167167 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
168168 SECTION 1. AMENDATORY 75 O. S. 2011, Section 250.2, as
169169 amended by Section 1, Chapter 357, O.S.L. 2013 (75 O.S. Supp. 2020,
170170 Section 250.2), is amended to read as follows:
171171 Section 250.2. A. Article V of the Oklahoma Constitution v ests
172172 in the Legislature the power to make laws, and th ereby to establish
173173 agencies and to designate agency functions, budgets and purposes.
174174 Article VI of the Oklahoma Constitution charges the Executive Branch
175175 of Government with the r esponsibility to implem ent all measures
176176 enacted by the Legislature.
177177 B. In creating agencies and designating their functions and
178178 purposes, the Legislature may delegate rulemaking authority to
179179 executive branch agencies to facilitate administration of
180180 legislative policy. The dele gation of rulemaking authority is
181181 intended to eliminat e the necessity of establishing every

234234 so doing, however, the Legislature reserves to itself:
235235 1. The right to retract any delegation of rulemaking authority
236236 unless otherwise precluded by th e Oklahoma Constitution;
237237 2. The right to establish any aspect of general policy by
238238 legislation, notwithstanding any delegation of rulemaking authority;
239239 3. The right and responsi bility to designate the method for
240240 rule promulgation, review , repeal and modification;
241241 4. The right to approve or disapprove or repeal any adopted
242242 rule by joint resolution; and
243243 5. The right to disapprove a proposed permanent, promulgated or
244244 emergency rule at any time if the Le gislature determines such rule
245245 to be an imminent harm to the health, safety or welfare of the
246246 public or the state or if the Legislature determines that a rule is
247247 not consistent with legislative intent.
248248 SECTION 2. AMENDATORY 75 O.S . 2011, Section 250.3, as
249249 amended by Section 2, Chapte r 357, O.S.L. 2013 (75 O.S. Supp. 2020,
250250 Section 250.3), is amended to read as follows:
251251 Section 250.3. As used in the Administrative Procedu res Act:
252252 1. “Administrative head” means an official or agency body
253253 responsible pursuant to law for issuing final ag ency orders;
254254 2. “Adopted” means a proposed emergency rule which has been
255255 approved by the agency but has not been approved or disapproved by
256256 the Governor as provided by Section 253 of this title, or a p roposed

308308 permanent rule which has been approved by the agency, but has not
309309 been approved or disapproved by the Legislature or by declaration of
310310 the Governor as provided by subsection D of Section 6 of this act;
311311 3. “Agency” includes but is not limited to an y constitutionally
312312 or statutorily created state board, bureau, commission, office,
313313 authority, public trust in which the state is a beneficiary, or
314314 interstate commission, except:
315315 a. the Legislature or any branch, committee or officer
316316 thereof, and
317317 b. the courts;
318318 4. “Emergency rule” means a rule that is made pu rsuant to
319319 Section 253 of this title;
320320 5. “Expedited repeal” means the procedure utilized by a rule -
321321 making agency as specified in Se ction 9 of this act;
322322 6. “Final rule” or “finally adopted rule ” means a rule other
323323 than an emergency rule, which has not been published pursuant to
324324 Section 255 of this title but is otherwise in compliance with the
325325 requirements of the Administrative Procedu res Act, and is:
326326 a. approved by the Legislature pursuant to Section 6
327327 308.3 of this act title, provided that any such joint
328328 resolution becomes law in accordance with Section 11
329329 of Article VI of the Oklahoma Constitution,
330330 b. approved by the Governor pursuan t to subsection D of
331331 Section 6 of this act,

384384 B of Section 308 of this title, provided that any such
385385 resolution becomes law in accordance with Section 11
386386 of Article VI of the Oklahoma Constitution, or
387387 d.
388388 c. disapproved by a joint resolution pursuant to
389389 subsection B of Section 308 of this title or Section 6
390390 308.3 of this act title, which has been vetoed by the
391391 Governor in accordance with Section 11 of Article VI
392392 of the Oklahoma Constitution and the veto has not been
393393 overridden;
394394 6. 7. “Final agency order” means an order that includes
395395 findings of fact and conclusions of law pur suant to Section 312 of
396396 this title, is dispositive of an individual proceeding unless there
397397 is a request for rehearing, reopening, or reconsideration pursuant
398398 to Section 317 of this title and which is s ubject to judicial
399399 review;
400400 7. 8. “Hearing examiner” means a person meeting the
401401 qualifications specified by Article II of the Administrative
402402 Procedures Act and who has been duly appointed by an agency to hold
403403 hearings and, as required, render orders or pro posed orders;
404404 8. 9. “Individual proceeding ” means the formal process employed
405405 by an agency having jurisdiction by law to resolve issues of law or

459459 9. 10. “License” includes the whole or part of any agency
460460 permit, certificate, approval, registration, charter, or similar
461461 form of permission required by law;
462462 10. 11. “Office” means the Office of the Secretary of State;
463463 11. 12. “Order” means all or part of a formal or of ficial
464464 decision made by an agency including but not limited to final agency
465465 orders;
466466 12. 13. “Party” means a person or agency named and
467467 participating, or properly seeking and entitled by law to
468468 participate, in an individual proceeding;
469469 13. 14. “Permanent rule” means a rule that is made pursuant to
470470 Section 303 of this title;
471471 14. 15. “Person” means any individual, partnership,
472472 corporation, association, governmental subdivision, or public or
473473 private organization of any character other than an agency;
474474 15. 16. “Political subdivision ” means a county, city,
475475 incorporated town or school district within this state;
476476 16. 17. “Promulgated” means a finally adopted rule which has
477477 been filed and published in accordance with the provisions of the
478478 Administrative Procedure s Act, or an emergency rule or preemptive
479479 rule which has been approved by the Governor;

531531 17. 18. “Rule” means any agency statement or group of related
532532 statements of general applicability and future effect that
533533 implements, interprets or prescribes law or po licy, or describes the
534534 procedure or practice require ments of the agency. The term “rule”
535535 includes the amendment or revocation of an effective rule but does
536536 not include:
537537 a. the issuance, renewal, denial, suspension or
538538 revocation or other sanction of an ind ividual specific
539539 license,
540540 b. the approval, disapprov al or prescription of rates.
541541 For purposes of this subparagraph, the term “rates”
542542 shall not include fees or charges fixed by an agency
543543 for services provided by that agency including but not
544544 limited to fees charged for licensing, permitting,
545545 inspections or publications,
546546 c. statements and memoranda concerning only the internal
547547 management of an agency and not affecting private
548548 rights or procedures available to the public,
549549 d. declaratory rulings issued pursuan t to Section 307 of
550550 this title,
551551 e. orders by an agency, or
552552 f. press releases or “agency news releases ”, provided
553553 such releases are not for the purpose of interpreting,
554554 implementing or prescribing law or agency policy;

606606 18. 19. “Rulemaking” means the process employed by an agency
607607 for the formulation of a rule; and
608608 19. 20. “Secretary” means the Secretary of State ;
609609 21. “Small business” means a for-profit enterprise consisting
610610 of fifty or fewer full -time or part-time employees; and
611611 22. “Technical legal defe ct” means an error that would
612612 otherwise invalidate an action by a court of law .
613613 SECTION 3. AMENDATORY 75 O.S. 2011, Section 250.4a, is
614614 amended to read as follows:
615615 Section 250.4a. A. Any agency exempt from all or part of the
616616 Administrative Procedures Act pursuant to subsection A of Section
617617 250.4 of this title shall maintain and make available for public
618618 inspection its exempt rules at its principal place of business and
619619 on any website associated with the agency .
620620 B. It is recognized by the Oklahoma Legislature that agencies
621621 specified by subsection A of this section have published rules
622622 containing obsolete rules or internal policy statements or agency
623623 statements which do not meet the Administrative Procedures Act
624624 definition of rules. Therefore, by December 31, 2005, each such
625625 agency shall conduct an internal review of its rules to determine
626626 whether each of its rules is current and is a rule as such term is
627627 defined by the Administ rative Procedures Act. Any rule determined
628628 by an agency to be obsolete or an internal policy statement or an y
629629 agency statement which does not meet the definition of a rule

681681 pursuant to the Administrative Procedures Act shall be deleted by
682682 the agency. Notice of such deletion shall be submitted to the
683683 Speaker of the House of Representatives, the President Pro Temp ore
684684 of the Senate and the Governor for informational purposes.
685685 C. The provisions of this section shall not be construed to
686686 authorize any agency to amend any rule or to delete any rule which
687687 affects any private rights or procedures available to the public.
688688 SECTION 4. AMENDATORY 75 O.S. 2011, Section 250.6, is
689689 amended to read as follows:
690690 Section 250.6. A. 1. The Commission for Human Services may
691691 promulgate a preemptive rule pu rsuant to the provisions of this
692692 section:
693693 a. when the Commission for Human Services is required by
694694 federal law, federal rules, a state law enacted
695695 pursuant to federal law or federal rule, or order of a
696696 court of competent jurisdiction to adopt a rule, or an
697697 amendment, revision or revocation of an existing rule ,
698698 and
699699 b. which if such rule is not immediately adopted would
700700 result in the imposition of a financial penalty, or a
701701 reduction, withholding or loss of federal funds.
702702 2. A preemptive rule must be approved by the Governor pursuant
703703 to this section.

755755 3. Any preemptive rule approved and published pursuant to this
756756 section shall also be posted to the website associated with the
757757 Commission.
758758 4. The conditions specified in this subsection for the
759759 promulgation of a preemptive rule shall be the only conditions
760760 authorized for promulgation of such rule by the Commission for Human
761761 Services.
762762 B. 1. Upon the adoption of such preemptive rule by the
763763 Commission, the Director of the Department of Human Services shall
764764 request the Governor to approve the rules on the basis that s uch
765765 rules are required to comply with a federal law, federal rule, a
766766 state law enacted pursuant to federal law or rule, or order of a
767767 court of competent jurisdiction and which if such rules are not
768768 immediately adopted would result in a financial penalty, o r a
769769 reduction, withholding or loss of federal funds.
770770 2. Upon the filing of the request for approval of a preemptive
771771 rule, the Governor shall review such rule and decide as to whether
772772 such rule should be approved. Prior to approval of a preemptive
773773 rule, the Governor shall submit the preemptive rule to the Office of
774774 the Secretary of State for review of proper formatting unless the
775775 preemptive rule has been reviewed by the Office prior to agency
776776 submission to the Governor. Failure of the Governor to approve such
777777 rule within twenty-eight (28) calendar days shall constitute denial
778778 of the rule as a preemptive rule.

830830 3. Upon approval of a pre emptive rule, the Governor shall
831831 immediately notify the Commission. Upon receipt of notice of the
832832 approval of the preempti ve rule, the Commission shall file the
833833 number of copies specified by the Secretary of the approval issued
834834 by the Governor and the num ber of copies specified by the Secretary
835835 of the preemptive rule with the Office pursuant to Section 251 of
836836 this title.
837837 4. The preemptive rule shall be published in accordance with
838838 the provisions of Section 255 of this title in “The Oklahoma
839839 Register” following approval by the Governor. The Governor ’s
840840 approval and the appr oved rules shall be retained as official
841841 records by the Office of Administrative Rules.
842842 5. For informational purposes only, a copy of the Governor ’s
843843 approval and the preemptive rule shal l be submitted by the
844844 Commission to the Speaker of the House of Repre sentatives and the
845845 President Pro Tempore of the Senate within ten (10) days of the
846846 approval of the preemptive rule by the Governor.
847847 6. Upon approval by the Governor, the rule shall be co nsidered
848848 promulgated and shall be in force immediately, or if a later date is
849849 required by statute or specified in the rule, the later date is the
850850 effective date.
851851 C. A preemptive rule shall be considered to be a permanent rule
852852 and shall remain in full forc e and effect unless and until
853853 specifically disapproved during the fir st thirty (30) legislative

906906 of such preemptive rule or unless an earlier expiration date is
907907 specified by the Commission. The Legislature may disapprove such
908908 rule pursuant to Section 308 of this title. Any resolution
909909 introduced for the purpos e of disapproving such rule shall not be
910910 subject to regular legislative cut off dates.
911911 D. Except as otherwise provided by this secti on, preemptive
912912 rules shall be promulgated and published in compliance with Article
913913 I of the Administrative Procedures Act. Preemptive rules
914914 promulgated pursuant to the provisions of this section shall be
915915 exempt from the provisions of Sections 253, 303, 30 3.1, 303.2, 304,
916916 308 and 308.1 of this title.
917917 SECTION 5. AMENDATORY 75 O.S. 2011, Section 250.10, as
918918 amended by Section 49, Chapter 227, O.S.L. 2013 (75 O.S. Supp. 2020,
919919 Section 250.10), is amended to read as follows:
920920 Section 250.10. The Governor by Executive Order or either house
921921 of the Legislature or both houses of the Legislature by resolution,
922922 or a small business, may request an agency to review its rules to
923923 determine whether or not the rules in question should be amended,
924924 repealed or redrafted. The agency shall respond to requests from
925925 the Governor or the Legislature within ninety (90) thirty (30)
926926 calendar days of such request. The agency shall respond to requests
927927 made by a small business within ninety (90) calendar days.

982982 Section 251. A. 1. Upon the request of the Secretary, each
983983 agency shall furnish to the Office a co mplete set of its permanent
984984 rules in such form as is required by the Secretary or a s otherwise
985985 provided by law.
986986 2. The Secretary shall promulgate rules to ensure the effective
987987 administration of the provisions of Article I of the Administrative
988988 Procedures Act. The rules shall include , but are not limited to,
989989 rules prescribing paper size , numbering system, and the format of
990990 documents required to be filed pursuant to the provisions of the
991991 Administrative Procedures Act or such other requirements as deemed
992992 necessary by the Secretary to im plement the provisions of the
993993 Administrative Procedure s Act.
994994 3. Each agency shall post their rules on any website associated
995995 with the agency.
996996 B. 1. Each agency shall file the number of copies specified by
997997 the Secretary of all new rules, and all amendmen ts, revisions or
998998 revocations of existing rules atteste d to by the agency, pursuant to
999999 the provisions of Section 254 of this title, with the Office within
10001000 thirty (30) calendar days after they become finally adopted.

10571057 Whenever it is necessary to refer to statutory
10581058 language in order to effectively convey the meaning of
10591059 a rule interpreting that language, the refe rence shall
10601060 clearly indicate the portion of the language which is
10611061 statutory and the portion which is the agency ’s
10621062 amplification or interpretation of that language,
10631063 c. shall indicate whether a rule is ne w, amends an
10641064 existing permanent rule or repeals an exi sting
10651065 permanent rule. If a rule amends an existing rule,
10661066 the rule shall indicate the language to be deleted
10671067 typed with a line through the language and language to
10681068 be inserted typed with the new languag e underscored,
10691069 d. shall state if the rule supersedes a n existing
10701070 emergency rule,
10711071 e. shall include a reference to any rule requiring a new
10721072 or revised form in a note to the rule. The Secretary
10731073 shall insert that reference in “The Oklahoma Register”
10741074 as a notation to the affected rule,
10751075 f. shall prepare, in plain language, a statement of the
10761076 gist of the rule and an analysis of new or amended

11361136 material is labeled or set f orth in a manner which
11371137 clearly distinguishes it from the rules,
11381138 h. shall include other information, in such form and in
11391139 such manner as is required by the Secretary, and
11401140 i. may change the format of exist ing rules without any
11411141 rulemaking action by the agency in order to comply
11421142 with the standard provisions established by the
11431143 Secretary for “Code” and “The Oklahoma Register ”
11441144 publication so long as there is no substantive change
11451145 to the rule.
11461146 C. The Secretary is authorized to determine a numbering system
11471147 and other standardized format for documents to be filed and may
11481148 refuse to accept for publication any document that does not
11491149 substantially conform to the promulgated rules of the Sec retary.
11501150 D. In order to avoid unnecessary expense, an agency may use the
11511151 published standards established by organizations and technical
11521152 societies of recognized national standing, other state agencies, or

12091209 offices of the agency. In addition, a copy of such standards shall
12101210 be kept and maintained by the agency pursuant to the provisions of
12111211 the Preservation of Essential Records Act.
12121212 E. The Secretary shall provide for the publication of all
12131213 Executive Orders received pursuant t o the provisions of Section 664
12141214 of Title 74 of the Okl ahoma Statutes.
12151215 F. The Secretary may authorize or require the filing of rules
12161216 or Executive Orders by or through electronic data or machine
12171217 readable equipment in such form and manner as is required by t he
12181218 Secretary.
12191219 G. In consultation with the Adjutant Ge neral, the Secretary
12201220 shall establish a method for the publication and archiving of all
12211221 military publications received by the Secretary of State from the
12221222 Adjutant General pursuant to the Oklahoma Uniform Code of Military
12231223 Justice and the Oklahoma State Guard Act. Military publications
12241224 shall be defined in accordance with Section 801 of Title 44 of the
12251225 Oklahoma Statutes. The Secretary may also authorize or require the
12261226 filing of military publications by or through electronic means in
12271227 such form and manner as is required by the Secretary. This

12811281 H. On or before October 1, 2021, the Secretary sh all commence
12821282 publication of all military publications provided by the Adjutant
12831283 General. On a biennial basis thereafter, the Secretary shall cause
12841284 the military publications received in the course of the previous two
12851285 (2) years to be published in a printed a nd bound format suitable for
12861286 physical archiving in sufficient numbers to satisfy the requirements
12871287 of the “Publications Clearinghouse ” established in Section 3 -113.3
12881288 of Title 65 of the Oklahoma Statutes.
12891289 SECTION 7. AMENDATORY 75 O.S. 2011, Section 253, as
12901290 amended by Section 3, Chapter 357, O.S.L. 2013 (75 O.S. Sup p. 2020,
12911291 Section 253), is amended to read as follows:
12921292 Section 253. A. 1. If an agency finds that a rule is
12931293 necessary as an emergency measure , the rule may be promulgated
12941294 pursuant to the provisions of this section, if the rule is first
12951295 approved by the Governor. The Governor shall not approve the
12961296 adoption, amendment, revision or revocation of a rule as an
12971297 emergency measure unless the agency sub mits substantial evidence
12981298 that the rule is necessary as an emergency measure to do any of the
12991299 following:
13001300 a. protect the public health, safety or welfare,
13011301 b. comply with deadlines in amendments to an agency ’s

13561356 d. avoid imminent reduction to the agency ’s budget, or
13571357 e. avoid serious prejudice to the public interest.
13581358 As used in this subsection, “substantial evidence ” shall mean
13591359 credible evidence which is of suf ficient quality and probative value
13601360 to enable a person of r easonable caution to support a conclusion.
13611361 2. In determining whether a rule is necessary as an emergency
13621362 measure, the Governor shall consider whether the emergency situation
13631363 was created due to the agency’s delay or inaction and could have
13641364 been averted by timely compliance with the provisions of this
13651365 chapter.
13661366 B. An emergency rule adopted by an agency shall:
13671367 1. Be prepared in the format required by Section 251 of this
13681368 title;
13691369 2. a. Include an impact statement which meets the
13701370 requirements set forth in subpar agraph b of this
13711371 paragraph unless the Governor waives the requirement
13721372 in writing upon a finding that the rule impact
13731373 statement or the specified contents thereof are
13741374 unnecessary or contrary to the public interest.
13751375 b. The rule impact statement shall include, but not be
13761376 limited to:
13771377 (1) a brief description of the proposed rule,

14411441 possible, a separate justification for each fee

14431443 (5) the probable costs and benefits to the agenc y and
14441444 to any other agency of the implementation and
14451445 enforcement of the propo sed rule, and any
14461446 anticipated effect on state revenues , including a
14471447 projected net loss or gain in such revenues if it
14481448 can be projected by the agency,
14491449 (6) a determination of whether implementation of the
14501450 proposed rule may have an adverse economic effect
14511451 on small business as provided by the Oklahoma
14521452 Small Business Regulatory Flexibility Act,

15111511 and, if the proposed rule is designed to reduce
15121512 significant risks to the public health, s afety
15131513 and environment, an explanation of the nature of
15141514 the risk and to what extent the proposed rule
15151515 will reduce the risk,
15161516 (9) a determination of any detrimental effect on the
15171517 public health, safety and environment if the
15181518 proposed rule is not implemented, a nd
15191519 (10) the date the rule impact statement was prepare d
15201520 and if modified, the date modified.
15211521 c. The rule impact statement shall be prepared on or
15221522 before the date the emergency rule is adopted;
15231523 3. Be transmitted pursuant to Section 464 of Title 74 of the
15241524 Oklahoma Statutes to the Governor, the Speaker of the Ok lahoma House
15251525 of Representatives and the President Pro Tempore of the Senate,
15261526 along with the information required by this subse ction within ten
15271527 (10) days after the rule is adopted; and

15811581 C. 1. Within forty -five (45) calendar days of receipt of a
15821582 proposed emergency ru le filed with the Governor, the Speaker of the
15831583 Oklahoma House of Representat ives and, the President Pro Tempore of
15841584 the Senate and the chairs of the Joint Committee on Administrative
15851585 Rules, the Governor shall review the demonstration of emergency
15861586 pursuant to subsection A of this section, and shall separately
15871587 review the rule in acco rdance with the standards prescribed in
15881588 paragraph 3 of this subsection.
15891589 2. Prior to approval of emergency rules, the Governor shall
15901590 submit the emergency rule to the Secretary of S tate for review of
15911591 proper formatting.
15921592 3. If the Governor determines the age ncy has established the
15931593 rule is necessary as an emerge ncy measure pursuant to subsection A
15941594 of this section, the Governor shall approve the proposed emergency
15951595 rule if the rule is:
15961596 a. clear, concise and understandable,
15971597 b. within the power of the agency to ma ke and within the
15981598 enacted legislative standards, and
15991599 c. made in compliance with the requirements of the
16001600 Administrative Procedures Act.
16011601 D. 1. Within the forty -five-calendar-day period set forth in
16021602 paragraph 1 of subsection C of this section, the Governor may

16551655 Failure of the Governor to approve an emergency rule within the
16561656 specified period shall constitute disapproval of the emergency rule.
16571657 2. If the Governor disapproves the adopted emergency rul e, the
16581658 Governor shall return the entire document to th e agency with reasons
16591659 for the disapproval. If the agency elects to modify the rule, the
16601660 agency shall adopt the modifications , and shall file the modified
16611661 rule in accordance with the requirements of sub section B of this
16621662 section.
16631663 3. Upon disapproval of an emergency rule, the Governor shall,
16641664 within fifteen (15) days, make written notification to the Speaker
16651665 of the House of Repres entatives, the President Pro Tempore of the
16661666 Senate, the chairs of the Joint C ommittee on Administrative Rules
16671667 and the Office of Adm inistrative Rules.
16681668 E. 1. Upon approval of an emergency rule, the Governor shall
16691669 immediately make written notification to th e agency, the Speaker of
16701670 the House of Representatives, the President Pro Temp ore of the
16711671 Senate, the chairs of the Joint Committee o n Administrative Rules
16721672 and the Office of Administrative Rules. Upon receipt of the notice
16731673 of the approval, the agency shall file with the Office of
16741674 Administrative Rules as many copies of the notice of approval and
16751675 the emergency rule as required by the Sec retary.
16761676 2. Emergency rules shall be subject to legislative review
16771677 pursuant to Section 308 of this title.

17321732 the approved rules shall be retained as official records by the
17331733 Office of Administrative Rules.
17341734 F. 1. Upon approval by the Governor, an emergency rul e shall
17351735 be considered promulgated and shall be in forc e immediately, or on
17361736 such later date as specified therein. An emergency rule shall only
17371737 be applied prospectively from its effective date.
17381738 2. The Except as otherwise provided in this subsection, the
17391739 emergency rule shall remain in full force and effect thr ough the
17401740 first day of the next succeeding regular session of the Legislature
17411741 following promulgation of such emergency rule until September 14
17421742 following such session, unless it is made ineffective pur suant to
17431743 subsection H of this section.
17441744 3. An emergency rule approved pursuant to this section may be
17451745 immediately suspended by the Joint Committee on Administrative Rules
17461746 until the emergency rule can be subject to legislative review
17471747 pursuant to Section 308 of this title. Within three (3) business
17481748 days, written notification of the suspension shall be sent to the
17491749 agency, Governor, the President Pro Tempore of the Senate and the
17501750 Speaker of the House of Representatives. The written notification

18051805 G. No agency shall adopt any emergency rule which establishes
18061806 or increases fees, except during such times as the Legislature is in
18071807 session, unless specifically mandated by the Legislature or federal
18081808 legislation, or when the failure to establish or increase fees would
18091809 conflict with an order issued by a court of law.
18101810 H. 1. If an emergency rule is of a continuing nature, the
18111811 agency promulgating such emergency rule shall initiate proceedings
18121812 for promulgation of a permanent rule pursuant to Sections 303
18131813 through 308.2 of this title. If an emergency rule is superseded by
18141814 another emergency rule prior to the enactment of a permanent rule,
18151815 the latter emergency rule shall retain the same expiration date as
18161816 the superseded emergency rule, unless otherwise authorized by the
18171817 Legislature.
18181818 2. Any promulgated emergency rule shall be made in effective if:
18191819 a. disapproved by the Legislature,
18201820 b. superseded by the promulgation of permanent rules,
18211821 c. any adopted rules based upon such emergency rules are
18221822 subsequently disapproved pursuant to Section 308 of
18231823 this title, or
18241824 d. an earlier expiration date is specified by the agency
18251825 in the rules.

18831883 agency shall not adopt any emergency rule, which has
18841884 become null and void pursuant to subparagraph a of
18851885 this paragraph, as a new emergency rule or adopt any
18861886 emergency rules of similar scope or intent as t he
18871887 emergency rules which became null and void pursuant to
18881888 subparagraph a of this paragraph.
18891889 I. Emergency rules shall not become effective unless approved
18901890 by the Governor pursuant to the provisions of this section.
18911891 J. 1. The requirements of Section 303 of this t itle relating
18921892 to notice and hearing shall not be appli cable to emergency rules
18931893 promulgated pursuant to the provisions of this section. Provided
18941894 this shall not be construed to prevent an abbreviated notice and

19531953 this title shall not be applicable to emergency rules promulgated

19551955 K. Prior to approval or disapp roval of an emergency rule by the
19561956 Governor, an agency may withdraw from review an emergency rule
19571957 submitted pursuant to the provisions of this section. Notice of
19581958 such withdrawal shall be given to the Governor, the Speaker of the
19591959 House of Representatives, t he President Pro Tempore of the Senate in
19601960 accordance with the requirements set forth in Section 464 of Title
19611961 74 and to the Office of Administrative Rules as required by the
19621962 Secretary. In order to be promulgated as emergency rules, any
19631963 replacement rules sh all be resubmitted pursuant to the provisions of
19641964 this section.
19651965 L. Upon completing the requirements of this section, an agency
19661966 may promulgate a proposed emergency rule. No emergency rule is
19671967 valid unless promulgated in substantial comp liance with the
19681968 provisions of this section.
19691969 M. Emergency rules adopted by an agency or approved by the
19701970 Governor shall be subject to review pursuant to the provisions of
19711971 Section 306 of this title.

20262026 Section 303. A. Prior to the adoption of any rule or am endment
20272027 or revocation of a rule and except as provided for pursuant to the
20282028 expedited rule repeal process provided in Section 9 of this act, the
20292029 agency shall:
20302030 1. Cause notice of any intended action to be published in “The
20312031 Oklahoma Register” pursuant to subsection B of this section;
20322032 2. For at least thirty (30) days after publication of the
20332033 notice of the intended rulemaking action, afford a comm ent period
20342034 for all interested persons to submit data, views or arguments,
20352035 orally or in writing. The agency shall c onsider fully all written
20362036 and oral submissions respecting the proposed rule;
20372037 3. Hold a hearing, if required, as provided by subsection C of
20382038 this section;
20392039 4. Consider the effect its intended action may have on the
20402040 various types of business and governmenta l entities. Except where
20412041 such modification or variance is prohibited by statute or
20422042 constitutional constraints, if an agency finds that its a ctions may
20432043 adversely affect any such entity, the agency may modify its actions
20442044 to exclude that type of entity, or m ay “tier” its actions to allow
20452045 rules, penalties, fines or reporting procedures and form s to vary
20462046 according to the size of a business or gover nmental entity or its
20472047 ability to comply or both. For business entities, the agency shall
20482048 include a description of the probable quantitative and qualitative

21072107 B. The notice required by paragraph 1 of subsection A of this
21082108 section shall include, but not be limited to:
21092109 1. In simple language, a brief summary of th e rule;
21102110 2. The proposed action being taken;
21112111 3. The circumstances which created the need for the rule;
21122112 4. The specific legal authority , including statutory citations,
21132113 authorizing the proposed rule;
21142114 5. The intended effect of the rule;
21152115 6. If the agency determines that the rule affects business
21162116 entities, a request that such entities provide the agency, within
21172117 the comment period, in dollar amounts if possible, the increase in
21182118 the level of direct costs such as fees, and indirect costs such as
21192119 reporting, recordkeeping, equipment, construction, labor,
21202120 professional services, revenue loss, or other costs expected to be
21212121 incurred by a particular entity due to compliance wi th the proposed

21852185 10. Where copies of the proposed rules may be obtained for
21862186 review by the public. An agency may charge pe rsons for the actual
21872187 cost of mailing a copy of the proposed rules to such persons ; and
21882188 11. A notarized statement executed by the agency director
21892189 affirming the legal authority cited in paragraph 4 of this
21902190 subsection and a statement of whether or not the su bject of the
21912191 proposed rule or rules has been included in any filed bill of the
21922192 Legislature within the last two regular legislative sessions. If
21932193 the subject matter of the proposed rule or rules did appear in filed
21942194 legislation, the bill number shall be incl uded in the statement.

22552255 notice in “The Oklahoma Register”, the agency shall cause a copy of
22562256 the notice of the proposed rule adoption and t he rule impact
22572257 statement, if available, to be mailed t o all persons who have made a
22582258 timely request of the agency for advance notice of its rulemaking
22592259 proceedings. Provided, in lieu of mailing copies, an agency may
22602260 electronically notify interested persons that a copy of the proposed
22612261 rule and the rule impact s tatement, if available, may be viewed on
22622262 the agency’s website. If an agency posts a copy of the proposed
22632263 rule and rule impact statement on its website, the agency shall not
22642264 charge persons for the cost of downloading or printing the proposed
22652265 rule or impact statement. Each agency shall maintain a listing of
22662266 persons or entities requesting such notice.
22672267 C. 1. If the published notice does not already provide for a
22682268 hearing, an agency shall schedule a hearin g on a proposed rule if,
22692269 within thirty (30) days after the published notice of the proposed
22702270 rule adoption, a written request for a hearing is submitted by:

23322332 3. The provisions of this su bsection shall not be construed to
23332333 prevent an agency from holding a hearing or hearings on the proposed
23342334 rule although not required by the provisions of this subsection;
23352335 provided that notice of such hear ing shall be published in “The
23362336 Oklahoma Register” at least thirty (30) days prior to such hearing.
23372337 D. 1. Except as otherwise provided in this subsection, an
23382338 agency shall issue a rule impact statement of a proposed rule prior
23392339 to or within fifteen (15) day s after the date of publication of the
23402340 notice of proposed rule adoption. The rule impact statement may be
23412341 modified after any hearing or comment period afforded pursuant to
23422342 the provisions of this section.
23432343 2. Except as otherwise provided in this subsection , the rule
23442344 impact statement shall include, but not be limited to:
23452345 a. a brief description of the purpose of the proposed

25502550 Upon request by an agency, the Governor may also waive the rule
25512551 impact statement requirements if the agency is required to implement
25522552 a statute or federal requirement that does not require an a gency to
25532553 interpret or describe the requirements, such as federally mandated
25542554 provisions which afford the agency no discretion to consider less
25552555 restrictive alternatives. If the Governor fails to waive such
25562556 requirement, in writing, prior to publication of th e notice of the
25572557 intended rulemaking action, the rule i mpact statement shall be
25582558 completed. The determination to waive the rule impact statement
25592559 shall not be subject to judicial review.
25602560 4. The rule shall not be invalidated on the ground that the
25612561 contents of the rule impact statement are insufficient or
25622562 inaccurate.
25632563 E. Upon completing the requirements of this section, an agency
25642564 may adopt a proposed rule. No rule is valid unless adopted in
25652565 substantial compliance with the provisions of this section.
25662566 SECTION 9. NEW LAW A new section of law to be codified
25672567 in the Oklahoma Statutes as Section 303a of Title 75, un less there
25682568 is created a duplication in numbering, reads as follows:
25692569 A. Upon request by a rule -making agency, an expedited rule

26242624 rule-making agency may initiate a request for expedited repeal of a

26262626 1. A request by the agency is submitted electronically to t he
26272627 President Pro Tempore of the Senate and the Speaker of the House of
26282628 Representatives. The request shall be assigned to the Joint
26292629 Committee on Administr ative Rules to conduct the repeal process ;
26302630 2. A copy of the rule or rules is provided along with a
26312631 statement indicating one of the following:
26322632 a. a rule is duplicate,
26332633 b. the rule is obsolete,
26342634 c. the rule is no longer enforced,
26352635 d. the rule is no longer in compliance with state or
26362636 federal law,
26372637 e. the rule is no longer in compliance with federal
26382638 regulation, or
26392639 f. the rule does not affect substantive rights of the
26402640 regulated community;
26412641 3. The agency provides notice in the “Oklahoma Register”, in a
26422642 format reasonably calculated to provide notice to those persons
26432643 interested in the rule; and

27812781 C. When the rules have been submitted to the Governor, the
27822782 Speaker of the House of R epresentatives and, the President Pro
27832783 Tempore of the Senate and chairs of the Joint Committee on
27842784 Administrative Rules, the agency shall also submit to the Office of
27852785 Administrative Rules for publication in “The Oklahoma Register ”, a
27862786 statement that the adopt ed rules have been submitted to the Governor
27872787 and the Legislature.
27882788 D. The text of the adopted rules shall be sub mitted to the
27892789 Governor, the Speaker of the House of Representatives and t he
27902790 President Pro Tempore of the Senate in the same format as required
27912791 by the Secretary pursuant to Section 251 of this title.

30673067 D. The Committee shall meet separately or jointly at any time,
30683068 as needed and during sessions of the Legislature and at regular
30693069 intervals in the interim.
30703070 C. E. The function of the committees so established or
30713071 designated Committee shall be the review and promotion of adequate
30723072 and proper rules by agencies and developing an understanding on the
30733073 part of the public respecting such rules. Such function s hall be
30743074 advisory only of all adopted agency admini strative rules and
30753075 emergency rules including recommendi ng an approval or disapproval of
30763076 each proposed rule to the Legislature for review. The Committee may
30773077 also recommend an agency amend or further consider a proposed rule .
30783078 Each committee may review all adopted rules and such other rules
30793079 the committee deems appropriate and may make recommendations
30803080 concerning such rules to their respective house of the Legislature,
30813081 or to the agency adopting the rule, or to both their respective
30823082 house of the Legislature and the agency
30833083 F. The Committee shall approve or disapprove a repeal of rules
30843084 under the expedited repeal process pursuant to this act. Those

31403140 D. G. In addition to the review of agency -adopted rules
31413141 pursuant to this act, each such committee the Committee shall have
31423142 the power and duty to:
31433143 1. Conduct a continuous study and investigations as to whether
31443144 additional legislation or changes in legislation are needed based on
31453145 various factors, including but not limited to, review of proposed
31463146 rules, review of existing rules includin g but not limited to
31473147 consideration of amendments to or repeal of existing rules, the lack
31483148 of rules, the ability of agencies to promulgate such rules, the
31493149 burden of administrative rules on the regulated community and the
31503150 needs of administrative agencies;
31513151 2. Conduct a continuous study of the rulemaking process of all
31523152 state agencies including those agencies exempted by Section 250.4 of
31533153 this title for the purpose of improving the rulemaking process;
31543154 3. Conduct such other studies and investigations relating to
31553155 rules as may be determined t o be necessary by the committee
31563156 Committee; and
31573157 4. Monitor and investigate compliance of agencies with the
31583158 provisions of the Administrative Procedures Act, make periodic
31593159 investigations of the rulemaking activities of all agenci es and
31603160 evaluate and report on all rules in terms of their propriety, legal
31613161 adequacy, relation to constitutional or statutory authorization,
31623162 economic and budgetary effects and public policy.

32143214 SECTION 13. AMENDATORY 75 O.S. 2011, Sect ion 308, as

32193219 Senate shall assign such rules to the appropriate committees of each
32203220 house of the Legislature for review Joint Committee on
32213221 Administrative Rules . Except as otherwise provided by this section:
32223222 1. If such rules are received on or before April 1, the
32233223 Legislature shall have until the last day of the regular legislative
32243224 session of that year to review such rules act on the recommendations
32253225 of the Joint Committee on Administrative Rules ; and
32263226 2. If such rules ar e received after April 1, the Legislature
32273227 shall have until the last day of the regular legi slative session of
32283228 the next year to review such rules act on the recommendations of the
32293229 Joint Committee on Administrative Rules .
32303230 B. By the adoption of a joint resolution resolutions during the
32313231 review period specif ied in subsection A of this section, the
32323232 Legislature may disapprove or approve any rule , disapprove all or
32333233 part of a rule or rules and disapprove or approve the repeal of
32343234 rules under the expedited repeal process pursuant to this act.
32353235 Rules under considera tion at a meeting of the Joint Committee on
32363236 Administrative Rules during the interim may be acted upon by the
32373237 Legislature at any time during session .

32893289 C. Unless otherwise authorized by the Legislature, whenever a
32903290 rule is disapproved as provided in subsectio n B of this section, the
32913291 agency adopting such rules shal l not have authority to resubmit an
32923292 identical rule, except during the first sixty (60) calendar days of
32933293 the next regular legislative session. Any effective emergency rule
32943294 which would have been supers eded by a disapproved permanent rule
32953295 shall be deemed null and void on the date the Legislature
32963296 disapproves the permanent rule. Rules may be disapproved in part or
32973297 in whole by the Legislature. Upon enactment of any joint r esolution
32983298 disapproving a rule, th e agency shall file notice of such
32993299 legislative disapprov al with the Secretary for publication in “The
33003300 Oklahoma Register”.
33013301 D. Unless otherwise provided by specific vote of the
33023302 Legislature, joint resolutions introduced for p urposes of
33033303 disapproving or approv ing a rule or the omnibus joint resolution
33043304 described in Section 6 308.3 of this act title shall not be subject
33053305 to regular legislative cutoff dates, shall be limited to such
33063306 provisions as may be necessary for disapproval or approval of a
33073307 rule, and any such other direction or mandate regarding the rule
33083308 deemed necessary by the Legislature. The resolution shall contain
33093309 no other provisions.
33103310 E. A proposed permanent rule shall be deemed finally adopted

33773377 F. Prior to final adoption of a rule, an agenc y may withdraw a
33783378 rule from legislative review. Notice of such withdrawal shall be
33793379 given to the Governor, the Speaker of the House of Representatives,
33803380 the President Pro Tempore of the Senate, and to the Secretary for
33813381 publication in “The Oklahoma Register ”.
33823382 G. An agency may promulgate an emerge ncy rule only pursuant to
33833383 Section 253 of this title.
33843384 H. Any rights, privileges, or interests gained by any person by
33853385 operation of an emergency rule, shall not be affected by reason of

34393439 SECTION 14. AMENDATORY Section 6, Chapter 357, O.S.L.
34403440 2013 (75 O.S. Supp. 2020, Section 308.3), is amended to read as

34423442 Section 308.3. A. The Legislature shall have an omnibus a
34433443 joint resolution prepared for consideration each session.
34443444 B. The joint resolution shall be substantially in the following
34453445 form: “All proposed permanent rules of Oklahoma state agencies
34463446 filed on or before April 1 are hereby approved except for the
34473447 following:”.
34483448 C. For the purpose of this section, a proposed permanent rule
34493449 may be disapproved, in whole or in part, in the omnibus a joint
34503450 resolution considered by the Legislature.
34513451 D. 1. If an agency believes that a rule has not been approved
34523452 by the Legislature pursuant to this section and should be approved
34533453 and finally adopted, the agency may seek the Governor’s declaration
34543454 approving the rule.
34553455 2. In seeking the approval of a proposed permanent rul e, the
34563456 agency shall submit a petition to the Governor that affirmatively
34573457 states:
34583458 a. the rule is necessary, and
34593459 b. a citation to the source of its authority to make the
34603460 rule.

35123512 3. a. If the Governor finds that the necessity does exist,
35133513 and that the agency has the authority to make the
35143514 rule, the Governor may declare the rule to be approved
35153515 and finally adopted by publishing that declaration in
35163516 “The Oklahoma Register” on or before July 17 of that
35173517 year.
35183518 b. The declaration shall set forth the rule to be
35193519 approved, the reasons the approval is necessary, and a
35203520 citation to the source of the agency ’s authority to
35213521 make the rule.
35223522 4. C. If the omnibus a joint resolution fails to pass both
35233523 houses of the Legislature and be signed by the Governor or is found
35243524 by the Governor to have a technical legal defect preventing approval
35253525 of administrative rules intended to b e approved by the Legislature,
35263526 the Governor may declare all rules to be approved and finally
35273527 adopted by publishing a single declaration in “The Oklahoma
35283528 Register” on or before July 17 without meeting requirements of
35293529 paragraphs 2 and 3 of this subsection . If the Governor finds that
35303530 the joint resolution has a te chnical legal defect, the Governor
35313531 shall make the finding in writing and submit the finding to the
35323532 Legislature.
35333533 SECTION 15. This act shall become effective September 1, 2021.
