AS INTRODUCED 
 
An Act relating to mask mandates; stating legislative 
intent; preempting the mandate and enforcement of 
masks; preventing cities and towns from enacting and 
enforcing local laws; providing for codification; and 
declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.    NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 3106.5 of Title 74, unless there 
is created a duplication in n umbering, reads as follows: 
A.  The Legislature, seeking to protect aga inst the overreach of 
governmental entities and to safeguard the individual freedoms of 
taxpayers and businesses, intends to preempt any other ordinance 
enacted or adopted to mandate the wearing of masks on public and 
private property. 
B.  Notwithstanding any other provision of law, cities and towns 
of this state may neither enact nor enforce any ordinanc e or other 
local law conflicting with subsection A of this section .

SECTION 2.  It being immediately necessary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage an d approval.
