38	39		An Act relating to the Corporation Commission ;
39	40		providing that certain employees be in the
40	41		unclassified service; providing tha t certain
41	42		appointees be in the unclassified service; providing
42	43		option to remain classified to certain employees;
43	44		requiring certain elections be in writing; providing
44	45		for codification; and providing an effective date.

50	51		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
51	52		SECTION 1. NEW LAW A new section of law to be codified
52	53		in the Oklahoma Statutes as Section 40.2 of Title 17, unless there
53	54		is created a duplication in numberi ng, reads as follows:
54	55		Any employee hired by the Corporation Commission on or after the
55	56		effective date of this act shall be in the unclassified service
56	57		unless the position is required to be subject to merit protections
57	58		as required by a federal program admin istered by the Oklahoma
58	59		Corporation Commission.
59	60		1. All future appointees to positions not required to be
60	61		subject to merit protections as required by a federal program
61	62		administered by the Commission shall be in the unclassified service .

88	90		2. In accordance with existing law, any classified employee who
89	91		is serving in a posi tion on the effective date of the removal of the
90	92		position from classified service and placement into the unclassified
91	93		service shall have the option of retaining the employee ’s classified
92	94		status. If the employee chooses to remain in the classified
93	95		service, the position occupied by the employee shall remain in the
94	96		classified service until the employee either vacates the position or
95	97		elects unclassified status in writing. All future appointees to
96	98		such positions shall be in the unclassified service .
97	99		SECTION 2. This act shall become effective November 1, 2021.
