilities concerning traffic in narcotics and
62	63		dangerous substances and in suppressing the abuse of dangerous
63	64		substances;

91	91		2. Arrange for the exchange of information between governmental
92	92		officials concerning the use and abuse of dange rous substances;
93	93		3. Coordinate and cooperate in training programs on dangerous
94	94		substances law enforcement at the local and state levels;
95	95		4. Cooperate with the Oklahoma State Bureau of Narcotics and
96	96		Dangerous Drugs Control by establishing a centralized un it which
97	97		will accept, catalog, file and collect statistics, including records
98	98		of drug-dependent persons and other dangerous substance law
99	99		offenders within the state, and make such information available for
100	100		federal, state and local law enforcement purposes; and may collect
101	101		and furnish statistics for other appropriate purposes; and
102	102		5. Coordinate and cooperate in programs of eradication aimed at
103	103		destroying wild or illicit growth of plant species from which
104	104		controlled dangerous substances may be extracted.
105	105		B. Results, information and evidence received from the Oklahoma
106	106		State Bureau of Narcotics and Dangerous Drugs Control relating to
107	107		the regulatory functions of this act, including results of
108	108		inspections conducted by that agency, may be relied upon and acted
109	109		upon by the Director in conformance with the regulatory functions
110	110		under this act.
111	111		C. The Director is further authorized and directed to:
112	112		1. Coordinate and cooperate in educational programs designed to
113	113		prevent and deter misuse and abuse of controlled danger ous
114	114		substances;

142	141		2. Promote better recognition of the problems of misuse and
143	142		abuse of controlled dangerous substances within the regulated
144	143		industry and among interested groups and organizations;
145	144		3. Assist the regulated industry, interested groups and
146	145		organizations in contributing to the reduction of misuse and abuse
147	146		of controlled dangerous substances;
148	147		4. Consult with interested groups and organizations to aid them
149	148		in solving administrative and organizational problems;
150	149		5. Assist in evaluating procedures, projects, techniques and
151	150		controls conducted or proposed as part of educational programs on
152	151		misuse and abuse of controlled dangerous substances;
153	152		6. Disseminate the results of research on misuse and abuse of
154	153		controlled dangerous substances to promote a bett er public
155	154		understanding of what problems exist and what can be done to combat
156	155		them;
157	156		7. Assist in the education and training of state and local law
158	157		enforcement officials in their efforts to control misuse and abuse
159	158		of controlled dangerous substances;
160	159		8. Conduct an annual seminar to be attended by selected law
161	160		enforcement officers in order to teach new techniques and advances
162	161		in the investigation of violations of the Uniform Controlled
163	162		Dangerous Substances Act; and
164	163		9. Supervise and direct agents appointed in the performance of
165	164		their function of enforcement of the provisions of this act.

193	191		D. The Director is further authorized and directed to:
194	192		1. Encourage research on misuse and abuse of controlled
195	193		dangerous substances;
196	194		2. Cooperate in establishing methods to assess accurately the
197	195		effects of controlled dangerous substances and to identify and
198	196		characterize controlled dangerous substances with potential for
199	197		abuse; and
200	198		3. Cooperate in making studies and in underta king programs of
201	199		research to:
202	200		a. develop new or improved approaches, techniques,
203	201		systems, equipment and devices to strengthen the
204	202		enforcement of this act,
205	203		b. determine patterns of misuse and abuse of controlled
206	204		dangerous substances and the social effects t hereof,
207	205		and
208	206		c. improve methods for preventing, predicting,
209	207		understanding and dealing with the misuse and abuse of
210	208		controlled dangerous substances.
211	209		E. The Director shall prepare a yearly report on all deaths and
212	210		nonfatal overdoses which were the result or probable result of abuse
213	211		of a controlled danger ous substance. The yearly report shall be
214	212		limited to statistical information including, but not limited to,
215	213		the county where the death or nonfatal overdose occurred, age, race,
216	214		gender, type of controlled dang erous substances involved in the

244	241		death or nonfatal overdose, and the method in which the controlled
245	242		dangerous substance was obtained by the person, when available.
246	243		F. The Director may enter into contracts with public agencies,
247	244		institutions of higher educa tion and private organizations or
248	245		individuals for the purpose of conducting research, demonstrations
249	246		or special projects which bear directly on misuse and abuse of
250	247		controlled dangerous substances.
251	248		G. The Director may enter into contracts for educational a nd
252	249		research activities without performance bond s.
253	250		H. The Director may authorize persons engaged in research or
254	251		scientific activities on the use and effects of dangerous substances
255	252		to withhold the names and other identifying characteristics of
256	253		persons who are the subjects of such research. Persons who obtain
257	254		this authorization may not be compelled in any state civil,
258	255		criminal, administrative, legislative or other proceeding to
259	256		identify the subjects of research for which such authorization was
260	257		obtained.
261	258		I. The Director may authorize the lawful possessi on,
262	259		distribution and use of controlled dangerous substances by persons
263	260		engaged in research or scientific activities; authorization for
264	261		possession of controlled dangerous substances may be extended to
265	262		persons engaged in a program of drug education or person s in the
266	263		performance of an official duty. Persons who obtain this
267	264		authorization shall be exempt from state prosecution for possession,

295	291		distribution or use of dangerous substances to the extent authorized
296	292		by the Director.
297	293		J. The Director is authorized to accept gifts, bequests,
298	294		devises, contributions and grants, public or private, including
299	295		federal funds or funds from any other source for use in furthering
300	296		the purpose of the office of the Director.
301	297		K. The Director is authorized to purchase or sell real
302	298		property, together with appurtenances, in the name of the Oklahoma
303	299		State Bureau of Narcotics and Dangerous Drugs Control upon approval
304	300		of the Oklahoma State Bureau of Narcotics and Dangerous Drugs
305	301		Control Commission.
306	302		L. The Director is authorized to purchas e and maintain motor
307	303		vehicles and other equipment for use by the employees of the Bureau.
308	304		M. The Director shall be in charge of all monies appropriated
309	305		for or deposited to the credit of the office of the Dire ctor and is
310	306		authorized to approve claims and pa yrolls as provided in Section
311	307		41.26 of Title 62 of the Oklahoma Statutes.
312	308		N. The Director shall have the authority of a peace officer and
313	309		is authorized to commission assistants of the office as peace
314	310		officers.
315	311		O. Upon determining that a practitioner is p rescribing a
316	312		controlled dangerous substance to a person engaged in fraudulent or
317	313		deceptive efforts to fill or refill multiple prescriptions for
318	314		controlled dangerous substances, the Director shall provide writt en

347	342		possibility that the person may be unlawfully obtaining prescription
348	343		drugs in violation of the Uniform Controlled Dangerous Substances
349	344		Act.
350	345		P. The Director may select and utilize an advisory c ouncil
351	346		comprised of medical professionals as deemed necessary by the
352	347		Director for the purpose of consultation and review to the benefi t
353	348		of the Bureau.
354	349		SECTION 2. This act shall become effective November 1, 2021.
