7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY Section 1, Chapter 160, O.S.L.
7575 2020 (76 O.S. Supp. 2020, Section 11 2), is amended to read as
7676 follows:
7777 Section 112. A. This section sha ll be known and may be cited
7878 as the “COVID-19 Product Protection Act ”.
7979 B. As used in this a ct:
8080 1. “COVID-19” means the novel coronavir us identified as SARS-
8181 CoV-2, the disease caused by SARS-CoV-2, and conditions associated
8282 with the disease;
8383 2. “COVID-19 public health emergency” means any emergency
8484 declared by the Governor of Oklahoma related to COVID-19, including
8585 but not limited to the emergency declared by the Governor by
8686 Executive Order 2020-07, and any amendments thereto, under the

138138 Oklahoma Emergency Management Act of 2003, Section 683.1 et seq. of
139139 Title 63 of the Oklahoma Statutes, beginning on March 15, 2020, and
140140 the health emergency declared by the Governor by Executive Order
141141 2020-13, and any amendments thereto, under the Catastrophic Health
142142 Emergency Powers Act, Section 6101 et seq. of Title 63 of the
143143 Oklahoma Statutes, beginning on April 8, 2020;
144144 3. “Disinfecting and cleaning su pplies” includes, but is not
145145 limited to, hand sanit izers, disinfectants, sprays , and wipes;
146146 4. “Essential business” means a person or entity:
147147 a. within a critical infrastructure sector as defined by
148148 the United States Department of Homeland Security,
149149 b. defined as essential by the Oklahoma Department of
150150 Commerce through use of the North American Industry
151151 Classification System during the COVID-19 pandemic, or
152152 c. within an industry designated as critical or essential
153153 by Executive Order or Executive Memorandum ;
154154 5. “First responder” means state and local law e nforcement
155155 personnel, fire department personn el and emergency medical
156156 personnel. First responder includes a person authorized by
157157 executive order who will be deployed in response to the COVID -19
158158 pandemic;
159159 6. 5. “Health care facility” and “health care provider” shall
160160 have the same meaning as such terms are defined as provided in
161161 Section 6104 of Title 63 of the Oklahoma Statutes;

213213 7. 6. “Person” means an individual, firm, partnership,
214214 corporation or associat ion;
215215 8. 7. “Personal protective equipment” means coveralls, face
216216 shields, gloves, gowns, masks, respirat ors, and other equipment
217217 designed to protect the wearer from the spread of infection or
218218 illness; and
219219 9. 8. “Qualified product” means personal protecti ve equipment
220220 used to protect the wearer from COVID -19 or the spread of COVID -19;
221221 medical devices, equipment , or supplies used to treat COVID-19
222222 including products that are used or modified for an unapproved use
223223 to treat COVID-19 or prevent the spread of CO VID-19; medical
224224 devices, equipment, or supplies utilized outside of such product ’s
225225 normal use to treat COVID -19 or to prevent the spre ad of COVID-19;
226226 medications used to treat COVID -19 patients including medications
227227 prescribed or dispensed for off -label use to attempt to combat
228228 COVID-19; tests to diagnose or determine immunity to COVID -19; and
229229 components of qualified products.
230230 C. Except as provided by subsection E of this section, any
231231 person that designs, manufactures, labels, sells, distributes , or
232232 donates disinfecting and cleaning supplies or personal pr otective
233233 equipment during and in response to the COVID -19 public health
234234 emergency that does not make such products in the ordinary course of
235235 business shall not be liable in a civil action alleging personal
236236 injury, death or property damage caused by or resu lting from the

288288 product’s manufacturing or design, or a fa ilure to provide proper
289289 instructions or sufficient warnings.
290290 D. Except as provided by subsection E of this section, a
291291 government entity, health car e facility, health care pro vider, first
292292 responder, or any business, or the employer or agent of such
293293 business, that utilizes a product meeting the qualifications of
294294 either subsection C or D of this section, shall not be liable in a
295295 civil action alleging pe rsonal injury, death or pro perty damage
296296 caused by or resulting from the selection, distribution , or use of
297297 such product.
298298 E. The immunity provided in subsections C and D of this section
299299 shall not apply to any person, or any employee or agent thereof,
300300 that:
301301 1. a. Had actual knowledge that the product was de fective
302302 when put to the use for which the product was
303303 manufactured, sold, distribut ed, or donated, and
304304 b. Acted with deliberate indifference to or conscious
305305 disregard of a substantial and unnecessary risk that
306306 the product would caus e serious injury to othe rs; or
307307 2. Acted with a deliberate intention to cause har m.
308308 F. Nothing contained i n this section shall be construed to:
309309 1. Relieve a plaintiff of the need to satisfy any required
310310 element of a claim; or

362362 2. Amend, repeal, alter or affect any other immunit y or
363363 limitation of liability provided for under the laws of this state.
364364 G. The provisions of this section shall apply to any claim
365365 arising on or after the emergency declared by the Governor of
366366 Oklahoma related to COVID-19 by Executive Order 2020-07 on March 15,
367367 2020.
368368 SECTION 2. This act shall become effective November 1, 2021.
