7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 25 O.S. 2011, Section 307.1, as
7979 last amended by Section 3, Chapter 3, O.S.L. 2020 (25 O .S. Supp.
8080 2020, Section 307.1), is amended to read as f ollows:
8181 Section 307.1. A. Except as provided in subsections C and D of
8282 this section, a public body may hold mee tings by videoconference
8383 where each member of the publ ic body is visible and audible to each
8484 other and the public th rough a video monitor, subj ect to the
8585 following:
8686 1. a. except as provided for in subparagraph b of this

140140 posted on the meeting notice and agenda,
141141 b. a virtual charter school approved and sponsored by the
142142 Statewide Virtual Charter School Board pursuant to the
143143 provisions of Section 3 -145.3 of Title 70 of the
144144 Oklahoma Statutes shall maintain a quorum of members
145145 for the entire duratio n of the meeting whether usi ng
146146 an in-person site, videoconference sites or any
147147 combination of such sites to achieve a quorum; and
148148 c. each public meeting held by videoco nference or
149149 teleconference shall be recorded either by written,
150150 electronic, or other mea ns;
151151 2. The meeting notice a nd agenda prepared in advan ce of the
152152 meeting, as required by law, shall indicate if the meeting will
153153 include videoconferencing locations and shall state:
154154 a. the location, address, and telephone number of each
155155 available videoconference site, and
156156 b. the identity of each member of the public body and the
157157 specific site from which each member of the body shall
158158 be physically present and participatin g in the
159159 meeting;
160160 3. After the meeting notice and age nda are prepared and posted,
161161 as required by law, no member of the public body shall be al lowed to

213213 participate in the meeting from any location other than the specific
214214 location posted on the agenda in ad vance of the meeting;
215215 4. In order to allow the public the maximum opportunity to
216216 attend and observe each public off icial carrying out the duti es of
217217 the public official, a member or members of a public body desiring
218218 to participate in a meeting by videoconf erence shall participate in
219219 the videoconference from a site and room located within the district
220220 or political subdivision from which they are e lected, appointed, or
221221 are sworn to represent;
222222 5. Each site and room where a member of the public body is
223223 present for a meeting by videoconference shall be open and
224224 accessible to the public, and the pu blic shall be allowed into t hat
225225 site and room. Public bodies may provide additional videoconference
226226 sites as a convenience to the public, but additional sites shall no t
227227 be used to exclude or discourage public attendance a t any
228228 videoconference site;
229229 6. The public shall be allowed to participate and speak, as
230230 allowed by rule or policy set by the public body, in a meeting at
231231 the videoconference site in the same manner and to the same extent
232232 as the public is allowed to partic ipate or speak at the site of the
233233 meeting;
234234 7. Any materials shared electronically betwee n members of the
235235 public body, before or during the videoconference, shall also be

288288 shared with members of the public body; and
289289 8. All votes occurring during any m eeting conducted using
290290 videoconferencing shall occur and be recorded by roll call vote.
291291 B. No public body shall conduct an executive sessio n by
292292 videoconference.
293293 C. Upon the effective date of t his act March 18, 2020, and
294294 until November 15, 2020, or the Governor declaring the state of
295295 emergency to be terminated, whichever date first occurs February 15,
296296 2022, the provisions of this subsection and subsection D shall
297297 operate as law in this state.
298298 1. A public body may hold meetings by t eleconference or
299299 videoconference if each member of the public body is audible or
300300 visible to each other and the public, subject to the following:
301301 a. for a virtual charter school app roved and sponsored by
302302 the Statewide Virtual Charter S chool Board pursuant t o
303303 the provisions of the Oklahoma Statutes, the publ ic
304304 body shall maintain a quorum of members for the entire
305305 duration of the meeting whether using an in -person
306306 site, teleconference , or videoconference or any
307307 combination of such sites to achieve a quorum, a nd
308308 b. if the meeting is held using either teleconfe rence or
309309 videoconference capabilities, and at any time the
310310 audio connection is disconnected, the meeting shall be

363363 restored;
364364 2. The meeting notice and ag enda prepared in advance of the
365365 meeting, as required by law, shall indicate if the meeting will
366366 include teleconferencing or videoconferencing and shall also state:
367367 a. each public body member appearing remotely and the
368368 method of each member’s remote appearance, and
369369 b. the identity of the public body member or members who
370370 will be physically present at the meeting site, if
371371 any;
372372 3. After the meeting notice and agenda are prepared and p osted
373373 as required by law, public body members shall no t be permitted to
374374 alter their method of attendance; provided, however, th ose members
375375 who were identified as appearing remotely may be permitted to
376376 physically appear at the meeting site, if any, for the meeting;
377377 4. The public body shall be allowed to parti cipate and speak,
378378 as allowed by rule or policy set by the public body, in a meeting
379379 which utilizes teleconference or videoconference in the same manner
380380 and to the same extent as the public is allowed to participate or
381381 speak during a meeting where all publi c body members are phy sically
382382 present together at the meeting site;
383383 5. Any materials shared electronically between members of the
384384 public body during a meeting utilizing teleconferencing or

436436 videoconferencing shall also be immediately available to the publi c
437437 in the same form as shared with the members of the public body; and
438438 6. All votes occurring during any meeting utilizing
439439 teleconference or videoconference shall occur and be recorded by
440440 roll call votes.
441441 D. Public bodies are permitted to conduct an execu tive session
442442 by teleconference or videoconference. For such executive se ssions,
443443 no public body member is required to be physically present so long
444444 as each public body member is audible or visible to ea ch other. The
445445 meeting notice and agenda prepared in a dvance of the meeting as
446446 required by law shall indicate if the executive session will include
447447 teleconferencing or videoconferencing and shall also state the
448448 identity of each public body member appearing remotely, the method
449449 of each member’s remote appearance, and whether any me mber will be
450450 physically present at the meeting site , if any, for the executive
451451 session.
452452 SECTION 2. AMENDATORY 25 O.S. 2011, Section 311, as last
453453 amended by Section 4, Chapter 3, O.S.L. 2020 (25 O.S. Supp. 202 0,
454454 Section 311), is amended to read as follows:
455455 Section 311. A. Notwithstanding any other provisions of law,
456456 all regularly scheduled, continued or reconvened, special or
457457 emergency meetings of public bodies shall be preceded by public
458458 notice as follows:

510510 1. All public bodies s hall give notice in writing by December
511511 15 of each calendar year of the schedule showing the date, time and
512512 place of the regularly scheduled meetings of such public bodies for
513513 the following calendar year;
514514 2. All state public bodies , including, but not lim ited to,
515515 public trusts and other bodies with the st ate as beneficiary, shall
516516 give such notice to the Secretary of State;
517517 3. All county public bodies including, but not limited to,
518518 public trusts and any other bodies with the county as beneficiary,
519519 shall give such notice to the county clerk of the county wh erein
520520 they are principally located;
521521 4. All municipal public bodies , including, but not limited to,
522522 public trusts and any other bodies with the municipality as
523523 beneficiary, shall give such notice to the mu nicipal clerk of the
524524 municipality wherein they are principally located;
525525 5. All multicounty, regional, areawide or district public
526526 bodies including, but not limited to, district boards of education,
527527 shall give such notice to the count y clerk of the county wherein
528528 they are principally located, or if no offi ce exists, to the county
529529 clerk of the county or counties served by such public body;
530530 6. All governing boards of state institutions of higher
531531 education, and committees and subcommitte es thereof, shall give such
532532 notice to the Secretary of State. All other public bodies covered
533533 by the provisions of the Oklahoma Open Meeting Act which exist under

585585 the auspices of a state institution of higher education, but a
586586 majority of whose members are not members of the in stitution’s
587587 governing board, shall give such notice to the county clerk of the
588588 county wherein the institution is principally located;
589589 7. The Secretary of State and each county clerk or municipal
590590 clerk shall keep a record of all notic es received in a regis ter open
591591 to the public for inspection during regula r office hours, and, in
592592 addition, shall make known upon any request of any person the
593593 contents of the register;
594594 8. If any change is to be made of the date, time or place of
595595 regularly scheduled meetings of public bodies, then notice in
596596 writing shall be giv en to the Secretary of State or county clerk or
597597 municipal clerk, as required herein, not less than ten (10) days
598598 prior to the implementation of any such change;
599599 9. In addition to the advance public notice in writing required
600600 to be filed for regularly sche duled meetings, described in paragraph
601601 1 of this subsection, all public bodies shall, at least twenty -four
602602 (24) hours prior to such regularly scheduled meetings, display
603603 public notice of the meeting by at least one of the following
604604 methods:
605605 a. by posting information that includes date, time, place
606606 and agenda for the meeting in prominent public view at
607607 the principal office of the public body or at the
608608 location of the meeting if no offic e exists, or

660660 b. by posting on the public body’s Internet website the
661661 date, time, place and agenda for the meeting in
662662 accordance with Section 3106.2 of Title 74 of the
663663 Oklahoma Statutes. Additionally, the public body
664664 shall offer and consistently maintain a n email
665665 distribution system for distribution of such notice of
666666 a public meeting required by this subsection, and any
667667 person may request to be included without charge, and
668668 their request shall be accepted. The emailed notice
669669 of a public meeting required by this subsection shall
670670 include in the body of the email or as an attachmen t
671671 to the email the date, time, place and agenda for the
672672 meeting and it shall be sent no less than twenty -four
673673 (24) hours prior to the meeting. Additionally, except
674674 as provided in subparagraph c of this pa ragraph, the
675675 public body shall make the notice of a public meeting
676676 required by this subsection available to the public in
677677 the principal office of the public body or at the
678678 location of the meeting during normal business hours
679679 at least twenty–four (24) hours prior to the meeting,
680680 or
681681 c. upon the effective date of this act March 18, 2020,
682682 and until November 15, 2020, or the Governor declaring
683683 the state of emergency to be terminated, whichever

735735 date first occurs February 15, 2022, the public body
736736 shall not be required to make the notice of a public
737737 meeting available to the public in the principal
738738 office of the public body or at the location of the
739739 meeting during normal business hours at least twenty -
740740 four (24) hours prior to the meeting;
741741 10. The twenty-four (24) hours required in paragraph 9 of this
742742 subsection shall exclude Saturdays, Sundays and h olidays legally
743743 declared by the State of Oklahoma. The posting or distribution of a
744744 notice of a public meeting as described in paragraph 9 of this
745745 subsection shall not preclude a public body from c onsidering at its
746746 regularly scheduled meeting any new busi ness. “New business,”, as
747747 used herein, shall mean any matter not known about or which could
748748 not have been reasonably foreseen prior to the time of the posting;
749749 11. In the event any meeting is to be continued or reconvened,
750750 public notice of such action inc luding date, time and place of the
751751 continued meeting, shall be given by announcement at the original
752752 meeting. Only matters appearing on the agenda of the meeting w hich
753753 is continued may be discussed at the continued or reconvened
754754 meeting;
755755 12. Special meetings of public bodies shall not be held without
756756 public notice being given at least forty -eight (48) hours prior to
757757 the meetings. Such public notice of date, time a nd place shall be
758758 given in writing, in person or by telephonic means to the Secretary

811811 bodies in the manner set forth in paragraphs 2, 3, 4, 5 and 6 of
812812 this subsection. The public body als o shall cause written notice of
813813 the date, time and place of the meeting to be mailed or deli vered to
814814 each person, newspaper, wire service, radio station and television
815815 station that has filed a written request for notice of meetings of
816816 the public body with the clerk or secretary of the publ ic body or
817817 with some other person designated by the public body. Such written
818818 notice shall be mailed or delivered at least forty -eight (48) hours
819819 prior to the special meeting. The public body may charge a fee of
820820 up to Eighteen Dollars ($18.00) per year t o persons or entities
821821 filing a written request for notice of meetings, and may require
822822 such persons or entities to renew the request for notice annually.
823823 In addition, all public bodies shall, at least twenty -four (24)
824824 hours prior to such special meetings, display public notice of the
825825 meeting, setting forth there on the date, time, place and agenda for
826826 the meeting. Only matters appearing on the posted agenda may be
827827 considered at the special meeting. Such public notice shal l be
828828 posted in prominent public vi ew at the principal office of the
829829 public body or at the lo cation of the meeting if no office exists.
830830 Twenty-four (24) hours prior public posting shall exclude Saturdays,
831831 Sundays and holidays legally declared by the State of Oklahoma. In
832832 lieu of the public posting requirements of this paragraph, a public
833833 body may elect to follow the requirements found in subparagraph b of

885885 paragraph 9 of this subsection, provided that forty -eight-hour
886886 notice is required for special meetings and that the forty-eight-
887887 hour requirement shall exclude Saturdays, Sundays and holidays
888888 legally declared by the State of Oklahoma; and
889889 13. In the event of an emergency, an emergency meeting of a
890890 public body may be held without the public notice heretofor e
891891 required. Should an emergency m eeting of a public body be
892892 necessary, the person calling s uch a meeting shall give as much
893893 advance public notice as is reasonable and possible under the
894894 circumstances existing, in person or by telephonic or electronic
895895 means.
896896 B. 1. All agendas required pu rsuant to the provisions of this
897897 section shall identify al l items of business to be transacted by a
898898 public body at a meeting including, but not limited to, any proposed
899899 executive session for the purpose of engaging in deli berations or
900900 rendering a final or intermediate decision in an individual
901901 proceeding prescribed by the Administrative Procedures Act.
902902 2. If a public body proposes to conduct an executive session,
903903 the agenda shall:
904904 a. contain sufficient information for the public to
905905 ascertain that an execut ive session will be proposed,
906906 b. identify the items of bus iness and purposes of the
907907 executive session, and

961961 SECTION 3. It being immediately necessary for the preservation
962962 of the public peace, health or safety, an emergency is hereby
963963 declared to exist, by reason whereof this act shall take effect and
