73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY Section 1, Chapter 160, O.S.L.
75	75	2020 (76 O.S. Supp. 2020, Section 11 2), is amended to read as
76	76	follows:
77	77	Section 112. A. This section sha ll be known and may be cited
78	78	as the “COVID-19 Product Protection Act ”.
79	79	B. As used in this a ct:
80	80	1. “COVID-19” means the novel coronavir us identified as SARS-
81	81	CoV-2, the disease caused by SARS-CoV-2, and conditions associated
82	82	with the disease;
83	83	2. “COVID-19 public health emergency” means any emergency
84	84	declared by the Governor of Oklahoma related to COVID-19, including
85	85	but not limited to the emergency declared by the Governor by
86	86	Executive Order 2020-07, and any amendments thereto, under the

139	139	Title 63 of the Oklahoma Statutes, beginning on March 15, 2020, and
140	140	the health emergency declared by the Governor by Executive Order
141	141	2020-13, and any amendments thereto, under the Catastrophic Health
142	142	Emergency Powers Act, Section 6101 et seq. of Title 63 of the
143	143	Oklahoma Statutes, beginning on April 8, 2020;
144	144	3. “Disinfecting and cleaning su pplies” includes, but is not
145	145	limited to, hand sanit izers, disinfectants, sprays , and wipes;
146	146	4. “Essential business” means a person or entity:
147	147	a. within a critical infrastructure sector as defined by
148	148	the United States Department of Homeland Security,
149	149	b. defined as essential by the Oklahoma Department of
150	150	Commerce through use of the North American Industry
151	151	Classification System during the COVID-19 pandemic, or
152	152	c. within an industry designated as critical or essential
153	153	by Executive Order or Executive Memorandum ;
154	154	5. “First responder” means state and local law e nforcement
155	155	personnel, fire department personn el and emergency medical
156	156	personnel. First responder includes a person authorized by
157	157	executive order who will be deployed in response to the COVID -19
158	158	pandemic;
159	159	6. 5. “Health care facility” and “health care provider” shall
160	160	have the same meaning as such terms are defined as provided in
161	161	Section 6104 of Title 63 of the Oklahoma Statutes;

213	213	7. 6. “Person” means an individual, firm, partnership,
214	214	corporation or associat ion;
215	215	8. 7. “Personal protective equipment” means coveralls, face
216	216	shields, gloves, gowns, masks, respirat ors, and other equipment
217	217	designed to protect the wearer from the spread of infection or
218	218	illness; and
219	219	9. 8. “Qualified product” means personal protecti ve equipment
220	220	used to protect the wearer from COVID -19 or the spread of COVID -19;
221	221	medical devices, equipment , or supplies used to treat COVID-19
222	222	including products that are used or modified for an unapproved use
223	223	to treat COVID-19 or prevent the spread of CO VID-19; medical
224	224	devices, equipment, or supplies utilized outside of such product ’s
225	225	normal use to treat COVID -19 or to prevent the spre ad of COVID-19;
226	226	medications used to treat COVID -19 patients including medications
227	227	prescribed or dispensed for off -label use to attempt to combat
228	228	COVID-19; tests to diagnose or determine immunity to COVID -19; and
229	229	components of qualified products.
230	230	C. Except as provided by subsection E of this section, any
231	231	person that designs, manufactures, labels, sells, distributes , or
232	232	donates disinfecting and cleaning supplies or personal pr otective
233	233	equipment during and in response to the COVID -19 public health
234	234	emergency that does not make such products in the ordinary course of
235	235	business shall not be liable in a civil action alleging personal
236	236	injury, death or property damage caused by or resu lting from the

288	288	product’s manufacturing or design, or a fa ilure to provide proper
289	289	instructions or sufficient warnings.
290	290	D. Except as provided by subsection E of this section, a
291	291	government entity, health car e facility, health care pro vider, first
292	292	responder, or any business, or the employer or agent of such
293	293	business, that utilizes a product meeting the qualifications of
294	294	either subsection C or D of this section, shall not be liable in a
295	295	civil action alleging pe rsonal injury, death or pro perty damage
296	296	caused by or resulting from the selection, distribution , or use of
297	297	such product.
298	298	E. The immunity provided in subsections C and D of this section
299	299	shall not apply to any person, or any employee or agent thereof,
300	300	that:
301	301	1. a. Had actual knowledge that the product was de fective
302	302	when put to the use for which the product was
303	303	manufactured, sold, distribut ed, or donated, and
304	304	b. Acted with deliberate indifference to or conscious
305	305	disregard of a substantial and unnecessary risk that
306	306	the product would caus e serious injury to othe rs; or
307	307	2. Acted with a deliberate intention to cause har m.
308	308	F. Nothing contained i n this section shall be construed to:
309	309	1. Relieve a plaintiff of the need to satisfy any required
310	310	element of a claim; or

363	363	limitation of liability provided for under the laws of this state.
364	364	G. The provisions of this section shall apply to any claim
365	365	arising on or after the emergency declared by the Governor of
366	366	Oklahoma related to COVID-19 by Executive Order 2020-07 on March 15,
367	367	2020.
368	368	SECTION 2. This act shall become effective November 1, 2021.
