3839 An Act relating to the Corporation Commission ;
3940 providing that certain employees be in the
4041 unclassified service; providing tha t certain
4142 appointees be in the unclassified service; providing
4243 option to remain classified to certain employees;
4344 requiring certain elections be in writing; providing
4445 for codification; and providing an effective date.

5051 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5152 SECTION 1. NEW LAW A new section of law to be codified
5253 in the Oklahoma Statutes as Section 40.2 of Title 17, unless there
5354 is created a duplication in numberi ng, reads as follows:
5455 Any employee hired by the Corporation Commission on or after the
5556 effective date of this act shall be in the unclassified service
5657 unless the position is required to be subject to merit protections
5758 as required by a federal program admin istered by the Oklahoma
5859 Corporation Commission.
5960 1. All future appointees to positions not required to be
6061 subject to merit protections as required by a federal program
6162 administered by the Commission shall be in the unclassified service .

8890 2. In accordance with existing law, any classified employee who
8991 is serving in a posi tion on the effective date of the removal of the
9092 position from classified service and placement into the unclassified
9193 service shall have the option of retaining the employee ’s classified
9294 status. If the employee chooses to remain in the classified
9395 service, the position occupied by the employee shall remain in the
9496 classified service until the employee either vacates the position or
9597 elects unclassified status in writing. All future appointees to
9698 such positions shall be in the unclassified service .
9799 SECTION 2. This act shall become effective November 1, 2021.
