20	49		Human Services; updating term; and providing an

28	55		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

30	56		SECTION 1. AMENDATORY 56 O.S. 2011, Section 411, is
31	57		amended to read as follows:

33	58		Section 411. A. Except as otherwise provided by subsection B
34	59		of this section, the Department of Human Services is authorized to
35	60		make the necessary funeral arrangements and pay any reasonable
36	61		burial expenses incurred upon the death of a child or a retarded
37	62		person an individual with intellectual disability who is either in
38	63		the custody of the Department or is a resident of an institution
39	64		under the jurisdiction of the Department. When possible, the
40	65		Department shall make such arrangements w ith any funeral home

43	95		home town of the child or the individual with intellectual

48	97		B. The Department of Human Servic es is not authorized to make
49	98		such funeral arrangements or make such burial payments if the
50	99		deceased child or deceased retarded person individual with
51	100		intellectual disability has any relatives or next of kin who is
52	101		financially able to make the funeral arran gements and make the
53	102		burial payments.

55	103		SECTION 2. This act shall become effective November 1, 202 1.
